Zambia: corruption and miscarriage of justice in Vedanta water poisoning case



  • Victim of Vedanta subsidiary KCM's water pollution receives death threats and harassment on behalf of KCM following guilty verdict.


  • Claimants angry that justice is still not served following Supreme Court decision to reduce $2 million damages to almost zero in controversial judgement.


  • Evidence of bribery, corruption and major irregularities throughout judicial process.


On 2nd April the Supreme Court of Zambia upheld a precedent High Court verdict that Vedanta subsidiary Konkola Copper Mines (KCM) is guilty of major water pollution which turned the Kafue into a river of acid in 2006 and poisoned thousands of people, some of who have suffered long term impacts to their liver, kidneys and other functions(1). But the $2 million compensation originally awarded by the High Court to 2001 victims who self organised to sue KCM, has been reduced to virtually nothing, denying them their long due justice.(2)


Now lead claimant James Nyasulu has been receiving threats and harassment from agents working on behalf of KCM, telling him not to fight this multinational company, which has connections in the judiciary. Nyasulu and the committee of claimants have evidenced multiple incidents of procedural irregularities, bribery and corruption during their nine year struggle for legal redress:


  • When victims went with their families to local clinics and hospitals (many sponsored by Vedanta) in November 2006 after drinking contaminated water, they were unable to get medical reports as staff feared they would be dismissed. This was noted in the 2011 High Court judgement1 but ignored in the recent Supreme Court verdict, which only granted the 12 out of 2001 claimants who had medical reports any possibility of damages, leaving 1,989 victims with nothing.


  • The claimant's first lawyer, Kelvin Bwalya (KBF Associates), was initially employed by them when he occupied a very small office, with one vehicle, in the back streets of Lusaka. Several years after taking their case he had inexplicably amassed a fleet of 12 new cars, and moved to large offices and residence in the centre of the capital city. They reported these discrepancies to the court which recused him on grounds of corruption in 2009.2


  • One of the three judges on the bench of the first Supreme Court hearing on 3rd June 2014 in Ndola, was former KCM lawyer Albert Wood.3 This major conflict of interest should have admitted to the Chief Justice by Justice Wood according to Zambian law, but was only addressed due to the intervention of the claimants, after which he was removed from the bench.


  • KCM's lawyers Nchito and Nchito abandoned the case before 3rd February 2015, and KCM instructed Malombo and Malombo in their place, who wrote letters to the claimant's lawyer Mr K Shepande, advising him of a false date for Supreme Court hearing (6th Feb instead of 5thFeb). However Malombo and Malombo were never been appointed before court or had their documents stamped and filed, though they appeared in court for KCM on 2ndApril. Instead, the final judgement again named Nchito and co as KCM's advocates.


  • Following the 2nd April Supreme Court verdict, a printed version of the judgement was not released until 6th May 2015, during which time Mr Nyasulu waited in Lusaka, periodically camping in the office of the Chief Justice to demand access to the delayed judgement, as he could not afford another expensive journey from Chingola in the Copperbelt to the capital city. During this period Nyasulu received many death threats and threatening calls telling him not to fight KCM.4



Nine years after the pollution occurred twenty two of the original 2001 claimants have now died, some from liver and kidney damage potentially caused by the poisoned water. The rest fear they will never get real justice before they also pass away. Other local people have experienced miscarriages and other birth problems.James Nyasulu from Chingola, lead claimant in the case, who worked for ZCCM from 1987 until 2000, says:


"I know about mining processes and the processes Vedanta use are very different to ZCCM. Yes, ZCCM still polluted but they released very small amounts. Vedanta is polluting with impunity and on a much larger scale and it is still happening all the time. When the water goes off for 2 or 3 days then you know there has been pollution. All those people who drink from the Kafue - from Chililabombwe to Lusaka - they have drunk polluted water at least once. The diseases those industrial chemicals cause cannot even be treated in our hospitals, but the government is not thinking of that."


London based solidarity group Foil Vedanta claim that disregard for domestic laws and for human and ecological life, and reliance on bribery and corruption is typical of KCM's parent company Vedanta:


Vedanta has repeatedly been accused of bribery and corruption in India. In Puri, Odisha, the company's attempts to acquire 10,000 acres of land for a corporate university were heavily aided by the state.5 Several weeks ago former, Chief Secretary of Odisha, B K Patnaik, who helped push the scheme, left his government employment to become President of the University project.6 During the Forest Bench hearing of the case challenging Vedanta's now banned Niyamgiri mine in 2009, Justice S H Kapadia and senior counsel Harish Salve admitted they were shareholders of Sterlite, but were allowed to continue in the case nonetheless.7


Vedanta's large donations to the two main Indian political parties between 2004 and 2012 were ruled as illegal by the Delhi High Court in March 2014.8


In 2009 Vedanta's iron mining subsidiary Sesa Goa Western Cluster Ltd, obtained a 1 billion tonne iron ore reserve in Liberia, for just $123.5 million (a fraction of its true value) in a abnormal deal with Israeli company Elenilto.9


In Rajasthan, India Vedanta bought state company Hindustan Zinc Limited for £64 million in 2002 (valued by BNP Paribas), against a true value of £2.5 billion.10 Their current attempt to buy the remaining 30% government shares is being opposed in the Indian Supreme Court.11

(1) On 6th November 2006 one of KCM's tailing pipelines burst, spilling highly acidic waste into the Chingola stream, which meets the Mushishima stream and then joins the River Kafue, providing water to 40,000 Zambians from Chililabombwe to Lusaka. It was not until 8th November 2006 that the Environmental Council of Zambia (ECZ) became aware of the spill and ordered KCM to cease operations at the tailings plant12. Local water companies Mulonga and Nkana Water stopped supplies as they were highly polluted and the entire Chingola district was without water for six to ten days13. Those who did not receive tanked water drank directly from the Kafue and its tributaries which was highly acidic and contained 10x acceptable levels of copper, 770x manganese, and 100x cobalt, turning the river bright blue with copper sulphate precipitate.14 Thousands of people became sick with diarrhoea, vomiting and loss of sight, and many later developed kidney and liver problems amongst other long term illnesses. Miscarriages and birth problems have also been recorded in the affected communities, as well as premature deaths with unknown causes.15


The ECZ later reported that the effluent was almost pure acid at PH 2.8, while other sources reported PH 1.516. Worse still KCM had knowingly been operating the Tailings Leach Plant without lime, which is usually used to neutralise acidic effluent,17 for up to a week, a major violation of KCM's license to release effluent under Zambia's Water Pollution Control (Effluent and Waste Water) Regulations of 1993 and KCM's Environmental Management Plan.18


(2) On 2nd April 2015 the Supreme Court finally gave its judgement, upholding the High Court verdict that KCM was guilty of negligence, gross pollution and disregarding the right to life. However, they disagreed with Justice Phillip Musonda's judgement that the twelve available medical records were indicative of the damage to other claimants who had shared the same water sources but did not have medical evidence. Instead the court ruled that only the twelve plaintiffs with medical records could be compensated, and the degree of damages would have to be assessed by the Deputy Registrar of the High Court.19 In reality that could mean that KCM pays virtually none of the High Court's $2 million damages award, let alone the substantial interest it would now have attracted. The referral of damages claims back to the High Court is also procedurally abnormal.

Brief synopses of the films:

Nam Poribortito is about rape and gender violence in West Bengal and the rest of the country. Through a series of incidents with focus on the survivors and victims it examines the various aspects of the crisis, looks for social and political roots of the problem and examines the women's movement fighting patriarchy. Some of the women fighting this battle against patriarchal 'norms and common-sense' on the ground will take part in the post-screening discussions.

Gadi Lohardaga Mail is a documentation of people's memories about a passenger train that ran on the now-defunct meter-gauge tracks till 2003. Accompanying the last journey of the train, the film archives some unforgettable melodies. Namely, 'biraha gaan' of the working class (working class songs of migration, separation and longing), songs of Jharkhandi identity and folk songs about the train becoming an inseparable part of the Jharkhandi landscape.

The Referendum documents the historic defeat of the the Vedanta mining company in the hands of the adivasis of Niyamgiri, where the multinational mining giant lost 12-0 to the adivasis in a series of 12 Gram Sabha referendums which unanimously rejected the mining company's bid for Bauxite mining and refining in the Niyamgiri hills in Odisha. In a film where even the concept of 'god' and 'worship' splits into two divergent worldviews, we have a strong document of people-centric and environment-centric struggles against mindless corporate loot.

This is going to be the very first screening of The Referendum in West Bengal.


First Cry is the story of the Shaheed Hospital and People's Health movement in Dalli-Rajhara under the able leadership of the workers' movement of the Chhattisgarh Mukti Morcha led by comrade Shankar Guha Niyogi. The film is much more than just the story. It also dwells on the meaning and essence of the slogan 'Sangharsh aur Nirman' (Struggle and Synthesis) through praxis. Activists who have engaged in people's health movements over decades will take part in the post-screening discussion

Let others know how easy it is to promote the promoters.We have earlier seen Anand University land being gifted to Tata  Motors for its dream project Nano which stumbled on highway despite refreshing the brand again and again.

What the Varsity got in return we could never know as Agrarian research has become irrelevant in India and the land acquired meant agrarian research.

Thus,the venture continued in Uttarakhand while Vikas Purush CM ND Tiwari acqired Pant Nagar Agriculture University land to grow Pantanagar Rudrapur SEZ directly in the heart of the university with ensured Tax Holiday and Electricity round clock which made the Tiger den in the Himalayan Terai a perfect cemented Jungle.

What wrong Telangana Chief Minister K. Chandrasekhar Rao might have done,the Osmania Varsity students could not explain as they opposeHousing project for the poor on their land.

University is not a sacred cow,mind you young guies and gals!Higher studies and research mean nothing in hiring firing business but you might take some lessons of promoting business which is going to become the only business in future for making in Gujarat.

Let us rather judge growth in terms of foreign investment.Let the CM go to foreign land to manage some FDI!

Mowever,media reports says that Telangana Chief Minister K. Chandrasekhar Rao's plans to build houses for poor over the land of Osmania University has snowballed into a huge row with students staging protests and the opposition parties warning him against the move.

The students of Osmania University on Wednesday took out a rally and even performed mock funeral of the chief minister to protest his plans to take the university land.

Rao's remark that universities don't require huge lands and that he will not budge an inch from his stand added fuel to the fire.

Raising slogans against the Telangana Rashtra Samithi (TRS) chief, the students took out a rally on the campus. Activists of Akhil Bharatiya Vidyarthi Parishad (ABVP) performed a mock funeral of the chief minister.

The student groups have also called for shutdown of educational institutions in Telangana on Thursday to protest the government's plans.

KCR, as Rao is popularly known, during his visit to Parsigutta area in Secunderabad on Monday, had declared that houses for poor will be built on 11 acres unused land of Osmania University.

This triggered protests by student groups, who took to streets and even staged a demonstration at state secretariat.

They recalled that KCR, during the movement for separate Telangana state, had said that thousands of acres of land in and around Hyderabad was grabbed by industrialists and other rich people from Andhra. They challenged him to take back those lands and build houses for poor.

KCR plans to build two bedroom houses for 200,000 poor in Hyderabad and has asked officials to identify the vacant government lands for the same.

Main opposition Congress and Bharatiya Janata Party (BJP) have also asked KCR to drop his plans to take OU land.

Congress leader Mohammed Ali Shabbir on Wednesday urged the chief minister to construct houses for poor on the vacant land adjacent to his camp office and also on the land allotted for TRS headquarters.

Shabbir, who is vice president of party's Telangana unit, also offered to identify more lands required for the scheme but warned the government against touching the varsity's land.

BJP leader N. Janardhan Reddy said KCR should keep in mind that students of the varsity were always in the forefront of agitation for a separate Telangana state and it was because of them that he is today sitting in the chief minister's chair.

The chief minister, however, said he would not budge even an inch from his stand. He made it clear that he will not bow to the students' pressure.

"If I take up something, I don't leave it in middle and pursue it till it is achieved. I am very stubborn person," he told a meeting during ongoing "Swacch Hyderabad" programme.

He alleged that some parties were playing petty politics when he is trying to provide housing to the poor.

KCR also remarked that universities don't need hundreds and thousands of acres when poor people did not have space for homes.

Another policy corruption –government trying to get the loan waive of from donor agencies-it sound nice to hear but the dirty machination in the process is very harmful to the nation. I strongly request all the donor agencies to consider the following  before thinking about the proposal of the corrupt power hungry crooks of Nepal whom the fool consider as political leaders

1.   Demand the return of all corrupt money from those who have looted it in the name of medical treatment.

2.   Demand forming a high power investigative commission to find the corruption of the leaders from 2046 and

3.   Demand death penalty to all corrupt

4.   Demand confiscation of all property of everybody that is without proper legitimate source.  

5.   Demand the limitation of minster to maximum 10

6.   Demand the dissolution of the CA and return of all salary perks collected by the 601 slaves of the corrupt leaders.

Until these 6 issues are properly fulfilled to waive the loan is nothing but to support the corruption .All donor agencies be careful the money is from the taxpayers of your country and to allow the looters of the Nepal to get those taxpayer's money is crime and the people and law  of your country will not leave you .do not sale your inner voice for petty commission you expect to get from the corrupt leaders of Nepal on waving the loan.

 Tribune de Geneve headline said it all "Nepal has lurched ground like a ship on the high seas" when the second major earthquake of 7.3 magnitude rocked Nepal on 12 May 2015 again. According to a study sponsored by the Netherlands‐Based Institute for Geo‐information Science and Earth Observation Kathmandu valley has a 300‐meter deep layer of black clay which amplifies damages caused by earthquakes. This region, therefore, is prone to liquefaction in strong earthquakes and vibrations can turn ground into something like quicksand – capable of swallowing buildings. This could mean by the turn of the century another powerful jolt could be a possibility. Therefore, future planning for human settlements should strictly adhere to the seismic‐resistant buildings throughout Nepal. Continuing series of shockwaves has created an unprecedented scale of humanitarian tragedy and developmental challenges not witnessed in our living memory since the great earthquake of 15 January 1934, which caused extensive damage to infrastructure in Nepal and India. It is imperative we carefully reassess our general approach to building infrastructures. The colossal damages inflicted by the recent earthquakes were so gigantic, embattled Government of Nepal may falter the reconstruction process no matter how hard it tries to convince the people of Nepal for we know government institutions and agencies are weak, inept and nearly dysfunctional. The mounting emergency needs faced by millions of Nepalese can be overwhelming for government's disaster response capabilities are cracking and its inability to respond to many in devastated inaccessible areas outside Kathmandu valley are coming to fore. At times, response appeared inadequate and mismanaged, adding further misfortune to vulnerable community. In this situation, there is a danger of over reaction from government, which is struggling with continuing political debacle and entrenched with bureaucratic challenges. This is unlikely to abate and could prove disastrous leading to existential threat, compounded by further loss of life and property. Millions of homeless people may end‐up living in tented shelter for months, if not for years. Everything must be built from the scratch. Rebuilding tasks will be arduous for economic gains have either disappeared or reversed by the extensive destruction. Hundreds of homes, schools, hospitals, bridges, roads and other infrastructure must be rebuilt; opportunities of economic means must be created and sustained. This requires money, takes time and needs appropriate technology. One early guestimate suggests Nepal's economy may have lost equivalent of years 'of national GDP and rebuilding cost may go as high as US$15‐20 billion. This is a staggering figure and a tall order for economically poor Nepal for it cannot finance it through domestically generated revenue resources. The overwhelming sympathy and solidarity displayed by international community for Nepal must not be missed by the government. It should be mulling over a program for reconstruction and rebuilding almost like that of the European Recovery Plan after the World War II , known as Marshall Plan, which was to rebuild economy making Europe prosperous. This plan must address all obstacles 1to post‐disaster recovery and Government of Nepal should look towards the future and focus on the destruction caused by natural calamities. Nepal is geographically isolated for it is sandwiched between China and India. Both countries were also hit by earthquakes and suffered losses. They are our closest friends and biggest trading partners. We must involve both nations in rebuilding effort. Nepal should solicit full cooperation of China and India and campaign for rebuilding program. We should leave aside political differences and must overcome individual compunction. Pursuing our over‐confident and isolationist‐policy‐tendency will not help for Nepal faces stellar tasks and crisis of confidence with population and international donors. Building a new nation cannot be business‐as‐usual. Given that the UN General Assembly has endorsed the flash appeal for US$ 415 million issued last month in Geneva by UNOCHA is a welcome endorsement. However, many Nepal observers believe rebuilding costs would be many fold higher than the initial emergency aid. The Government of Nepal should now, in collaboration with China and India, move ahead with a follow‐up consciousness‐raising resolution at the UN Security Council for additional support for 'rebuilding plan for Nepal', similar to the Marshall Plan. This is to re‐energize the world community calling for financial and technical assistance aiming at restoring one third of Nepal's population's lives which are at serious risk of survival and deprived of means of livelihood. In parallel, the government should also reinforce its own resolve to address the challenges with open door policy for foreign government's active participation. To lead the process, the Government of Nepal should consider a new consortium of friends of Nepal co‐chaired by members from major donors, trading partners and philanthropist advocates of Nepal. The suggested approach is timely for we would not want to stagger like some countries which faced large disasters. Lessons from unsatisfactory response and weak coordination during the hurricane Katarina, Haiti's earthquake and Haiyan typhoon in the Philippines should guide to our response to the crisis. Poor response to hurricane Katarina and Typhoon Haiyan were largely attributed to political inaction from the centre. Haiti, as a failed state, stumbled for reasons there was no one appeared coordinating complicated and diverse relief work, causing delays in aid distribution. According to Refugee International the aid agencies were dysfunctional and the humanitarian response appeared paralyzed. Oxfam also noted that relief and recovery were at standstill due to government inaction and poor donor response. Does not it sound familiar? It is worrying that Nepal, a fragile state, may also quickly descent into similar chaos. काठमाडौं । विनाशकारी भूकम्पबाट पीडित भएका परिवारलाई राहत दिने विषयलाई लिएर नेपाल सरकारका दुई उपप्रधानन्त्री आरोप प्रत्यारोपमा उत्रेका छन् । उपप्रधान तथा गृहमन्त्री बामदेव गौतले पीडितको पीडामा राजनीति गरेको आरोप अर्का उपप्रधान तथा स्थानीय विकासमन्त्री प्रकाशमान सिंहले आरोप लगाए छन् । ब्यवस्थापिका संसद विकास समितिको बैठकमा गौतमको खुलेर आलोचना गर्दै सिंहले भने उहाकै कारण राहतमा ढिलाई भइरहेको छ त्यो हामीलाई सह्य छैन । केन्द्रीय दैविक प्रकोप उद्धार तथा राहत समितिको प्रमुख गौतम भएका र उनले आफ्नो दलसँग नजिक भएका पीडितप्रति बढि राहत केन्द्रीत गरेको आरोप लगाए । मैले केही ठाउँको भ्रमण गरेँ, त्यहाँ कसैले धेरै राहत पाएका छन्, कतिपयले हालसम्म राहतको एक टुक्रा पनि पाउन सकेका छैनन् । यसले झन समस्या ल्याएको छ । उनले मेरो मन्त्रालयबाट गएका राहतमा राजनीति कतै भएको छैन ।


