The Lament of the Half Golden Mongoose – Mrinal Pandey

Selfie 1Is it possible that the State, which is supposed to protect the small fish against the big, may on occasion sympathise with murderous predatory fish roaming the territory? Is it possible that many may witness the hunt passively because it is politically expedient? One does not, of course, want to believe such things are possible, but the absence of other plausible explanations justifies considering it.

This is how Ved Vyas in his great epic, the Mahabharata, muses about an ancient fratricidal war that wiped out entire families. Truth, he finds, absolute truth, is the first casualty. In this epic, the family elders, great generals and diplomats and priests mutely watch the wilful dismantling ofRajdharma by the powerful. Their appalling, self-serving silence is broken by some of the smallest and most ordinary of creatures, which indict them for relegation of their Dharma. After all, it is hardly debatable that the state must exercise its monopoly of power to intervene swiftly and decisively while the butchering of men and the burning of women and children is going on. And the individual's right to protection by the ruler must not be sacrificed to the god of popular sentiment.

IMG_20150720_170936Towards the end of the Mahabharata comes the tale of a strange mongoose sniffing around the area where a jubilant Pandava king, Yudhishthra (also known as Dharmaraj or the king of Dharma) has just performed the glorious Rajsuya Yagna signalling his arrival on the throne after a long war.

The lowly mongoose with half his fur of gleaming gold, comes to the site where the fire sacrifice has been performed and as the amused citizens watch, begins to roll in the ashes. While they are wondering at his strange behaviour, the mongoose stands shaking the ashes off his fur and cries, "Fie upon you, Dharmraj, for this your great Rajasuya Yagna is a sham! If you had really earned the blessings of the Gods, my remaining fur would have also turned to gold. Years ago, during a great drought I happened to be in the home of a hungry farmer and saw him and his family feed their last meal to an unknown starving beggar and court death. After witnessing this great act of self abnegation I rolled in the tiny patch where a few grains of the last meal lay scattered, and half my body that touched it turned to gold. I thought the rest of my fur would also turn to gold if I rolled in the remains of your regal Rajasuya Yagna. But nothing has happened. O Yudhishthir, you killed your Rajdharma when you killed your own brothers to get to the throne, so you may mount great and glorious rituals but they will not generate good will. Dharmaraj indeed!"

How the state failed in Gujarat

2514_gujarat_riotsThe mongoose's ghost is roaming the streets of India once again in the shape of a woman called Teesta Setalvad. She is pursuing justice for the victims of the 2002 riots in Gujarat. In a country of over a billion she is among the few to ask the question the mongoose posed: Why did the state, despite its monopoly of power, fail in its most basic duty to protect so many from extreme violence and leave them to be slaughtered on the streets as the police watched mutely? She has, understandably, been facing the most suffocating pressures and ugly innuendoes for the past 13 years. But she and her brave band of supporters have not allowed that fratricidal carnage to be pushed out of public memory. Make no mistake. The criminal revision petition she has been chasing on behalf of Zakia Jafri is not just about the riots in a housing society where Zakia's husband was dismembered and killed by a violent mob. It is about the much larger issue of Rajdharma or what the jurist Indira Jaising calls the Doctrine of Command Responsibility.

nation4According to Hindu scriptures, final accountability for all great acts of sin or redemption, paap or punya, must lie with the leadership in the rajya; A raja becomes a raja only to uphold Rajdharma and to protect the people, not to do as he wills, says the sage Angiras to Mandhata.

It is not Teesta but Rajdharma, that is on trial. We need her just as India after the Mahabharata war needed that half golden mongoose.

तुम जिनके जाते हो उनका बहुत सुना है नाम,
सुनता हूँ, उस एक छत्र में कभी न होती शाम,
काले, पीले, गोरे, भूरे, उनके अनगिन दास,
साथ किसी के साझेदारी और कोई बेदाम,
खुश होकर वे लोगों को दे देती हैं सौराज .

उनका कॉमनवेल्थ कि जैसे दोधारी तलवार ,

घटे पौंड की पूँछ पकड़कर रुपया मांगे भीख,
आग उगलती टॉप कहीं पर, कहीं शुद्ध व्यापार,
कहीं मलाया और कहीं सर्वोदय सुखी समाज .

रूमानी कविता लिखता था सो अब लिखी न जाय,
चारो ओर अकाल, जियूं मैं कागद-पत्तर खाय ?
मुझे साथ ले चलो कि शायद मिले नयी स्फूर्ति 
बलिहारी वह दृश्य, कल्पना अधर-अधर लहराय-
साम्राज्य के मंगल तिलक लगाएगा सौराज .

Report of Delhi IFTU Team to Khajuri Khas

Press Release

The Delhi IFTU Committee sent a team to the Khajuri Khas area of North East Delhi to investigate alleged communal clashes there after we received reports of the same  from several workers who reside in the area. In Delhi in the months since Modi Govt came to power, there have been several such incidents in all of which investigations found that the actual situation was that Hindutva elements abetted by the local police had attempted to, or at times actually succeeded in provoking anti muslim violence. In addition, there have been attacks on churches usually in the early hours of the morning . The report of our team is released herewith.

Report of Delhi IFTU Team to Khajuri Khas

On 1st August newspapers were full of reports that there were 'clashes between two groups' in Khajuri Khas area of north east Delhi and that the Delhi police had acted to restore law and order. We were also contacted by several workers residing in the kuccha colony of Khajuri Khas, a poor and working class colony, that the area was communally disturbed. As this is an area where both Hindus and Muslims reside and also because the memory of incidents in Trilokpuri and Seelampur in the past few months are there, the Delhi Committee of Indian Federation of Trade Unions  sent a team to investigate the incident. Com Rajesh, Secretary of the Committee, Com. Jai Prakash Joint Sec. and Com. Raja of West  Delhi IFTU Committee accordingly visited the area on 2nd August 2015.

