    Golwalkar- The Guru Of Hate – Ramachandra Guha

    This column generally deals more — much more — in appreciation than in depreciation. However, it is obligatory on the historian to also (occasionally) notice individuals whose influence on history was malign rather than salutary. One such person was the Hindutva (A Right Wing ideology NOT to be mistaken for Hinduism the religion) ideologue M.S. Golwalkar, whose birth anniversary his followers are marking this year.

    Early initiation


    Born in February 1906, Golwalkar studied and then taught briefly at the Banaras Hindu University (hence the appellation "Guru", which he carried for the rest of his life). He joined the Rashtriya Swayamsewak Sangh as a student, attracting the attention of its founder, Dr. K.B. Hedgewar. When the elder man died in 1940, Golwalkar became the sarchangchalak of the RSS. He headed the organisation until his death some three decades later.

    Golwalkar was a man of much energy and dynamism, under whose leadership the RSS steadily grew in power and influence. His ideas are summarised in the book Bunch of Thoughts, which draws upon the lectures he delivered over the years (mostly in Hindi) to RSS shakhas across the country. This identifies the Hindus, and they alone, as the privileged community of India. It disparages democracy as alien to the Hindu ethos and extols the code of Manu, whom Golwalkar salutes as "the first, the greatest, and the wisest lawgiver of mankind".

    Angels and demons

    The early chapters of Bunch of Thoughts celebrate the glories of the Motherland and its chief religion, this a prelude to the demonisation of those Indians who had the misfortune of not being born into the Hindu fold. Golwalkar writes that the "hostile elements within the country pose a far greater menace to national security than aggressors from outside". He identifies three major "Internal Threats: I: The Muslims; II: The Christians; III: The Communists". A long chapter impugns the patriotism of these groups, speaking darkly of their "future aggressive designs on our country".

    On January 30, 1948, Mahatma Gandhi was murdered by Nathuram Godse. Although Godse was not a member of the RSS at the time of the murder, he had been one in the past. And there were reports that in several places RSS members had celebrated his act by distributing sweets. As a precautionary measure, Golwalkar and other RSS workers were put in jail.

    Secret documents that this writer has recently seen strongly suggest that even if the RSS was not directly implicated in Gandhi's murder, its main leader was not entirely averse to such a happening. Thus, on December 6, 1947, Golwalkar convened a meeting of RSS workers in the town of Govardhan, not far from Delhi. The police report on this meeting says it discussed how to "assassinate the leading persons of the Congress in order to terrorise the public and to get their hold over them".

    Two days later, Golwalkar addressed a crowd of several thousand volunteers at the Rohtak Road Camp in Delhi. The police reporter in attendance wrote that the RSS leader said that "the Sangh will not rest content until it had finished Pakistan. If anyone stood in our way we will have to finish them too, whether it was Nehru Government or any other Government… " Referring to Muslims, he said that no power on earth could keep them in Hindustan. They should have to quit this country… "If they were made to stay here the responsibility would be the Government's and the Hindu community would not be responsible. Mahatma Gandhi could not mislead them any longer. We have the means whereby [our] opponents could be immediately silenced".

    Dogged commitment

    Six weeks later, Gandhi was assassinated, and Golwalkar and his colleagues put in jail. Released a year later on a bond of good behaviour, they retained a dogged commitment to their ideas. Golwalkar himself argued that "in this land Hindus have been the owners, Parsis and Jews the guests, and Muslims and Christians the dacoits". He asked, maliciously: "Then do all these have the same right over the country?"

    Golwalkar saw Muslims, Christians and Communists (among others) as threats to the nation. Other Indians saw him and his ilk as a "Danger to our Secular State". The words in quotes served as the title of an essay on Golwalkar written in 1956 by the Bombay columnist D.F. Karaka. The RSS leader, noted Karaka, "thinks in terms of Hindu India and only Hindu India". As one who had many criticisms to make of the Prime Minister of the day, the columnist nonetheless believed that "it is necessary for all of us whatever our differences are with Mr. Nehru to stand firm with him on this point, namely, that ours is a secular state and that whether we are Hindus, Muslims, Parsis or Christians, freedom of religion, which is guaranteed to us under our Constitution should not be allowed to be crucified at the altar of the RSS — the organisation from which came the man who murdered Mahatma Gandhi".

    Failed project

    Karaka's column was sparked by the celebration by the RSS of the 50th birthday of Madhav Sadashiv Golwalkar. In this, the year of his 100th birth anniversary, all I need do is endorse Karaka's words. For, Golwalkar was a guru of hate, whose life's malevolent work was — as Jawaharlal Nehru so memorably put it — to make India into a "Hindu Pakistan". That project has not succeeded yet, and may it never succeed either.

    The BJP government and Prime Minister Narendra Modi can be faulted for
    betraying every promise that they had made to the people during the 2014
    general elections, except one. This is the relentless pursuit of sharpening
    communal polarisation to establish the RSS project of a rabidly intolerant,
    fascistic 'Hindu Rashtra' in place of our present constitutional republic.

    Coming weekend, Delhi University will host scholars to re-date the Vedas as
    originating, according to the host Sanskrit department's head, "5,000 or
    10,000 years back". Historical evidence so far holds that the Indus Valley
    Civilisation declined around 1800 BC and only around 1500 BC, the Aryan
    influence entered these lands. Using philological evidence and the overlap
    between Vedic Sanskrit, old Persian and ancient European languages, most
    scholars showed that the Rigveda Aryans came from outside. Eminent historian
    Romila Thapar, however, establishes that "the linguistic evidence of Vedic
    Sanskrit supports the coming into India of an Indo-European language (from
    Western Asia) but does not support the notion that India was the homeland of
    the Aryan speaking people" (Seminar, No. 400, 1992). All this is brushed
    aside by the RSS with 'faith' replacing evidence, mythology replacing
    history and theology replacing philosophy.

    On September 19, the RSS' All India Prachar Pramukh, Manmohan Vaidya, said:
    "The Bharatiya tradition has from time immemorial regarded all faiths and
    sects as one and that the artificial injection of secularism is not needed."
    Indeed, why this renewed communal offensive against religious minorities,
    Muslims and Christians?

    The 2014 BJP election manifesto begins by stating 'India is the most ancient
    civilization of the world.' (not one among others). The time has come to
    'pick up the thread from the point where the continuum of our civilizational
    consciousness was lost and reorient the polity in consonance with those
    strong points of Indian psyche which will be the engine for our future
    glory'. And this psyche, it says, is 'one country, one people and one
    nation'. Thus, echoing the RSS and negating the rich plurality of our

    MS Golwalkar, in his 1939 tract 'We, or our Nationhood Defined', chillingly
    articulated the RSS ideological project. He says: "The glory of the Hindu
    civilization (was) interrupted by foreign invaders. .We - Hindus - have been
    in undisputed and undisturbed possession of this land for over eight or even
    10 thousand years before the land was invaded by any foreign race" and,
    therefore, this land, "came to be known as Hindusthan, the land of the
    Hindus". There is a deliberate silence on the wealth of investigations of
    ancient Indian history, including the possibility of the name Hindusthan
    originating from people outside India describing these lands as being across
    the Indus river.

    Such an assertion is absolutely central to the RSS political project since
    otherwise, the Aryans/Hindus would be as much of a 'foreign race' as anybody
    else who came to these lands.

    Hence, the assertion that the Aryans did not migrate to India from anywhere
    but originated here. Historical evidence is dismissed as the 'shady
    testimony of western scholars'. The RSS guru, however, had to contend with
    Lokmanya Bal Gangadhar Tilak's theory of the Arctic origin of the Vedas.
    Unable to reject the thesis of a popular Hindu leader, an incredible
    assertion is made that the Arctic zone was originally that part of the world
    which is today called Bihar and Orissa, '...that then it moved north-east
    and then by a sometimes westerly, sometimes northward movement, it came to
    its present position. If this be so, did we leave the Arctic Zone and come
    to Hindusthan or were we all along here and the Arctic Zone left us and
    moved away northwards in its zigzag march? We do not hesitate in affirming
    that had this fact been discovered during the lifetime of Tilak, he would
    unhesitatingly have propounded the proposition that "The Arctic Home of the
    Vedas" was verily in Hindusthan itself and that it was not the Hindus who
    migrated to that land but the Arctic Zone which emigrated and left the
    Hindus in Hindusthan'.

    Astounding indeed! Golwalkar may have been unaware of the advances in
    geological sciences and plate-tectonics (which fairly accurately allow us to
    map the movement of various land masses over centuries). A simple question
    arises: If the Arctic zone moved away from Bihar-Orissa, how could it leave
    behind the people who inhabited that land mass? When the land mass moves, it
    moves along with everything on it. People cannot be left hanging in a vacuum
    only to drop down when and where the RSS wishes. Such is the perfidy to
    'establish' that the Aryans originated in India.

    Indian history is depicted as a single thread of a long war by the 'Hindu
    nation as a whole' against the invading Muslims. Golwalkar, however, says
    that the Hindu nation, which was finally emerging victorious, was subjugated
    by a new foe - the British. "The attempt (1857) failed but even in their
    defeat a whole galaxy of noble Hindu patriots stands out - glorious objects
    of the Nation's worship." What a distortion! The symbol of this revolt
    against the British, declared by the heroic and devout Hindu queen, Rani
    Laxmi Bai of Jhansi, was the Mughal Badshah, Bahadur Shah Zafar. Was this
    the war of 'Hindus' against Muslim invaders or that of Indians together
    against the colonial rule?

    The RSS and Modi today are carrying forward such gross distortions of
    history as assertions of 'faith'. In the bargain, the intensity of the
    attacks on religious minorities, particularly Muslims, is increased to
    accomplish their project. History is being rewritten in order to control the
    present and shape the future. Can we permit such a metamorphosis of our
    modern secular democratic republic to succeed?

    Three Murders of Rationalists and the Dilemma of the Violent Fringe

    two years before him, little attention was paid to the Sanstha, a shadowy religious cult headquartered in , with followers along the south and west of Maharashtra, extending into coastal Karnataka.

    What set the Sanstha apart from the various groups and individuals whose practises Dabholkar and Pansare sought to debunk – and made them potential suspects in the killing of both men – was the hyper-aggressiveness of response. As journalist Nikhil Wagle, who, according to the police, is named by Gaikwad in phone transcripts as the next target after Pansare, the Sanstha is capable of ratcheting up the pitch against any one who takes them on.

    Wagle claimed he had had several run-ins with them, culminating in a 2011 talk show he hosted on Maharashtra's proposed anti-superstition bill, during which the Sanstha spokesperson walked out after an altercation with Wagle. This, Wagle said, led to his cellphone number being published by the Sanstha in their journal Sanatan Prabha, and to a deluge of abusive and threatening calls. More ominously, he says that they published photographs of him with his image crossed out, just as they had done with images of Dabholkar and Pansare. The journalist Kumar Ketkar, another reputed Marathi editor and critic of Sanstha, also received the same treatment, said Wagle.

    To a certain extent, such bellicosity has not been taken seriously by the state, often dismissed as outrage-inducing actions by fringe groups simply out to grab headlines.

    But even prior to the Dabholkar and Pansare killings, this dismissal was increasingly in need of a relook. In two separate but seemingly related incidents, the Sanstha appeared to demonstrate an increased capacity of violence – the first, in June 2008 when when two of their members were arrested after three blasts in suburban . Two were against the screenings of the  Jodhaa Akbar, and one against a Marathi play. The two men were sentenced to ten years in jail by a Mumbai court in August 2011, later released on bail. The case against them continues.

    The second was October 2009, when an Improvise Explosive Device or IED carried in the boot of a scooter by Malgonda Patil and Yogesh Naik, both Sanstha members, exploded prematurely in Margao, Goa, killing both men. (Their target was an effigy-burning competition held a few days before Diwali every year. The Sanstha felt the competition insulted Krishna, whose idol was placed near the demon Narakasur during the ritual.) Eight men were charged, of whom three are absconding, and five have been acquitted for lack of evidence.

    Even so, when the Sanstha 's name cropped up after the Pansare/Dabholkar murders, there was skepticisim. The group was clearly capable of aggressive threats, inciting mob fury, perhaps even having as their members those who can assemble and detonate crude bombs. But the killings of Pansare and Dabholkar, the logic went, were cold-blooded assassinations carried out with the cool-headedness of professionals – in both cases, the killers were a pair of men on motorcycles, shooting their targets in broad daylight and riding away. Could this be the next level of the violent potential of fringe groups? Or is this making exaggerated assumptions over their capability?

    Across the border in Karnataka, the same dilemma surfaced earlier this month after the killing of MM Kalburgi, the scholar who had skirmished with conservatives in his own Lingayat community as well as with the Hindu right.

    Amongst the usual suspects, there is the Sri Ram Sene, another extreme Hindutva fringe group much more public than the Sanstha in its acts of aggression against those perceived to be enemies of Hindu society. In Kalburgi's case, the protests triggered by his comments last year (not just limited to the fringe – in some cities of Karnataka, the led the protests) included throwing bottles at his home, asking for his arrest, calling him anti-national , asking for his expulsion from and even holding a  mock "shraadh" or funeral ceremony for him.