उनले जिल्ला दैविक प्रकोप उद्धार तथा राहत समिति मार्फत गएका केही ठाउँमा निस्पक्ष भएपनि धेरै ठाउँमा राजनीतिक आस्थाले काम गरेको बताए । आफू निकटका प्रमुख जिल्ला अधिकारीलाई आदेशै दिएर गौतमले राजनीति गरेको उनले आरोप लगाए । गृहमन्त्री गौतमले राहतमै राजनीति गर्न थालेपछि आफ्नो दल नेपाली कांग्रेसबाट सरकारमा गएका मन्त्रीहरु दैनिक गृहमन्त्रालयमा बाच गर्न पुग्ने गरेको बताए ।


उता गृहमन्त्री गौतमले राहतमा राजनीतिक गरेको प्रमाणित गर्न सिंहलाई चुनौति दिएका छन् । राप्ती काठमाडौं सम्पर्क मञ्चले गरेको रक्तदान कार्यक्रममा गृहमन्त्री गौतमले राहतमा राजनीति गरेको प्रमाणित भए देखाउन अन्यथा जथाभावी नवोल्न सिंहलाई चेतावनी दिए । मैले कुन जिल्लाका कुन स्थानमा बस्ने पीडितलाई राजनीतिक आस्थाका आधारमा राहत वितरण गरेँ, प्रमाण देखाउनु परयो फाल्तु कुरा गर्न मिल्दैन ।
गृहमन्त्री गौतमले उल्टै स्थानीय विकासमन्त्री सिंहले राजनीति गरेको प्रतिआरोप लगाएका छन् । राज्यको गएको राहतलाई प्रकाशमान दाईले पठाउनु भएको हो भन्दै उनका कार्यकर्ताले वितरण गरेको सुचना बरु मैले पाएको छु, गृहमन्त्री गौतमले भने । स्थानीय विकास मन्त्रालयबाट गएका राहतमा सिंहले राजनीति गरेको उनले प्रतिआरोप लगाए ।

कॉरपोरेट हमले और सांप्रदायिक फासीवाद के खिलाफ एकजुट हुएलेखक, संस्‍कृतिकर्मी और पत्रकार

नरेंद्र मोदी के नेतृत्‍व में पिछले साल केंद्र की सत्‍ता में आयी एनडीए सरकार को साल भर पूरा होते-होते साहित्यिक-सांस्‍कृतिक क्षेत्र भी अब उसके विरोध में एकजुट होने लगा है। बीते रविवार इसकी एक ऐतिहासिक बानगी दिल्‍ली में देखने को मिली जब दस हिंदीभाषी राज्‍यों से आए लेखकों, संस्‍कृतिकर्मियों, कवियों और पत्रकारों ने एक स्‍वर में कॉरपोरेटीकरण व सांप्रदायिक फासीवाद की राजनीति के खिलाफ अपनी आवाज़ बुलंद की और अपने-अपने इलाकों में भाजपा-आरएसएस द्वारा फैलायी जा रही अपसंस्‍कृति के खिलाफ मुहिम चलाने का संकल्‍प लिया। यहां स्थित इंडियन सोशल इंस्टिट्यूट में ''16 मई के बाद की बदली परिस्थिति और सांस्‍कृतिक चुनौतियां'' विषय से तीन सत्रों की एक राष्‍ट्रीय संगोष्‍ठी का आयोजन किया गया जिसके मुख्‍य अतिथि बंबई से आए मकबूल फिल्‍मकार सागर सरहदी थे। 

 

पहले सत्र की शुरुआत करते हुए स्‍त्री अधिकार कार्यकर्ता कविता कृष्‍णन ने हिंदू परिवार के मिथक पर सवाल उठाया और यह बताने की कोशिश की कि कैसे श्रम कानूनों के संदर्भ में औद्योगिक कार्यस्‍थलों पर भी मौजूदा सरकार इस ढांचे को लागू करना चाह रही है। तमिलनाडु के कपड़ा उद्योग के उदाहरण से उन्‍होंने समझाया कि कैसे कार्यस्‍थलों पर हिंदू परिवार के पितृसत्‍तात्‍मक ढांचे को 'परिवार' के नाम पर लागू किया जा रहा है। मोदी सरकार द्वारा आंबेडकर के नाम पर किए जा रहे सामाजिक समरसता यज्ञ को घर वापसी का दूसरा संस्‍करण करार देते हुए उन्‍होंने हिंदू परिवार के मिथक को तोड़ने की जरूरत पर बल दिया। लेखकों-संस्‍कृतिकर्मियों के लिएमिथकों को तोड़ने की ज़रूरत का महत्‍व दक्षिण एशियाई स्‍तर पर समझाते हुए वरिष्‍ठ पत्रकार सुभाष गाताड़े ने साफ शब्‍दों में कहा कि इस धारणा को अब तोड़ना होगा कि हमारा समाज बहुत सहिष्‍णु है, बल्कि वास्‍तव में यह समाज बहुत हिंसक है। गाताड़े ने सांप्रदायिकता की बहस में महाराष्‍ट्र की विशेष स्थिति और 1848 में फुले के नेतृत्‍व में हुई क्रांति को समझने की अपील की। झारखण्‍ड से आए उपन्‍यासकार रणेन्‍द्र ने इस बात पर अफ़सोस जताया कि प्रगतिशील जमातों ने संस्‍कृति के मिथकीय आयाम को छोड़ दिया जिसका नतीजा यह हुआ कि दक्षिणपंथियों ने बड़ी आसानी से संस्‍कृति को धर्म में घुसा दिया और संस्‍कृति के पूरे मायने को ही वि‍कृत कर डाला। इसी संदर्भ में कवि नीलाभ 'अश्‍क' ने सांस्‍कृतिक हस्‍तक्षेप या संस्‍कृति में हस्‍तक्षेप का सवाल उठाते हुए बेर्तोल्‍ट ब्रेख्‍त की 'सच कहने की पांच दिक्‍कतों' का उल्‍लेख किया। रेयाज़-उल-हक़ ने भी ब्रेख्‍त की इस कविता का दूसरे सत्र में पाठ किया।

 

माओवादी होने के आरोप में दो साल जेल में रह चुकी संस्‍कृतिकर्मी सीमा आज़ाद ने सांस्‍कृतिक हमले के मनोवैज्ञानिक पक्ष को उठाया और 'सेंचुरी ऑफ दि सेल्‍फ' नामक फिल्‍म के हवाले से बताया कि कैसे राज्‍यसत्‍ता हमारे दिमागों पर कब्‍ज़ा करती है। उन्‍होंने सांस्‍कृतिक एकाधिकार के खतरे का भी जिक्र किया। इस हमले को कुछ ताज़ा घटनाओं और खबरों के माध्‍यम से समझाने का काम पत्रकार अरविंद शेष ने किया, तो राजनीतिक कार्यकर्ता अर्जुन प्रसाद सिंह ने आज के दौर में सांस्‍कृतिक सेना का गठन करने की जरूरत को ऐतिहासिक परिप्रेक्ष्‍य में समझाया। अर्जुन प्रसाद ने कहा कि सबसे पहले मजदूर वर्ग के भीतर सांस्‍कृतिक स्‍तर पर काम किए जाने की ज़रूरत है। फिर दूसरा स्‍तर किसानों का है, छात्रों और मध्‍यवर्ग का है। इसके बाद जरूरी हो तो छोटे देसी कारोबारियों के बीच भी काम किया जा सकता है।

 

मध्‍य प्रदेश से आए कहानीकार सत्‍यनारायण पटेल, लखनऊ से आए कवि कौशल किशोर और इलाहाबाद से आयीं कवियत्री संध्‍या नवोदिता ने प्रगतिशील जमातों के भीतर सांस्‍कृतिक एकता की समस्‍याओं और सांस्‍कृतिक चुनौतियों पर अपनी बात रखी। इस संदर्भ में शिक्षक अपूर्वानंद ने नरेंद्र मोदी की कामयाबी के पीछे उनकी सरल भाषा का हवाला देते हुए लेखकों से भाषा की जटिलता व पेचीदगी को बचाए रखने का आह्वान किया और मित्रता का दायरा बढ़ाने की बात कही। उन्‍होंने कहा कि जनता के पास जाने और संघर्ष की दुहाई देने के क्रम में कवि कहीं सरलीकरण में न फंस जाए, इसका ध्‍यान रखने की ज़रूरत है। कवि असद ज़ैदी ने पहले सत्र के समापन पर अध्‍यक्षीय वक्‍तव्‍य में भाषा और सरलीकरण के सवाल को प्राध्‍यापकीय चिंता ठहराते हुए कहा कि हमारे भीतर अतिसाहित्यिकता समा गयी है क्‍योंकि मामला सिर्फ अभिव्‍यक्ति या शैली का नहीं है, बल्कि एक लेखक के नागरिक होने का भी है। महाराष्‍ट्र में भगवा गिरोहों द्वारा की गयी नरेंद्र दाभोलकर और गोविंद पानसरे की हत्‍या का संदर्भ देते हुए उन्‍होंने एक 'हत्‍यारे' के हाथों लेखक भालचंद नेमाड़े के ज्ञानपीठ पुरस्‍कार लेने पर अफसोस जताया और कहा कि नेमाड़े ने ''सत्‍ता के सामने सच कहने'' (स्‍पीकिंग ट्रुथ टु पावर) का एक मौका गंवा दिया। असद ज़ैदी ने इस अभियान को कविता के दायरे से बाहर निकालकर समूचे संस्‍कृतिकर्म तक विस्‍तारित करने और इसे एक नया नाम देने का प्रस्‍ताव रखा।

 

कार्यक्रम का आधार वक्‍तव्‍य पढ़ते हुए अभियान के राष्‍ट्रीय संयोजक कवि रंजीत वर्मा ने सत्र के आरंभ में ज्ञानपीठ पुरस्‍कारों के संदर्भ में सवाल उठाया, ''पिछले दिनों हिंदी के वयोवृद्ध आलोचक नामवर सिंह को ज्ञानपीठ सम्मान समारोह में प्रधानमंत्री नरेंद्र मोदी के साथ हंसते-बतियाते पाया गया। किस बात पर वे हंस रहे थेक्या उन्होंने प्रधानमंत्री से पूछा कि आपके आने के बाद देश की एक बड़ी आबादी असहज हो गई हैकिसान बड़ी संख्या में आत्महत्याएं करने लगे हैं और आप हैं कि ऐसे नाजुक समय में उन्हें ढांढस बंधाने की जगह उनकी जमीन छीनने में लगे हैंउन्हें कहना चाहिए था कि लोगों को सच बोलने से रोका जा रहा है और फिर भी जो बोलने का हिम्मत दिखा रहे हैं आपके लोग उनकी हत्याएं तक कर दे रहे हैंइसके बावजूद आपकी चुप्पी क्यों नहीं टूट रही है जबकि आप सबसे ज्यादा बोलने वाले प्रधानमंत्री माने जाते हैं?'' वयोवृद्ध राजनीतिक कार्यर्ता शिवमंगल सिद्धांतकर ने योग और आइटी जैसे दो विरोधी सिरों को मिलाने का हवाला देते हुए मोदी को आड़े लिया और सरकार की श्रम नीतियों पर सवाल उठाए। 

 

कार्यक्रम का दूसरा सत्र अलग-अलग हिंदीभाषी राज्‍यों की ज़मीनी स्थिति और हस्‍तक्षेप की संभावनाओं पर था। इसमें उत्‍तर प्रदेश से कौशल किशोर, उत्‍तराखंड से पंकज, बिहार और पश्चिम बंगाल से अर्जुन प्रसाद सिंह व मृत्‍युंजय प्रभाकर, झारखंड से रणेन्‍द्र, मध्‍य प्रदेश से सत्‍यनारायण पटेल, छत्‍तीसगढ़ से सियाराम शर्मा, राजस्‍थान से संदीप मील, महाराष्‍ट्र से एडवोकेट बबिता केशरवानी और दिल्‍ली से अभिषेक श्रीवास्‍तव ने प्रतिनिधित्‍व किया। संदीप मील कार्यक्रम में उपस्थित नहीं थे, उनका वक्‍तव्‍य अभिषेक श्रीवास्‍तव ने पढ़कर सुनाया। अध्‍यक्षीय वक्‍तव्‍य में आनंद स्‍वरूप वर्मा ने अफ्रीका के देशों में संस्‍कृतिकर्म और लेखन के राजनीतिक महत्‍व के उदाहरण गिनाते हुए बताया कि कैसे दुनिया भर में लेखकों और संस्‍कृतिकर्मियों ने फासीवाद के खिलाफ कुर्बानियां दी हैं, लेकिन हिंदी में याद करने पर भी एक ऐसा लेखक नहीं दिखायी देता जिसका नाम लिया जा सके। चीनी लेखक लू शुन की एक कहानी के हवाले से उन्‍होंने हिंदी के लेखकों की तुलना उस कलाकार से की जो ड्रैगन की तस्‍वीरें तो बहुत अच्‍छी बनाता था, लेकिन उसके दरवाज़े पर जब ड्रैगन मिलने आया तो उसे देखकर वह बेहोश हो गया। अपने अध्‍यक्षीय वक्‍तव्‍य में कवि मंगलेश डबराल ने प्रतिवाद किया कि फिलहाल देश में कोई क्रांति की स्थिति ही नहीं है, इसलिए यह कहने का कोई मतलब नहीं बनता कि निर्णायक स्थिति में लेखक क्‍या करेगा और क्‍या नहीं।

 