Location and Background

The team found that the area comprises of Khajuri chowk, less than half a kilometer away from which is a traffic light termed the kuchcha- pucca colony red light. To the left is the kuchcha Khajuri Khas colony and to the right is the main or pucca colony. The kuchcha colony comprises of five blocks. Muslim families predominate here who earn their living by selling fruits, vegetables and other items from redis or by plyng rickshaws. Workers from other states like UP, mostly from majority community, have also purchased land here and live  in houses they have built. There is one govt. primary school and one private school (upto 8th) in the area. The pucca colony houses mostly Gujjar families who are govt. employees, traders or do their own business. Here there are two big govt. schools where children from the kuchcha colony also come to study. These schools have a morning shift for girls and an evening shift for boys and are overpopulated. According to residents of the kuchcha colony, there are regular disputes regarding eve teasing of girl students by the youth of the colony. There is also a private school here where few students of the kuchcha colony also study. Overall, there is a significant class difference between the two colonies.

At the Khajuri Khas chowk there is a PCR 'heading' point where a PCR vehicle is stationed and just a small distance away, a police beat box which remains manned. Local people said there are normally upto four policemen there. The chowk is chock full of redi patri sellers, there is a bus stand, a regular market, a small mandir and autos and jeeps stand around the chowk. Thus it is a very busy and crowded square.

Around 500 yards away from the kuchcha pucca colony traffic light is situated the thana of the area.

Events on 31st July 2015

On 31st July, at around 2:30 Am in the morning, near the Khajuri Khas Thana, police stopped a tempo carrying animal skin. This skin has subsequently apparently been sent for testing while drive and helper are in police detention though it is reported that they have appropriate licenses.

The same morning, at about 11 AM, at the kuchcha-pucca khajuri traffic lights, some vehicle slightly injured a cow which probably also fell down but later got up and limped away. This created a jam for some time as the light was not working. Around 40 youth of the majority community came from the side of the pucca colony and started saying that the Muslims have 'cut up' a cow. In a group, and blocking the road, they walked the less than half a kilometer distance to the Khajuri Chowk, which at that time of the day is specially crowded. The crowd, on seeing them, got confused and while some started gathering, other started trying to go away. The youth reached the chowk, stopped a Muslim youth coming on a bike and began beating him. An old Muslim (reportedly 65 years of age) tried to intervene and was also beaten up. The youth set fire to the bike. Another bike also belonging to a Muslim was also set on fire a little distance away. All this occurred in the proximity of the police beat box and the PCR point where eyewitnesses who have redis in the area and maintain that they were present on that day, maintain that the PCR van and police were standing.  In the middle of this, word spread that Hindus had killed four butchers in the kuchcha colony and also a child. This further added to the ferment in the crowd. It later turned out that no one was killed and one child sustained accidental burns in a shop in the kuchcha colony that morning.

It is only after the burning of the bikes and by when the crowd had swelled further in number that the police appeared on the scene. The police then tried to force the crowd to disperse but made no attempt to arrest the youth who had tried to provoke a communal situation  and  who melted away into the crowd, despite there being two burning bikes, and at least two people having been assaulted. Police also resorted to caning- the crowd was apparently argumentative and agitated but mostly not organized and after a while drifted away. Thus it was mostly the good sense of the people there that prevented the situation from aggravating. Though people got agitated for a while due to the severe provocation, yet they did not succumb. People went and calmly picked up their children from school. However the market shut down and redis closed shop and returned to their homes. Police then maintained a heavy presence at the chowk.

Police has registered an FIR against 'unknown persons'. The youth who tried to incite communal violence can be easily identified and are untouched. Both the burnt bikes are still standing a little away from the police beat box at the chowk, on the day the IFTU team visited the area. The rest of the area was normally going about its work; in fact due to the Sunday bazaar there was more crowd than usual and consisted of all communities.

Comments

It is absolutely clear that there was an attempt here to use a totally unrelated incident to provoke communal violence and at least communal polarization. The pattern resembles the Trilokpuri incident a few months earlier, wherein a group of youth from majority community marched into the area unchecked by police, indulging in violence and inciting others. However here, despite the youth burning bikes of Muslims, the crowd did not lose its good sense and that is why the situation did not result in mad violence like it did in Trilokpuri. However this is not for want of trying by Hindu communal forces. It is known that RSS is active in the pucca Khajuri colony. Yet such incidents do create communal polarization. The Muslim families and the Hindu workers have been living peacefully in the kuchcha colony. The workers had left in the morning for their work place that day and returned only at night. However they told the IFTU team that some incident had occurred because people protested as the Muslims 'had cut up' a cow. When asked if they had met anyone who had seen this, or whether this routinely happened etc., they retracted.

The police is fully hand in glove with those Hindutva elements who attempted to provoke communal violence. With a police beat box, a PCR van present in the area, a crowd cannot un-noticed block a road and march up to the chowk and then beat up two Muslims and set two bikes on fire. The police chose not to intervene. Similarly, none of the youth has been detained for deliberately trying to incite communal violence by several provocative acts. Rather the police has put out a story that the incident happened because a tempo 'carrying animal skin was detained by the police on information given by a member of the public', in the daytime. This tempo was stopped by the police several hours earlier, in the middle of the night. The police must have passed on this information to elements in the pucca colony. There is no connection at all in time between the two events. Rather, now to go along with their story, the police have kept the driver and the cleaner of the tempo in their custody. The team could not ascertain their identity. The majority communal nature of the police is once again clear in this incident, as it was earlier in Trilokpuri, Seelampur, and other such incidents in Delhi in the past few months since the Modi Govt. came to power at the centre. Such incidents have also taken place in areas surrounding Delhi in Gurgaon and in other parts of Haryana and  in Uttar Pradesh.