    And yet the Sene, headed by the volatile Pramod Mutalik, has (like the Sanstha after the Pansare and Dabholkar killings) issued vocal denials in its role in the Kalburgi murder, describing its differences with Kalburgi as well within the boundaries of permissible protest. When we were in North Karnataka to report this story two weeks ago, the same doubts were raised over the role of the Sene or similar groups: they are capable of ugly talk, street thuggery, but can they order or conduct executions?

    In fact, the theory of a  property dispute as a potential motive for the Kalburgi killing carried much greater traction till it was finally discarded by the Karnataka police for sheer lack of evidence. The police now grudgingly say that ideological differences are the most likely reason for Kalburgi's murder.

    Even so, investigators in Karnataka have come up with what are only so far hints of a greater proficiency for violence by the fringe; notably, the questioning of a Sene member known as Veeresh, who according to police sources is a sharpshooter and is said to have imparted training to other sharpshooters in Athani in north Karnataka.

    A tenuous Maharashtra-Karnataka link also appears to be emerging. Based on their questioning of Gaikwad, the Maharashtra police are reportedly coming around to identifying a man called Rudra Patil as the key accused in the Pansare murder. Patil was amongst the three Sanstha members who absconded after the Goa blasts.

    Patil, while a native of Sangli in Maharashtra, is according to the police originally from Northern Karnataka, not far from where Kalburgi was killed. He is by caste a Lingayat (the same community with whom Kalburgi had skirmished).

    These may yet be straws in the wind, even if the straws appear to be getting entangled. The final shape of the weave is in the hands of investigators.

    But that we do not even now have conclusive answers is solely not enough reason to continue to dismiss the full violent potential of the fringe. If anything, the tendency to treat such outfits with a lack of seriousness contributes to an investigative blind-spot to their activities, which in turn perpetuates a cycle of dismissiveness by the state and claims of being vindicated by these groups. There is enough of a case to be made to intensify surveillance and penetration of these groups, much as is done with outfits considered more 'mainstream' threats. That is a longer term measure.

    More immediately, what is appalling is the reluctance by the state to act against the steady stream of violence-inducing (or directly threatening) statements and actions by these groups. These are in the public domain, and require no great investigative heavy-lifting. Till such time as graver charges are established (or not), there is no reason for the argument of the fringe to be invoked to not act. Instead, the consistent, forceful application of the law can serve as a powerful deterrent to these groups to rethink their tactics, and to any followers who individually (as lone wolves) or in a planned manner may want to take the threat of violence to the next level.

    SC – Meat ban can't be forced down people's throat

    New DelhiThe Supreme Court on Thursday declined to interfere with theBombay High Court order staying the order of the Municipal Corporation ofGreater Mumbai prohibiting the sale of meat during the Jain festival of Paryurshan, noting vegetarianism could not be "forced down throats".

    A bench of Justice T.S. Thakur and Justice Kurian Joseph, while refusing to entertain the plea by a trust, said that there should be a spirit of "tolerance and accommodation".

    The court however allowed the petitioner Shree Tapagachiya Atma Kamal Labhdisuriswarji Gyanmandir Trust to go to the high court to raise all the contentions and plea for an early hearing.

    The trust has challenged September 14 interim order of Bombay High Court staying the Maharashtra government notification of September 7, 2004, and subsequent orders of the Greater  Municipal Corporation banning sale of meat on Paryurshan.

    Senior counsel Manish Singhvi, appearing for the Trust, sought to refute the allegation that there was an attempt to "control the diet" of the people, saying that in 365 days, a ban of two days on the sale of meat could not be described as "unreasonable".

    As he urged the court that already half of the day has passed and if the court could ban the sale of meat for the remaining half (of the day), the court said""There has to be a spirit of tolerance and accommodation" as it cited a saying of poet Kabir: "Kabira Teri Jhopri Gal Katiyan Ke Pass, Jo Karn Ge Vo Bhharn Ge, Tu Kyo Bhayaon Udas."

    Obviously referring to internationally growing trend towards vegetarianism, the court told Singhvi that this has "to be inculcated through reforms, subtle ways. It can't be forced down the throat".

    "Forcible" tribal eviction: Central India village draws international attention

    A small village of about 200 in Central , a majority of whose residents is dependent on mining as the main source of livelihood, is all set to become a major focal point, nationally and internationally. Reason: Allegations of refusal of the Madhya Pradesh government to protect them from forcible eviction from their land.
    Earning about Rs 100 to 200 per day, and belonging to Amravan village of Panna district, representations have been made against their forcible eviction to powerful international NGO  Indigenous People's Pact, Thailand; Victoria Tauli Corpuz, special rapporteur, UN High Commission for Human Rights; Satyanaryan Mohanty, CEO, Natonal  Commission; PL Punia, chairman, National Commission for Scheduled Castes and Scheduled Tribes; and Jual Oram, minister for tribal affairs, Government of India, among others.
    The representation appeals for "urgent intervention" in the present crisis in Umaravan, whose residents are being "brutally evicted without the implementation of any proper rehabilitation process or settlement of rights".
    According to the representation, "The affected families belong to the Gond tribe who are marginal farmers and live on forest produce and cultivation. The village received legal notices from the district collector in February 2015 to evict them from the village for expansion of thePanna Tiger Reserve and with an offer of cash compensation. No written or accurate information regarding settlement of rights and alternate livelihoods was provided to the affected families."
    "Majority of the families are illiterate and do not understand any governance procedures", the representation says, adding, "They have been intimidated and harassed by the district administration and wildlife officials and live in constant fear. They were verbally promised various rehabilitation measures and coerced into giving their consent."

    Officials read out eviction notice to villagers

    The representation says, "Even when the aggrieved tribal families raised several objections, cash compensation was forcefully deposited into their bank accounts but most of the tribal families who are residing in the village have not taken the amount. The village had earlier put up claims under Forest Rights Act for settlement of individual and community forest rights. Some of the families also received title deeds and others are still awaiting settlement."
    The representation further says, "The district administration has not bothered to settle their rights as mandated in the Forest Rights Act Section 2d, 2c and 4(1). Section 2d includes settlement of rights in sanctuaries and national park areas. There is a writ  filed in the High Court of Jabalpur, Madhya Pradesh, by the affected families of Umravan and the local NGO, Prithvi Trust."
    Pointing out that the case is posted for hearing on September 28, 2015, the representation says, "In spite of this the local police and forest officials descended on the village on Saturday, September 19, 2015, and have created panic by threatening the villagers that they will be forcefully evicted in the next few days if they do not vacate the village immediately."
    "This is a blatant violation of the rights of scheduled tribes, and of their constitutional and human rights, as well as blatant violation of the Forest Rights Act", the representation insists, adding, "Therefore, we appeal to you to intervene and protect the rights of the adivasis in this crisis."

    Activists protest government move

    It concludes, "Besides, as the legal case is under process we request you to give directions to the state authorities to follow due legal procedures and consider the long term sustainability of tribal people who are being thrown out unceremoniously without any rehabilitation or sustainable alternatives."
    Those who have signed the representation include Bhanumathi Kalluri, Dhaatri Resource Centre for  and Children, Vijayawada; Ashok Shrimali, general secretary, Mines, Minerals and People, and Setu Centre for Knowledge and Action, Ahmedabad; Snehalata Nath, director, Keystone Foundation, Nilgiris district, Tamilnadu; Yousufbeg, Prithvi Trust, Panna district, Madhya Pradesh; Ravi Rebbapragada, Samata, Visakhapatnam, among others.
    Giving this information, Shrimali told Counterview that he personally met Mansukh Vasava, MP from Gujarat and India's minister of state for tribal affairs at Rajpipla, telling him about the havoc created by forcible eviction. "Vasava told me that he would ensure no such eviction takes place and  are not violated", Shrimali said.
    A highly neglected village, the state officialdom does not even care to provide jobs to the villagers under the National Rural Employment Guarantee Scheme, say reports. Worse, the village is devoid of any developmental work for the last three years. There is no ration shop in the village – if they want to buy ration from the public distribution system, they must go six kilometres away.
    The situation is such that, a large number of workers, who are involved in mining, suffer from the deadly silicosis disease, but there is no one to treat them. They begin working at the age of 14 or 15, but live for another 20 years before they become victims of the disease.

    The Hindutva conspiracies of fomenting communal tension in Delhi

    Continued attempts of Hindutva fascists of fomenting communal tension in the workers' colonies of North-West Delhi

    (Investigation report of Naujawan Bharat Sabha, North-West Delhi)

    1.  Introduction

    timthumbIn recent months the Hindutva fundamentalist forces are involved in fomenting communal tensions and paving the way for riots in the workers' colonies of North-West Delhi in a very systematic and conspiratorial manner. There has been a surge in the number of RSS shakhas in the parks and on the vacant land of DDA in this area. At the same time the activities of Bajrang Dal is also on the rise in this area. Most of the workers' settlement in the areas of Holambi Kalan, Holambi Khurd, Bhawana, Narela, Bhalaswa Dairy etc. are the resettlement colonies where the working population which was uprooted from different parts of Delhi have been resettled.

    The illegal activities such as gambling and sale of illegal liquor, smack and other intoxicants are carried out on large scale in these colonies and apart from common working population there exists lumpen elements in substantial numbers. In the shakhas of RSS mainly shopkeepers, contractors, house owners, property dealers and the middle class youth are seen while the lumpen elements play an important role in hooliganism during communal tension. It is in the mobilization of such lumpen elements that theBajrang Dal comes into picture. These days widespread public contact campaign is being organized even in the middle class colonies of the entire area on the pretext of running a signature campaign under the banner of "Go Raksha Maha Abhiyan".              

    2. Background: incidents of the recent past

    Ever since the Narendra Modi government has come to power, the incidents of communal tension and conflict have been taking place on a continual basis. In most of the cases these incidents are the outcome of the planning and provocation by the fraternal organizations of the Sangh Parivar in which the local BJP leaders and people's representatives have played an active role.

    Even after leaving the stray incidents one cannot ignore the pattern behind some important incidents.

    On the last 1 August 2014 a local dispute was given the form of communal clashes in NandNagri in North-East Delhi (in which 12 people were injured), between 2 October and 6 October fomenting the communal tension by spreading false rumour of cattle theft and cow slaughter by 'Hindu Krantikari Sena', an outfit associated with RSS, by forcible search of muslim houses, by beating up a scrap trader and by organizing a motor cycle rally, On 11 October inflicting serious damage to the property of a shrine by stone pelting in Zorbag Karbala of South Delhi and in the process injuring dozens of kids, on 22-23 October giving a communal color to a local dispute in Trilokpuri and stone pelting and violent clashes after provoking communal feelings by local BJP MLA Sunil Vaidya, Between 25 October-4 November provoking people to stop the Tazia procession during Moharram by people belonging to Sangh Parivar in the J.J. Colony Bawana, gathering people in the adjoining villages of Haryana-Delhi and the ABVP activists in the name of 'Mahapanchayat' ( local BJP MLA from Bawana Gugan Singh Ranga and many others delivered provocative speeches in this Mahapanchayat which was held without police permission, but there was no action against anybody) and creating a seriously tense communal atmosphere, on 5 November attempt to foment communal tension by throwing a dead pig in front of a mosque in Okhla's Madanpur Khadar, On 9 November attempts of communal mobilization after finding a corpse of a cow by some unknown person in front of a restaurant in Babarpur, on 11 November calling a Panchayat by 'Yuwa Hindu Sangh' in Ghonda which is adjacent to Babarpur, on 25 November in a clear violation of the Supreme Court directive and the 'National Capital Territory of Delhi Laws (Special Provisions) Act 2011' running Bulldozer by Delhi administration on 900 houses of the muslim settlements of Israeli Camp in Rangpuri Pahari of Vasant Kunj and in the process making thousands of people homeless which includes 2000 children, on 1 December vandalizing and setting on fire the Sabastian Church, on 6 December stone pelting at Syro Malabar Church located in Okhla, On 8 December Sadhvi Niranjan Jyoti delivering the notorious "Ramzada-Haramzada" speech in Trilokpuri and trying to foment trouble – series of all these events by itself is sufficient to suggest that the Hindutva fundamentalists in various ways are continuously involved in the systematic attempts of fomenting communal tension and riots from 2014 itself.

    What we witness is a common trend in all the above incidents which are noteworthy. In almost all the above incidents the local people showing their concrete solidarity foiled the conspiracies of the communal forces and prevented the situation from turning explosive. Secondly, in almost all the cases the police played the role of mute spectator, no action was taken against the culprit after investigation and even when it tried to control the situation through mediation it was owing to the pressure from the local community and their institutions such as peace committee. Thirdly, some incidents of provocation were carried out by "unknown" persons but in most of the cases the organizations belonging to Sangh Parivar and the local BJP leaders played a significant role.

    In North-West Delhi the activities of the Hindutva forces began to rise towards the end of 2014 and most of incidents of communal violence in 2015 have taken place in this very region. In Bawana the beginning was already made, on 10 December the communal forces tried to make Holambi Khurd as their laboratory.

    In 2001, the workers uprooted from many areas in Delhi were resettled in Metro Vihar, Holambi Khurd. The muslim families here had made a demand for land from the administration for a mosque and a graveyard at that time itself (the nearest graveyard is located at a distance of 8 km from here). In September 2001 they erected a temporary mosque on a vacant land after informing the administration. In 2002 on the provocation of the RSS activists some people constructed a temple on the land in front of the mosque. To escape from a potential dispute the muslim families repeatedly demanded from the administration that the land be allotted for temple and crematorium apart from mosque and graveyard, but despite writing letters to sixteen departments in the last fourteen years and despite making innumerable rounds to the office the administration did not take any step.