तीसरे सत्र में देश भर से आए करीब दो दर्जन कवियों का कविता पाठ और गीत हुए जिसका संचालन पाणिनि आनंद ने किया। अंग्रेजी के वरिष्‍ठ पत्रकार जावेद नक़वी, जिन्‍हें पहले सत्र में वक्‍तव्‍य रखना था, उन्‍होंने इस सत्र में दो कविताएं पढ़ीं। पंकज श्रीवास्‍तव, आदियोग, बलवंत यादव, उषा-राजेश और रिवॉल्‍यूशनरी कल्‍चरल फ्रंट के गीतों से सजे इस सत्र का समापन मंगलेश डबराल के कविता पाठ से हुआ। जेएनयू से आए कवि रमाशंकर यादव 'विद्रोही' अपने परिचित अंदाज़ में एक कविता पढ़ी, तो अन्‍य कवियों में कौशल किशोर, संध्‍या नवोदिता, सीमा आज़ाद (यूपी), उन्‍मुक्‍त (छत्‍तीसगढ़), निखिल आनंद गिरि, सपना चमडि़या (दिल्‍ली), देवेंद्र रिणवा (इंदौर), महादेव टोप्‍पो (झारखण्‍ड) और विनोद शंकर (बनारस) शामिल रहे। 

 

ध्‍यान रहे कि पिछले साल 16 मई को लोकसभा चुनाव का नतीजा आने के बाद दिल्‍ली में ''कविता: 16 मई के बाद'' नाम से एक प्रक्रिया शुरू हुई थी जिसके अंतर्गत देश भर में बीते आठ महीनों के दौरान नौ जगहों पर प्रतिरोध का काव्‍य पाठ हो चुका है। दिल्‍ली से चलकर लखनऊ, इलाहाबाद, बनारस, पटना, रांची, चंडीगढ़ और झारखण्‍ड के गांवों में पहुंची इस कविता-यात्रा ने कई ऐसे कवियों को साथ लाने में कामयाबी हासिल की है जो अपनी रचनाओं के माध्‍यम से नए निज़ाम को चुनौती दे रहे हैं। इसी कड़ी में जनादेश का एक साल पूरा होने पर यह आयोजन किया गया था। शुरुआती दो सत्रों की अध्‍यक्षता वरिष्‍ठ पत्रकार आनंद स्‍वरूप वर्मा, कवि मंगलेश डबराल और असद ज़ैदी ने की और संचालन क्रमश: अभिषेक श्रीवास्‍तव व रंजीत वर्मा ने किया। अध्‍यक्ष मंडल में कहानीकार पंकज बिष्‍ट का भी नाम था, लेकिन वे नहीं आ सके। कविता सत्र की अध्‍यक्षता कवि वीरेन डंगवाल को करनी थी जिनके नहीं आ पाने के कारण यह जिम्‍मेदारी कवि नीलाभ 'अश्‍क' ने आंशिक रूप से निभायी।

সরকারের বিভাজনের রাজনীতির দীর্ঘমেয়াদি নেতিবাচক ফলাফল অপেক্ষমাণ। ইতোমধ্যে স্বল্পমেয়াদি কুফলগুলো ফলতে শুরু করেছে। গণতন্ত্রহীনতার বাতাবরণের ভেতর চরম বাম ও চরম ডান দু'টি প্রান্তিক ধারা জন্ম নিয়েছে। আগেও এটি ছিল চুয়াত্তরের দুর্ভিক্ষ, অপশাসন ও বাকশাল গঠনের আগের প্রেক্ষাপটে। এটি অগণতান্ত্রিক সরকারের নেতিবাচক ক্রিয়ার পাল্টা প্রতিক্রিয়া। চরম বামপন্থী ভাবনায় নতুন করে যোগ হয়েছে যেকোনো ধর্ম ও সৃষ্টিকর্তাকে অস্বীকার করার প্রবণতা। এটা বোধ করি বৈশ্বিক প্রোপাগান্ডার বাংলাদেশী সংস্করণ। অন্য দিকে নিয়মতান্ত্রিক পথ হারিয়ে চরম ডান ভাবনায় জন্ম নিয়েছে অতি চৈতন্য লালনকারী একধরনের চরমপন্থী। প্রান্তিক চিন্তার দুই ধারারই শেষ কথা সরকার নিয়ম মানে না, গণতন্ত্র মানে না, বিচার মানে না, আইন মানে না, মানবাধিকার মানে না, আইনের শাসন মানে না, মৌলিক অধিকার পর্যন্ত স্বীকার করে না- তখন নকশালী কায়দায় বা সর্বহারা ধারায় শ্রেণিশত্রু খতম করে এগোতে হবে। যে সরকার আইন মানে না- তাদের আমলে আইন হাতে তুলে নেয়াই তারা নিজেদের জন্য বৈধ বানিয়ে নিয়েছে। এরা হঠকারিতারই পথ বেছে নিয়েছে। তাদের ভাষায়- এই পথ বেছে নিতে তারা বাধ্য হয়েছে। এই সরকারকে এবং তাদের কথিত আদর্শের সব প্রতিপক্ষকে প্রতিবিপ্লবী ও শ্রেণিশত্রু আখ্যায়িত করছে। একইভাবে চরম ডানপন্থী যাদের জঙ্গি বলা হচ্ছে, কথায় কথায় মৌলবাদী, তালেবান, আলকায়েদা, নাসরুল্লাহ ও আনসার উল্লাহ খেতাব দেয়া হচ্ছে- তারা নিজেদের মতো করে জেহাদের একটা সংজ্ঞা বানিয়ে নিয়েছে। আমার ধারণা ভুলও হতে পারে, তবে রবিন হুড, দস্যু বাহরাম, দস্যু বনহুর ও কিরিটি রায় ধরনের সুপারম্যান হওয়ার রোমান্টিক ধারণা একটা বয়স পর্যন্ত যেকোনো মানুষের ভেতর বসবাস করতে পারে। বিশেষত স্বপ্নভঙ্গের কারণে আশাহত তারুণ্যের ভেতর একধরনের দ্রোহের জন্ম নেয়। সেই দ্রোহ থেকে বিদ্রোহের ভ্রুণ বিকশিত হতে থাকে। তাদের কাছে খুন-জখম তখন সাধারণ বিষয় মনে হয়। তারা ধরে নেয়, ভালো লক্ষ্যে খারাপ কাজ করা যায়। যেমন সরকার গণতন্ত্রহীন এক অলিক উন্নয়নের ডুগডুগি বাজাচ্ছে। একবার চরমপন্থী সেজে গেলে, এরা নিজের মৃত্যুকেও হাতছানি দিয়ে ডাকতে ভয় পায় না। ধরেই নেয় তার মৃত্যু এক 'মহান ত্যাগের'জন্য। অথচ কোনো ভালো কাজ খারাপ পদ্ধতিতে হয় না। নীতিশাস্ত্রের এ সত্য উচ্চারণটি আমাদের সরকারও মানে না।
সম্প্রতি কিছু বিচারবহির্ভূত হত্যাকাণ্ডের সাথে রাষ্ট্রের বা প্রজাতন্ত্রের কর্মকর্তা-কর্মচারীদের সংশ্লিষ্টতার সংযোগ খুঁজে পাওয়ার পর চরমপন্থীরা যেন যুক্তি খুঁজে পেল- বিনা বিচারে মানুষ হত্যা কোনো অপরাধ নয়। তারা কুযুক্তি দিয়ে সম্ভবত বলতে চায়, রাষ্ট্র যদি তার সন্তানতুল্য নাগরিকদের বিনা বিচারে হত্যা করতে পারে, তাহলে 'আদর্শিক'ভাবনায় বিদ্রোহী কিংবা 'খোদাদ্রোহীকে'হত্যা করা ন্যায়সঙ্গত। আমাদের কাছে মনে হয় সরকার তার নেতিবাচক কাজের মাধ্যমে চরমপন্থীদের যেন উসকানি দিয়ে জানান দিয়ে যাচ্ছে- তোমরা প্রান্তিক চিন্তা লালন করো এবং মানুষ খুনের উল্লাসে মেতে ওঠো। একইভাবে অপহরণ ও গুমের বিস্তার ঘটছে। পৈতৃক শত্রুতার জন্য শিশু অপহৃত হচ্ছে। টাকার জন্য নারী-শিশু গুম হচ্ছে। দেশের রাজনীতিবিদেরা যখন ভিন্নমতের জন্য ইলিয়াস আলী কিংবা সালাহউদ্দিন হয়ে যাচ্ছেন, তখন বিপর্যয় ঠেকাবে কে?
এরিখ মারগোলিস একজন তত্ত্বীয় লেখক। নাইন-ইলেভেনের পর তার লেখা একটি প্রবন্ধ পড়েছিলাম। তিনি স্পষ্ট করে জানিয়ে দিলেন- জুলুম-অত্যাচার, নির্যাতন-নিপীড়ন, দুঃশাসন, অপশাসন ও অধিকার হরণের কারণে চরমপন্থী ও হঠকারী জন্ম নেয়। আগেই উল্লেখ করেছি, আমাদের দেশে বেশ কিছু রাজনৈতিক হত্যাকাণ্ড ঘটল, যার সাথে আইনশৃঙ্খলা বাহিনীর সংশ্লিষ্টতা প্রশ্নাতীতভাবে প্রমাণিত। অথচ সরকার দায় নিলো না। সরকারপ্রধান বললেন, পুলিশকে অস্ত্র দেয়া হয়েছে পকেটে রাখার জন্য নয়। জনগণ সরকারকে একেবারেই বিশ্বাসে নিলো না। ফল যা হওয়ার তাই হতে লাগল। এক সময় শুনলাম একজন কথিত পীর ও আরেকজন টিভি উপস্থাপক মাওলানাকে পরিকল্পিতভাবে জবাই করে হত্যা করা হলো। এখন পর্যন্ত সেই খুনের মোটিভ ও কাদের সংশ্লিষ্টতা এর সাথে রয়েছে তা খুঁজে পাওয়া গেল না। অথচ তোতাপাখির মতো পুলিশ-গোয়েন্দারা প্রমাণের আগে বিচারের মতো জঙ্গিবাদীদের দুষল, সেই জঙ্গিবাদীর চেহারা জাতি এখনো দেখল না। আরো দেখলাম কথিত ব্লগার হত্যার এক নিষ্ঠুরতা। ব্লগার মানে নাস্তিক, এটা বিশ্বাস করি না। কিছু রোমান্টিক তরুণ বয়সের দোষে, সমাজ-সভ্যতার অনাচারের কারণে সৃষ্টিকর্তাকে অস্বীকার করার ধৃষ্টতা দেখাতে পারে। এটা শুধু ব্লগার গোষ্ঠী ও শাহবাগী সম্প্রদায় কিংবা কথিত গণজাগরণ সংশ্লিষ্টতার জন্য নয়, এটা বিশেষ কোনো তরুণের কাজ হতে পারে। সব তরুণের নয়। এটা জ্ঞানের স্বল্পতা, পারিবারিক শিক্ষার অভাব, জাতীয় শিক্ষানীতির সীমাবদ্ধতা, ধর্মীয় জ্ঞানের অপ্রতুলতা এবং বর্তমান সমাজের নৈতিক অবক্ষয়ের উদর থেকে জন্ম নিতে পারে। বাম ধারণার সেকেলে তত্ত্বীয় চিন্তায় ধর্মকে আফিম বলার জন্যও হতে পারে। যে কারণেই হোক এ ধরনের যে কেউ নাস্তিক হোক, বকধার্মিক হোক, হোক ভিন্নমতের লোক, কাউকে হত্যা করার এখতিয়ার মানুষের নেই। বিনা বিচারে হত্যার অধিকার রাষ্ট্রও পায় না। সরকার আইনের বাইরে হত্যার কোনো সুযোগ নিলে এ ধরনের খুন, হত্যা শুধু বৈধতা পায় না, উৎসাহিতও হয়। যার বিষময় ফলাফলের মুখোমুখি এখন আমরা এসে দাঁড়িয়েছি।
যে নবীন ভোটারটি ভোট দেয়ার অধিকার পেল না- তার ভোটাধিকার কেড়ে নিলো সরকার। বঞ্চিত সেই তরুণ ব্লগার কেন তার ব্লগে ক্ষোভ দেখাবে না। ধর্মের নামে কবরপূজা, ভণ্ডামিই বা সে সহ্য করতে যাবে কেন? তাই ক্ষেপে ওঠে, সব অনাচারের বিরুদ্ধে ক্ষোভ জানাতে গিয়ে সংযম হারিয়ে ভুল করে বসে। মনস্তাত্ত্বিক সমস্যাটা এখানেই। একটা দৃষ্টান্ত দেয়া যাক, ঢাকা ও চট্টগ্রামের একজন তরুণ ভোট লুটপাটের ফসল এই মেয়রদের সম্মান করবে কেন। বিনা ভোটের এমপি-মন্ত্রীদের সমীহ করবে কেন। এর জন্য নিয়মতান্ত্রিক প্রতিবাদের জায়গা কই! তাহলে তারুণ্য ও সংক্ষুব্ধ মানুষের করণীয় কী? এর জবাবে বলব, তার পরও আইন হাতে তুলে নেয়া সঠিক হবে না।
এ ক্ষেত্রে একটি মৌলিক বিষয় হচ্ছে, আমরা যেকোনো মত লালন করতে পারি। নিজস্ব মতের প্রচারও করতে পারি। কিন্তু কিছু মত যখন অন্যের অধিকার ক্ষুণ্ন করে, সংক্ষুব্ধ করে, চিরায়ত মূল্যবোধ ধ্বংস করে নৈতিক স্খলনকে বাড়িয়ে তোলে তখন সেই মত নিজে লালন করতে পারি, প্রচার করতে পারি না। যেমন- ধর্ম না মানা বা সৃষ্টিকর্তাকে অস্বীকার করা কোনো ভালো গুণ নয়। তার পরও কারো ভালো না লাগলে সেটা নিজের ভেতর রাখা সঙ্গত। প্রচার করে বেড়ালে অন্যের ধর্মীয় অধিকারে হস্তক্ষেপ করা হয়, যা কোনো সভ্য জগৎ মেনে নেয় না। মেনে নিলে পার্শ্বপ্রতিক্রিয়া কতটা ভয়াবহ হয় তার তাৎক্ষণিক প্রমাণ ফ্রান্সসহ আজকের পশ্চিমা জগৎ। তা ছাড়া আমরা ভুলে যেতে পারি না- কোনো ধর্ম মন্দ নয়, কোনো প্রকৃত ধার্মিক অনাচার করে না। অনাচার কিংবা বাড়াবাড়ি করে নামসর্বস্ব মানুষ। যার নামটা ধর্মীয়, কর্মটা অধর্মের। এখানে যেকোনো ধর্ম সৃষ্টিকর্তা-নবী-রাসূল দায়হীন। তাদেরকে ক্ষোভের বিষয় বানাব কেন?
বাংলাদেশের মানুষ যে ধর্মই পালন করুক- অসাম্প্রদায়িক চেতনা ধারণ করে। একজন সৃষ্টিকর্তাকে মনেপ্রাণে জানে। ধর্ম আক্ষরিকভাবে পালন না করতে পারলেও ধর্ম নিয়ে কেউ অবজ্ঞা প্রদর্শন করুক, তা সহ্য করতে চায় না। আমাদের সমাজ, রাষ্ট্র ও আইন ব্যক্তির এই ধর্মীয় অধিকার সংরক্ষণ করে। তার পরও যারা স্বঘোষিত নাস্তিক তাদের জন্য খুনের শাস্তি বরাদ্দ করে হত্যাকে বৈধ করে নেয়ার জন্য আইন হাতে তুলে নেয়ার অধিকার কারো নেই। থাকতে পারে না। তাই সবার জন্য নিরাপদ হবে নৈতিক বেষ্টনীর আলোকে ব্লাসফেমি ধরনের একটি আইন; যাতে খ্রিষ্টান, মুসলমান, হিন্দু, বৌদ্ধ কারো সৃষ্টিকর্তা, ধর্মাবতার ও নবী-রাসূল অজ্ঞ ও অবুঝদের কারণে আক্রান্ত না হন।
আর যাদের ন্যূনতম বিশ্বাস কিংবা ঈমান আছে তারা ধর্ম পুরোটা না জানলেও, না মানলেও বিচারবহির্ভূত হত্যাকে নিজের জন্য বৈধ করে নিতে পারে না। কোনোকালেই কোনো ভালো কাজ খারাপ পদ্ধতিতে হয় না, হবে না। এ সত্যটি সবার আগে ক্ষমতা তস্কর সরকারের নীতিনির্ধারকদের মগজে নেয়া উচিত।
এখন ভারসাম্যপূর্ণ আচরণ হচ্ছে, ধর্মীয় বিদ্বেষ ছড়ানো বন্ধ করা। ধর্ম নিয়ে বাড়াবাড়ি ঠেকাতে হবে। ধর্মের নামে মতান্ধতা গ্রহণযোগ্য নয়। আবার মত প্রকাশের স্বাধীনতা ও অধিকারের নামে নাস্তিকতা প্রচার, নবী-রাসূলদের অসম্মান বৈধ হতে পারে না। যে বা যারা এমন অপকর্ম করে তার নাম ব্লগার হোক, হিন্দু হোক, মুসলমান হোক, হোক খ্রিষ্টান-ইহুদি কিংবা বৌদ্ধ কারো ধর্মাচারকে কটাক্ষ করার অধিকার কাউকে দেয়া যেতে পারে না।
অপারেশন ক্লিনহার্ট থেকে অপারেশন ডার্টি হার্ট অর্থাৎ বিরোধী দল নির্মূল অভিযান কোনোটাই কোনোকালে সমর্থন করতে পারিনি, আজও নয়। বিচারবহির্ভূত যেকোনো হত্যাই জুলুম। এ জুলুম বন্ধ করতে হলে সরকারের সদিচ্ছা জরুরি। প্রতিটি বিচারবহির্ভূত হত্যা, খুন, গুম, অপহরণের পর আমরা মাতম করব- সুফল পাবো না। বরং এর ফলে আরো একটি হত্যাকে উসকানি দেয়া হবে। কেউ ব্লগার মেরে উল্লাস করবে। কেউ জামায়াত-শিবির মেরে প্রেতের মতো অট্টহাসিতে ফেটে পড়বে। ভিন্নমতের রাজনীতিবিদকে নাই করে দিয়ে কেউ দাবি করবে রাজনৈতিক সাফল্য। এর পরিণাম শেষ পর্যন্ত ভয়াবহ হতে বাধ্য। সরকার নিজে সততা ও স্বচ্ছতা নিশ্চিত না করলে ইনসাফ ও আইনের খেলাপ এই মহাপাপাচার বন্ধ হবে না।

Mind you,beefore Raghuram Rajan became the governor of the Reserve Bank of India, he was the former chief economist of the International Monetary Fund (IMF) who famously predicted the source of the global financial meltdown in 2005. It's another matter that few listened.