The AAP Govt. of Delhi has made no comment on the incident. Always ready to take on the police and the Central Govt. when AAP legislators or their appointees are involved, this Govt. has not demanded that the Central Govt. enquire into the police being hand in glove with the Hindu communal elements in this incident. It has not even questioned the veracity of the police story, let alone condemning the role of the Delhi police. This is in keeping with the role of this party in earlier such incidents in Delhi especially in Trilokpuri, where there was an AAP MLA. They did not say a word against the police or the Central Govt. in the earlier such incidents.

The team demands that an enquiry be conducted by a sitting High Court Judge into the role of the police in the events in Khajuri Khas and for that the local police senior officers as well as the police personnel be shifted out of the area. The Hindu youth who attempted to provoke communal violence by spreading totally baseless rumours, by beating up innocent Muslim citizens and destroying their bikes in acts of arson should be arrested and charged. The bike owners should be compensated.

The team points out that this incident too is part of the series of incidents in Delhi where communal polarization has been attempted at the local level by Hindutva forces with police collusion. We call on the people of Delhi to remain vigilant, to pinpoint the trouble mongers and not allow our city, with its different religious communities, to be divided along communal lines.

VARANASI: Eloping with a minor girl proved costly to a Dalit youth of Koirajpur village in Baragaon police station area as his own family got their head tonsured and paraded them in the village when they returned home after four days of elopement on Sunday


The police have arrested four persons, including the youth and his brother, in this connection. 


According to reports, one Raju (20) eloped with a 14-year-old girl from the village on July 30. 


They returned home on Sunday afternoon. When the girl's father, a daily wager, went to Raju's house, he was allegedly thrashed by the youth's family members. 


Later, family members of the youth gathered at the spot, shaved the couple's heads and paraded them in the Dalit basti of the village. 


The girl's father alleged that he had also gone to Harahua police outpost but his complaint was not entertained. 


Contacted on Monday, Baragaon police inspector Isha Khan said an FIR has been registered under sections 363, 366, 368, 376, 323, 504, 506 of IPC and POCSO Act in this connection. "The police have arrested four persons including the youth Raju, his elder brothers Ramji, Shyamji and sister-in-law Urmila," he added.

The Maharashtra government has set March 2016 as the deadline to end manual scavenging in the state.

 

Chief Minister Devendra Fadnavis has directed officials to ascertain the exact number of manual scavengers and prepare alternative employment plans to end the practice by March. The social justice and water and sanitation departments have been told to look into the matter.

 

The state has the highest number of households engaged in manual scavenging.

 

According to the latest caste census data, 63,713 households in Maharashtra have manual scavengers. Madhya Pradesh, Tripura, Uttar Pradesh and Karnataka are some other states that still have the practice.

 

Fadnavis said, "Maharashtra was the first to raise concern over manual scavengers. Various cleanliness schemes were undertaken but manual scavenging continues in some parts of the state."

 

The state administration is stressing the "toilet for every household" and providing incentive of up to Rs 12,000 for construction of toilets in rural Maharashtra.

 

This in turn is expected to bring down the number of manual scavengers.

 

A senior official said, "Generally, manual scavengers were from a community representing dalits. The socio-economically backward were expected to do such menial jobs. Over the years, there have been reforms and protests over manual scavengers. Today, the biggest challenge which still remains in the employment of manual scavengers to clean the human excreta along the railway tracks."

 

In rural Maharashtra, 42 per cent households do not have toilets. A major campaign for community toilets undertaken 15 years ago did not succeed.

 

In almost 25,000 drought-prone villages, lack of running water posed a hurdle to the success of the campaign.

Individuals continued to prefer open fields to community toilets.

 

In view of the Swachh Bharat Abhiyan, and the directive to put an end to manual scavenging, the state government has decided to promote eco-friendly toilets both in urban and rural Maharashtra.

 

Fadnavis said, "It is demeaning for a human being to carry human excreta. We have to ensure toilets are built in rural landscapes to phase out manual scavengers."

NOIDA: State government employees met Gautam Budh Nagar MP Mahesh Sharma on Sunday evening to register their protest against the government's plan to introduce the Constitution (117th Amendment) Bill, 2012, that aims to provide quota in promotions to scheduled castes and scheduled tribes. 


The protesters included employees of Noida and Greater Noida Authorities, Yamuna Expressway Authority, and employees from the departments of power, water, education, PWD, irrigation, trade and finance, and the district administration. 

"We are against the policy of reservation in promotions and will go on an indefinite strike if the bill is implemented. We met Mahesh Sharma to reiterate this demand of ours and asserted that the said amendment is against the basic structure of the Constitution. We want him to raise our concerns in Parliament," said Dinesh Kumar Jain, executive engineer of PVVNL. 


The 117th Constitution Amendment Bill providing for quota for SCs and STs in government job promotions was passed by the Rajya Sabha in 2012, when the Congress-led UPA was in power, but the bill has been stuck since then. There have been reports, however, that the NDA government could introduce it in the Lok Sabha in an attempt to end the parliamentary logjam. 


Jain, who is the convener of the Noida wing of Sarvjan Hitaye Sanrakshad Samiti (SHSS - general welfare protection committee), said that employees would go on a nationwide agitation if the bill was passed. 


"If the central government makes any move to implement the 117th amendment to the Constitution, then all government officials, employees and teachers of Noida will stage an indefinite sit-in protest. We will hold protests without any prior notice and the central government will be responsible for the agitation. We will also approach MLAs and MPs if the matter is not addressed soon," said Kushalpal Singh, president SHSS.