    On last 10 September (2014) some anti-social elements began to level the land of the temporary mosque and temple. When some concerned people called the police they assured the police that they did not intend to grab the land. After that the land began to be used as a spot for gambling and intoxication and the people coming in and out of mosque began to be harassed. Subsequently on 27 December the vacant land was surrounded with bamboo-sticks by the same elements. When informed the PCR van and local police arrived but returned after orally stopping them but the enclosure remained intact. Even today the enclosure and the assembling of the anti-social elements continues unabated. Since it is in front of the mosque and temple and owing to the continuous activities of the Sangh parivar activists the situation is maintained in such a manner that it can be turned into communal tension and clash at any time.

    After this brief discussion about the background we now turn to continuous activities of the Hindutva forces currently of fomenting communal tension in Holambi Kalan, Narela and Bhalaswa Dairy and their dangerous conspiratorial plans the confirmed information of which has been obtained by the investigation team of Naujawan Bharat Sabha.

    3. The activities of fanning communal fire in Holambi Kalan and the dangerous preparations for future

    The task of habilitating the multi-phase Metro Vihar colony in Holambi began in 2000-2001. In 2006 the Delhi government demolished the slum from Jakhira and resettled the uprooted population in Metro Vihar, Phase-2, block-B. In 2007 some families uprooted from Indralok were also resettled here. In all Holambi Kalan is divided in two phases and six blocks where there are 600 muslim families and the muslims constitute ten percent in the total population of 10,000.

    Right from the time of habilitating Holambi Kalan (Metro Vihar) people have been demanding for temple-mosque and crematorium-graveyard. People continued to build temples one after another on the vacant DDA lands. The muslim community too demanded land several times from administration for mosque. A local DDA Junior Engineer told them orally that until the permanent allotment of land for mosque they could construct temporary mosque on any vacant land and in 2006-7 a temporary structure of Bilal mosque was erected by Bilal Welfare society.

    After inspection by the slum officials and assuring the allotment of land for mosque in 2010 the muslim families applied for allotment twice, in 2010 and 2012, but no action was taken and the Bilal mosque continued to operate on temporary basis. The land on which the Bilal mosque is situated was earlier proposed for constructing a primary school, but due to a high tension wire overhead it was cancelled. It is to be noted that apart from Namaz 65 children are provided education in Hindi, Urdu and other subjects in the Bilal mosque.

    It is to be noted that it's not just the Bilal mosque which faces such a troublesome situation. There are 28 temples and 4 mosques in all in Holambi Kalan phase -2 which are constructed on the vacant land of DDA. Similarly construction work is ongoing on three more temples as of now. Between 2007 and 2014 there has been no dispute between the Hindu-muslim population regarding Bilal mosque or any other mosque. The acts of provocation began for the first time by the Sangh Parivar people after the coming to power of Modi government on 26 May, 2014.

    On 3 June 2014 when after the thatch of the Bilal mosque blew away in the storm and after the tarpaulin was torn when the mosque was being repaired by collecting donation from the colony and when the tarpaulin was being re-erected, some Sangh parivar activists entered the mosque along with a crowd of hundren people. They stopped the repairing work, removed the tarpaulin and started creating ruckus. They called police by saying that an illegal new construction was taking place there even though it was only the repairing of the harm done due to storm which was taking place. After arriving the police halted the repairing work and took away an office bearer of the mosque committee Mohd. Nisar to police chowki and registered a complained against him. After this the Namaz began to take place under open sky by erecting tarpaulin, but the Sangh Parivar activists continued to carry out propaganda among the Hindu population and the task of mobilizing people on religious ground.

    The incident of 14-15 August and its aftermath

    On 15th August this year the members of Bilal Welfare Society had made preparations for a programme of hoisting the national flag on the vacant land in front of the mosque and on 14th August a tent and 100 chairs were placed. But on the night of 14th August the local SHO reached there and got the chairs and tent removed and confiscated the mobile phone of the Imam of the mosque. He claimed that there was no permission to hold such an event. The local muslim population was of the belief that in the many colonies of city the citizens organize 15 August programmes in public parks and they do not need any permission for the same, but the police paid no heed to them.

    On the morning of 15 August the people belonging to RSS and Bajrang Dal reached the mosque along with a crowd of 400-500 (most of the people in the crowd were outsiders) and started raising extremist religious slogans and tried to hoist the flag. On this occasion the police did not put forward the logic of not having permission and did not make any attempt to stop them. Then it was decided that 5 people each from both the communities would hoist the flag. But after the hoisting of flag the crowd raised extremist religious slogan and poured Ganga Jal around the mosque. The police silently watched all this.

    We obtained information from the residents of the colony that on 14th August the RSS and Bajrang Dalpeople had carried out a widespread propaganda that the muslims were planning to hoist Pakistan's flag on Bilal mosque. On the evening of 15 August the police seized the flag and the stick and put them on police station. But on the same day the RSS activists carried out a widespread propaganda with a burnt flag and spread the rumour that the flag was burnt by muslims. Whereas the police later clarified that the hoisted flag is in its safe custody.

    On 16th August once again a crowd led by RSS activists gathered in front of mosque and tried to hoist the flag. This time the police stopped them. Then the crowd retreated with the threat that they would come back once the police returns.

    The atmosphere for the 15 August incident was being built up by Sangh Parivar much in advance. On the fateful day the RSS activists of nearby areas of Shahabad Dairy, Bawana, Narela etc. were alerted in advance for gathering the crowd. While responding to the accusation by the muslim community that all this was done by the Sangh Parivar in a planned manner the state propaganda chief Rajesh Tuly told media, "All these accusations are baseless. The local muslim population is planning to grab the land in front of the mosque. The mosque is unauthorized. Actually these people disrespect out national flag". DCP Outer Delhi Vikramjeet Singh's tone matches with that of the state propaganda chief of RSS. He too said that the mosque was constructed by grabbing the land illegally. Rejecting the details of the incident of 15 August which took place in front of around one thousand people, the DCP says that both the communities wanted to organize the 15 August programme separately and one community was opposing the other and then the police intervened to prevent the communal clash and asked to hold the event jointly. The approach of police administration is clearly biased and it has continuously ignored all the provocative acts of Sangh Parivar.

    The modus-operandi of RSS propaganda and its future preparations

    Naujawan Bharat Sabha has managed to obtain some shocking information regarding the preparations, modus-operandi and planning of the Sangh Parivar in this region.

    Apart from the traditional means of propaganda such as door-to-door, mouth-to-mouth and propaganda during the Shakhas the leading local activists of RSS remain in constant touch with an inner circle of credible people through a WhatsApp group with which they spread information instantly and exchange ideas regarding their plans. The name of this WhatsApp group is "RSS Haripur nagar" and it is run by a leading local RSS activist Indresh (Kailash, Dr. Pramod, Dr. Ravi, Rashtrapal Jhakra etc are other leading members). This WhatsApp group is active much before the incident of 15 August and the investigation team of Naujawan Bharat Sabha has managed to obtain the entire detail of their conversation in this group of a few days in August (15 August to 29 August) from the internal sources.

    It is from those internal sources that we have come to know that now the responsibility of the Holambi Kalan case has been handed over to Bajrang Dal. The Bajrang Dal had conducted secret meetings in the A Block of Metro Vihar, phase-2 on 7 September and 13 September and charted out the future plan. The plan is to carry out some big action on or around 25 September "to teach them a lesson". Around 100-150 outsiders are supposed to come from Alipur, Shahabad Dairy, Sannoth and Bawana to carry out this action. We also came to know that the internal secret preparations of Bajrang Dal and RSS are going on in full swing in the nearby areas. In the 7 September meeting a plan to distribute swords was put forward and it was decided that in the 20 September meeting money will be collected for the swords (the core team members would be given the sword free of cost), the concrete plan for 25 September action will be made and on 22 September swords will be distributed.  

    By the time we completed this report on 20 September at 10 pm we have received the confirmation that the secret meeting of Bajrang Dal had taken place but we have not yet received information about the decisions taken during the meeting. Probably we would get this information by tomorrow evening. We will present it as an annexure to this report once we manage to get it.

    There is yet another mosque in the Metro Vihar in a Marathi dominant area. From the internal sources ofBajrang Dal we managed to get the information about the increase in their activities in this area as well but we are yet to receive the concrete information regarding the form.

    4. The preparations are on to fan communal fire in Narela as well

    Narela happens to be an old area of North-West Delhi where apart from old villages, new middle class localities and old workers settlements new resettlement colonies are also there. The investigation of the Naujawan Bharat Sabha took place most intensively in Holambi Kalan, but during the investigation we came to know about the activities of communal elements in Narela as well.

    On 12 September a mutilated dead body of a boy was recovered on the railway line near Narela regarding which it was rumoured that it was in fact a murder carried out by muslims. From the internal sources of Bajrang Dal we also received information regarding a similar propaganda being carried out in the workers colonies in Narela as well. The manner in which the Sangh Parivar uses totems-superstitions gets revealed from the fact that the family of deceased boy has been asked to sweep the floor in front of a muslim house.  

    Yet another information which we managed to obtain is that a membership campaign is being run by Bajrang Dal in Narela phase-2 by propagating the Bilal Mosque incident in Holambi Kalan by giving its own interpretation.

    Most of the muslim population reside in the pocket-8 of Narela. It is in this very area that some issue such as mosque is being planned to be raised. Towards this purpose support base is being prepared and the atmosphere is being built up in the areas resided by the workers who mainly come from Hindi speaking areas.

    The plan of carrying out some "big action" around 25 September (Bakrid) in Holambi Kalan mainly by outsiders which the Bajrang Dal is acting on includes the plan to take some boys from Narela as well. This shows that their internal acivities are going on in Narela.

    Planned activities with the aim to instigate riot in the J.J. Colony of Bhalaswa Dairy

    The J.J. Colony of Bhalaswa Dairy was rehabilitated in 1999-2000 in which the uprooted population from Jahangirpuri, Rohini and Nizamuddin was resettled. Among the population coming from Jahangirpuri the muslim families were more in number. In the block B-6 and B-7 of the colony muslim families are more in number and next to it on the other side of the twenty feet road is the dominance of Hindu population. In other blocks there is a mixed population.

    The RSS shakhas began there two-three years ago. In D-block there is a temple in front of which there exists a mosque which falls under B-7 block. Some months ago a few outside boys began their movement in and out of temple. Subsequently about two months back the priest of the temple suddenly disappeared. It is to be noted that he did not have any troublesome relation with the local population, rather he had a cordial relationship. After the disappearance of the priest the Aarti began to be conducted by some youth who belonged to RSS. The RSS activists systematically carried out the propaganda that the priest was kidnapped by muslims. This area which is dominated by muslim population is known as Bengali tola. The Sangh activists have systematically propagated that people staying here are illegal Bangladeshi immigrants who are staying here with the help of forged identity card.

    In the temple of D-1 block every Tuesday Hanuman chalisa was chanted and special Aarti and Jaikaraused to take place, but never before was there any clash with the timing of the Azan of the mosque and nor was there any complaint earlier by the Namazis with regard to the volume of its speaker. Ever since the temple's operations came into the hands of committee consisting of RSS members clashes began with regard to timing and the volume of the audio. There are some small shops of muslims nearby temple. They say that in the loud volume of Hanuman Chalisa, aarti and Jaikara the volume of Azan gets subdued. After an agreement between both the committee it was decided that the Azan will take place at 8 pm while Aarti will begin at 8:15 pm, but this agreement was not followed by the temple.

    Every Tuesday 50 youth used to come from outside in order to join the Aarti and the chanting ofHanuman Chalisa against whom several cases have been registered in the adjoining police stations as per police. The local residents also told that the brother of the RSS person who conducts the Aarti in the temple was arrested by police on 4 September on the charge of attacking a muslim boy with a knife and he is yet to be granted bail.

     The incident of 8 September

    On 8 September (Tuesday) when the volumes of Azan and Hanuman chalisa chanting-Arti began to be clashed, suddenly stone pelting started. Some people said that first the stone was pelted on temple from the mosque side, but it is yet not clear whether the stones came from outside or somebody threw them from inside the temple premises. Stones were being pelted from both the sides for 10-15 minutes. The situation came under control only after the arrival of police. Some muslim family told that it was during the same time that some people came on 5-6 bikes who returned after muslim youth started gathering.

    Some people told that the police have seized some bikes which contained knife and country made gun etc. When we tried to confirm this claim the police refused to reveal anything. On calling the police station we were asked to talk to the SHO, the SHO asked us to talk to DCP and the DCP office did not reveal anything on this. Whomsoever we spoke to they all said that the police knows the identity of those who came from outside very well and yet it has registered FIR against unknown people.

    Widespread contact with the local population revealed that not only the muslim population but even the majority of Hindu population which has been staying in communal harmony for years is disturbed with the incident of fanning communal tension by the RSS people who are outsiders, but the section of population which is under the influence of extremist communal propaganda is more vocal.

    As of now the rumours are rampant in the entire region. The RSS members are carrying out propaganda (D-1 block is most affected by such propaganda) that the muslims have issued open threat that after Bakrid Hindus would be attacked and a massacred would be carried out and hence there must be full preparations for the retaliatory action. Some local youth associated with RSS told us that a programme ofBhandara would be organized around Bakrid (between 23-25 September) and in case the muslims cut buffalo we would cut pig because the pig is sacrificed in Balmiki puja at one of our Hindu brother's place.