Multilateral institutions like the IMF need to re-examine "rules of the game" but central banks should not ignore international responsibilities despite their domestic mandates, RBI Governor Raghuram Rajan has said.


Rajan, in his address to the Economic Club of New York here yesterday, made a strong case for the IMF to analyse each new unconventional monetary policy, including sustained unidirectional exchange rate intervention.

meanwhile media reports:Four major banks pleaded guilty on Wednesday to trying to manipulate foreign exchange rates and, with two others, were fined nearly $6 billion in another settlement in a global probe into the $5 trillion-a-day market.

Citigroup Inc (C.N), JPMorgan Chase & Co (JPM.N), Barclays Plc (BARC.L), UBS AG (UBSG.VX)(UBS.N) and Royal Bank of Scotland Plc (RBS.L) were accused by U.S. and UK officials of brazenly cheating clients to boost their own profits using invitation-only chat rooms and coded language to coordinate their trades.

All but UBS pleaded guilty to conspiring to manipulate the price of U.S. dollars and euros exchanged in the FX spot market. UBS pleaded guilty to a different charge. Bank of America Corp (BAC.N) was fined but avoided a guilty plea over the actions of its traders in chatrooms.

"The penalty all these banks will now pay is fitting, considering the long-running and egregious nature of their anticompetitive conduct," said U.S. Attorney General Loretta Lynch at a news conference in Washington.

The misconduct occurred until 2013, after regulators started punishing banks for rigging the London interbank offered rate (Libor), a global benchmark, and banks had pledged to overhaul their corporate culture and bolster compliance.

The expectations from the Narendra Modi government when it came to power in 2014 were "probably unrealistic" but it has taken steps to create an environment for investment and is "sensitive" to concerns of investors, RBI governor Raghuram Rajan has said.


"This government came in with tremendous expectations and I think the kind of expectations were probably unrealistic for any government," Dr Rajan said responding to questions after his address to the Economic Club of New York on Tuesday.


He said in the minds of the people, PM Modi's im-age was that of "Ronald Reagan on a white horse" coming to slay anti-market forces and such comparison was "probably not appropriate."


Dr Rajan, however, said the government has "taken steps to create the environment for investment, which I think is important."

The government is "sensitive" to the concerns of investors and is looking into addressing economic issues, he said.


"My sense is that things are happening," Dr Rajan said.


The RBI governor said a "big part" of the business environment is taxes and the government has said it will not bring retrospective taxation again.


"However once the tax authority levies a demand on you, there is a quasi-judicial nature of that proceeding and therefore it has to go through the courts before it is resolved. The government cannot intervene," Dr Rajan said.


At domestic level Modi's government claims to have started many pro-people schemes like Jan Dhan Yojana with an aim to provide banking access to all and bring in more public money into the banking system, which can be availed for various developmental purposes.

With an aim to speed up infrastructure development in the country to woo domestic as well as foreign investors the government has proposed amendments in the existing land acquisition act. But so far it has failed to get it passed inRajya Sabhawhere the opposition has majority.

Dr.BB Bhattacharya,ex-Vice Chancellor, JNU and an eminent economist:"I will say that their performance was good in International diplomacy, leadership ability, enthusiasm. Good causes likeSwachh Bharatand all. Coming to economic front - not yet action, some intentions. So, this is my sum up for one year."

DHPai Panandiker, anotedeconomistand president of the RPG Foundation think-tank:As far as the results are concerned, they are looking at the rate of growth, employment, inflation and all those. There is not much one can sort of say, that has been achieved. Because the rate of growth remains almost stagnant and employment is actually going down, and coming to inflation, of course there is some satisfaction that inflation has come down, or it has reached a level which is almost half over the year. So I think that is one plus point, otherwise I don't see much happening on the ground. But, there is an effort made to change both policies as well as governance. Policy changes have taken place, like private sector investment, in Railways, defence, mining, insurance sector etc. There are changes, but two main things that have not changed, and which were expected to happen are GST and other is the land acquisition bill."

Anjan Roy, former economic advisor atindustry bodyFICCI:"There could not be many sparkling achievements, but they are making an effort and trying to bring improvement, no doubt. But the point is that they are caught in a very difficult political situation. They cannot move on some very critical and major measures because of the parliamentary strength, so that is the limiting factor for the government. So, within that limit they are trying to make the best of it. But of course the expectations were very high and compared to that expectation it might not look very substantive. But nonetheless in these circumstances the government has made some efforts and it is making some difference. The biggest of it is at least the feeling that the government is not functional, it is no longer there. Taken the last government, second UPA almost was completely stigmatized by large scale corruption. Everyone was making money and the corruption charges were flying all over that has virtually brought the government to a stand still. Now, we have got over that situation, this is a very major achievement. And then in some critical areas there are some movements which will bear fruits over a period. So, on the whole it is not bad, not too disappointing, but one can say that it is not outstanding."

DevinderSharma,a noted agriculturepolicyexpert:"I think the performance of the Modi government has been quite satisfactory when it comes to economic parameters, but only the broad and macro economic parameters like physical deficit, current account deficit and the GDP. But the nation is looking forward to, whether they are giving more jobs or not. I think that would be the biggest challenge for the government."

Mumbai: The present period of slow economic growth is dangerous for the world and central banks are engaged in a risky competition to divert growth from other nations through monetary easing, rather than acting in unison to create new growth opportunities, Reserve Bank of India (RBI) governorRaghuram Rajan said on Tuesday.Financial Express reports.

Multilateral agencies such as International Monetary Fund, Rajan suggested, should develop a consensus on new rules for policy making and should be able to hold the rules inviolable.

"This period of slow growth is particularly dangerous because both industrial countries and emerging markets need high growth to quell rising domestic political tensions," Rajan said in a speech at the Economic Club of New York.

"Policies that attempt to divert growth from others rather than create new growth are more likely under these circumstances. Even as we create conditions for sustainable growth, we need new rules of the game, enforced impartially by multilateral organizations, to ensure countries adhere to international responsibilities," Rajan said.

The prevalent international monetary policy practice is a source of substantial risk, both to sustainable growth as well as to the financial sector, Rajan said. He emphasised that growth is not a problem for industrial or emerging markets, but it is a problem of collective action.

Countries should not compete with each other to corner whatever global growth and demand they can manage, but should create new growth, he said. The ideal solution is to fund emerging markets so that a new segment of global growth is created.

"We are being pushed towards competitive monetary easing," Rajan said in his speech, titled Going Bust for Growth.

Dr Rajan's remarks come as the Modi-led government completes one year in office this month, having received a commanding majority from an electorate that wanted jobs, economic development and respite from rising prices and corruption.


The Reserve Bank of India Governor said a "big part" of the business environment is taxes and the government has said it will not bring retrospective taxation again.


"However once the tax authority levies a demand on you, there is a quasi-judicial nature of that proceeding and therefore it has to go through the courts before it is resolved. The government cannot intervene," Dr Rajan said.


"Legacy issues are winding their way through the courts, including issues based on laws that existed before they were changed," he said.


The corporate tax rate will also come down one per cent every year going forward, he added.


The former International Monetary Fund chief economist said "perhaps" India could have done a "better job" in handling these issues but "going forward the government says no more of this kind of stuff we will do."


Dr Rajan said there are several areas where the government has taken more "serious and significant" advances to improve investor confidence and propel growth.


On the issue of subsidies, he said petrol and diesel subsidies have gone.


"Going forward these subsidies will be transferred directly into bank accounts," he said, adding that already the cooking gas subsidy is being transferred directly to bank accounts.


Dr Rajan said there is a "broad consensus" for the Goods and Services Tax (GST) and while he had hoped for the GST Bill to have passed in the just concluded session of Parliament, he feels there is "enough momentum" that "it will be done well in time and roll out by March 31 or April 1 next year."


"In fact (the government) is going ahead with the apparatus to ensure that it is actually done," Dr Rajan said.


Another key legislation that the government is focussing on is the Land Acquisition Bill, which is important from the perspective of certain public works, Dr Rajan said.


He said that since different states have their own land acquisition bills, some commentators have suggested the possibility that the states should decide for themselves as to how to implement their respective land acquisition provisions.


There are tremendous plans for investment, particularly in the Mumbai-Delhi industrial corridor and freight corridors, the RBI Governor said.


"My sense is that things are happening," he said.


Dr Rajan also called the government's spending cuts "significant," and said "there has been some amount of fiscal consolidation over and above what the government is owning up to."


He said inflation "has come down tremendously in India" and rupee has basically stayed relatively flat since the beginning of the year."


"...if you look at rupee's volatility relative to other currencies, you'd have to argue that the rupee has been one of the most stable currencies (against) the dollar," Dr Rajan said.


"It's been much stronger than other currencies," he said.


With the Current Account Deficit also projected to come down from more than four per cent to 1.5 per cent this year, Dr Rajan said "the big deficit numbers have come down" and the focus is on growth.


He, however, said while investment intention and investment is picking up, the pace can be faster.


Dr Rajan noted that the problem to some extent lies in the week balance sheet of banks and there is no supply problem as banks are willing to lend.

Now, India's central banker has some advice for his counterparts elsewhere in the world: Aggressive and competitive monetary policies are a risk.


In a speech at the Economic Club of New York on May 19, Rajan argued that the "spectre of deflation" is spurring major central banks around the world into a dangerous struggle for stronger domestic growth. This struggle, he added, is risky for financial markets and also ignores the needs of developing nations.


"I fear that in a world with weak aggregate demand, we may be engaged in a risky competition for a greater share of it," Rajan said. "We are thereby also creating financial sector risks for when unconventional policies end."

In recent years, central banks in major economies have held interest rates to near zero and embarked on asset-purchasing programmes in a bid to lower the cost of borrowing. But now, with the end of the bond-buying programme, and a possibility of an interest rate hike in the US, equity markets—especially in India—have been extremely volatile.Rajan also made a case for better coordination among central banks on the monetary policy. "It is not an industrial country problem, nor an emerging market problem, it is a problem of collective action," he said. "We are being pushed towards competitive monetary easing."


"We need much clearer rules of the game on what's allowed and what's not allowed," Rajan added.


In a question-and-answer session after his speech, Rajan also spoke on the performance of Indian prime minister Narendra Modi's first year in power.


The new Indian government, he said, came in with huge expectations, which were probably unrealistic. The perception of Modi as some sort of  "Ronald Reagan on a white horse" coming to slay anti-market forces was "probably not appropriate," Rajan explained.


The Modi government, he added, is sensitive towards investors and has taken steps to create an environment for investment, although in recent weeks the issue over unpaid minimum alternate tax on foreign investors has flared up. The total tax bill for international funds and banks could be as much as $8 billion, according to estimates.

As Narendra Modi completes one year in office, the palpable mood in the financial markets is that of disappointment. The government's ability to push forward the growth agenda is being viewed with some amount of skepticism by foreign investors in the backdrop of slow-paced reforms and faltering growth in core sectors.

The disappointment is logical. Expectations were sky-high when Modi took over and projected himself as an agent of quick change everywhere -- be it reviving a battered economy, improving governance or pushing the reform agenda to attract large investments.

But the danger in keeping expectations high is that if you fail to live up, the setback will be severe and even the good things done is overlooked.

Indian stock markets rallied like there was no tomorrow ever since Modi was named as the Prime Minister candidate of the BJP. Between September 2013 and 28 February 2015, when the union budget for 2015-16 was announced, India's bellwether index, Sensex on the BSE, jumped 48.8 percent, while the Nifty jumped 52.2 percent. Everyone joined the party.

But the market euphoria somewhat ended post the budget when the government failed to give a convincing roadmap on how it intends to reboot the economy — especially on bank recapitalisation — something vital to the economic revival in the absence of the government's willingness to spend. Since then, both the Sensex and Nifty lost around 7 percent. The bankex, the index of major bank stocks, plunged 7.3 percent (as of 15 May 2015).

The good things in Modi's one year include passage of some of the reform bills (insurance, coal, mining and black money), easing the process of doing business by fast-tracking clearances and initiating a massive financial inclusion push using banking channels. That said, many high-priority items such as land acquisition reforms and bringing clarity on tax-front are still in the to-do list.

Modi has indeed managed to inject the much-needed positive momentum in the economy and, more importantly, has restored the faith of common man in the government, which was absent in most part of the UPA rule, marred by series of corruption cases and lack of political will. For him, Modi was an agent of change.

To be sure, the former Gujarat chief minister had lot of luck too on his side. For instance, Modi's much hyped victory on inflation wasn't really his battle but more due to a sharp decline in global crude prices and the timely use of monetary policy byRaghuram Rajan at the Mint road.

But despite all the positive economic factors the falling inflation and a marginal improvement in the growth compared with the UPA years (factory out improved to an average 2.8 percent in fiscal year 2015 as against a contraction of 0.1 percent in the year before partly due to the base effect) — foreign investors seem to be losing patience.

Foreigners have begun pulling out money from local bourses and no fresh investments are made beyond plain promises. The stock markets seem to have lost the steam and global agencies have begun raising eyebrows on the timing of the potential pick up of growth in the economy.

Clearly, the government couldn't sell investors the brand new image of the economy depicted by the re-based GDP numbers that pushed India to the fastest growing economy in the world, matching China. Experts, both within and outside the country, questioned the lack of correlation between the GDP numbers and high frequency macro numbers that told a different tale.

The government's statisticians were, and still are, struggling to offer an explanation to the sudden twist in the story.

What acted as a major turn off to investors, despite the slow-progress made by the Modi government, was the absence of strong growth drivers. By passing legislations and improving the operational environment to do business, Modi prepared a conducive environment for the growth to happen, but the question of who would fund the growth remained unanswered.

After a period of dormant economic activities, three factors can typically reboot the economy: 1) Higher government spending; 2) private sector funding; 3) Bank lending. Unfortunately, all three are absent in the current context. When the government didn't put money on the table and private investors logically preferred to stay on the sidelines.

Perhaps, investors were more curious to know what precise plan the government had to revive economy using the third — the banking sector. The moment of distrust between the investor community and the government began when finance minister Arun Jaitley chose to mess up with the banking sector by cutting down bank recapitalisation in the February budget. This paralysed state-run banks from any further credit expansion and posed a question mark on revival.

Wrong strategy

The banking sector strategy of the government was flawed from the beginning. Jaitely announced a capital infusion of Rs 7,940 crore in the budget, much less than what state-run banks actually required and lower than what the government committed for fiscal year 2015.

Even for the previous year, the government has so far infused only about Rs 6,990 crore, out of the promised capital Rs 11,200 crore, that too based on performance. This further deepened the crisis in banks, which were already neck deep in bad loans.

Jaitley's message was clear: Small government banks, especially which rank lower in terms of performance, will have to go to the market to raise funds or get merged with other banks. They needn't expect any capital from the government from now on.