National Law University has said that some prison authorities have reported that data related to death row convicts has either been lost or destroyed by termites.

 

In a serious lapse by prison authorities, records of death penalty convicts who have been executed since India's independence, have gone missing from many prisons, according to a report in a leading English daily. National Law University (NLU) has been compiling data on all death penalty cases in India since 1947, as part of a research study to examine the fairness with which capital punishment is awarded. 

 

However, NLU director Anup Surendranath, who is heading the death penalty research project, said that some prison authorities had written to them saying that records had either been lost or destroyed by termites.

 

NLU is being aided in the study by the Central government and was able to confirm data related to 755 executions. According to a report of the Law Commission (1967), the total number of cases in which the death sentence was awarded between 1953 to 1963 was 1,410. 

 

The missing files include mercy pleas of four convicts - Krishna Mochi and three others convicted in the Krishna Mochi & Ors vs. Bihar case of 2001. Their pleas were sent to the President in 2003, but an RTI filed by Suhas Chakma of Asian Centre for Human Rights found that the records were missing from the Home Ministry. 

 

Surendranath said that they have been unable to find an exhaustive list of prisoners executed in India. The data produced by the National Crime Records Bureau reportedly has gaps, as the numbers given by them are contradictory.  

 

Till now, the NLU has interviewed 373 surviving death penalty convicts, and has drawn their socio-economic profiles which shows that a majority of them belong to backward classes, religious minorities and economically-weak sections. Also, 94% prisoners sentenced to death in terror cases are Dalits and religious minorities.

The NLU will make public a detailed analysis of the socio-economic profile, legal representation and death row duration of convicts by mid-August.

LUCKNOW: In a major change in the land law in the state, the UP government is likely to allow members of scheduled caste to sell their land to non-Dalits even if their holding is less than 3.5 acre. According to highly placed sources, the state cabinet in its meeting on Tuesday is likely to accept a recommendation to this effect made by a committee set up to present the Revenue Code Bill 2015. This recommendation is a key feature of the bill.


As per the existing rules, a Dalit can't sell his land to a non-Dalit if his holding is less than 3.5 acre. If the cabinet accepts the recommendation made by the committee formed under additional advocate general RBS Yadav, members of scheduled caste with smaller holdings would be able to sell their land to non-dalits.


Subsequent governments in the state have been trying to effect this change, but have not been able to do so. Even SP chief Mulayam Singh Yadav as cooperative minister in 1977 had initiated this move couldn't be successful. A fresh attempt in this regard was made in 2012 when the SP came to power with full majority and set up a committee under Yadav for presenting the revenue code bill having many provisions for land reforms in the state.


The committee strongly recommended for repealing the existing provision in favour of the non-Dalits and had met the chief minister last month who had asked the members of the committee to take feedback from different political parties and other sections of the society.


Speaking to TOI, RBS Yadav confirmed that he has recommended for the same on the ground that in many cases members of the SCs need money for urgent matters like treatment of deadly diseases, but they don't get buyers as their choice is restricted to selling it to the members of their own community only. "So, they have to go for distress sale and get peanuts for their land which is an injustice for them," he said, adding "that's why the committee has asked that the SCs should be allowed to sell their land to anyone whenever needed."


When asked about taking opinion of the major political parties as desired by the chief minister, the he said except BSP, most of the parties have agreed to his recommendations.


Speaking to TOI, Leader of Opposition and BSP leader Swami Prasad Maurya retaliated that it was an onslaught on the rights of the SCs who are already socially, economically and politically weak and depriving them of their land would amount to snatching their livelihood and weakening them further.

State scholarship sends 30 SC/ST to US for master's course

Born in a daily labourer's family, Kannekanti Sudev Yashwant of Ibrahimpatnam worked hard and graduated as an engineer (ECE) from the Nuzvid IIIT on the strength of scholarships. Just as he was wondering what to do next, he managed to make it to the list of 30 candidates whose master's education overseas will be sponsored by the State Government under the B.R. Ambedkar Overseas Study Programme.

 

"It is a dream come true. I wanted to pursue my Master's and gain international exposure," said a beaming Yashwant, who is scheduled to go to the US on August 11 to pursue a Master's degree in computer science at Texas A&M.

 

The State Government plans to send 300 candidates like Yashwant for overseas education in different countries. This year it has shortlisted 30 candidates for the programme. The second batch will be finalised in January 2016.

Under the programme, the government sponsors each candidate to the tune of Rs 10 lakh. An additional Rs. 5 lakh will be facilitated as a loan from the Scheduled Caste Corporation, said Social Welfare Minister Ravella Kishore Babu.

 

In 2013, 66 candidates were sent overseas for higher education from the erstwhile Andhra Pradesh, 48 from Telangana and 18 from Seemandhra. In 2014, 32 candidates were so sponsored.

 

Chief Minister Chandrababu Naidu presented cheques for Rs. 10 lakh each to the selected candidates here on Saturday. Among the 30 candidates, six candidates, three male and three female, hail from Krishna district.

 

The candidates said they were screened by a team of senior officials in Hyderabad. Chatla Mallika haails from Chimalapadu village in A. Konduru mandal in Krishna district. Her father is a tenant farmer. She completed the engineering course from Nuzvid IIIT and is travelling to the US for her master's in civil engineering at Alabama University. Didla Vamsi from the city and his father D. James is a lorry driver. He is an engineering graduate and is heading to the US for a PG programme in computer science at New Hampshire University.

 

P. Ajay Kumar from Penumalauru, born into a low-income family. He completed his B. Tech from Andhra Loyola College and he too is heading to Texas A&M for a master's programme in computer science. P. Krishna Manjira hails from Challapally. Her parents too are daily labourers. An engineering grad from R.V.R and J.C College, Guntur, she bagged a seat in the IT programme at Maryhordin Belar University. T. Aparna is from Bhavanipuram and the daughter of car driver. She bagged a seat in the computer science programme at Polytechnic University, California.