    Owing to such rumours and provocative propaganda the communal tension is continuously brewing below the surface. As long as police does not take any action against the new management of temple which is associated with RSS and the outside elements it would be difficult to bring the situation to normal.

    5. Epilogue

    The activities of Bajrang Dal and RSS have been intensified these days in the working class areas of Shahabad Dairy, Suraj Park, Raja Vihar, Jahangirpuri, Samaypur Baadli, Baadli village etc. of North-West Delhi.

    Our present report and our general observation is about the North-West Delhi, but based on the incidents which have taken place in the last one year there is ample ground to believe that the communal venom is being spread rapidly in the workers' areas throughout Delhi and the Hindutva forces are especially active to recruit for their Storm Troupers' gang and goonda gangs from among the dehumanized-lumpen elements and petty bourgeois class. At the same time by breaking the class solidarity on religious ground and by increasing the communal polarization they are weakening the ground of possible resistance of workers against the onslaught of the policies of privatization-liberalisation.

    We appeal to all the pro-people forces to unite, to be active to carry out extensive and intensive propaganda campaigns against the communal fundamentalism and especially to organize workers and youth at the grass root level so as to counter the systematic and planned attack by the communal forces on the unity of common people. We appeal that all the pro-people intellectuals, workers' organizations and student-youth organizations must join together to put immense pressure on the Delhi government and Delhi Police to take stringent action against the communal goonda gangs.

    हम किसी दलदल में नहीं हैं,डिसक्लेमर यह हम बार बार दे रहे हैं और सावन के अंधों को अपने रंग को छोड़ बाकी तमाम लोग रंगीन नजर आत हैं। सवालों से जूझे बिना जो गालियां बकने के शौकीन है तो उनकी गालीगलौज की हदों से टकराने का माद्दा भी हममें हैं।हम किसी को डीफ्रेंड भी नहीं करते हैं।लोग खुद भाग खड़े होते हैं या तमामो गदहे घोड़े बेचकर बेफिक्र सो जाते हैं।हम जानते हैं कि सोये हुए मुल्क को नेताजी जगा नहीं सके और हम नेताजी हैं नहीं।हम उनके आभारी हैं जो नेताजी को गरियाने के बजाय हमे गिराय रहे हैं।क्योंकि,सच पूछो तो दिल चाक चाक है।

    सच पूछो तो हम इस देश का इतिहास कुछो नहीं जानते हैं।कुछ जालसाजों ने अपने कुनबों का इतिहास हमारे मत्थे मढ़ दिया और हम बल्ले है।हम झूठ का पुलिंदा ढोते हुए गधों की तरह सच का समाना करने से डर इसलिए रहे हैं कि हम आज भी वे गुलाम हैं,जिन्हें आजादी दिलाने के लिए किसी नेताजी ने सबकुछ दांव लगा दिया।

    जिनके लिए देश सा बड़ा न सियासत थी और न मजहब था।जिस गोमांस के सवाल पर इतना बवाल हो रहा है,नेताजी के भारतछोड़ते वक्त उनके साथी तलवार जी का आंखोदेखा हाल पढ़ लें,नेताजी ने देश की आजादी के लिए हिटलर से मिलने की राह मुस्लिम मुल्क अफगानिस्तान में बेहिचक अपे छद्मवेश की प्रामाणिकता के लिए गोमांस भी खा लिया।

    गोमांस काकर वे हिंदू रहे या नहीं,इस पर कोई भी फतवा जारी कर सकता है या नेताजी को भी मुस्लिम की औलाद कह सकता है।

    देश निकाला उन्हें बहरहाल दिया जा नहीं सकता क्योंकि वे तो देश को आजाद करने के लिए जब बाकी लोग पके हुए आम की तरह आजादी और सत्ता,एक के साथ एक फ्री लपकने के लिए पूरे मुल्क को आग के हवाले कर रहे थे और जाहिरा तौर पर ब्रिटिश हुकूमत से टकराने के बजायउससे सौदा करके सबकुछ हासिल कर लेने के फिराक में थे,तब इस महादेश के नेता अकेले दम अंग्रेजी हुकूमत से टकराने चल पड़े थे और वापस अभीतक लौटे नहीं है।हमें अहसास तक नहीं है कि इस देश का सच्चा सपूतअबी घर वापस हुआ नहीं है।

    गांदी के बाद न जाने किस किसकी हत्या होती रही और न जाने कितने कत्लेआम हुए और न जाने कितने मारे गये,ताजातरीन पनसारे,कलबुर्गी और दाभोलकर भी मारे गये।

    गनीमत है कि वे इस हिंदूराष्ट्र में नहीं है और उकी कोई हत्या भी कर नहीं सकता यकीनन।

    क्या पता कि कभी वे लौटकर आते तो न जाने कैसे हम उनसे सलूक करते जो पूरे सात दशक तक उनको जिंदा दफनाते रहे।

    बेहद शर्म की बात है कि आजादी के सात दशक पूरे होने जा रहे हैं और लोकतंत्र छीज गया है।संविधान मर गया है और मेहनतकश मर मर कर जी रहे हैं।आजादी सिरे से लापता है।

    विकास हरिकथा अनंत में बेदखली और हादसों का सिलसिला है।देश आजादी के लिए बंटा,हम शुरु से अब तक यही मानते रहे हैं।

    यह झूठ जिताना सच है, यह झूटा इतिहास जितना सचहै, नेताजी के बारे में पूरा सच भी किसी को मालूम नहीं है।

    सिर्फ इतना तय है कि सत्ता पर काबिज होने वालों ने उन्हें झूठो ही फासिज्म से जोड़ दिया है जबकि वे स्टालिन के नक्शेकदम चलकर दूसरे विश्वयुद्ध को आजादी का निर्णायक मौका मानकर आजादी के लड़ रहे थे और उनकी फौज मुकम्मल हिंदुस्तानी थी जिसमें इंद्रधनुष के सारे रंग हजारोंहजार फूलों की तरह खिल रहे थे।

    जिस शख्स ने हिंदु्स्तान की सरजमीं पर फासिस्टों का हर कदम पर मुकाबला किया,हमने उन्हें फासिस्ट बना दिया।

    उससे बड़ी शर्म यह इस खंड खंड अब भी खंडित हो रहे लहूलुहान, झुलसते महादेश के महानायक को हमने जिंदा दफना दिया।

    हमने भारत छोड़ने से पहले नेताजी के भाषण को आपसे साझा करके अनुरोध किया कि समझ लें कि नेताजी के दिलोदिमाग में आखिर चल क्या रहा था।

    बंगाल के युवाजनों को संबोधित करते हुए नेताजी ने हिदुत्व पुनरूत्थान को मुल्क और इंसानियत के लिए सबसे बड़ा खतरा बताया और युवाजनों से साम्राज्यवाद और पूंजी के साथ साथ फासीवादी तत्वों का मुकाबला करने के लिए वक्त रहते तैयार हो जाने की नसीहत दी।

    वह भाषण साझा करने के बाद हमें थोक भाव से गालियां मिल रही हैं।गालियां देने वाले बेहद मेहरबान हैं।लेकिन नेताजी के विचारों को साझा करने के लिए ये गालियां दरअसल हमारे लिए नहीं हैं।

    दरअसल ये गालियां नेताजी,तमाम शहीदों और हमारे पुरखों के लिए हैं,जिनमें आजादी के लिए हर जंग लड़ने का जिगरा था।

    हम चूंकि कुछ भी नहीं कर पा रहे हैं और हम चूंकि बिना खून,बिना रीढ़ के शुतुरमुर्ग हैं,गालियां हमारे लिए खूब जायज है कि हम मेहनतकशों के हकहकूक लूटते देख रहे हैं बेबस।

    हम रीढ़ विहीन लोग शहीदों की शहादतों का सौदा होते देख रहे हैं तमाशबीन।हम पल पल देश को बिकते हुए देख रहे हैं।

    हम आजादी गिरवी होते हुए देख रहे हैं और हम भारत की जनता को लगातार बेदखल होते देख रहे हैं।हम कत्लेआम देख रहे हैं।हम तमाम हत्यारों को रंग बिरंगे रब बना रहे हैं तो नेताजी खी फिर फिक्र क्यों करनी है।

    हम कयामतों के इस सिलसिले में वसंत बहार देख रहे हैं और चारों तरफ आगजनी हैं और हम मदहोश हैं।

    मैं तो अपने को लेखक भी नहीं मानता और इसलिए कालजयी होने की कोई कोशिश भी नहीं करता और मेरे पांव फिरभी धंसे हुए हैं या बसंतीपुर के गोबर कीचड़ में या हिमालय में धंसकती इंसानियत के टुकड़ा टुकड़ा होते वजूद में।

    मेरे पिता पुलिनबाबू और मेरे ब्रह्मराक्षस गुरुजी ताराचंद्र त्रिपाठी कहते थे कि लिखकर अगर दुनिया न बदल सकें तो लिखना मत।

    खेत जोतते हो और पैदावर कुछ नहीं तो जैसे किसान नहीं वैसे ही लिखते हैं और दुनिया बदलती नहीं,तो ससुरा कोई लेखक है ही नहीं।  

    फिरभी लिखने की बदतमीज जुर्रत करता हूं तो दस जूते हमारे सर पर मारो लेकिन उस नेताजी को उनके कहे के लिए बख्श दो,जिनको हमने जिंदा दफना दिया।

    ऩेताजी के भाषण के बाद ऐसे दस्तावेज को साझा कर रहा हूं,जिससे रोंगटे खड़े हो जाने चाहिए और इंसानियत का कोई जब्जा हो तो चुल्लूभर पानी में डूब मरना चाहिए।

    इसके बावजूद गालियां देने में जिन्हें मजा आता है,उनसे निवेदन है कि उनकी गालियां सर माथे हैं बशर्ते कि वे सच को जानने की कोशिश भी करें और सचा का समाना बहादुरी के साथ करें भी।

    गौरतलब है कि यह दस्तावेज नेताजी के मृत्यु रहस्य के खुलासे के लिए गठित मुखर्जी कमीशन के निष्कर्षों,शोधार्थी पूरबी राय की रपट और के तथ्यों के आधार पर हैं,जो नेताजी के बारे में अब तक हुई पड़ताल का निचोड़ भी कहा जा सकता है।हम पर भरोसा न हो तो ककुद अनुवाद भी करवा लें।

    हूबहू अनुवाद कर नहीं रहे हैं क्योंकि मूल दस्तावेज बांग्ला में साझा भी कर रहे हैं।अब अपने तरकश भी तमाम गालियां लामबंद कर लें क्योंकि हम इंसानियत के मुल्क को लामबंद कर रहे हैं और भारत में सांस्कृतिक विविधता,लोकतंत्र और स्वराज के सबसे प्रामाणिक दिलों के महानायक की बात कर रहे हैं।

    इस दस्तावेज का बुनियादी मुद्दा यही है कि नेताजी को लेकर इतनी घृणित साजिशें आखिर किसलिए हैं,किसके हक में है?

    इस दस्तावेज में खुलासा हुआ है कि नेताजी के मरने या जीने का सच अभी इस महादेश को मालूम नहीं,लेकिन दो दो डाक्टरों ने उनकी मौत के तीन प्रमाणपत्र जारी कर दिये!

    गौरतलब संजोग भी देखिये कि भारत सरकार ने भी मरणोपरांत नेताजी को भारत रत्न देकर निर्णायक  मृत्यु प्रमाणपत्र जारी करने लगा था,भूल गये?