But Jaitley forgot that raising money from the market wouldn't be an easy task for smaller banks, since there is very less investor appetite in these banks, burdened with high bad loans and poor growth. Except the large lenders, like State Bank of India, not many lenders have been successful in tapping private funds.

State-run banks, which control 70 percent of the banking sector, faced a deeper crisis with the government's new approach. Instead, the government could have offered a phased approach for cutting down capital support from the government. But, Jaitely chose to give a shock treatment to banks, whose lending capacity was already constrained with high bad loans.

The impact was visible. Even with some revival on the ground, state-run banks, which control 70 percent of the banking industry, aren't in a position to lend. Besides lack of capital, high bad loans too limited their ability, in turn, hurting revival in economy.

"On the one hand, they expect us to further the cause of growth, on the other, there is no capital support," the chairman of a state-run bank told Firstpost on condition of anonymity.

With loan growth to industries remaining stagnant, mid-sized companies were caught in a crisis. Only a few top-rated large corporate managed to tap the corporate bond market. Others were constrained to shrink their business.

Had Jaitley handled the issue in a different way — by infusing a sizeable chunk of capital in state-run banks — it would have aided banks significantly to resume lending to good projects.

At this point, the business, investor confidence has surely taken a beating. Rebooting the economy would require two things:

One, put more money in the hands of state-run banks so that they can resume lending. This can be done by paring government holding in these banks.

Second, forget fiscal deficit and increase government spending on capital expenditure. There is no point in keeping the balance sheet of a corporation clean, when business is stagnant. Even if higher spending can push up fiscal deficit in the short term, this can eventually contribute to economic growth in medium-to-long-term.

The growth would remain a mirage unless funding channels are opened. This would continue to repel foreign investors, who are well past the Modi-wave. The signs of this happening are already visible.

Borrowers defaulting on restructured loans

The worst fears of Reserve Bank of India Governor Raghuram Rajan on the restructuring of bad loans look to be coming true. Banks had sought to recast dodgy loans over the past few years -taking haircuts and extending repayment periods -in order to make their books look better. They have only managed to kick the can down the road.

Defaults by borrowers given such a helping hand are soaring.The failure of these loans jumped 90% in the fourth quarter of the last fiscal year amid a sluggish economic environment and what look like poor business practices.

Restructured loans worth Rs 56,995 crore were classified as having failed at the end of the March quarter, almost twice the Rs 29,980 crore in the year-earlier period, according to data from the RBI's corporate debt restructuring cell.

"We had expected 30-35% of the loans restructured to go bad, but the prolonged slowdown has tak en a toll on companies," said a banker involved with the restructuring programme. "The packages were drafted on certain assumptions which have not paid off. Many of these cases should not have been restructured at all as we were sure of no turnaround, but to protect the bank balance sheets some excesses were done."

When faced with mounting bad loans in 2011-14, Indian banks resorted to restructuring, which helped them avoid having to report these as non-performing assets (NPAs). That reduced the funds they had to set aside for potential defaults.

It comes after Commonwealth Bank of Australia subsidiary Bankwest has also imposed a loan-to-valuation ratio cap on investor mortgages of 80 per cent.

An ANZ spokesman said the change in discounting, effective immediately, meant the bank would no longer offer discounts off its advertised rate, which is currently 5.38 per cent.

"For customers with Investor only lending, ANZ will only offer advertised rates with no discretionary pricing available," the spokesman said. "For customers with existing owner occupier lending, ANZ will continue to offer discretionary pricing on their investor loans."

ANZ had not changed its loan to valuation ratio for investor loans, he said, but the bank was " keeping a close eye on how the market develops," he said.

Bankwest's LVR limit will mean that property investors will need to provide 20 per cent of the purchase price as equity in order to receive the loan.

The changes are in response to a demand from the Australian Prudential Regulation Authority for banks to slow the pace of housing investor credit growth below 10 per cent.

Despite the cap being announced in December, investor credit has since accelerated year to 10.4 per cent in the year to March, the quickest pace since early 2008.

Latest numbers show ANZ, NAB, and Westpac were all growing faster than the threshold, and the lenders are under pressure to be under the cap by the second half of this year.

The pace of growth prompted APRA chairman Wayne Byres to last week say he expected slower growth in the second half of year, adding that banks had had "long enough to revise their ambitions".

Other banks are also cutting back on lucrative discounts and other special offers to property investors in response to fears about an over-heating property market and lending standards, with The Australian Financial Review revealing that each of the big four banks have contacted mortgage brokers in confidential letters advising them of more restrictive pricing.

In one of the letters, NAB warns "investment loans will not be eligible for any pricing discretion".

A NAB spokesman said: "As we have said previously, NAB is supportive of APRA's approach and we have been working closely with the regulator to ensure our practices are aligned to its best practice guidelines."

Westpac has not changed its LVR rules, but earlier this month it said it would apply tougher tests to new property investor borrowers when  assessing how they would cope with higher interest rates. It is also changing its criteria for "non-resident" home lending.

Other banks are also likely to be looking closely at their LVR policies and interest rate offers to investor borrowers.

In the letters to the brokers, Bankwest said it will apply a maximum loan-to-value ratio of 80 per cent  and has cut back on other special pricing deals for property investors.

The bank claimed the moves were aimed to "ensure sustainable growth in the home loan investment sector to protect both investors and the home loan market".

Bankwest said in a statement reported in Banking Day on Thursday that its LVR cap would not affect existing investment mortgage customers or customers with an application already formally submitted.

"As a responsible lender, Bankwest has reviewed the acceptable loan-to-valuation ratios for investment purposes to ensure sustainable growth in the home loan investment sector and to protect both investors and the home loan market," Bankwest said.

The Reserve Bank of New Zealand has introduced LVR caps to lending in Auckland to attempt to cool hot property markets across the Tasman.

APRA has indicated it will soon require the big banks to carry more capital against their mortgage books, in response to a recommendation from the financial system inquiry.

Bankwest said more than three-quarters of its investor loan book is currently below a LVR of 80 per cent.

বিগত ২০০৭-০৮ সালে ১/১১-এর তত্ত্বাবধায়ক সরকারের সময় ব্যবসায়ীদের নানাভাবে হয়রানি করা হয়। অনেককেই কর ফাঁকির অভিযোগে জেলে পাঠানো হয়। জেল থেকে বাঁচতে অনেকেই আত্মগোপনে যায়। ফলে ২০০৭ ও ২০০৮ এই দুই বছর ব্যবসায়ীরা ব্যবসায়ের দিকে মনোযোগ দেয়ার পরিবর্তে নিজেদের রক্ষায় ব্যস্ত ছিলো। ফলে ওই সময় বিনিয়োগ শূন্যের কোঠায় নেমে আসে। উদ্যোক্তারা ধরেই নিয়েছিলো, রাজনৈতিক সরকার ক্ষমতায় এলে ব্যবসায়-বাণিজ্য উন্নতি হবে। কিন্তু ২০০৯ সালে নির্বাচিত সরকার ক্ষমতায় এসে সঙ্কটের কথা বলে নতুন করে বিদ্যুৎ ও গ্যাস সংযোগ বন্ধ করে দেয়। দুই বছর পর শর্তসাপেক্ষে বিদ্যুৎ সংযোগ চালু করলেও গ্যাস সংযোগ আজো পুরোপুরি চালু হয়নি। এর বাইরে রাজনৈতিক অনিশ্চয়তা, আইন-শৃঙ্খলা পরিস্থিতি অবনতির কারণে ব্যবসায়ীরা নতুন করে বিনিয়োগে আস্থা পায়নি। সেই সাথে ব্যাংক থেকে অতিরিক্ত ঋণ নেয়ায় বেসরকারি খাতে সুদ ব্যয় ছিল চড়া। এদিকে ২০১৪ সালের ৫ জানুয়ারিতে নির্বাচনের পর থেকে রাজনৈতিক সহিংসতায় ও রাজনৈতিক গোলযোগে বিনিয়োগকারীরা নতুন করে বিনিয়োগে আরো নিরুৎসাহিত হয়ে পড়েছে। এ পরিস্থিতি অব্যাহত থাকলে আর বিনিয়োগকারীদের আস্থা ফেরাতে না পারলে বিনিয়োগ স্থবিরতা দীর্ঘস্থায়ীতেই রূপ নেবে।
প্রসঙ্গত উল্লেখ্য, 'এশিয়ার টাইগার'হিসেবে খ্যাত মালয়েশিয়া, সিঙ্গাপুর, থাইল্যান্ড ও তাইওয়ানের অর্থনৈতিক উত্থানের পেছনে কাজ করেছে দেশীয় বিনিয়োগকে সর্বোচ্চ প্রাধান্য দেয়ার নীতি। এসব দেশ আমদানি বিকল্প খাতে স্থানীয় উদ্যোক্তাদের নানা সহায়তায় বিনিয়োগে আকৃষ্ট করার মধ্য দিয়ে দেশের অর্থনীতিকে ধনী দেশগুলোর প্রায় সমান কাতারে নিয়ে যায়, বৈশ্বিক অর্থনীতিবিদদের কাছে যা 'এশিয়ান মিরাকল'নামে পরিচিত। কিন্তু বাংলাদেশে দেখা যায় তার উল্টো চিত্র। নানা ঝুঁকি নিয়ে বিনিয়োগ করা শিল্পপতিদের চেয়ে বাড়তি সুবিধা ভোগ করছে একই পণ্যের আমদানিকারকরা। এতে দেশী শিল্প যেমন ধ্বংস হচ্ছে, তেমনি আমদানি প্রাচুর্যের কারণে খরচ হচ্ছে মূল্যবান বৈদেশিক মুদ্রা। আবার এদেশে স্থানীয় উদ্যোক্তাদের পদে পদে বাধার সম্মুখীন হতে হয় বিনিয়োগ করতে গিয়ে, আর বিদেশীদের জন্য নিশ্চিত করা হয় নানা সুবিধা।
দেশী-বিদেশী বিনিয়োগকারীদের মধ্যে দীর্ঘদিন ধরে চলা এই 'বৈষম্যমূলক'নীতির সমালোচনা করেছে বিশ্লেষকরা। কারণ দেশের শিল্পপতিরা বিনিয়োগের পর সেখান থেকে যে মুনাফা পায়, তা আবারো বিনিয়োগ করে দেশের মাটিতেই। ফলে জ্যামিতিক হারে বাড়তে থাকে শিল্পের বিকাশ, উৎপাদন, প্রবৃদ্ধি ও কর্মসংস্থান। অন্যদিকে নানা সুবিধায় মোড়ানো ইনকিউবেটরে স্থাপিত বিদেশী বিনিয়োগ থেকে যে মুনাফা আসে, তার বড় অংশই চলে যায় বিদেশে। কিন্তু দেশে বিনিয়োগ হলে কর্মসংস্থানের ক্ষেত্র তৈরি হয়।
উৎপাদন বাড়ায়, জিডিপি'র প্রবৃদ্ধিও বাড়ে। বিনিয়োগের ক্ষেত্রে দেশীয় উদ্যোক্তাদেরই বেশি সুযোগ-সুবিধা দেয়া উচিত। সব দেশেই স্থানীয় বিনিয়োগকারীদের অগ্রাধিকার দেয়ার নীতি অনুসরণ করা হয়। কারণ স্থানীয় বিনিয়োগ বাড়লে তাতে কোনো ঝুঁকি তৈরি হয় না। বিদেশীদের ক্ষেত্রে সে ঝুঁকি থাকে। অতীতে দেখা গেছে, কোনো দেশ থেকে হঠাৎ করেই বিদেশী বিনিয়োগ প্রত্যাহার করে নেয়া হয়েছে। তখন ওই দেশে বিনিয়োগের ক্ষেত্রে এক ধরনের শূন্যতা দেখা যায়। তাই কোনো কারণে বিদেশী বিনিয়োগকারী তার পুঁজি প্রত্যাহার করে নিলে দেশের অর্থনীতিতে বিশৃঙ্খলা দেখা দিতে পারে।
স্থানীয় বিনিয়োগকারীদের অভিযোগ- উৎপাদনশীল খাত তো বটেই, অনুৎপাদনশীল খাতেও বিদেশী বিনিয়োগ এলে সরকারের পক্ষ থেকে সেখানে দ্রুত গ্যাস, বিদ্যুৎসহ অন্যান্য সুবিধা নিশ্চিত করা হয়। কিন্তু দেশের শিল্প মালিকরা বিপুল অর্থ উৎপাদনশীল খাতে বিনিয়োগ করে বছরের পর বছর এসব সরবরাহ পায় না। উল্টো বিনিয়োগের পর উৎপাদনে যাওয়ার জন্য প্রয়োজনীয় সেবা পেতে সরকারের দপ্তরগুলোতে গিয়ে স্থানীয় বিনিয়োগকারীদেরকে হয়রানির শিকার হতে হয় পদে পদে। বিদেশী বিনিয়োগকারীদের ভূমির বন্দোবস্ত করতে সরকার ইপিজেড প্রতিষ্ঠা করেছে। অন্যদিকে দেশীয় উদ্যোক্তারা বিনিয়োগের জন্য ব্যক্তিমালিকানাধীন ভূমির উন্নয়ন করতে গিয়েও সরকারের বাধায় তা করতে পারছে না। এতসব বৈষম্যমূলক নীতির পাশাপাশি আরো বড় ফাঁস হয়ে সামনে এসে দাঁড়ায় ব্যাংকঋণের উচ্চ সুদহার। ব্যাংক থেকে ঋণ নিয়ে বিনিয়োগের পর গ্যাস-বিদ্যুৎ সংযোগের অভাবে বছরের পর বছর অচল পড়ে থাকা কারখানার যন্ত্রপাতি একদিকে নষ্ট হয়, অন্যদিকে বাড়তে থাকে ঋণের সুদভার। ফলে স্বাভাবিক নিয়মেই স্থানীয় উদ্যোক্তাদের খেলাপি হয়ে যেতে হয়। অর্থ মন্ত্রণালয়, বিনিয়োগ বোর্ড, বাংলাদেশ ব্যাংকসহ সরকারের সংশ্লিষ্ট মন্ত্রণালয় ও সংস্থাগুলো বিষয়টি জানলেও এর সুরাহায় তাদের কোনো উদ্যোগ নেই।
সংশ্লিষ্টরা বলছে, দেশীয় বিনিয়োগ বাড়ানোর জন্য সুনির্দিষ্ট কোনো নীতিমালা নেই। স্থানীয় বিনিয়োগকারীরা প্রকল্প প্রস্তাব নিবন্ধনের সময় থেকেই নানা ধরনের প্রতিবন্ধকতা ও ঘুষ বাণিজ্যের মুখোমুখি হতে থাকে। কিন্তু বিদেশীদের ক্ষেত্রে এতসব বাধা ও ঝুঁকি নেই। কেউ বিদেশী বিনিয়োগের কথা বললেই সরকার ও সংশ্লিষ্ট দপ্তরগুলো নিজ উদ্যোগে সহায়তা করার প্রস্তুতি নিয়ে রাখে। স্থানীয় উদ্যোক্তারা বলছে, বিনিয়োগের ক্ষেত্রে সরকারের এই বৈষম্যমূলক নীতির কারণে দেশীয় বিনিয়োগকারীদের অনেকেই নতুন শিল্পপ্রতিষ্ঠান গড়ে তোলার আগ্রহ হারিয়ে ফেলছেন। ফলে উৎপাদন, কর্মসংস্থান বাড়ছে না। এতে বেকারত্বের মিছিল দীর্ঘতর হচ্ছে।
বর্তমানে সেবা খাত বাংলাদেশে সবচেয়ে লাভজনক। তবে এর মধ্য বেশি মুনাফা হচ্ছে টেলিযোগাযোগ খাতে। এখানে দেশী উদ্যোক্তাদের কোনো সুযোগ দেয়া হয়নি। ফলে সবচেয়ে লাভজনক খাতটি চলে গেছে বিদেশীদের হাতে। ঝুঁকিপূর্ণ ভাড়াভিত্তিক বিদ্যুৎকেন্দ্র সরকারের অনুগত কিছু উদ্যোক্তাকে দেয়া হলেও বড় ধরনের কেন্দ্র স্থাপনের সুযোগ দেশী উদ্যোক্তাদের ক্ষেত্রে নেই। এগুলোও চলে যাচ্ছে বিদেশীদের হাতে। একই অবস্থা গ্যাস খাতেও। বিদেশী সহায়তা নিয়ে গ্যাস খাতে দেশী উদ্যোক্তারা বিনিয়োগের সক্ষমতা রাখলেও তাদের সেই সুযোগ দেয়া হচ্ছে না। মোটা অঙ্কের কমিশনের বিনিময়ে এগুলো চলে যাচ্ছে কমিশনভিত্তিক ব্যবসায়ী ও বিদেশীদের হাতে।
জাতীয় রাজস্ব বোর্ডের (এনবিআর) তথ্য অনুসারে, কোনো বিদেশী উদ্যোক্তা এককভাবে অথবা যৌথ মালিকানায় ঢাকা ও চট্টগ্রাম বিভাগে বিনিয়োগ করলে প্রথম দুই বছরের জন্য ১০০ শতাংশ কর অবকাশ, তৃতীয় ও চতুর্থ বছরের জন্য ৫০ শতাংশ এবং পঞ্চম বছরে ২৫ শতাংশ কর অবকাশ সুবিধা দেয়া হয়। রাজশাহী, খুলনা, সিলেট, বরিশাল বিভাগ এবং চট্টগ্রামের পাহাড়ি এলাকায় বিনিয়োগ করলে প্রথম তিন বছর ১০০ শতাংশ কর অবকাশ, পরবর্তী তিন বছর ৫০ শতাংশ এবং সপ্তম বছরের জন্য ২৫ শতাংশ কর অবকাশ মেলে। নতুন শিল্পপ্রতিষ্ঠানের যন্ত্রপাতির জন্য প্রথম বছরে ৫০ শতাংশ অবচয় সুবিধা, দ্বিতীয় বছরে ৩০ শতাংশ এবং তৃতীয় বছরে ৩০ শতাংশ অবচয় সুবিধা দেয়া হয়। উৎপাদিত পণ্যের ৮০ শতাংশের বেশি রপ্তানি করলে শুল্কমুক্ত যন্ত্রাংশ আমদানি এবং আলাদা বন্ডেড ওয়্যারহাউজিং সুবিধা আছে। এছাড়া এলসি'র বিপরীতে ৯০ শতাংশ ঋণ এবং রপ্তানি উন্নয়ন তহবিল থেকে কম সুদে ঋণ নেয়ার সুযোগও রয়েছে। ইপিজেডের বাইরে শতভাগ রপ্তানিমুখী শিল্পপ্রতিষ্ঠানকেও স্থানীয় বাজারে একই শুল্কে ২০ শতাংশ পর্যন্ত পণ্য বিপণনের সুযোগ দেয়া হয়। সুনির্দিষ্ট কিছু পণ্যে ৫ থেকে ২০ শতাংশ নগদ সহায়তা আছে। এছাড়া বিদেশী বিনিয়োগকারীদের ক্ষেত্রে ৭৫ হাজার ডলার বিনিয়োগ করলে স্থায়ী আবাসন সুবিধা এবং পাঁচ লাখ ডলার বিনিয়োগ করলে বাংলাদেশের নাগরিকত্ব দেয়া হয়।
এভাবে নানা সুবিধায় বিনিয়োগ করার পর বিপুল পরিমাণ লভ্যাংশ বিদেশীরা নিয়ে যাচ্ছে বাংলাদেশ থেকে। ঢাকা স্টক এক্সচেঞ্জের তথ্য মতে, একটি বিদেশী কম্পানি প্রতিবছর ১৪০ শতাংশের বেশি লভ্যাংশ দিচ্ছে। কিন্তু তাদের শেয়ার মাত্র ১০ শতাংশ। বাকি ৯০ শতাংশ শেয়ার উদ্যোক্তাদের হাতে। অর্থাৎ ব্যবসা সম্প্রসারণ না করে, নিজেদের দেশে অর্থ নিয়ে যাচ্ছে বিদেশী কম্পানিগুলো। এগুলো রিজার্ভ ভেঙেও লভ্যাংশ দেয়। পাশাপাশি বিদেশী উদ্যোক্তাদের ব্যক্তিগত বিনিয়োগের আয়ের কর দেয়ার বিধান না থাকায় প্রতিবছর হাজার হাজার কোটি টাকা রাজস্ব আয় থেকে বঞ্চিত হচ্ছে সরকার।
স্থানীয় বিনিয়োগের ক্ষেত্রে বিদ্যমান বাধা ও জটিলতাগুলো অব্যাহত থাকলে দেশীয় শিল্পপতিরা আর বিনিয়োগে এগিয়ে আসবে না। তারা দেশের বদলে অর্থপাচার করে বিদেশে বিনিয়োগেই উৎসাহিত হবে। অনেক শিল্পপতি অর্থপাচারের মাধ্যমে বেনামে ভারত, মিয়ানমারসহ অন্যান্য দেশে শিল্প-কারখানা ও ভূমিতে বিনিয়োগ করছে বলে অভিযোগ রয়েছে। স্থানীয় বিনিয়োগকারীদের ক্ষেত্রে প্রযোজ্য এসব নেতিবাচক পরিস্থিতি দূর করতে হলে অগ্রাধিকার ভিত্তিতে দেশীয় বিনিয়োগকারীদের শিল্প-প্রতিষ্ঠানে প্রয়োজনীয় গ্যাস ও বিদ্যুতের সংযোগ নিশ্চিত করতে হবে।
অপরদিকে ব্যাংকগুলো ঋণের সুদের যে হার দেখায়, কার্যকরী সুদহার তারও বেশি। কারণ ব্যাংকগুলো তিন মাস পর পর ঋণের সুদ মূল ঋণের সঙ্গে যোগ করে। ফলে সুদের উপর সুদ বসছে। এতে সুদের হার দাঁড়ায় ২৩ শতাংশ পর্যন্ত। অথচ ভারতসহ পাশের দেশগুলোতেও ব্যাংক ঋণের সুদের হার এর অর্ধেকেরও কম। উচ্চ সুদের কারণে অনেক শিল্পপতিই বিনিয়োগের আগ্রহ ও পরিকল্পনা থাকা সত্ত্বেও ঋণ নিতে সাহস পাচ্ছে না। ফলে ব্যাংকে অলস টাকার পাহাড় জমেছে। এর নেতিবাচক প্রভাব পড়ছে অর্থনীতিতে।