The first comprehensive survey of procurement undertaken by public sector undertakings (PSUs) from micro and small enterprises (MSEs) promoted by Dalit (Scheduled Castes/ Scheduled Tribes) entrepreneurs showed that their supplies were just Rs 419 .37 crore in 2013-14 — 0.51 per cent of the total PSU procurement of Rs 81,319.28 crore during the year.

 

The government's Public Procurement Policy for MSEs, Order 2012, issued on April 25, 2012, requires all central ministries, departments and central PSUs to ensure at least 20 per cent procurement from MSEs, and within this, 4 per cent from MSEs promoted by Dalits (SCs/STs).

 

While procurement from SC/ST enterprises was way below target in 2013-14, that from all MSEs was much better at Rs 12,440.76 crore or 15.30 per cent of the total PSU procurement during the year.

 

The policy announced during the UPA government, as part of its larger 'affirmative action' agenda, did not make it mandatory for the departments, ministries and PSUs to stick to the procurement order in the first three years. From April 1, 2015, it will be mandatory for ministries, departments as well as PSUs to meet the guidelines.

 

Contrast this with the number of small and micro enterprises in the country and the share of Dalits and other backward classes. The 2013 survey by the National Sample Survey Office reveals there are 5.77 crore MSEs employing 12 crore people, and over 60 per cent of units are owned by persons belonging to SCs, STs and OBCs.

 

Anup Pujari, Secretary, Ministry of Micro, Small & Medium Enterprises (MSME), told The Indian Express that there needs to be more awareness on both sides – the PSUs and government, and the MSEs promoted by entrepreneurs from the backward community. "It is theoretically possible to increase procurement to 4 per cent from MSEs owned by SCs and STs. We need to make more efforts," Pujari said.

 

When his comments were sought, R G Rajan, Chairman and Managing Director of Rashtriya Chemicals and Fertilisers, and the chairperson for Standing Conference of Public Enterprises (SCOPE), said while PSUs fared reasonably when it came to procurement from MSEs, identification was proving difficult in the case of Dalit entrepreneurs, "But yes, we need to undertake targeted vendor meetings. PSUs must be more proactive," he said.

 

A National Board for Micro, Small and Medium Enterprises, chaired by Union Minister Kalraj Mishra, is scheduled to meet next month and the Dalit Indian Chamber of Commerce and Industry (DICCI), representing SC/ST entrepreneurs, also represented in the board, is expected to seek more active government support to sensitive PSUs.

 

DICCI president Milind Kamble told The Indian Express that the ministry and his chamber sent several reminders and letters to PSUs. "But I have not received response from a single PSU over the last two three years," he said. In fact, the survey undertaken by the government states that 48 of 179 functional PSUs did not procure at all from SC or ST enterprises. The MSME ministry was awaiting information from 17 PSUs while 13 PSUs did not supply any data when the results were shared with the national board earlier this year.

 

The Office of Development Commissioner, MSME, sent at least seven reminders in 2012 and 2013 to secretaries of ministries and departments as well as CPSUs. After some PSUs complained about lack of clarity in identifying MSEs, the ministry issued a statement in June 2013 that an MSE in which 51 per cent is owned by SC or ST entrepreneurs should be considered as one promoted by Dalits for the purpose of procurement.

High court seeks chancellor's reply in VKSU VC case

Patna: The Patna high court on Monday sought the chancellor's reply regarding appointment of Veer Kunwar Singh University (VKSU) vice-chancellor.


Hearing a PIL, a division bench of acting Chief Justice Iqbal Ahmed Ansari and Justice Chakradhari Sharan Singh directed the chancellor to file the reply byAugust 10.


The PIL was filed by one Ram Tawakya Singh, who alleged that the appointment of VKSU VC did not conform to the rules. He also alleged that the present VC didn't have the academic qualifications required for holding the post in any university.


Reply sought on bridge collapse: Hearing a PIL in a matter related to collapse of a newly built bridge before its inauguration in Muzaffarpur district, the same division bench sought reply from the state government. The bridge collapsed on August 30, 2014.


The PIL was filed by one Surendra Narayan Choudhary submitting that the Basghatta bridge was built by Bihar State Bridge Construction Corporation over river Bagmati in Muzaffarpur at a cost of Rs 25 crore. He alleged that rampant corruption and poor quality material used in the bridge construction led to its collapse.


Order reserved: The Patna high court on Monday heard a PIL regarding reservation in APP (additional public prosecutor) examination and reserved its order. A division bench of acting Chief Justice Iqbal Ahmed Ansari and Justice Chakradhari Sharan Singh was hearing the matter. The PIL was filed by the Bihar State SC/ST Advocate Union & others seeking reservation for SC/ST advocates in the appointment of APPs.


Why Hindi ignored: The same division bench also reserved its order regarding holding the examination for appointment of ADJs in Hindi as well. The court was hearing a PIL filed by one Sanjay Kumar, who sought to know why at ADJ examination questions were not set in Hindi? Why Hindi is being ignored?

IIT-Roorkee takes back all 72 expelled students

DEHRADUN: In a turnaround that triggered massive celebrations in the IIT-Roorkee campus, the institute on Monday took back all the 72 students it had expelled earlier on the grounds of poor performance. 


The institute had on July 8, as reported first by TOI, in an unprecedented step struck off its rolls 73 students from the first year BTech batch. All of them had scores of less than 5 CGPA (cumulative grade point average) in their examinations and were expelled from college after a late-nigh senate meeting. 