    नेताजी के परिजनों के कड़े विरोध के बाद गनीमत है कि नेताजी को जिंदा दफनाने की वह वैदिकी रस्म अदा हो ही नहीं सकी।

    इस दस्तावेज का सार यही है जो उनके पहले से साझा भाषण का सार है,जिसके लिए भगवा हिंदुत्व के झंडेवरदार तमाम बजरंगी गुस्से से लालपीला हो रहे हैं.यह इसलिए कि  जिस शख्स ने हिंदु्स्तान की सरजमीं पर फासिस्टों का हर कदम पर मुकाबला किया,हमने उन्हें फासिस्ट बना दिया।

    कहना न होगा,हम अहसान फरामोश लोगों के लिए उससे बड़ी शर्म यह कि इस खंड खंड अब भी खंडित हो रहे लहूलुहान,झुलसते महादेश के महानायक को हमने जिंदा दफना दिया।

    इसदस्तावेज के मुताबिक इस महदेश के महानायक की मौत साबित करने के लिए घृणित साजिशें परत दर परत हैं।

    सोचें,ऐसा किसके हित में हुआ और वे कौन लोग हैं,उन्हें भी पहचान लें,जो पिछले सात दशकों से ये साजिशें रचते रहे हैं।

    शख्सियत एक और मौत के सर्टिफिकेट तीन तीन,वाह कि आनंदो।

    नेताजी की मृत्यु के प्रमाणपत्र जारी किये दो डाक्टरों ने और डेथ सर्टिफिकेट कुल तीन हैं।

    इसमें भी मजा यह है कि तीन मृत्यु प्रमणपत्र में नेताजी की मृत्युतिथि और समय भिन्न भिन्न हैं।

    एक व्यक्ति तीन तीन बार अलग अलग तिथि पर अलग अलग समय पर मर गया यह तो कुदरत का चमत्कार है।

    हमने फर्जी आजादी,फर्जी लोकतंत्र का इतिहास गढ़ने के सिलिसे में जो पवित्र देवमंडल का सृजन किया है,उसमें ईश्वर की कृपा से यह अनहोनी है।

    पूजा पाठ,होम यज्ञ बहुत हुआ ,अब तो भइये,सच्चा भक्त हैं तो उस ईश्वर का दर्शन भी कर लें जिनकी यह रचना विचित्र है।परदा पर परदा है।रहस्य घनघोर और किसी को मालूम ही नहीं कि यह रचनाक्रम किस विभूति का कला कौशल है।

    ऐसा करिश्मा जिनने कर दिया,उनका  I.Q लेवेल का लोहा मानना ही होगा।जिन डाक्टरों ने ये सर्टिफिकेट जारी कर दिये,वे अब संपूर्ण निजीकरण,संपूर्ण एफडीआई समय में चप्पे चप्पे तैनात है और महामारियों का आयात हैं।हम बाकायदा मृत्यु कार्निवाल मना रहे हैं।यही आजाद भारत का मुक्त बाजार और नस्ली राजकाज है।

    यह शर्म कैसे सहेजें,इसका भी कोई उपाय कीजिये।दुई चार नरसंहार का इंतजाम और करके देख लीजिये कि हुकूमत सियासत मजहब और मुक्ता बाजार का त्रिशुल है।

    विमान दुर्गटना में नेताजीकी मौत साबित करने में बड़ी रचनाधर्मिता दीख रही है।

    आखिरी वक्त नेताजी की चिकित्सा करने वाले चिकित्सक बतौर दो डाक्टरों के नाम हैंःतानियोशी इयोशिमि और सुरुता।

    जाहिर है कि विमान दुर्घटना जापान में हैं तो दोनों डाक्टर भी जापानी हैं।

    कथा यह है कि या तो तानियोशी इयोशिमि या फिर सुरुता ने नेताजी की चिकित्सा की है।

    नेताजीके मत्यु प्रमाण पत्र इन दोनों डाक्टरों ने जब बी बारत के सत्तातबके को नेताजी की मौत साबित करने की जरुरत हुई,बेहिचक जारी कर दी।

    नेताजी का मृत्यु प्रमाण पत्र पर पहली दफा दस्तखत हुआ 1946 मेें।

    तसल्ली नही हुई जनता को तो फिर 1955 में नेताजी का डेथ सर्टिफिकेट जारी हो गया।

    इस महादेश को फिर भी यकीन न हुआ तो फिर वहीं डेथ सर्टिफिकेट 1988 में जोरी हो गया।

    सवाल है कि किसी मनुष्ट का डेथ सर्टिफिकेट कितनी दफा और कितने कितने समय के अंतराल में जारी हो सकता है।

    बाकी दस्तावेजअलग अलग जारी अलग अलग डेथ सर्टिफिकेड के ब्यौरे और उनके अंतर्विरोध हैं और उनका ब्यौरा जरुरी भी नहीं है।जिन्हें जरुरी लगता है ,खुद पढ़ लें और अनुवाद करवा लें।

    गरज के साथ बरसात शुरु हो गयी है।बिजलियां गिर रही हैं और बिजली जा सकती है।इसलिए यहीं तक।

    দেশনায়ক নেতাজীর মৃত্যু নিয়েও চলেছে ঘৃন্য ষড়যন্ত্র। লোক এক জনই কিন্তু death certificate দিয়েছেন দুজন। তার থেকেও বেশী তাজ্জব ব্যপার হলো মৃত্যু সার্টিফিকেটের সংখ্যা তিনটে। সেই তিনটে সার্টিফিকেটে মৃত্যুর দিন ও সময় আবার ভিন্ন ভিন্ন। একটা মানুষ তিনটে আলাদা দিন ও সময়ে মরতে পারেন? এতেই বোঝা যাচ্ছে যার নির্দেশে এই কাজ হয়েছে তার I.Q লেভেল কি বিশাল! আর যে ডাক্তারেরা মৃত্যু সার্টিফিকেট লিখেছেন তারা কতো বড় চিকিৎসক! এই সব ডাক্তার দেশে থাকলে দেশ ধন্য হয়ে যাবে। লজ্জা! লজ্জা!


    কলকাতা, ২০ অগাস্ট :


    নেতাজির "বিমান দুর্ঘটনা ও তারপর মৃত্যু"তত্ত্ব নিয়ে অনুসন্ধানে নেমে খুব স্বাভাবিকভাবেই গবেষকদের প্রথম প্রশ্ন ছিল - কে ছিলেন সেই চিকিৎসক, যিনি নেতাজিকে শেষ সময়ে চিকিৎসা করেছিলেন ? খুব স্বাভাবিক ও সঙ্গত প্রশ্ন। তাতে অন্তত একজন সাক্ষীর সাক্ষ্যগ্রহণ সম্ভব হবে। কিন্তু মুশকিল হল - এখানেও উঠে এল দু-জনের নাম। একজনের নাম - তানিয়োশি ইয়োশিমি । অন্যজনের নাম সুরুতা।

    ইয়োশিমিই নেতাজির চিকিৎসা করেছিলেন বলে প্রচলিত মত। ভিন্ন মতে ডাক্তার সুরুতা। আবার আরও একমতে ২ জনেই ছিলেন ওই হাসপাতালে - একজন চিকিৎসক, অপরজন সহ-চিকিৎসক। এই তৃতীয় মত অনুযায়ী যদি এগোনো যায়, তাহলে তানিয়োশি ইয়োশিমিই চিকিৎসা করেছিলেন নেতাজির। সাহায্য করেছিলেন সুরুতা। কিন্তু মজার ব্যাপার হল, যখন (পডুন যখন যখন) ডেথ সার্টিফিকেটের প্রয়োজন পড়ল, তাঁরা ২ জনেই ডেথ সার্টিফিকেট ইস্যু করে দিলেন। একবার ১৯৪৬, একবার ১৯৫৫, একবার ১৯৮৮। এবং একেকবার একেক ধরনের ভিন্নতা ধরা পড়ল সার্টিফিকেটগুলিতে। আচ্ছা এতেও সন্দেহ হবে না ? একটা লোকের একটা মৃত্যু, তার একাধিক সার্টিফিকেট এবং একাধিক ভিন্নতা বা পার্থক্য।

    মৃত্যুর সময় নিয়ে বিভ্রান্তি :-


    ডেথ সার্টিফিকেট নম্বর ১


    নেতাজি গবেষক ডঃ পূরবী রায় জানাচ্ছেন, ১৯৪৬ সালের জুলাই মাসে ডঃ সুরুতাকে দিয়ে একটি ডেথ সার্টিফিকেট লেখানো হয়। সে রিপোর্ট জমা পড়ে ২৫ জুলাই। তাতে লেখা ছিল, বিকেল ৪টের সময় তিনি হাসপাতালে সুভাষচন্দ্র বসুকে অ্যাটেন্ড করেন। এবং সন্ধে ৭টায় তাঁর মৃত্যু হয়। সেই রিপোর্টে নাকি উল্লেখ ছিল, একটি ক্যামফর ইনজেকশন দেওয়ার সঙ্গেসঙ্গে রোগী কোমায় চলে যান, আর তার কিছুপরেই তাঁর মৃত্যু হয়।

    ডেথ সার্টিফিকেট নম্বর ২


    পূরবী রায় আরও জানান, এখানেই শেষ নয়। অক্টোবর মাসে আরও একটি ডেথ সার্টিফিকেট তৈরি করা হয়েছিল। সেই সার্টিফিকেট তৈরি করেছিলেন ডাক্তার তানিয়োশি ইয়োশিমি। তারিখ ছিল ১৯ অক্টোবর, ১৯৪৬। সেখানে ইয়োশিমি জানিয়েছিলেন রোগীর মৃত্যু হয়েছিল রাত ১১টা নাগাদ।

    ডেথ সার্টিফিকেট নম্বর ৩


    আগের পর্বেই জানিয়েছিলাম, মুখার্জি কমিশনের রিপোর্ট অনুযায়ী, ওকারা ইচিরোর নামে ডেথ সার্টিফিকেট ইস্যু করেছিল তাইপেইয়ের ডিরেক্টর অফ ব্যুরো অফিস। নেতাজির নাম বদলে নাকি ওকারা ইচিরো করা হয়। নেতাজির মৃত্যু সম্পর্কে খতিয়ে দেখতে তাইপেই গিয়েছিলেন শ্রী হরিন শাহ (INTUC-র জার্নাল - ইন্ডিয়ান ওয়ার্কারের তৎকালীন সম্পাদক)। তিনি ওই অফিসে গিয়ে নেতাজির মৃত্যু এবং তাঁর শেষকৃত্য সংক্রান্ত রিপোর্ট দেখতে চেয়েছিলেন। তাঁকে ওই অফিস থেকে ওই ডেথ সার্টিফিকেট দেওয়া হয়। সেই সার্টিফিকেট আবার বলছে, ওকারা ইচিরো (পড়ুন নেতাজি) মারা যান ১৯ অগাস্ট, বিকেল ৪ টেয়। মানে বিমানদুর্ঘটনা যে দিন হয় তার পরের দিন। আশ্চর্য !

    দুর্ঘটনার সময় ও হাসপাতালে "চন্দ্র বোসে"র পৌঁছনো নিয়ে বিভ্রান্তি


    বিমান দুর্ঘটনার সময় নিয়েই বিভ্রান্তি। কেউ বলে দুপুরে। এই ২টো - আড়াইটে হবে। আবার কেউ বলে বিকেল ৫টা। কেউ বলে সন্ধে ৬টা। একেকজনের একেক মত। কিন্তু সবচেয়ে আশ্চর্যের যিনি চন্দ্র বোসের চিকিৎসা করেছিলেন, সেই ডঃ ইয়োশিমির নিজেরই ২টি ভিন্ন মত। যেমন ধরুন তিনি যখন এফিডেভিট দিচ্ছেন, সেখানে বলছেন দুর্ঘটনা ঘটার পর আহত যাত্রীদের নিয়ে যখন হাসপাতালে গাড়ি পৌঁছয় তখন বিকেল ৫টা বাজে। আবার এই তথ্য ব্রিটিশ গোয়েন্দা-সংস্থা MI-2 পাঠাচ্ছে তার সদর কার্যালয়ে গোপনে নিজেদের সিল দিয়ে। (ছবি নীচে দেওয়া হল)

    ডঃ ইয়োশিমির বয়ান অনুযায়ী (ব্রিটিশ গুপ্তচর সংস্থা MI-2 সিল দেওয়া) বিকেল পাঁচটার সময় হাসপাতালে এসেছিলেন দুর্ঘটনাগ্রস্ত যাত্রীরা। যাঁদের মধ্যে ছিলেন "চন্দ্র বোস"। এবং তিনি তাঁর চিকিৎসা করেন। এই একই চিকিৎসক ডেথ সার্টিফিকেট ইস্যু করতে গিয়ে লিখছেন সন্ধে ৬টার সময় বিমান দুর্ঘটনা ঘটেছিল।

    ডঃ ইয়োশিমির ইস্যু করা ডেথ সার্টিফিকেট, যেখানে তিনি বলছেন সন্ধে ৬টার সময় বিমান দুর্ঘটনা ঘটেছিল। তাহলে প্রশ্ন হচ্ছে, দুর্ঘটনা ঘটার পর, রানওয়ে দিয়ে দৌড়ে গিয়ে বিমানের যাত্রীদের একে একে উদ্ধার করে, গাড়িতে চাপিয়ে, হাসপাতাল অবধি নিয়ে গিয়ে ডঃ ইয়োশিমির হাতে "চন্দ্র বোস"কে উদ্ধারকারীরা যখন পৌঁছে দিলেন তখন বিকেল ৫টা বাজে। অর্থাৎ ঘড়ির কাঁটা উলটো দিকে ঘুরছিল।

    বিভ্রান্তি ডঃ সুরুতার ডেথ সার্টিফিকেট নিয়েও


    শুধু ইয়োশিমির রিপোর্টেই নয়, ডাক্তার সুরুতা যে ২টি ডেথ সার্টিফিকেট (প্রথমটি ১৯৪৬ ও দ্বিতীয়টি ১৯৫৫) দিয়েছিলেন বলে ডঃ পূরবী রায় জানিয়েছেন, সেগুলিতেও পরস্পরবিরোধী বক্তব্য আছে।

    বিভ্রান্তি ১


    যেমন ১৯৪৬ সালের রিপোর্টে তিনি লিখেছিলেন নেতাজি যে বিমানে ছিলেন সেটি ১০ মিটার উচ্চতা থেকে ভেঙে পড়ে। কিন্তু, ১৯৫৫ সালের রিপোর্টে তিনি বলেন, নেতাজির বিমান ২০ মিটার উচ্চতা থেকে ভেঙে পড়ে।

    নেতাজি গবেষক পূরবী রায়ের বক্তব্য অনুযায়ী, সুরুতা দ্বিতীয় রিপোর্টে লিখছেন, "চন্দ্র বোস"কে যখন হাসপাতালে নিয়ে যাওয়া হয়, তিনি দেখেন তখন বোসের গায়ে থার্ড ডিগ্রি বার্ন ছিল। তাঁর মনে হয়েছিল বাঁচানো সম্ভব নয়। তবে, তিনি সজ্ঞানে ছিলেন। কথাও বলছিলেন খুব আস্তে আস্তে। এরপর হঠাৎই হৃদযন্ত্র কাজ করা বন্ধ করে দেয়। অথচ প্রথম রিপোর্টে সুরুতা নিজেই লিখেছিলেন নেতাজিকে ক্যামফর ইঞ্জেকশন দেওয়া হয়েছিল। যার ফলে তিনি কোমায় চলে যান। দ্বিতীয় রিপোর্টে কিন্তু তার কোনও উল্লেখ নেই। কেন... ?