নারায়ণগঞ্জ জেলা ও সাতটি বিভাগীয় শহরে হয়রানি বা নির্যাতনের ঘটনায় সহায়তা পেতে পুলিশের ওপর ৯৫ শতাংশ নারী আস্থাশীল নন। হেনস্তার শিকার হওয়ার আশঙ্কায় তাঁরা কোথাও অভিযোগও করেন না।

২০১৪ সালের মে-জুন মাসে পরিচালিত বাংলাদেশ উন্নয়ন গবেষণা প্রতিষ্ঠানের (বিআইডিএস) একটি গবেষণায় এ তথ্য পাওয়া
গেছে। জনপরিসরে নারীরা যেসব নির্যাতন বা হয়রানির শিকার হন, তার ধরন ও সমস্যা চিহ্নিত করতে গবেষণাটি করা হয়।
গবেষণায় অংশ নেন ৮০০ জন নারী ও কিশোরী এবং ৪০০ জন প্রাপ্তবয়স্ক পুরুষ। এতে দেখা গেছে, অংশগ্রহণকারী নারীদের ৮৪ শতাংশ যৌন হয়রানি বা নিপীড়নের শিকার হলেও কোথাও কোনো অভিযোগ করেননি। লোকনিন্দার ভয় (৭৬ শতাংশ), পরিবারের সুনাম (৬৯ শতাংশ), অভিযোগ দাখিলের জটিল পদ্ধতি ও তাতে প্রতিকার না পাওয়া (৪৭ শতাংশ) এবং পুলিশের মাধ্যমে পুনরায় হয়রানির আশঙ্কাকে (৩০ শতাংশ) অভিযোগ না করার কারণ হিসেবে উল্লেখ করেছেন।
গবেষণায় অর্থায়ন করেছে বেসরকারি সংস্থা অ্যাকশনএইড। গতকাল বুধবার রাজধানীর ধানমন্ডিতে ছায়ানট ভবনে সংস্থাটি আয়োজিত 'নিরাপদ নগরী নির্ভয় নারী'প্রচারণার উদ্বোধনী অনুষ্ঠানে এ গবেষণার তথ্য তুলে ধরা হয়। অ্যাকশনএইড কাজ করে—বিশ্বের এমন ২০টি দেশে এ প্রচারণার উদ্বোধন হয় গতকাল। একই সঙ্গে সংস্থাটি প্রতিবছর ২০ মে 'নিরাপদ নগরী, নির্ভয় নারী'দিবস হিসেবে পালন করার ঘোষণা দিয়েছে।
গবেষণায় অংশগ্রহণকারীরা জনপরিসরে যৌন হয়রানি, অপর্যাপ্ত সড়কবাতি, অপ্রতুল মহিলা বাস এবং সক্রিয় ও কার্যকর পুলিশের অভাবকে নারীদের জন্য অন্যতম ঝুঁকি হিসেবে চিহ্নিত করেছেন। তাঁদের মধ্যে ৯৫ শতাংশ নারী পুলিশের ওপর আস্থাশীল নন বলে উল্লেখ করেছেন। উত্তরদাতাদের ৬৫ শতাংশের মতে, পুলিশ অভিযোগকারীকেই দোষারোপ করে, ৫৭ শতাংশের মতে, মামলা নিতে পুলিশ গড়িমসি করে, ৫৩ শতাংশের মতে, অভিযোগ করে কোনো ফল পাওয়া যায় না।
পুলিশ চাইলেই অপরাধীদের চিহ্নিত ও ধরতে পারে বলে মন্তব্য করেন অনুষ্ঠানের প্রধান অতিথি ঢাকা উত্তর সিটি করপোরেশনের মেয়র আনিসুল হক। তিনি বলেন, নারীর প্রতি সহিংসতা কমাতে প্রয়োজন রাজনৈতিক ক্ষেত্রে সচেতনতা বৃদ্ধি। সে জন্য সামাজিক চাপ সৃষ্টি করতে হবে। তাতে সরকার ও প্রশাসন বাধ্য হবে ব্যবস্থা নিতে।
বিচার না হওয়ার প্রবণতায় দিন দিন নারীর প্রতি হয়রানি-সহিংসতা বেড়েই যাচ্ছে বলে মন্তব্য করেন ঢাকা বিশ্ববিদ্যালয়ের উইমেন অ্যান্ড জেন্ডার স্টাডিজ বিভাগের অধ্যাপক তানিয়া হক।
গবেষণা চলাকালে বিগত তিন মাসে কটূক্তি ও অশোভন আচরণের শিকার হয়েছেন এমন নারীর সংখ্যা ৮৪ শতাংশ। ৫৭ শতাংশকে অনাকাঙ্ক্ষিত স্পর্শ বা গায়ে হাত দেওয়ার মতো হয়রানির সম্মুখীন হতে হয়েছে।
দেশে নারী নির্যাতনের এ চিত্র উদ্বেগজনক উল্লেখ করে অনুষ্ঠানের সভাপতি অ্যাকশনএইড বাংলাদেশের দেশীয় পরিচালক ফারাহ্ কবির বলেন, 'নারীর প্রতি সহিংসতাকে প্রত্যক্ষ বা পরোক্ষভাবে আমরা প্রশ্রয় দিচ্ছি। রাজনৈতিক সদিচ্ছার অভাব তো আছেই, তার ওপর অপরাধীরা কোনো কোনো ক্ষেত্রে প্রশাসনেরও প্রশ্রয় পাচ্ছে। আইনকে প্রভাবিত করার এই চেষ্টা যেকোনো মূল্যে বন্ধ করতে হবে।'
অ্যাকশনএইড বাংলাদেশের নির্বাহী কমিটির সদস্য মনসুর আহমেদ চৌধুরী, মহিলাবিষয়ক অধিদপ্তরের পরিচালক জাকির হোসেন প্রমুখ আলোচনায় অংশ নেন।
অনুষ্ঠানের দ্বিতীয় পর্বে চারজনকে নাসরীন হক স্মৃতিপদক দেওয়া হয়। মুক্তিযুদ্ধে অবদান ও পেশায় সৃজনশীলতা বিভাগে ফেরদৌসী প্রিয়ভাষিণী, সহিংসতা প্রতিরোধে নারী বিভাগে শান্তি মালো, অপ্রথাগত পেশায় নারী বিভাগে রোখসানা খাতুন, সমাজ পরিবর্তনে যুবা নারী বিভাগে দনোমনি তিগ্যা পদক পেয়েছেন। অ্যাকশনএইডের প্রয়াত দেশীয় পরিচালক নাসরীন হকের প্রতি শ্রদ্ধা জানিয়ে ২০০৭ সাল থেকে সংস্থাটি এ পুরস্কার দিয়ে আসছে।

राजस्थान की राजधानी जयपुर से तक़रीबन ढाई सौ किलोमीटर दूर स्थित अन्य पिछड़े वर्ग की एक दबंग जाट जाति की बहुलता वाला नागौर  जिला इन दिनों दलित उत्पीडन की निरंतर घट रही शर्मनाक घटनाओं की वजह से कुख्यात हो रहा है .विगत एक साल के भीतर यहाँ पर दलितों के साथ जिस तरह का जुल्म हुआ है और आज भी जारी है ,उसे देखा जाये तो दिल दहल जाता है ,यकीन ही नहीं आता है कि हम आजाद भारत के किसी एक हिस्से की बात कर रहे है .ऐसी ऐसी निर्मम और क्रूर वारदातें कि जिनके सामने तालिबान और अन्य आतंकवादी समूहों द्वारा की जाने वाली घटनाएँ भी छोटी पड़ने लगती है .क्या किसी लोकतान्त्रिक राष्ट्र में ऐसी घटनाएँ संभव है ? वैसे तो असम्भव है ,लेकिन यह संभव हो रही है ,यहाँ के राजनीतिक और प्रशासनिक ढांचें की नाकामी की वजह से ...

 

दलित उत्पीडन का गढ़ बन गया है नागौर

नागौर जिले के बसवानी गाँव में पिछले महीने ही एक दलित परिवार के झौपड़े में दबंग जाटों ने आग लगा दी ,जिससे एक बुजुर्ग दलित महिला वहीँ जल कर राख हो गयी और दो अन्य लोग बुरी तरह से जल गए ,जिन्हें जोधपुर के सरकारी अस्पताल में इलाज के लिए भेजा गया ,इसी जिले के लंगोड़ गाँव में एक दलित को जिंदा दफनाने का मामला सामने आया है.मुंडासर में एक दलित औरत को घसीट कर ट्रेक्टर के गर्म सायलेंसर से दागा गया और हिरडोदा गाँव में एक दलित दुल्हे को घोड़ी पर से नीचे पटक कर जान से मरने की कोशिश की गयी .राजस्थान का यह जाटलेंड जिस तरह की अमानवीय घटनाओं को अंजाम दे रहा है ,उसके समक्ष तो खाप पंचायतों के तुगलकी फ़रमान भी कहीं नहीं टिकते है ,ऐसा लगता है कि इस इलाके में कानून का राज नहीं ,बल्कि जाट नामक किसी कबीले का कबीलाई कानून चलता है,जिसमे भीड़ का हुकुम ही न्याय है और आवारा भीड़ द्वारा किये गए कृत्य ही विधान है .

नागौर जिले की तहसील मेड़ता सिटी का निकटवर्ती गाँव है डांगावास ,जहाँ पर 150 दलित परिवार निवास करते है और यहाँ 1600 परिवार जाट समुदाय के है ,तहसील मुख्यालय से मात्र 2 किलोमीटर दुरी पर स्थित है डांगावास ,..जी हाँ ,यह वही डांगावास गाँव है ,जहाँ पिछले एक साल में  चार दलित हत्याकांड हो चुके है ,जिसमे सबसे भयानक हाल ही में हुआ है. एक साल पहले यहाँ के दबंग जाटों ने मोहन लाल मेघवाल के निर्दोष बेटे की जान ले ली थी ,मामला गाँव में ही ख़त्म कर दिया गया ,उसके बाद 6 माह पहले मदन पुत्र गबरू मेघवाल के पाँव तोड़ दिये गए ,4 माह पहले सम्पत मेघवाल को जान से ख़त्म कर दिया गया ,इन सभी घटनाओं को आपसी समझाईश अथवा डरा धमका कर रफा दफा कर दिया गया .पुलिस ने भी कोई कार्यवाही नहीं की .

स्थानीय दलितों का कहना है कि बसवानी में दलित महिला को जिंदा जलाने के आरोपी पकडे नहीं गए और शेष जगहों की गंभीर घटनाओं में भी कोई कार्यवाही इसलिए नहीं हुयी क्योंकि सभी घटनाओं के मुख्य आरोपी प्रभावशाली जाट समुदाय के लोग है .यहाँ पर थानेदार भी उनके है ,तहसीलदार भी उनके ही और राजनेता भी उन्हीं की कौम के है ,फिर किसकी बिसात जो वे जाटों पर हाथ डालने की हिम्मत दिखाये ? इस तरह मिलीभगत से बर्षों से दमन का यह चक्र जारी है ,कोई आवाज़ नहीं उठा सकता है ,अगर भूले भटके प्रतिरोध की आवाज़ उठ भी जाती है तो उसे खामोश कर दिया जाता है .