One of the students, however, had his expulsion nullified after it was found on re-checking that he had a CGPA of more than 5, as mandated by the institute's rules. Seventy-two students, though, were out in the cold. Their problems were later compounded after the Uttarakhand high court, which they had petitioned, upheld the institute's decision. 


About the latest development, Prashant Garg, registrar at IIT-Roorkee and secretary, senate, told TOI, "All students who have less than 5 CGPA at the end of the first year of the undergraduate programme (Btech) will be re-admitted as a one-time measure, but on strict conditions." 


These "conditions" entail that all the 72 students whose names were struck off the rolls of the institute on July 8 shall be put on academic probation throughout the first year. They will also have to repeat the year and will be bound to clear again all the courses of both autumn and spring semesters of the first year, besides maintaining a minimum attendance of 75% in every subject. 


Other conditions that have been put includes: there shall be no backlog in any subject in either of the semesters at the end of the first year and students will have to obtain a CGPA of more than or equal to 5. 


"The decision by the senate has been taken in the students' favour after many deliberations," said a senior official at the institute. "The students, however, will have to get themselves registered on or before August 10 and their attendance will be counted from the date of registration. Every single student will have to agree in writing to all the conditions before being re-admitted." 


The expelled students and their supporters immediately updated their Facebook statuses and said, "We did it". Days after the expulsion there had been a huge online campaign, with the hashtag 'Take them back', that garnered thousands of petitioners. 


Ecstatic at the reversal of the expulsion orders, Raj Maheshwari, one of the students who had been asked to go, said, "I am in Nagpur right now and I was thinking of applying to other colleges. But today's decision has brought back all of us from the lowest point of our lives. Roorkee jaa raha hun waapas (I am going back to Roorkee)." 


Another student, Abhishek Mandal, said, "I am very happy to have got a second chance and with the fact that the administration finally decided in favour of us students. I will make sure I perform to the best of my capability this year and such a thing in my life never happens again."

लखनऊ/ आज़मगढ़ 4 अगस्त 2015। ग्राम मिमारिज़पुर (मीरपुर), जनपद आज़मगढ़
निवासी मो० ज़ाकिर जो कि 13 जून को अमौसी हवाईअड्डे लखनऊ से गायब हुआ, वह
52 दिनों बाद 2 अगस्त को अपने घर पहुंचा तो परिजनों को जहां उसके घर वापस
पहुंचने की खुशी थी. वही वह उसकी हालत देख परेशान और दुखी भी थे। तथ्यों
की जानकारी के लिए रिहाई मंच का तीन सदस्यीय दल जिसमें मसीहुद्दीन संजरी,
विनोद यादव, तारिक शफीक शामिल थे, ने मोमारिज़पुर का दौरा कर ज़ाकिर और
उसके परिजनों से मुलाकात की।

विनोद यादव ने कहा कि ज़ाकिर बहुत डरा हुआ था और कुछ भी बोलने को तैयार
नहीं था। उसके भाई शाहिद ने प्रनिधिमंडल को बताया कि ज़ाकिर को
अपहरणकर्ताओं ने शंकरपुर चेक पोस्ट, रानी की सराय पर लाकर छोड़ दिया था।
उनके परिवार के एक परिचित द्वारा सूचना दिए जाने पर वह ज़ाकिर को घर ले
आए। वह किसी वाहन की आवाज़ या किसी अजनबी को देख कर डर जाता है कि कहीं
फिर उसका अपहरण न हो जाए। परिजनों के पूछने पर उसने केवल इतना बताया कि
अगवाकारों के बारे में कोई बात न की जाए वह लोग पहुंच वाले है और घर के
अन्य लोगों को भी पकड़ कर ले जा सकते हैं।

मसीहुद्दीन संजरी ने कहा कि ज़ाकिर से बातचीत के दौरान कई ऐसी चीज़ें
सामने आयीं जिससे इस घटना में एजेंसियों के लिप्त होने की आशंका पुख्ता
हो जाती है। लेकिन ज़ाकिर को जैसे ही उसे यह एहसास होता है कि उसने वह
बात बता दी जिसे न बताने के लिए उसे डराया धमाकाया गया था तो वह अपना सिर
पकड़ लेता और फौरन कहने लगता कि उसे कुछ याद नहीं है। उन्होंने कहा कि
तथ्यों से ऐसा प्रतीत होता है कि एजेंसियों द्वारा ज़ाकिर को उठाया गया
था और गैरकानूनी हिरासत के रख कर उसे प्रताड़ित किया गया था। उसके सिर
में चोट का निशान है जिस पर टाके लगवाए गए थे इससे अंदाज़ा होता है कि
पिटाई के बाद उसका इलाज भी करवाया गया था जबकि आमतौर पर अपहरण की घटनाओं
में ऐसा नहीं होता है और न ही अपहरणकर्ता इस तरह से किसी को उसके घर के
रास्ते पर लाकर छोड़ जाते हैं। ज़ाकिर का पास्पोर्ट और मोबाइल भी उससे ले
लिया गया जिससे अपहरणकर्ताओं को कोई लाभ नहीं हो सकता।