    বিভ্রান্তি ৩


    বিমান দুর্ঘটনার পর, জাপানি সেনা অফিসারদের নির্দেশে নেতাজির ডেথ সার্টিফিকেট লিখতে বলা হয়েছিল সুরুতাকে। বলা হয়েছিল নাম বদলে দিতে। কারণ নেতাজির নাম গোপন রাখার নাকি নির্দেশ ছিল। সেই মতো সুরুতাও সুভাষ চন্দ্র বোসকে নাকি ওকারা ইচিরো করে দিয়েছিলেন। যা পরে তিনি নিজেই জানাচ্ছেন। কিন্তু প্রশ্ন হচ্ছে, তাঁরই সহ-চিকিৎসক ইয়োশিমির কাছে কেন সেই নির্দেশ ছিল না ? ইয়োশিমি দাবি করেছিলেন, তিনিই তো মরমপট্টি করেছিলেন। তাঁর চোখের সামনেই তো চন্দ্র বোস শেষ নিঃশ্বাস ত্যাগ করেন। তাহলে তাঁর কাছে কেন জাপানি সেনার সেই নির্দেশ যায়নি ? তিনি তো বেশ আত্মবিশ্বাসের সাথেই "চন্দ্র বোসে"র নামে ডেথ সার্টিফিকেট ইস্যু করেছিলেন বলে দাবি করেন।

    অন্য বিভ্রান্তি :-


    তদন্তচলাকালীন তাইহোকু এয়ারপোর্টে সেদিনের দুর্ঘটনার বিবরণ দিয়ে একটি স্কেচ আঁকানো হয়েছিল। স্কেচে দেখা যাচ্ছে, নেতাজিকে নিয়ে বিমানটি ভেঙে পড়ার পর তিনি বেরিয়ে আসেন। এবং একটি জায়গায় দাঁড়িয়ে ছিলেন। প্রশ্ন হচ্ছে ২০ মিটার ( প্রায় ৭০ ফিট) বা আরও সহজ করে বললে প্রায় ৬-তলা বাড়ির উচ্চতা থেকে বিমান ভেঙে নীচে পড়ার পর, নেতাজি নাকি ওখানে দাঁড়িয়েছিলেন ! তাও আবার শরীরে থার্ড ডিগ্রি বার্ন নিয়ে.. !

    ইয়োশিমি কি জাল সার্টিফিকেট তৈরি করেছিলেন ?



    বিচারপতি মুখার্জি কমিশনের রিপোর্ট কিন্তু সেই ইঙ্গিতই দিচ্ছে। মুখার্জি কমিশনের রিপোর্টে উল্লেখ, তানিয়োশি ইয়োশিমিকে জিজ্ঞাসাবাদ করে জানা গিয়েছিল, তিনি চন্দ্র বোসের নামে ডেথ সার্টিফিকেট ইস্যু করেছিলেন। কিন্তু তদন্তে নেমে কমিশন শেষকৃত্য সংক্রান্ত রেজিস্টার পরীক্ষা করে জানতে পারে, নেতাজি তো দূর অস্ত, তাঁর নিহত সহযাত্রীদের নামও সেই রেজিস্টারে ছিল না।

    এখন প্রশ্ন হল দুর্ঘটনায় মৃত চন্দ্র বোসের নাম গোপনের প্রয়োজন ছিল যদি ধরেও নেওয়া যায়, মৃত জাপানিদের নাম গোপনের প্রয়োজন কোথায় ? নাকি আর কেউ মরেননি ওই ঘটনায়। কিন্তু সরকারি তথ্য বলছে আরও কয়েক জন মারা গিয়েছিলেন ওই দুর্ঘটনায়। তাঁদের কী হল ?

    শুধু তাই নয়, ইয়োশিমি যে সত্যি বলছেন না তার আরও একটি সূত্র মেলে। ইয়োশিমির কাছ থেকে তিনি নেতাজির ডেথ সার্টিফিকেট পেয়েছেন বলে ডঃ পূরবী রায়কে জানিয়েছিলেন শিকাজ়ু শিমোদা। তার প্রেক্ষিতে কমিশনের পক্ষ থেকে যখন ইয়োশিমির কাছে জানতে চাওয়া হয়, তিনি শিমোদাকে চেনেন ? ইয়োশিমি বলেন, "না।"পরে তাঁকে সার্টিফিকেটের বিষয়টি জানানো হলে তিনি বলেন, ওটি একটি ফোটোকপি। এরপর তাঁকে প্রশ্ন করা হয় কী কারণে ওই ডেথ-সার্টিফিকেট তিনি ইস্যু করেছিলেন ? তার উত্তরে ইয়োশিমি বলেন, তাঁর নাকি মনে পড়ছে না। সবকিছু খতিয়ে দেখে মুখার্জি কমিশন মনে করে, ইয়োশিমি সত্যি বলছেন না। ওই ডেথ সার্টিফিকেট ভুয়ো হতে পারে।

    উপরিউক্ত বিষয়গুলি পড়লে একটা বিষয় স্পষ্ট করে বলা যায়, নেতাজির কোনও নির্দিষ্ট ডেথ সার্টিফিকেট ছিল না। সময়ে সময়ে তাঁর ডেথ সার্টিফিকেট তৈরি করানো হয়েছিল। বলছেন ডঃ পূরবী রায়। কিন্তু কেন...?

    Article 334 - Reservation of seats and special representation to cease after seventy years.?Notwithstanding anything in the foregoing provisions of this Part, the provisions of this Constitution relating to? (a) the reservation of seats for the Scheduled Castes and the Scheduled Tribes in the House of the People and in the Legislative Assemblies of the States; and (b) the representation of the Anglo-Indian community in the House of the People and in the Legislative Assemblies of the States by nomination, shall cease to have effect on the expiration of a period of ten years from the commencement of this Constitution: 

    8th, 23th, 45th, 62th,79th,95th, Amendment in Article 334 of Constitution of India for the words "ten years" the words "twenty years"(8th), thirty year(23th), fourty years (45th), fifty years(62th) , sixty years (79th), seventy years (95th) respectively shall be substituted.

    Slowly and Steadily the Indian Intellectual are getting it. What is the real Problem of Nepal

    Not really, this is not a correct analysis. To begin with there is no Nepalese analyst included in the discussion. This is merely Indian attempt at promoting Nepalese of Indian origin. It is not about inclusive politics of all Nepalese subgroups. All our political parties are aware of the imbalances and marginalization of many of our Nepalese sub-groups. They are working in their own ways, and through democratic process. You may see in the 'Samanupatic' or both President and Vice-President being Madheshi, or Speaker being a Limbu. 
    But the Jatiya Sanghiyata, or Ethnicity based Federal system is not the demand of people. There must be referendum for it. It came about due to Maoists strategy of fomenting Jatiya fights to impose Communism against Democracy. Unfortunately, it is aided by Euro-Churches to facilitate conversions and India to control internal affairs of Nepal. Is not it true that Maoists were supported by Indian?
    Exactly, how Janajatis or Madheshis are marginalized? Which of our constitutions (Panchayat, 1990, Interim) discriminates? On the contrary all of them are distinctly against any kind of discrimination. Nepal is not made of majority and minority communities. We all are minorities, including Bahuns and Chhetris. Yes, some are much ahead and some are marginalized. But then, the process of including all does not come from Sanghiyata, but from - a. education, b. job / business diversity, and c. inclusive politics.
    Does India use their own recipe? What about Gorkhaland movement? When in fact, the Hill Gorkhas and Plains Bengalese are much more distinct than in Nepal. Indian UP has over 200 million population, as compared to Nepal with about 25 millions (current 7 states). In that proportion, UP should be divided into over 55 states. Not to forget that India begun as over 500 rajyas in 1947, and Nepal has been 1 over 2 centuries.
    The real issue is Nepalese people's wish. The issue of federal states 'Sanghiyata' was never discussed in the public. It is imposed through Maoists terror and foreign meddling. The issue must be discussed for public information and referendum conducted for mandate. Let informed Nepalese citizens decide. Otherwise, it remains imposed, without mandate and a treason against people.

    URGENT CALL: Protest against deteriorating health situation in Delhi

    Keeping in mind the recent tragic dengue deaths of two children in which private hospitals had refused them admission, an urgent meeting of public health groups, activists and concerned individuals was called on 17th September 2015. It is the need of the hour to collectively oppose the deteriorating health system in the city and
     build pressure through direct action since there is much anger and frustration amongst general public against denial of services, expensive treatment and a host of other grievances.

    India has one of the largest privatized health system where 85% of expenditure on health is borne by individuals. Health is a vital issue because it is a matter of life and survival. The Delhi Nursing Home Act 1953 and Clinical Establishments Act 2010 are limited in their scope and have grave limitations in ensuring universal access to healthcare or even minimum human rights. Private hospitals are indulging in criminal activity with some even deploying agents to dupe the poor. 

    There has been a dengue outbreak in the city every time this year for more than a decade and various government agencies are only passing the buck without addressing its root causes. There are many unreported deaths. Even though the Delhi govt. has taken much credit for the increased health budget, its benefits are yet to be seen. There is a pressing need to bring the issue into the public arena, only public accountability can bring about the goal of right to health for all. 

    Calling all organisations and individuals who have been a victim to the private healthcare racket and crumbling public health system to join the protest on 23rd at Delhi Secretariat ITO and demand affordable healthcare for all.

    बीते सप्ताह दक्षिणी दिल्ली में निजी अस्पतालों द्वारा दो डेंगू पीड़ित बच्चों को अस्पताल में भर्ती लेने से मन कर दिया गया और अंतत: दोनों ही बच्चे काल के गाल में समा गए. इस प्रकार नीजी अस्पतालों द्वारा गरीब मरीजों को भर्ती लेने से किया जाने वाले अपराधिक इन्कार व सार्वजनिक स्वास्थ व्यवस्था के बिगड़ते हालातों ने दिल्ली शहर को चलाने वाले गरीबों के स्वास्थ को बुरी तरह प्रभावित किया है. इन तमाम मुद्दों पर चर्चा करने के लिए जन स्वास्थ से सरोकार रखने वाले सामजिक समूहों, राजनितिक कार्यकर्ताओं और संवेदनशील लोगों की एक आवश्यक बैठक 17 सितम्बर 2015 को बुलाई गई थी, जिसमे उपस्थित सभी लोगों ने महसूस किया कि दिल्ली में डेंगू एक महामारी का रूप धारण करती जा रही और इससे निपटने के लिए सार्वजनिक स्वास्थ सुविधाओं का अभाव, निजी अस्पतालों की मनमानी व खर्चीले इलाज ने आम लोगों के अन्दर गुस्से व जन-विच्छोभ को जन्म दिया है. ऐसे में आज के समय की जरुरत है कि दिल्ली में डेंगू से प्रभावित व इससे चिंतित लोग, संगठन व संस्थाएं एक साथ आयें और अपने संयुक्त संघर्ष के ज़रिये सार्वजनिक स्वास्थ व्यस्था को बेहतर करने तथा निजी अस्पतालों की मनमानी पर रोक लगाने के लिए दिल्ली सरकार पर दबाव कायम करें.


    यद्यपि कि स्वास्थ का प्रश्न जीवन-मरण के प्रश्न से जुड़ा होता है फिरभी भारत में निजी स्वास्थ सुविधाओं का बड़े पैमाने पर निजीकारण किया जा चूका है. और आज इस देश में इलाज का 85% खर्च मरीजों द्वारा स्वयं उठाया जाता है. दिल्ली के अन्दर एक तरफ स्वास्थ के क्षेत्र में लागू दो अधिनियम "दिल्ली नर्सिंग होम अधिनियम, 1953 एवं नैदानिक स्थापन (रजिस्ट्रीकरण व विनियमन) अधिनियम, 2010"गरीबों को स्वास्थ सुविधाएं मुहैय्या कराने के मामले में काफी सिमित दायरा रखते हैं. तथा इन अधिनियमों की सीमाएं स्वास्थ तक सबकी पहुँच व न्यूनतम मानवाधिकारों को सुनिश्चित करने में भी बाध्यकारी साबित हो रही हैं. दूसरी तरफ नीजी अस्पताल मरीजों को अपने यहाँ खींच लाने के लिए एजेंटों की तैनाती किये हुए हैं और इलाज के नाम पर आम जनता से पैसा ऐंठने के लिए अपराधिक कृत्यों में संलिप्त हैं.