जमीन के बदले जान लेने का प्रचलन

एक और ध्यान देने योग्य तथ्य यह भी है कि राजस्थान काश्तकारी कानून की धारा 42 (बी ) के होते हुए भी जिले में दलितों की हजारों बीघा जमीन पर दबंग जाट समुदाय के भूमाफियाओं ने जबरन कब्ज़ा कर रखा है.यह कब्जे फर्जी गिरवी करारों,झूठे बेचाननामों और धौंस पट्टी के चलते किये गए है ,जब भी कोई दलित अपने भूमि अधिकार की मांग करता है ,तो दबंगों की दबंगई पूरी नंगई के साथ शुरू हो जाती है.ऐसा ही एक जमीन का मसला दलित अत्याचारों के लिए बदनाम डांगावास गाँव में विगत 30 वर्षों से कोर्ट में जेरे ट्रायल था ,हुआ यह कि बस्ता राम नामक मेघवाल दलित की 23 बीघा 5 बिस्वा जमीन कभी मात्र 1500 रूपये में इस शर्त पर गिरवी रखी गयी कि चिमना राम जाट उसमे से फसल लेगा और मूल रकम का ब्याज़ नहीं लिया जायेगा ,बाद में जब भी दलित बस्ता राम सक्षम होगा तो वह अपनी जमीन गिरवी से छुडवा लेगा .बस्ताराम जब इस स्थिति में आया कि वह मूल रकम दे कर अपनी जमीन छुडवा सकें ,तब तक चिमना राम जाट तथा उसके पुत्रों ओमाराम और काना राम के मन में लालच आ गया,जमीन कीमती हो गयी ,उन्होंने जमीन हड़पने की सोच ली और दलितों को जमीन लौटने से मना कर दिया .पहले दलितों ने याचना की ,फिर प्रेम से गाँव के सामने अपना दुखड़ा रखा ,मगर जिद्दी जाट परिवार नहीं माना ,मजबूरन दलित बस्ता राम को न्यायालय की शरण लेनी पड़ी .करीब तीस साल पहले मामला मेड़ता कोर्ट में पंहुचा ,बस्ताराम तो न्याय मिलने से पहले ही गुजर गया ,बाद में उसके दत्तक पुत्र रतनाराम ने जमीन की यह जंग जारी रखी और अपने पक्ष में फैसला प्राप्त कर लिया .वर्ष 2006 में उक्त भूमि का नामान्तरकरण रतना राम के नाम पर दर्ज हो गया तथा हाल ही में में कोर्ट का फैसला भी दलित खातेदार रतना राम के पक्ष में आ गया .इसके बाद रतना राम अपनी जमीन पर एक पक्का मकान और एक कच्चा झौपडा बना कर परिवार सहित रहने लग गया ,लेकिन इसी बीच 21 अप्रैल 2015 को चिमनाराम जाट के पुत्र कानाराम तथा ओमाराम ने इस जमीन पर जबरदस्ती तालाब खोदना शुरू कर दिया और खेजड़ी के वृक्ष काट लिये.रत्ना राम ने इस पर आपत्ति दर्ज करवाई तो जाट परिवार के लोगों ने ना केवल उसे जातिगत रूप से अपमानित किया बल्कि उसे तथा उसके परिवार को जान से मार देने कि धमकी भी दी गयी .मजबूरन दलित रतना राम मेड़ता थाने पंहुचा और जाटों के खिलाफ रिपोर्ट दे कर कार्यवाही की मांग की.मगर थानेदार जी चूँकि जाट समुदाय से ताल्लुक रखते है सो उन्होंने रतनाराम की शिकयत पर कोई कार्यवाही नहीं की ,दोनों पक्षों के मध्य कुछ ना कुछ चलता रहा .

निर्मम नरसंहार ,अमानवीयता ,पशुता ,दरिंदगी !

12 मई को जाटों ने एक पंचायत डांगावास में बुलाने का निश्चय किया ,मगर रतना राम और उसके भाई पांचाराम के गाँव में नहीं होने के कारण यह स्थगित कर दी गयी ,बाद में 14 मई को फिर से जाट पंचायत बैठी ,इस बार आर पार का फैसला करना ही पंचायत का उद्देश्य था ,अंततः एकतरफा फ़रमान जारी हुआ  कि दलितों को किसी भी कीमत पर उस जमीन से खदेड़ना है  ,चाहे जान देनी पड़े या लेनी पड़े ,दूसरी तरफ पंचायत होने की सुचना पा कर दलित अपने को बुलाये जाने का इंतजार करते हुये अपने खेत पर स्थित मकान पर ही मौजूद रहे ,अचानक उन्होंने देखा कि सैंकड़ों की तादाद में जाट लोग हाथों में लाठियां ,लौहे के सरिये और बंदूके लिये वहां आ धमके है और मुट्ठी भर दलितों को चारों तरफ से घेर कर मारने लगे ,उन्होंने साथ लाये ट्रेक्टरों से मकान तोडना भी चालू कर दिया .

दलितों ने गोली चलायी ही नहीं

लाठियों और सरियों से जब दलितों को मारा जा रहा था ,इसी दौरान किसी ने रतनाराम मेघवाल के बेटे मुन्नाराम को निशाना बना कर  फ़ायर कर दिया ,लेकिन उसी वक्त किसी और ने मुन्ना राम के सिर के पीछे की और लोहे के सरिये से भी वार कर दिया ,जिससे मुन्नाराम  गिर पड़ा और गोली रामपाल गोस्वामी को जा कर लग गयी ,जो कि जाटों की भीड़ के साथ ही आया हुआ था .गोस्वामी की बेवजह हत्या के बाद जाट और भी उग्र हो गये ,उन्होंने मानवता की सारी हदें पार करते हए वहां मौजूद दलितों का निर्मम नरसंहार करना शुरू कर दिया.

ट्रेक्टरों से कुचला ,लिंग नोचा ,ऑंखें फोड़ दी ,गुप्तांगों में लकड़ियाँ डाल दी

ट्रेक्टर जो कि खेतों में चलते है और फसलों को बोने के काम आते है ,वे निरीह ,निहत्थे दलितों पर चलने लगे ,पूरी बेरहमी से जाट समुदाय की यह भीड़ दलितों को कुचल रही थी ,तीन दलितों को ट्रेक्टरों से कुचल कुचल कर वहीँ मार डाला गया .इन बेमौत मारे गए दलितों में श्रमिक नेता पोकर राम भी था ,जो उस दिन अपने रिश्तेदारों से मिलने के लिए अपने भाई गणपत मेघवाल के साथ वहां आया हुआ था .जालिमों ने पोकरराम के साथ बहुत बुरा सलूक किया ,उस पर ट्रेक्टर चढाने के बाद उसका लिंग नोंच लिया गया तथा आँखों में जलती लकड़ियाँ डाल कर ऑंखें फोड़ दी गयी .महिलाओं के साथ ज्यादती की गयी और उनके गुप्तांगों में लकड़ियाँ घुसेड़ दी गयी .तीन लोग मारे गए ,14 लोगों के हाथ पांव तोड़ दिये गए ,एक ट्रेक्टर ट्रोली तथा चार मोटर साईकलें जला कर राख कर दी गयी ,एक पक्का मकान जमींदोज कर दिया गया और कच्चे झौपड़े को आग के हवाले कर दिया गया .जो भी समान वहां था ,जालिम उसे लूट ले गए .इस तरह तकरीबन एक घंटा मौत के तांडव चलता रहा ,लेकिन मात्र 4 किलोमीटर दूरी पर मौजूद पुलिस सब कुछ घटित हो जाने के बाद पंहुची और घायलों को अस्पताल पंहुचाने के लिए एम्बुलेंस बुलवाई  ,जिसे भी रोकने की कोशिश जाटों की उग्र भीड़ ने की ,इतना ही नहीं बल्कि जब गंभीर घायलों को मेड़ता के अस्पताल में भर्ती करवाया गया तो वहां भी पुलिस तथा प्रशासन की मौजूदगी में ही धावा बोलकर बचे हुए दलितों को भी खत्म करने की कोशिश की गयी .

यह अचानक नहीं हुआ ,सब कुछ पूर्वनियोजित था

ऐसी दरिंदगी जो कि वास्तव में एक पूर्वनियोजित नरसंहार ही था ,इसे नागौर की पुलिस और प्रशासन जमीन के विवाद में दो पक्षों की ख़ूनी जंग करार दे कर दलित अत्याचार की इतनी गंभीर और लौमहर्षक  वारदात को कमतर करने की कोशिश कर रही है .पुलिस ने दलितों की और से अर्जुन राम के बयान के आधार पर एक कमजोर सी एफआईआर दर्ज की है ,जिसमे पोकरराम के साथ की गयी इतनी अमानवीय क्रूरता का कोई ज़िक्र तक नहीं है और ना ही महिलाओं के साथ हुयी भयावह यौन हिंसा के बारे में एक भी शब्द लिखा गया है. सब कुछ पूर्वनियोजित था ,भीड़ को इकट्टा करने से लेकर रामपाल गोस्वामी को गोली मारने तक की पूरी पटकथा पहले से ही तैयार थी ,ताकि उसकी आड़ में दलितों का समूल नाश किया जा सके . कुछ हद तक वो यह करने में कामयाब भी रहे ,उन्होंने बोलने वाले और संघर्ष कर सकने वाले समझदार घर के मुखिया दलितों को मौके पर ही मार डाला . बाकी बचे हुए तमाम दलित स्त्री पुरुषों के हाथ और पांव तोड़ दिये जो ज़िन्दगी भर अपाहिज़ की भांति जीने को अभिशप्त रहेंगे ,दलित महिलाओं ने जो सहा वह तो बर्दाश्त के बाहर है तथा उसकी बात करना ही पीड़ाजनक है ,इनमे से कुछ अपने शेष जीवन में सामान्य दाम्पत्य जीवन जीने के काबिल भी नहीं रही ,इससे भी भयानक साज़िश यह है कि अगर ये लोग किसी तरह जिंदा बच कर हिम्मत करके वापस डांगावास लौट भी गये तो रामपाल गोस्वामी की हत्या का मुकदमा उनकी प्रतीक्षा कर रहा है ,यानि कि बाकी बचा जीवन जेल की सलाखों के पीछे गुजरेगा ,अब आप ही सोचिये ये दलित कभी वापस उस जमीन पर जा पाएंगे .क्या इनको जीते जी कभी न्याय हासिल हो पायेगा ? आज के हालात में तो यह असंभव नज़र आता है .

इस शर्मनाक कृत्य पर शर्मिंदा नहीं है जालिम

कुछ दलित एवं मानव अधिकार जन संगठन इस नरसंहार के खिलाफ आवाज़ उठा रहे है ,मगर उनकी आवाज़ कितनी सुनी जाएगी यह एक प्रश्न है .सूबे की भाजपा सरकार के कान पर जूं तक नहीं रेंगी है ,कोई  भी ज़िम्मेदार सरकार का नुमाइंदा घटना के चौथे दिन तक ना तो डांगावास पंहुचा था और ना ही घायलों की कुशलक्षेम जानने आया .अब जबकि मामले ने तूल पकड़ लिया है तब सरकार की नींद खुली है ,फिर भी मात्र पांच किलोमीटर दूर रहने वाला स्थानीय भाजपा विधायक सुखराम आज तक अपने ही समुदाय के लोगों के दुःख को जानने नहीं पंहुचा .नागौर जिले में एक जाति का जातीय आतंकवाद इस कदर हावी है कि कोई भी उनकी मर्जी के खिलाफ नहीं जा सकता है .दूसरी और जाट समुदाय के छात्र नेता ,कथित समाजसेवक और छुटभैये नेता इस हत्याकाण्ड के लिए एक दुसरे को सोशल मीडिया पर बधाईयाँ दे रहे है तथा कह रहे है कि आरक्षण तथा अजा जजा कानून की वजह से सिर पर चढ़ गए इन दलितों को औकात बतानी जरुरी थी ,वीर तेज़पुत्रों ने दलित पुरुषों को कुचल कुचल कर मारा तथा उनके आँखों में जलती लकड़ियाँ घुसेडी और उनकी नीच औरतों को रगड़ रगड़ कर मारा तथा ऐसी हालत की कि वे भविष्य में कोई और दलित पैदा ही नहीं कर सकें .इन अपमानजनक टिप्पणियों के बारे में मेड़ता थाने में दलित समुदाय की तरफ से एफ आई आर भी दर्ज करवाई गयी है ,जिस पर कार्यवाही का इंतजार है.

सीबीआई जाँच ही सच सामने ला सकती है .

अगर डांगावास नरसंहार की निष्पक्ष जाँच करवानी है तो इस पूरे मामले को सी बी आई को सौपना होगा ,क्योंकि अभी तक तो जाँच अधिकारी भी जाट लगा कर राज्य सरकार ने साबित कर दिया है कि वह कितनी संवेदनहीन है ,आखिर जिन  अधिकारियों के सामने जाटों ने यह तांडव किया और उसकी इसमें मूक सहमति रही ,जिसने दलितों की कमजोर एफ आई आर दर्ज की और दलितों को फ़साने के लिए जवाबी मामला दर्ज किया तथा पोस्टमार्टम से लेकर मेडिकल रिपोर्ट्स तक सब मैनेज किया  ,उन्हीं लोगों के हाथ में जाँच दे कर राज्य सरकार ने साबित कर दिया कि उनकी नज़र में भी दलितों की औकात कितनी है .

ख़ामोशी भयानक है .

इतना सब कुछ होने के बाद भी दलित ख़ामोश है ,यह आश्चर्यजनक बात है .कहीं कोई भी हलचल नहीं है ,मेघसेनाएं ,दलित पैंथर्स ,दलित सेनाएं ,मेघवाल महासभाएं सब कौनसे दड़बे में छुपी हुयी है ? अगर इस नरसंहार पर भी दलित संगठन नहीं बोले तब तो कल हर बस्ती में डांगावास होगा ,हर घर आग के हवाले होगा ,हर दलित कुचला जायेगा और हर दलित स्त्री यौन हिंसा की शिकार होगी ,हर गाँव बथानी टोला होगा ,कुम्हेर होगा ,लक्ष्मणपुर बाथे और भगाना होगा .इस कांड की भयावहता और वहशीपन देख कर पूंछने का मन करता है कि क्या यह एक और खैरलांजी नहीं है ? अगर हाँ तो हमारी मरी हुयी चेतना कब पुनर्जीवित होगी या हम मुर्दा कौमों की भांति रहेंगे अथवा जिंदा लाशें बन कर धरती का बोझ बने रहेंगे .अगर हम दर्द से भरी इस दुनिया को बदल देना चाहते है तो हमें सडकों पर उतरना होगा और तब तक चिल्लाना होगा जब तक कि डांगावास के अपराधियों को सजा नहीं मिल जाये और एक एक पीड़ित को न्याय नहीं मिल जाये ,उस दिन के इंतजार में हमें रोज़ रोज़ लड़ना है ,कदम कदम पर लड़ना है और हर दिन मरना है ,ताकि हमारी भावी पीढियां आराम से ,सम्मान और स्वाभिमान से जी सके .