तारिक शफीक ने कहा कि इससे पहले भी जनपद के कई युवकों के साथ इस तरह की
घटना हो चुकी है। जनपद के ही ग्राम छाऊं निवासी नदीम को 2008 में
एअरपोर्ट पर रोक कर पूछताछ के नाम पर उसका पास्पोर्ट ले लिया गया था
जिसके कारण उसकी फ्लाइट छूट गई थी। उस समय रिहाई मंच के अध्यक्ष एडवोकेट
मुहम्मद शुऐब और अन्य मानवधिकार नेताओं के हस्तक्षेप से उसे छुड़ाया गया
था। कस्बा फूलपुर निवासी मो० अनीस को भी 2008 में एजेंसियों द्वारा अगवा
किया गया था और एक हफ्ता बाद उसे भोर में फुलपुर बाज़ार के बाहर ला कर
छोड़ दिया गया था। उसे भी इतना शारीरिक और मानसिक तौर पर टार्चर किया गया
था कि उसने भी लम्बे समय तक अपहरणकर्ताओं के बारे में ज़बान नहीं खोली
थी। इस तरह 2009 में राशिद और उसके साथी को लखनऊ-कानपुर के बीच में
एजेंसियों द्वारा अगवा करने की कोशिश की जा चुकी है। उन्हें रेलवे ट्रैक
पर खड़ा करके उनके फोटो भी लिए गए थे। इसके अलावा जनपद के ही कुछ अन्य
मुस्लिम नौजवानों को रास्ते से उठाकर पूछताछ के नाम पर प्रताड़ित करने
मामले इससे पहले सामने आ चुके हैं और लखनऊ शहर ऐसी प्रताड़नाओं का अड्डा
बनता जा रहा है।

रिहाई मंच अध्यक्ष मुहम्मद शुऐब ने कहा कि 13 जून 2015 को ज़ाकिर के
अपहरण इससे पहले होने वाली ऐसी घटनाओं का विस्तार लगता है जो एक तरफ एक
क्षेत्र और समुदाय विशेष को लगातार आतंकित करने और बदनाम करने की साज़िश
का हिस्सा हैं तो वहीं पुलिस और सरकारी तंत्र की मानसिकता और उसके
खोखलेपन को भी उजागर करती हैं। हम उत्तर प्रदेश सरकार से मांग करते हैं
कि ज़ाकिर अपहरण कांड की निष्पक्ष जांच करवाई जाए और दोषियों को चिन्हित
कर दंडित किया जाए। साथ ही यह सुनिश्चित किया जाए कि भविष्य में ऐसी
घटनाओं की पुनरावृत्ति न हो।

NSA paid Utah over $1M to police data center roads - records| 01 Aug 2015 | The National Security Agency has paid Utah more than 1 million [in bribes] over the past year and a half for state troopers to guard the entrance to the spy agency's massive data center south of Salt Lake City, according to Utah Highway Patrol records. From January 2014 through March of this year, the NSA has paid for state troopers to sit in their vehicles on roads outside the agency's data storage warehouse in Bluffdale and ensure no one blocks traffic. Court: German spy agency need not give info on NSA list | 31 July 2015 | A German federal court has ruled that the country's spy agency is under no obligation to divulge to the media a list of names compiled from search terms provided to it by the U.S. National Security Agency. A newspaper publisher sought an injunction forcing the Germany agency, the BND, to disclose information about what German companies and citizens were on the list after the spy agency refused to answer questions. The Federal Administrative Court said in a ruling released Friday that the spy agency had "justified interests that are worthy of protection" in the list remaining confidential.

Sandy Hook Victims Settle Lawsuits Against Nancy Lanza Estate for $1.5 Million | 03 Aug 2015 | The families of 16 victims of the Sandy Hook School shooting [drill-gone-live] will receive about 94,000 each to settle a pair of lawsuits against the estate of the [alleged] shooter's mother, Nancy Lanza. Documents filedMonday in Probate Court show that the families have agreed to equally divide a 1.5 million homeowner's insurance policy that Lanza had on the Newtown home she shared with her son, Adam Lanza. Each family will get 93,750, records show.

Legionnaires outbreak: 4 dead, 65 infected, New York City on alert | 02 Aug 2015 | New York City is in the midst of a deadly outbreak of a type of severe pneumonia known as Legionnaires' Disease. Bronx residents have become anxious, as four people have succumbed to the illness and 65 others have been infected in the area since July 10. According to hospital officials, fifty-five of the infected have been hospitalized. The current outbreak is regarded as very unusual as it involves five times more cases than the previous one, in which only 12 people fell sick.

Texas attorney general indicted by grand jury on fraud charges - reports | 01 Aug 2015 | The attorney general of Texas has been indicted on securities fraud and other charges over an alleged scheme to mislead investors in a technology company, the New York Times and other media reported on Saturday. The three-count indictment against Ken Paxton, a Republican, will be unsealed in Dallas on Monday, when the former longtime state lawmaker is expected to turn himself in to authorities, according to the Times. The newspaper named Kent A. Schaffer, one of the two special prosecutors handling the case, as one of its sources.

After Killing of Cecil the Lion, Delta Joins Airline Ban on Game Trophies | 03 Aug 2015 | The recent killing of a popular lion named Cecil by an American dentist in Zimbabwe sparked considerable outrage on social media and elsewhere against safari hunting. The event has also brought to light the role that airlines play in transporting trophy kills as cargo, and may have contributed to changing airline policy. On Monday, Delta Air Lines became the latest carrier to change its rules about transporting hunting trophies. Its announcement came as a group of airlines including Air France, KLM, Iberia, IAG Cargo, Singapore Airlines and Qantas signaled last week they would ban the transport of trophy-hunting kills, according to Paul Ferris, the campaign director at SumOfUs dot org, a consumer-based petition agency in Brooklyn, which has pressed for changing cargo policies.

Cecil the lion: Big game hunting banned in Zimbabwe as outrage grows over animal killings | 03 Aug 2015 | Big game hunting has been BANNED in Zimbabwe following the global disgust at the slaughter of Cecil the lion by a US dentist. Authorities in the south African country announced the move after it emerged a second American hunter [terrorist] is wanted for allegedly killing a different lion in April. News of this lion's death led to rumours circling that Jericho, Cecil's 'brother', had been shot and killed by poachers. This was later proven to be false after the Mirror Online spoke to a researcher who had been studying the pride for nine years.