    पिछले पांच वर्षों से हर साल बारिश के मौसम में मच्छर जनित वीमारी "डेंगू"अपना पैर पसारता है और सैकड़ों लोगों की जान ले लेता है. साथ ही साथ इस बिमारी से मरने वाले लोगों की एक  अच्छी खासी तादाद सार्वजनिक नहीं हो पाती है. लेकिन सरकारी एजेंसियां इसके मूल कारण पर काम कर इसका स्थाई समाधान करने के बजाय इस बिमारी को रोकने का सतही उपाय करते हुए एक दुसरे पर आरोप-प्रत्यारोप लगाने में मशगूल हो जाती हैं. वर्तमान में दिल्ली सरकार स्वयं के द्वारा स्वास्थ बजट बढ़ा देने का ढिंढोरा पीटने में लगी हुई है लेकिन इस डेंगू संकट में उस बढ़े हुए बजट का साकारात्मक असर कहीं भी दिखाई नहीं दे रहा है. इसलिए ऐसे में यह जरुरी है कि इन तमाम सच्चाईयों को जनता के बीच ले जाया जाय और जन स्वस्थ के मुद्दे पर सरकारों को जनता के प्रति जवाबदेह बनाया जाय. जनस्वास्थ के मुद्दे पर सरकारों को जनता के प्रति जवाबदेह बनाकर के ही सबके लिए स्वस्थ के अधिकार की गारंटी की जा सकती है.


    इसलिए सार्वजनिक स्वस्थ सेवा के चरमराने व निजी स्वास्थ सेवा के गोरख धंधे के शिकार व्यक्तियों व इससे चिंतित संगठनों व संस्थाओं से अपील है कि इसके विरोध में 23 सितम्बर 2015 को दिल्ली सचिवालय पर हो रहे विरोध प्रदर्शन में शामिल होकर सबके लिए स्वस्थ अधिकार के गारंटी की मांग बुलंद करें.

    Meerut: A 52-year-old Dalit man was found hanging from a tree near a local temple on Monday morning in Muzaffarnagar's Shernagar village

    "We found the man hanging from a tree. He only goes by his first name. Sheetal was a vegetable vendor who lost his wife around 15 years ago. His family members told us that he had gone to sleep after dinner on Sunday night. They said there was nothing amiss about his behavior that night. He must have slipped out of his house when everybody was asleep," said Arun Kumar Singh, station officer, Nai Mandi police station. 

    The SO said prima facie it appeared to be a suicide case. "We didn't find any signs of struggle so we have reason to believe it was suicide. However, his family members said he did not have any cause to take his life. They said they do not suspect anybody and Sheetal did not have any enemies in the village. We enquired about his financial condition and found it to be more or less stable. Though he made a living by selling vegetables on a cart, he was not under any major debt. No complaint or FIR has been filed in the case so far because the postmortem report has not come. Once we have the report, we can proceed with the case," he said.

    Police have registered a case against one person in connection with the killing of a Dalit man in the district. 

    Dham Singh (40) was stabbed to death by unidentified men over collecting grass at Gadla village under Bhopa police station here last evening, police said. 

    A case has been registered against Arvind Tyagi in this connection, SHO, Promod Pawar said, adding, efforts were on to nab him.

    Congress on Monday launched a hard-hitting attack on BJP-RSS and Prime Minister Narendra Modi over Mohan Bhagwat's call for review of reservation policy, saying it was a "manifestation of anti-poor mindset".


    The party's reaction came against the backdrop of two of its leaders -- Manish Tewari and Jitin Prasada -- criticising the existing quota policy.


    Speaking to reporters, Congress communication department chief Randeep Surjewala said, "RSS-BJP combine continues to spread polarising divisive agenda to undermine the rights of deprived and the underprivileged, particularly the scheduled castes, scheduled tribes and other backward classes.


    "The latest interview of RSS Sarsanghchalak Mohan Bhagwat in RSS mouthpiece Organiser calling the reservation principles enshrined in the Constitution as 'politicisation' as also for a review of reservation for the scheduled castes, scheduled tribes and backward classes is a manifestation of anti-poor mind set espoused by RSS and now by BJP since pre-Independence days," he said.


    In an interview to RSS mouthpiece Organiser, Bhagwat had pitched for a review of the reservation policy, contending it has been used for political ends and suggesting setting up of an apolitical committee to examine who needs the facility and for how long.


    Congress is contesting the Assembly elections in Bihar in alliance with Lalu Prasad's RJD and Chief Minister Nitish Kumar's JD-U, which owe their origin to Mandal politics. Both the parties have taken serious umbrage to Bhagwat's remarks.


    Surjewal's late night statement that the party was committed to the issue of reservation came even as senior party leaders Tewari and Prasada voiced their opposition to the current caste-based quota.


    "Congress introduced the system of reservation for scheduled castes, scheduled tribes in government employment, educational institutions as well as elected bodies as part of affirmative action enshrined in India's Constitution.


    "It is also Congress that introduced reservation for OBCs in government employment and educational institutions in the mid-1990s and later. The party is of the firm opinion that affirmative action in favour of scheduled castes, scheduled tribes and OBCs must continue in order to deal with the discrimination imposed by centuries of subjugation and oppression," Surjewala said.


    Accusing Modi of pursuing "anti-dalit, anti-ST ideology, policies and decisions" since the time he was Gujarat Chief Minister, Surjewala cited purported references from his books as well as decisions made by him.


    "In November, 2007, Modi authored a book Karmyog in which he stated that he does not believe that they (Valmikis) were doing this job to sustain their livelihood. He argued that had this been so, they would not have continued with this type of work generation after generation. He said and that at some point of time, somebody must have got the enlightenment that it is their (Valmiki's) duty to work for the happiness of the entire society and the gods," Surjewala said.


    The Congress spokesperson further alleged that on April 30, 2010 during a release of his book titled 'Samajik Samrashta', Modi drew parallels between "mentally-retarded children and dalits".


    "He (Modi) stated that just as people give special treatment to mentally-retarded children when they visit their houses, the dalits, too, ought to be treated the same way," Surjewala alleged.


    Noting that as per the orders of Planning Commission each state is required to have a Scheduled Caste Sub Plan (SCSP) as also Scheduled Tribe Sub Plan (STSP), he said Modi as Gujarat CM did not hold a meeting of SCST or STSP for 10 years since 2004 up to the date of demitting office.


    Surjewala also alleged that inter-district filling of vacancies under reserved categories was not allowed in Gujarat during Modi's tenure, "denying lakhs of job opportunities to dalits and backward classes which went unfilled".


    Claiming that Congress believes in true equality of opportunity, Surjewala recalled that in its 2009 Lok Sabha Election Manifesto, the party had pledged to explore carving out reservation for 'economically weaker sections of all communities' without prejudice to existing reservation for scheduled castes, scheduled tribes and OBCs.


    "In the 2014 Lok Sabha Election Manifesto, the party pledge said that the Congress was committed to finding a way forward for introducing reservation in education and employment for economically weaker sections without in any way affecting existing reservation for scheduled castes, scheduled tribes and other backward classes," he said.

    Surjewals also cited a statement by Congress President Sonia Gandhi in January, 2014 in which she had said that the empowerment of the SC/ST and OBCs has been an "article of faith" with the Congress.

    The Schedule caste officers and employees protesting against their reversion in service following the order of the Supreme Court have given a call for observing the 83rd anniversary of the RsPoona Pact' as the black day on September 24. The Poona Pact refers to an agreement between Dr. Babasaheb Ambedkar and Mahatma Gandhi signed on 24 September 1932 at Yerwada Central Jail in Pune.


    The RsAarakshan bachao sanghhrash samiti', spearheading the campaign for  restoration of the facility of reservation in promotion   for the SC employees said September 24 will be observed as black  day to mobilize the public opinion in favor of their cause. 


    The convener of the samiti Avadesh Verma said here on Monday that the black day will be organized to protest against indifference of the NDA government at the Center towards the passage of the Constitution (117th) amendment) bill and the persecution of the SC officers and employees by the Samajwadi party government under the cover of the compliance of the Supreme court order. The Apex court in April 2012 had quashed the Legislation providing for the reservation in promotion for the SC/ST employees. The apex court later fixed September 15 as the deadline for the compliance of its order passed in 2012. He said the constitution amendment bill was passed by the Rajya sabha during the previous UPA government. The NDA has clear majority in Lok Sabha and the government can get the bill passed easily but nothing has been done so far.


    Over 8: Lakh schedule caste employees across the state will assemble at district headquarters and stage protest.   The organization of the Sc employees is already running  a campaign RsRsChupee Todo' to mount pressure on the MLAs of  the ruling Samajwadi Party  and MPs of the BJP from the  reserved seats.  The SC MLAs of the SP and MPs of the BJP from the BJP are maintaining silence on this issue.

    To appease Dalits, MLAs want job quota enforced

    The issue of jobs for Dalits, who comprise one-third of state's population, dominated the Question Hour today with Assembly Speaker Charanjit Singh Atwal asking the government to ensure the reservation policy was followed in contractual/outsourced jobs as well.


    The matter was raised by Akali MLA Justice Nirmal Singh (retd). Intervening in arguments between legislators over the issue of ignoring reservation for SCs/BCs, the Speaker told Deputy Chief Minister Sukhbir Badal that reservation policy was not being followed in contractual and outsourced jobs.


    He asked Sukhbir to find a way out to ensure its proper implementation.


    The Deputy CM, in a response to Congress MLA Charanjit Channi's allegation of the government being anti-Dalit, claimed that the government was committed to the welfare of Dalits. He said more MLAs from reserved classes were in the Akali Dal which proved that the Dalit population favoured them.


    With about 32 per cent of state population being Dalits, both Akalis and Congress MLAs strongly raised issues concerning them. Justice Nirmal Singh took on Transport Minister Ajit Singh Kohar and Health Minister Surjit Kumar Jyani over the recruitment of Class III and IV employees.


    Nirmal Singh, who is also chairman of the Welfare of SC/BC Organisation, said the mandatory representation for SCs/BCs was not provided in contractual and outsourced jobs in both transport and health sectors.


    Kohar said as per reservation policy, 675 posts for SCs and 324 for BCs were kept reserved, of which only 358 SC employees and 204 BC employees were found eligible.


    When Jyani said Class IV jobs were outsourced, Nirmal Singh pointed out that the government had to follow the reservation policy in this category also. He argued that the person or company to whom the jobs were outsourced had a contract with the government and hence, liable to follow the reservation policy. The Assembly could not take up another question on Dalits.


    Govt ducks queries on sensitive issues

    Chandigarh: The SAD-BJP government on Monday managed to duck queries on certain sensitive issues such as farmer suicides, illegal blue card holders and plots for homeless Dalits by seeking time to submit the reply. While Food and Supply Minister Adaish Partap Kairon sought time to reply to a question by his own party MLA Gobind Singh Longowal on the cancellation of blue card holders in Dhuri Assembly segment, Revenue Minister Bikram Majithia sought time for replying on the number of suicides cases in the farm sector from March, 2012 till date. Congress MLA Ajaib Singh Bhatti raised the issue of suicides. He also sought information on compensation paid and the existing policy. He and other party MLAs were livid when they were informed by the Speaker that the minister concerned had sought time. The Congress MLAs alleged the government was avoiding the issues as the current Assembly session was of a short duration, eight days with four effective sittings. — TNS

    A Primary School That Runs under Tree for Five Yrs

    BARIPADA: Even as efforts are being made by the State Government to check the dropout rate of school students, loopholes in the education schemes have virtually derailed the process.


    Among the handicaps faced by the schools, lack of infrastructure stands out as a prominent reason of the failure of the schemes. Kakrisul Project Primary School in Kuliana block of Mayurbhanj district is one such example. Located nearly 17 km from the Collector's office at Baripada, students of the school learn their lessons under a tree in absence of a permanent structure.

    A revenue village, Kakrisul is dominated by Scheduled Caste (SC) community and has a population of nearly 150. None of the villagers has cleared Matriculation till date.


    Opened in 2010, the school was a ray of hope for the villagers who hoped to educate their children. Besides own building, the school lacks other basic facilities like drinking water, electricity and even a toilet. The mid-day meal is not served to students.


    The school, having Classes I to IV, has been functioning under a tree for the last five years. Two teachers have been appointed for 14 students including five girls.


    Though Mayurbhanj Collector Rajesh Pravakar Patil has been awarded by the Centre for his efforts to make the tribal dominated district free from school dropouts, insensitivity on the part of the authorities concerned has deprived the school of a permanent structure.


    While Sports Minister Sudam Mrandi is elected from Kuliana constituency, Lok Sabha MP Ramachandra Hansdah has adopted the village for its all round development. But, with Hansdah in judicial custody in connection with a chit fund case, development of the village has been relegated to the background.


    Villagers lamented that neither district administration nor the officials of Sarva Siksha Abhiyan (SSA) have visited the school to take stock of the situation.


    Headmistress Jharana Dandapat said chairs have been provided by villagers. "Attendance is taken regularly and I keep the registers along with other important office files in my house. The school remains closed during rainy days due to water-logging around the tree," she said. The irony is that though the villagers are ready to provide land, the administration is yet to take any step for construction of the building. 


    District Project Coordinator of SSA Diganta Routray said he was unaware of the condition of the new primary school but assured to do the needful for construction of a building.