'উজান সাহিত্য গোষ্ঠী'র উদ্যোগে তিনসুকিয়াতে ভাষা শহীদ দিবস পালিত হলো এবারেও। দুর্গাবাড়ি মিউজিক কলেজে ছোট্ট ঘরোয়া অনুষ্ঠানে সভাপতিত্ব করেন গোষ্ঠীর সভাপতি সুজয় রায়। 'ডাকে ঐ ১৯শের শহীদেরা ভাই' গানের সঙ্গে পুষ্পার্ঘ দিয়ে অনুষ্ঠান শুরু হয়। একই গান , আবার পরিবেশন করেন তুহিনা ভট্টাচার্য পরে । এছাড়াও গান করেন জীবন সরকার ও বর্ণালী সেনগুপ্ত। নিজের লেখা কবিতা পড়েন পার্থ সারথি দত্ত ও ভানু ভূষণ দাস। আমি এবং আমার কন্যা পড়ে শোনাই ক্রমে বিজয় ভট্টাচার্য এবং শক্তিপদ ব্রহ্মচারীর কবিতা। এছাড়াও ১৯শের প্রাসঙ্গিকতা নিয়ে উপস্থিত নানা জন বক্তৃতা করেন।

कमल जोशी नैनीताल में हमारे साथ डीएसबी कालेज के दिनों में रसायन शास्त्र से शोध करते थे और बीकर और परखनली में रसायन प्रयोगशाला मेंउनकी बनायी चायइस दुनिया में फिर कहीं नहीं मिली और न मिलने वाली है।


वे छात्र जीवन से हिमालयके जनजीवन में पगलाये हुए हैं।हिमालयका मतलब उनके लिए पहाड़ और पर्यावरण नहीं है सिर्फ ,अर्थव्यवस्था तो है ही नहीं।हिमालयी जनता की आंखों में आंखे डालकर उनकी दिनचर्या को वे लगातार लगातार कैमरे में कैद करते रहे हैं।


हमारे लिए वे दुनिया के सबसे बेहतरीन फोटोकार कलाकार है,जिसके हरफ्रेम में कायनात की खूबसूरती में इंसानियत का कलरव है।


कमल कभी लिखते नहीं है।


वे कैमरे की जुबान में बातें करते हैं।


गिरदा और हमारे जैसे उधमियों के बीच वे हमारी उमा भाभी की तरह खामोश रहे हैं हमेशा।


इसबार जब राजीव नयन दाज्यू ने मुझे देहरादून में बीजापुर गेस्ट हाउस में ठहराया तो मूसलाधार बारिश थी।


रात के दस बजे कमल स्कूटी किसी से मांगकर चले आये।


कमल ने शायद पहलीबार फेसबुक पर कोई टिप्पणी की है।


इसे इसीलिए साझा कर रहा हूं।


कमल अपनी तारीफ से बेहद झल्लाते हैं।


लेकिन हम क्या करें,इतने महबूब दोस्त की तारीफ खुदबखुद जुबान पर आ ही जाती है।


कमल प्यारे ,इस गुस्ताखी के लिए माफ करना।

मेरे एक "बुद्धिजीवी" (?) परिचित ने, उसके बारे में, जिससे वो खुंदक खाए थे झुंझला कर कहा

"जिसकी दुम उठाओ- वो ही मादा है यार"....! पुरुषों में बहुत प्रचलित है ये कथन.

किसी धोखेबाज़, कायर, कम समझ वाले को मादा कह कर अपमानित करने का तरीका है ये... पर सोचिये अगर सारी दुनिया मादा हो जाए तो...?

मादा माने स्त्री! मादा शब्द ही माता से आया है....! मां माने संवेदन शील, केयर करने वाली , सब बच्चों में बराबरी रखने वाली और कमजोर के पक्ष में खड़ी होने वाली..., अपनी नहीं परिवार की सोचने वाली.......! क्या आप सारी दुनिया में एसे लोगों को नही चाहेंगे...!

मादा शब्द को गाली समझने/समझाने वाले लोगों से एक निवेदन..., अपनी माँ की आँखों में झांक कर देखें ...क्या दुनिया में हर व्यक्ति को ऐसा ही नहीं चाहेंगे आप....!

जो लोग स्त्री को व्यक्ति नहीं समझते...., उनकी नज़र में तो हर औरत मादा है ....माँ भी मादा ही है.....!

वैसे मुझे पता नहीं क्यों लिख दिया ये आज....

गंगा आरती : देवप्रयाग

नदियों के बारे में हम उनकी पूजा करने, आरती उतारने और पाप धोने के लिए स्नान करने तक ही सिमित क्यों हैं...? नदियों की पूजा करना आरती तक ही सीमित होना नहीं बल्कि ये वचन देना है की: "हे नदी , तू जीवनदायनी है ! मैं तेरी रक्षा करूंगा, कोई ऐसा कार्य नहीं करूंगा जिससे तुझे क्षति हो, या तू अपवित्र हो."

क्या नदी की आरती उतारते वक्त भक्तों से ये वचन लिवाया जा सकता है पंडा समाज द्वारा..?

शक है, क्यों की इसी आरती स्थल से 50 मीटर दूर, झूला पुल के पाए के बगल में ऐसा पेशाब घर बनाया गया है जिससे पेशाब सीधी गंगा में उतरती है और फिर 50 मीटर बह कर इस आरती स्थल तक पहुंचती है...! पेशाब घर के लिए कोई दूसरी व्यवस्था या पेशाब उपचारित करने की ज़रूरत नहीं समझी गयी…


कठिन है डगर.....जिनगानी की...

एक तो औरत....., फिर मां की जिम्मेदारी

बहुत कहेंगे की औरत है तो माँ बनेगी ही ....., नियती है....ज़रूरी भी है..!

पर समझ में नहीं आता की पति-पत्नी-बच्चे वाले परिवार में बच्चे का बोझ केवल मां पर ही क्यों....! कम से कम तब तक, जब तक वो अपने मां बाप पर ही निर्भर हो....! पति अगर संवेदन शील नहीं तो मां को ही सब भोगना पड़ता है...

और समाज के रीती रिवाजों ने औरत होना कितना कठिन कर दिया है...

सब ऐसे नहीं...... पर अधिकांश हाल तो यही है...

कठिन है जिन्दगानी तेरी



मजदूर दिवस.....!

इस मजदूर को किस श्रेणी में डाला जाएगा जिसको पता ही नहीं की वो मजदूर भी है...!

या फिर उसे सिर्फ बाल मजदूर के आंकड़ों में शामिल कर इतिश्री कर लि जायेगी.....!

देवभूमि का एक सच ये भी है..!

पीएचडी का संकट ये है कि सरकार ग्रांट देने में मुंह फुलाती है और फिर इसी का बहाना बनाकर यूनिवर्सिटीज़ में टीचिंग पोस्ट ख़ाली रखती है. दलील ये है कि 'अच्छे पीएचडी' वाले लोग नहीं मिलते.
यानी उनकी कमी है. इसी दलील के आधार पर सेंट्रल यूनिवर्सिटीज़ में लगभग 6000 टीचिंग पोस्ट ख़ाली हैं.

The paper reported that the amendments are already cleared by the EPFO's Central Board of Trustees and the Union Cabinet is expected to ponder over these in the Monsoon Session of the Parliament next month.

According to a report in The Indian Express, labour ministry has said that house rent, gratuity, traveling and other allowances to be taken as part of "contributing wages". Provident fund is deducted on these contributing wages. 

In the current structure, PF is deducted on basic wages. 

What this effectively means is that contributing wages, as part of your salary, will increase if the amendments to the PF act are passed and as a result of which, the PF deduction on your salary will rise. 

The concept of "contributory wages" for the purpose of PF deductions has been included in the employees provident funds and miscellaneous provisions (amendment) bill, 2015, which will soon be placed before the cabinet for approval.

The proposal is part of the final amendments of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, that has also sought to increase PF deductions to 12 per cent of the contributing wages from the current rate of 10 per cent.

Indian Express reports:The proposal is a significant change from the current practice, wherein PF is deducted only on the basic wages. Under the new proposal, even contributions to the related Employees' State Insurance Corporation will be part of the "contributing wages" on which PF will be deducted.

The proposal comes due to the different wage structures followed by establishments and High Court rulings. "To bring uniformity and transparency in the calculation of contribution payable by the employers, the definition of the contributing wages is proposed to be included. Specific details of allowances included or excluded for the purpose of PF contribution have been mentioned to avoid any ambiguity," said the labour ministry.

It has also called for a significant expansion of the coverage of the scheme to include establishments with up to 10 workers, all types of establishments as well as all kinds of employees including those on contract and apprentices.
These amendments have already been cleared by the EPFO's Central Board of Trustees and are expected to be taken to the Union Cabinet by next month and tabled in Parliament in the Monsoon Session.

"The bill has been firmed up. It will be sent for cabinet approval so that it could be introduced in the monsoon session of parliament," a senior labour ministry official said. The final draft, prepared by the labour ministry, is significant dilution of concept of clubbing wages proposed by the labour unions.

Money guruindia reports:While the unions wanted that 12 per cent PF contribution by the employers should be on total take home salary, the employers were opposed to the idea as it would have increased their PF liability and reduced workers' pay.

The final draft has proposed that PF contribution made by employers would be a portion of contributory wages which will not include HRA, travel allowance, allowance to defray special expenses entailed on workers by nature job, gratuity.

As per the bill the contributing wages means all remuneration paid or payable to an employee in terms of the contract of employment, express or implied, and will include any payment to an employee in respect of any period of authorised leave, lock-out, strike which is not illegal or layoff and other additional remuneration, if any, paid at intervals not exceeding two months.

The proposed bill also provides one-time option to EPFO subscribers to choose between EPF and new pension scheme. Finance minister Arun Jaitley had made announcement regarding providing an option to formal sector workers to choose between EPF and NPS in his budget speech.

At present formal sector workers are covered under social security schemes run by Employees Provident Fund Organisation (EPFO) as per the Employees Provident Funds & Miscellaneous Provisions Act 1952. The proposed Section 16-B provides that workers opting for NPS shall be deemed to have exited from the Employees' Provident Fund Scheme, Employees' Pension Scheme, Employees' Deposit Linked Insurance Scheme or any other scheme notified under this act from the date of submission of the application.

The bill also provides for a definition of 'small establishment' which employ less than 40 workers. These firms' cash in bank or hand, plant and machinery and office equipment critical to function, would be protected from attachment under the Act for recovery of PF dues for 90 days from date of issue of recovery certificate to these firms.

The draft bill also provides flexibility to increase or decrease the mandatory contribution of 8.33 per cent of basic wages toward employees' pension scheme.

Dr. Muhammad Qasim was arrested on 05.02.1993 for his political views but to prolong his detention he was booked u/s 3 (TADA), u/s 302 r/w 120-B RPC.

TADA Court Jammu acquitted him on 14.07.2001 and made following observation:

"The prosecution has miserably failed to prove the case against the accused persons"  (File-16, TADA Court Jammu)

Government challenged the said acquittal in Supreme Court of India, as it was the case of no evidence no proof no witness turned against the accused, case was thus solely based on "confessional statement" recorded under section 15 of TADA. Supreme Court sentenced the accused for life imprisonment with this important direction at the end of the judgement:

"They   (accused)   shall  be  given   benefit   of the  period  already undergone (undertrial period) by them"(Criminal Appeal No. 889 of 2001)

Note:- 

This direction speaks mind of the Judge, that convict is entitled for release as per the law established; Government while exercising her prerogative should give convict benefit of his undergone period. If he has to die in Prison, what is the fun to pass this direction?

On completion of 14 years, J&K High Court directed the Jail authorities to place Dr. Muhammad Qasim's case before the Review Board for review of his case. (OWP No. 430/2008 dated 23.5.2008)

Review Board while taking into consideration all aspects of ihe case. Recommended premature release of Dr. Mohammad Qasim in its meeting held on 03.06.2008.

J&K Government rejected the Review Board's recommendations not on the basis of interpretation of the life imprisonment that life imprisonment mean imprisonment of convicts whole natural life but on the basis of J&K Jail Manual Rule 54.1 which according to Government debars TADA lifer convicts from release on completion of two thirds (14 years) of 20 years. (Govt. order No. Home-773(P) of 2009 dated 14.9.2009).

High Court Judge Mr. Mansoor Ahmad Mir quashed the impugned order and directed the Government to consider the case on the basis of J&K Jail Manual:

"keeping in view the discussion made hereinabove read with law laid down by the Apex Court, the respondents had to consider the case of the petitioner in terms of the Jail Manual and law laid down by the Apex Court."

"Viewed thus, the writ petition is allowed impugned order is quashed and respondents are directed to consider the case of the petitioner as indicated above and made a decision."

(OWP No. 997/2009 dated 5.6.2010)

Government challenged the said order before the double bench of the High Court. The said bench in its judgment observed as under:

"The petition as highlighted warrants favourable consideration but impediment in the way of respondent (writ petitioner) is the scope of Rule 54.1 of the J&K Jail Manual which orders him ineligible"

 

Note:-There is no mention of interpretation of the life imprisonment that, life imprisonment mean; imprisonment for convict's whole natural life.

29. "The disentitlement of the respondent (writ petitioner) for remission of his sentence in terms of Rule 54.1 of the Jail Manual does not deprive him from working out other remedies."

 

31. "Irrespective of the provision i.e. section 401 and 402 of the State Code of Criminal Procedure, which corresponds to section 432 and 433 of the Central Code, the power of the executive is absolute and unfettered to remit sentence" 

(LPA No. 120/2010, dated 08.09.2011)

 

Ø  For the purpose of execution, a sentence of imprisonment for life "shall mean a sentence for 20 years". (J&K Jail Manual Chapter XXI,21.2)

Ø  Dr. Muhammad Qasim completed 20 years of imprisonment on 31.05.2012.

Ø  More than 26  lifer convicts were released by the Government since 1975, the said list was produced to the High Court with the petition.

Ø  Two   TADA   lifer   convicts   were   released   by   the   Delhi Government    even    before    completion    of    20    years    of imprisonment. The said Govt. order was also made available to the High Court.

Ø  Order copy of the Under Secretary to Government which directs DG Prisons that the lifer convict can be released only after completion  of 14  years  excluding remission,  was presented before the High Court also.

Ø  Lifer   TADA   convicts   are   entitled   for   remission,   the   said information provided by the Tihar Jail authorities was forwarded to the High Court.

Ø  Letter of DIG Prisons to Principal Secretary to Government, Home' Department   that,   lifer   Dr.   Muhammad   Qasim   has completed the life sentence according to para 21.2 of the Jail Manual thus necessary action may be taken in pursuance to J&K Jail Manual provision 21.27, was also presented before the High Court.

Our Case: Brief Summary

We do not dispute that, it is the domain prerogative of the Government to remit or commute the sentence of a convict and we need not to discuss the supreme court's interpretation of life imprisonment because our case  is entirely based on JK Jail Manual. JK Jail Manual if debars Dr. Muhammad Qasim from release on completion of 14 years (Government version of the rule 54.1, Chapter LIV JK Jail Manual) the Same Jail Manual makes him eligible for release on completion of 20 years. (21.2, Chapter XXI, 46.18, Chapter XLVI). The million dollar question is does prerogative mean wish or will of the Government or there is an established mechanism through which Government exercise her prerogative! It is the J&K Jail Manual which provides this mechanism.

J&K jail Manual says, soon after completion of 14 years ( 2/3 of 20 years [chapter LIV, 54.2, (VI)C ] ) Jail authorities should forward the case of lifer to Review Board for review, after taking into consideration every aspect of the case said board if finds merit, shall make recommendations for convicts release to the Government and Government may order the release of the convict (J&K Jail Manual : Chapter XXI, 21.21, 22, 23).

Since 1947 every lifer convict was released by the Government once Review Board recommended his/her case. In Dr. Muhammad Qasim's case same procedure was followed, his case was forwarded to Review Board soon he completes 14 years, board after review of his case recommended his release to the Government. Government on the basis of J&K Jail Manual Rule 54.1 rejected the Review Board's recommendations. Important question here is that Government does not reject the Review Board's recommendations by saying life is life or it is our prerogative exclusively to remit the sentence or otherwise? But Government in it's order dated 14.09.2009 (Govt. order No. Home-773(P) of 2009) said J&K Jail Manual debars Dr. Qasim!

Justice Mansoor Mir in his order dated 05.06.2010 OWP No. 997/2009, not only quashed the impugned order but directed the Govt. to consider the case afresh. Government challenged the said order before the double bench of the High Court. Double bench in it's order dated 08.09.201 I (LPA No. 120/2010) while set asiding the single bench order said life sentence according to J&K Jail Manual is 20 years and J&K Jail Manual Rule 54.1 debars Dr. Qasim from release on completion of two-thirds (14 years) of 20 years.

Clear Case of Political Vendetta !

The question is why Government is not exercising her prerogative (Sec. 401, 402 CrPc) for Dr. Muhammad Qasim, even when he has completed the period of 20 years and his case has been already recommended by the Review Board for release? Prerogative is not wish or will of the Government. There must be a legal ground for the Government for not exercising the prerogative ! For example ; when Government rejected the Review Board recommendations for Dr. Muhammad Qasim's release in 2008 in it's order reason given was Rule 54.1 of J&K Jail Manual, on completion of 20 years Government again rejected the representation of Dr. Muhammad Qasim but this time in it's order (dated 23.08.2012) no reason was given, but the interpretation of life imprisonment, that life imprisonment means life imprisonment of convict's whole life, very important question here is that, this interpretation of life imprisonment! is not applicable to any particular case but to all life convicts, how does than Government release lifer convicts every year? Is it not misuse of prerogative that Government exercise her powers to release lifer convicts every year, but when it is a case of a convict whose political views are unacceptable to the Government, Government refuse to exercise it's prerogative to order his release?