Doctor becomes second American named in African lion-killing investigation: Pittsburgh physician who has posed with dead elephants, hippos, zebras and ostriches 'killed lion in illegal hunt' | 02 Aug 2015 | A second American [terrorist] has been named in a growing big game poaching investigation in Zimbabwe. Pennsylvania Dr. Jan Casimir Seski, 68, is accused of killing a lion in an illegal hunt in April and his guides have been arrested in the African Country. Dr. Seski has been pictured online with a series of dead animals including elephants, hippos, zebras, ostriches, impala and water buffalo. An online hunting club claims he has killed six elephants. It comes a week after Africa's most famous lion Cecil was killed by Minnesota Dentist Dr. Walter Palmer in early July, sparking international outrage. [Too bad the animals were unable to *shoot first.*]

Revenge of the bulletproof armadillo: Texas man shot after bullet he fired at animal ricocheted off its shell and hit him  | 31 July 2015 | Don't mess with Texas armadillos. That is the lesson that one local man learned the hard way when he landed in the hospital with a bullet wound after trying to shoot one of the hardy armor-plated critters. Officials in Cass County, Texas, say the man suffered a graze wound to the head when he fired at an armadillo and the bullet ricocheted off the mammal's rigid protective covering and struck him.

 

Judge rules VA can remove Confederate Flag from license plates | 31 July 2015 Federal Judge Jackson Kiser has ruled that Virginia can remove the Confederate Battle Flag from license plates, dissolving his 2001 injunction that allowed the flag on specialty plates. The 2001 injunction had allowed the Sons of Confederate Veterans to place the confederate battle flag on certain specialty license plates in Virginia. The ruling will not be official until Kiser enters his order, addressing whether the decision will only apply to new plates or will also apply to existing ones.

Police union demands reinstatement of indicted U. Cincinnati cop's job | 31 July 2015 | The union representing the University of Cincinnati police force filed a grievance on behalf of the officer indicted on a murder charge, demanding that he get his job backbecause the university fired him without due process, a union official said Friday. Thomas Fehr, representative of the Fraternal Order of Police-Ohio Labor Council, said the union filed the grievance Thursday, the same day Ray Tensing was arraigned in Hamilton County Common Pleas Court after his arrest. Tensing is accused of killing unarmed black motorist Samuel DuBose on July 19 in Mount Auburn, a neighborhood just off campus of the University of Cincinnati.

હોય ઈશ્વર તો , જગતમાં આવ તું. 

ધૂપ, દીવા, આરતી હું નૈ કરું, 
એ જ છે મારી શરતમાં આવ તું. 

આખડી, બાધા બધું ભૂલી જ જા, 
આવવું છે? તો તરતમાં આવ તું. 

છાશ, ઘી, માખણ હવે મળશે નહીં, 
દૂધ પણ છે અછતમાં આવ તું.

I quit Gujarat judiciary because

Ahmedabad, 04 Aug 2015: Amidst alleged threats to judge Ms Jyotsna Yagnik who had convicted Maya Kodnani, Babu Bajrangi and others for their involvement in the Gujarat 2002 riots, a former judge has now come forward and claimed that he and other judges were tried to be pressurized by the state government (then ruled by Narendra Modi as chief minister) to act against the minority community following the riots.



 

Himanshu Trivedi, now settled and practicing in New Zealand, was a district cadre judge in Ahmedabad City Civil and Sessions Court in 2002 when the riots took place in different parts of the state following the Godhra train carnage.

 

In a Facebook post three days ago, Trivedi, a former colleague of Justice Yagnik, wrote that the Gujarat government wanted the judges and judiciary to act against the minority community and he resigned because he was sworn to the Constitution of India.

 

While appreciating the work of rights activist Teesta Setalvad, who has been fighting for justice for the victims of Gujarat riots since 2002, Trivedi wrote on his Facebook page on 1st Aug 2015:


"Teesta Setalvad. Hats off. I have always admired you and your courage and outspokenness on these issues. I also take this opportunity to state that I am indeed pained (and I am the one who had QUIT Gujarat's Judiciary (I was a district cadre judge in Ahmedabad City Civil and Sessions Court - once a colleague of the bravest judge Ms Jyotsna Yagnik) ... because they (the State of Gujarat) wanted us (the judges and the judiciary) of Gujarat to be acting against minority community (albeit with no written orders but DEFINITELY communicated loud and clear messages to us). I could not be part of it as I was sworn to Constitution of India and not to the butchers..."



 

  

Trivedi posted his comment while sharing a video talk of Teesta Setalvad which was uploaded on 2nd Aug 2013. The topic of her talk was Civil Society and Current Challenges to a United India.

 

Trivedi's facebook profile describes him as Solicitor and Barrister at Philip Lee Law Limited. He worked at Bay of Plenty Polytechnic in an earlier stint. Trivedi, who studied law of contract at AUT University, now lives in Auckland, New Zealand.

 

Meanwhile, back home, Teesta Setalvad is facing a criminal case from the Central Bureau of Investigation (CBI). The federal agency last month raided her home and office in Mumbai a week after booking her and her husband Javed Anand for allegedly illegally receiving funds from abroad through their company Sabrang Communications and Publishing Pvt. Ltd. However, Teesta has denied charges and levelled them as vendetta by the BJP government.

 

CBI has started probe on the request of the Gujarat government.

 

Since the Gujarat riot 2002, Teesta has been fighting for justice for the riot victims. In the post-Godhra train carnage riot, around 2000 people, mostly Muslims, were killed in the state then ruled by Narendra Modi as chief minister. In the train carnage, around 60 Hindu karsevaks were killed while returning from Ayodhya.