    "We have been facing untouchability, atrocity, boycott and gang-rape – at the root of all these problems is the Hinduwadi system. While living in this system, no friend from outside helps us saying it is our internal issue. We have thought that if we have to save our future, if not present, then we will have to go out of this system," said Satish Kajla wearing a white Muslim skullcap. He is just one of the victims of the rigid Hindu caste system which, to this day, seeks to vehemently oppress those belonging to the lowest of castes – the Dalits. Satish hails from Haryana, where a majority of the Dalits, tired of being forced to live in seclusion by the upper caste Hindus, have chosen to embrace Islam instead. These Muslim Dalits are part of a growing number of the lower caste Hindus who have converted to other religions such as Christianity, Islam, Buddhism and Sikhism in order to escape the shackles of the caste system that was an integral part of the Hindu social order. Although given legal sanction by the Indian Constitution, which prohibits discrimination on the basis of caste and directs equal treatment, in most communities of Bihar, Uttar Pradesh and Haryana, caste system- and the ensuing discrimination for the Dalits – is commonplace, and little can be done to regulate it.


    The Dalit-Muslim Identity

    The term in itself seems to be a contradiction, as there is no concept of a caste system in Islam. Yet the group is slowly seeking to form an identity of its very own, with some Dalits – seen as the lowest of the low in the Hindu caste system, and traditionally performing tasks that rendered them 'impure'– converting to other faiths either as a mark of protest against the oppression and acts of violence faced by them due to members of the upper castes, and many more to secure hope for the future, where they will no longer be treated as inferior. With some considering Islam as "a great example of equality in the world", they became Muslims, hence crafting the term 'Dalit Muslims'.

    However, conversion comes with its own set of difficulties – it is by no means an escape. A majority Muslims in the aforementioned states are low caste converts, and these prejudices of class apparently transcend religions. Muslims are divided into ashrafs – the 'nobles' and the ajlafs– the 'low born', to say nothing of the 'jatis' or sub-communities present within these.

    Yoginder Sikand, an Indian writer and academic, says, "As among the Hindus, the various jatis among the ajlaf Muslims maintain a strong sense of jati identity. The emergence of democratic politics is, however, bringing about a radical change in the manner in which this sense of identity is articulated. Aware of the importance of numbers in order to acquire political power and the economic benefits that accrue from it, the Dalit movement has sought to establish a wider sense of Dalit identity that transcends inter-caste and inter-religious divisions and differences among the 'lower' caste majority. This wider Dalit identity does not seek to deny individual jati identities. Rather, it takes them into account but seeks to subsume them within the wider collective Dalit identity, based on a common history of suffering as well as common racial origins as indigenous people." Hence, there is the emergence of a new 'Dalit Muslim' identity, seeking to bring all the 'lower' caste Muslims under one umbrella, defined by their common identity as Muslim as well as Dalit.

    The conditions of Dalit Muslims are worrisome – with respect to poverty, they are unquestionably amongst the worst off Dalits, not even featuring in the affluent group for urban India. In terms of occupation in the urban sector, they are in the bottom slot, with the highest proportion in the 'casual labour' and the lowest proportion in the 'regular wage' category, and educationally too, they remain lacking- worst off in rural India in terms of illiteracy, but ironically, this is matched by the levels of illiteracy among Dalit Hindus. In short, even when they convert to a different religion, in terms of educational benefits and other forms of help, they remain Dalits first, and Muslims second – a combination ill-suited for survival in India's hierarchy where wealthy, upper caste Hindus take precedence.

    The Ghar Waapsi Philosophy And The Anti-Conversion Laws: The Difficulties Faced In Conversion

    Often, converts have to face violent protests from people who do not want them to leave the religion. This now has legal validation – hence the anti-conversion laws in various states that have already been enacted, and the zealous Hindus who have now propounded the concept of 'ghar waapsi', where, as a Vishv Hindu Parishad party member puts it, "We are bringing people back into the Hindu fold, as it is their original religion."

    This is being done under the guise of the Anti-Conversion Law, which forbids conversion to any other religion unless the head of the district administration is duly notified. Supposedly to protect people from forced conversion- conversion under fraud and inducement, the law imposes a double penalty on people from lower castes wishing to convert, if found guilty of the above. Dalit Christian and Dalit Muslim converts, when arrested under Anti-Conversion laws, are subject to a 'purification' or a cleansing and made to 'reconvert' to their original religion. The ideas imposed by this programme – that of being of an 'original' or 'authentic' lineage to belong to the land go directly against the secular policies of our Constitution.

    Unsurprisingly, these laws seem to be evoked only when the people involved seek to move out of Hinduism. Even more unsurprisingly, while the administration stringently enforces laws in Odisha, Madhya Pradesh, Gujarat, Himachal Pradesh, Chhattisgarh, it does not raise the issue of 'reconversion' even once. Added to this the violent reactions of the community in which converts are born into (in the community's pursuit of detainment of those who want to convert, some are even killed), and the difficulties seem to be never-ending.


    The Disadvantages Of Conversion: Reservation Act And Positive Discrimination

    Even if they do manage to avoid getting arrested on the basis of such anti-conversion laws, the Dalit Muslim converts enter into identity doldrums, where even though they form a minority, and that too a highly disadvantaged one, they are no longer eligible for the positive discrimination extended to Scheduled Castes by way of the Reservation Act.

    As a result of wealthy upper-caste Hindus converting to Islam, the concept of class entered the previously class free concept of Islam – thus the Dalit Muslim converts enter a social order that is little different from the one they left behind. Although different in nomenclature, it seeks to do the same thing in principle, which is the continued oppression of the lower class. The Government seems to be of little help, as it fails to recognize Dalit Muslims under Scheduled Caste; effectively cutting off any positive discrimination that might have helped them secure jobs and other opportunities had they not been converts.

    Under the Reservation Act, the socially and economically backward classes of society are given advantages in lieu of recognizing years of cruelty, yet "the protection includes Sikhs and Jains, and Buddhists, but it doesn't include Christians and Muslims, so what happens is that they get excluded from those – the quotas for SCs [Scheduled Castes]," says Meenakshi Ganguly, South Asia director for Human Rights Watch. Since the Dalit Muslims seem to be on the same economic and social level, there is little reason for them to not get the same benefits. When these are denied, they are forced to choose between being socially oppressed or having the opportunity to be an a level equal to the rest of the society, and that is a choice no one should ever have to make in a fair legal system.

    A day after right-wing outfit Sri Rama Sene founder Pramod Muthalik said that he will sue Kannada writers for naming his organization as a conspirator behind the killing of renowned writer and rationalist Dr MM Kalburgi, its state convener has now threatened to cut off the tongues of writers if they continue to "insult" Hindu gods.

    Siddalinga Swami told reporters in Kalburgi in north Karnataka that Hindus were hurt by the comments of the litterateurs like Professor KS Bhagwan and Chandrashekhar Patil, who allegedly spoke ill of Hindu epics, the Ramayana and the Mahabharata.

    "The epics are followed by millions of Hindus as sacred texts. People will not tolerate the belittling of Ramayana characters, who are worshipped. They will cut off the tongues of writers if they do not stop insulting Hindu gods," he said.

    Recently, in an interview to a Kannada TV channel, Professor Bhagwan had said that Rama and Krishna should not be worshipped because they did not uphold human values. His statements had led to a furore.

    Swami's threats are likely to land the Sri Rama Sene in trouble again even as Muthalik is trying to maintain a low profile by controlling his activists. On Sunday, the police had arrested a Sri Rama Sene leader for threatening writers with dire consequences. Muthalik had disowned the leader and apologized to the writers. However, he had also sought an apology from the writers for allegedly defaming his organization.

    It is to be seen now if Muthalik will disown Siddalinga Swami for his comments on the writers. The police said they are keeping an eye on Sri Rama Sene leaders for their inflammatory public speeches.

    International courts and refugees

    Behind Europe's policy of saving refugees at sea and bringing them in for asylum lies a controversial 2012 decision by the European Court of Human Rights

    If you're as cynical as I am about Europe's impulse to control migration from Arab lands, you might have the same question that I did: Why don't European navies interdict the refugees at sea, and send them back to Libya or Turkey or wherever they're coming from? It might seem cruel, but after all, that's what the US did with Haitian boat people in the 1990s and what Australia still does with asylum-seekers.

    You might think the answer is that the Europeans are just more softhearted than the Americans or Australians, but it turns out the answer isn't that simple. Behind Europe's policy of saving refugees at sea and bringing them in for processing and asylum lies a controversial 2012 decision by the European Court of .

    Motivated by humanitarian instincts, and decided before Syria's collapse put the flow of Arab refugees into overdrive, the decision is a model of how law can affect policy. It's also a model of the risks when international courts make decisions that have huge consequences for real-world policy. I was struck to learn from an article by scholar Jill Goldenziel that, before the 2012 decision, while Muammar Gaddafi's regime was still standing, Italy had an agreement with the dictator that it would stop boats of refugees on sea and send them straight back to Libya. On the surface, the arrangement sounds ugly, and indeed, Human Rights Watch led the international human rights community in criticizing it.

    What changed since the time of the Libya deal was the European court's 2012 decision in Hirsi Jamaa vs. Italy. In that case, Somali and Eritrean nationals argued that Italy's policy violated the most important provision of the Geneva Convention relating to the Status of Refugees. Article 33 of the convention says that no signatory may "expel or return ('refouler') a refugee in any manner whatsoever to the frontiers of territories where his life or freedom would be threatened on account of his race, , nationality, membership of a particular social group or political opinion". This right is known as "non-refoulement".

    In the Hirsi Jamaa case, Italy said Article 33 didn't apply to a rescue mission that took place in international waters. The fleeing East Africans were never in Italy, after all, so Italy's obligation not to send them home never kicked in.

    The US  made the same argument successfully to the US Supreme Court in the 1993 case of Sale vs. Haitian Centers Council. In an 8-1 decision, the court held that the domestic US law implementing the refugee convention didn't apply to Haitians who were intercepted at sea by the US Navy and then held in Guantanamo Bay, Cuba.

    The unsuccessful case for the Haitians was argued by Harold Hongju Koh, who later became a state department official in both the Bill Clinton and Barack Obama administrations. Koh did, however, induce justice Harry Blackmun, for whom he'd earlier clerked, to write a heartfelt dissent. In the dissent, Blackmun, who was given to moving rhetoric on behalf of victims, ended by saying that the refugees had raised "a modest plea, vindicated by the Treaty and the statute. We should not close our ears to it".

    The European Court of Human Rights was apparently touched by Blackmun's rhetoric, which it quoted at the conclusion of its opinion. It held that Italy's naval vessels were part of Italy, and that the refugee treaty's obligation not to send refugees back home applied the moment the Italian navy took control of the refugees' ships. It concluded by banning Italy's strategy of pushback.

    Unlike the US Supreme Court or the Australian High Court, which reached its own similar conclusion in 2000, the European court isn't a national body interpreting the law for a single country. This supranational body effectively made policy for its 47 members by holding that rescue efforts at sea automatically trigger the obligation to process refugees for asylum. Of course, politics matters, too. And, of course, many refugees are now coming over land and sneaking into European countries, where non-refoulement would ordinarily apply.

    But it seems almost inconceivable that European politicians would be treating the immigration flow at sea as inevitable if the legal position were different. There would be calls for pushback—and a policy discussion about whether such an approach would be morally justified. Now, the policy debate is more limited— and it remains to be seen what the consequences will be for Europe, or those desperate to get there. Bloomberg

    सचमुच, मैं एक अँधेरे वक़्त में जीता हूँ !
    सीधा शब्द निर्बोध हैं। बिना शिकन पडा माथा
    लापरवाही का निशान। हँसने वाले को
    ख़ौफ़नाक ख़बर
    अभी तक बस मिली नहीं है।
    कैसा है ये वक़्त, कि
    पेड़ों की बातें करना लगभग ज़ुर्म है
    क्योंकि उसमें कितनी ही दरिंदगियों पर ख़ामोशी शामिल है !
    बेफ़िक्र सड़क के उस पार जानेवाला
    अपने दोस्तों की पहुँच से बाहर तो नहीं चला गया
    जो मुसीबतज़दा हैं?
    यह सच है : कमा लेता हूँ अपनी रोटी अभी तक
    पर यकीन मानो : यह सिर्फ़ संयोग है। चाहे
    कुछ भी करूँ, मेरा हक़ नहीं बनता कि छक कर पेट भरूँ।
    संयोग से बच गया हूँ। (किस्मत बिगड़े,
    तो कहीं का न रहूँ)
    मुझसे कहा जाता है : तुम खाओ-पीओ ! ख़ुश रहो कि
    ये तुम्हें नसीब हैं।
    पर मैं कैसे खाऊँ, कैसे पीऊँ, जबकि
    अपना हर कौर किसी भूखे से छीनता हूँ, और
    मेरे पानी के गिलास के लिए कोई प्यासा तड़प रहा हो ?
    फिर भी मैं खाता हूँ और पीता हूँ।
    चाव से मैं ज्ञानी बना होता
    पुरानी पोथियों में लिखा है, ज्ञानी क्या होता है :
    दुनिया के झगड़े से अलग रहना और अपना थोड़ा सा वक़्त
    बिना डर के गुजार लेना
    हिंसा के बिना भी निभा लेना
    बुराई का जवाब भलाई से देना
    अपने अरमान पूरा न करना, बल्कि उन्हें भूल जाना
    ये समझे जाते ज्ञानी के तौर-तरीके।
    यह सब मुझसे नहीं होता :
    सचमुच, मैं एक अँधेरे वक़्त में जीता हूँ!
