র্যাংকিং ওয়েব অব ইউনিভার্সিটির তালিকায় বাংলাদেশের বিশ্ববিদ্যালয়গুলোর মধ্যে সবচেয়ে এগিয়ে রয়েছে বাংলাদেশ ইউনিভার্সিটি অব ইঞ্জিনিয়ারিং অ্যান্ড টেকনোলজি (বুয়েট)। বিশ্ব র্যাংকিংয়ে এর অবস্থান ২১০৬ এ। আর দেশের দ্বিতীয় স্থানে থাকা ঢাকা বিশ্ববিদ্যালয় রয়েছে বিশ্বের ২৪৬২তম স্থানে। এরপরেই রয়েছে বেসরকারি বিশ্ববিদ্যালয় ব্র্যাক। দেশের সেরা ১০ এর তালিকার নবম স্থানে আছে আরেকটি বেসরকারি বিশ্ববিদ্যালয় ইন্ডিপেন্ডেন্ট ইউনিভার্সিটি বাংলাদেশ।

বিএনপির একাধিক সূত্র জানায়, দল সমর্থক বুদ্ধিজীবীরা নানা সময়ে বিএনপিকে পরামর্শ দিয়ে থাকেন। কিন্তু প্রতিষ্ঠার ৩৭ বছর হয়ে গেলেও দলের নিজস্ব কোনো গবেষণা সেল নেই। এই থিংক ট্যাংক গবেষণাধর্মী কাজ করবে। বিএনপির মহাসচিবের সঙ্গে পরামর্শ করে সমসাময়িক জাতীয় রাজনীতি ও বিভিন্ন ইস্যু নিয়ে বিশ্লেষণ, পর্যবেক্ষণ তুলে ধরার পাশাপাশি দলের সম্ভাব্য করণীয় ঠিক করতে প্রয়োজনীয় পরামর্শ দেবে এই থিংক ট্যাংক। জাতীয় রাজনীতির বাইরে উপমহাদেশ ও আন্তর্জাতিক রাজনীতির গতি-প্রকৃতি বিশ্লেষণ করা, বিএনপির অবস্থান ও বক্তব্য ঠিক করার কাজও করবেন থিংক ট্যাংকের এই সদস্যরা। তবে তাঁরা কোনো সিদ্ধান্ত দেবেন না। নিজেদের পরামর্শ বিএনপির চেয়ারপারসনকে দেবেন। গবেষণামূলক কাজের মাধ্যমে বিএনপিকে যুগোপযোগী বাস্তবভিত্তিক পদক্ষেপ নিতে সহযোগিতা করা। এই গোষ্ঠীতে ১৬টি উপভাগ থাকবে। শিক্ষা, স্বাস্থ্য, অর্থনীতি, আইটি, কৃষি, কূটনীতি—এ ধরনের খাতভিত্তিক বিভিন্ন গবেষণামূলক কাজও করবে থিংক ট্যাংক। সে আলোকে বিএনপির অবস্থান কী হওয়া উচিত এবং ক্ষমতায় গেলে বিএনপি কী কী করতে পারে বা করার ক্ষেত্র আছে—তা চিহ্নিত করবে।

Her revolting words were music to my ears.

'Even if you hang me on a lamp-post for not cleaning your 'shit', I am ready for it but I will never do this. Never do this, never do this', said Champa Devi when I interviewed her first in the late 1990s when I started going to Mohammdabad, a small town of district Ghazipur in Uttar Pradesh where the families of those engaged in manual scavenging work became my extended family. I always wanted to hear the words from those who are victims of our racist caste system that assigned the work of cleaning human excreta to a particular community of untouchables, known in this region of eastern Uttar Pradesh, as Rawat. Champa Devi always believed in 'sukhi roti khayenge lekin jhadu nahi lagayenge, malmutra nahi dhoyenge' (We would rather eat simple dry bread yet won't touch broom to clean human excreta of others). These words were music to my ears as I felt that the biggest roadblock in our war against manual scavenging is the mental slavery, which has been imposed on the community for centuries. There is no denial of factor that the brahmanical system enslaved people mentally and compelled them to do the work but ultimately the liberation need our own convictions to fight it back. It is therefore important to acknowledge many of those who may not have been celebrity but lived life on their own conditions despite prevailing socio-cultural environment of gender and caste prejudices.
Champa Devi was working in the Mohammdabad Municipality as Safai Karmchari i.e. sanitation worker, when I met her for the first time around 1997. I was visiting Mohammdabad and trying to understand various issues that Rawat community was facing here in their engagement with the sanitation work, which is a sophisticated acronym for manual scavenging. Many of the young girls were interested in studying further but most of them had left their school due to financial constraints as their parents were unable to support their education. As I roamed around, spoke to many who were engaged in the manual scavenging work, the quick-fix reply was, 'What do we do? Where is the alternative? Who will feed us?'. And if you compel them to speak they would say,' If you want us to leave then we will leave it." It was a way to suggest that we need economic alternative to do that. I would often question them as what do they get out of it and the answer would be 'economic security' but the fact is that it is not economic security but 'security of life'. What is the 'economics' when somebody clean the human excreta of the other human being without getting anything in return? The only thing the 'bade-log' i.e. dominant caste people whose toilets are cleaned would provide 'leftover food' in the afternoon. Is not that a humiliation of the people who strive hard to live their life? And in the year end, during some festivities, they get 20 kilogram of rice or wheat and some left over cloths. Champa Devi had always despised this in her typical style,' What do you get after working day in and out. The filthy leftover food and you don't feel humiliated in begging for it. What cant you do other work which other community people do. None of the other community people do this work if they don't get the work", she would retort.
Mohammdabad is dominated by the Muslim Ansaris and rural areas by Bhumihar Hindus, who are powerful landlords and both have deep faith in the caste hierarchy. In the city area, it is the Ansaris that calls the shot politically but in the villages both the Muslims and Hindu upper castes run the show. For the Rawat community here untouchability exists both the side however its forms may be different in the town and the village. Just last year when some of our friends started a sewing centre for young girls in a village called Ranipur the upper caste Muslims refused to come to the house of the Rawat community people, as they remain untouchables.
Champadevi lived life according to her own convictions. She was married in childhood but never really able to live with her so-called in laws and revolted. She could not confine herself to domesticated village life engaged in manual scavenging hence left the village to life her life independently. She moved out and found the job of a Safai Karmchari in Mohammadabad. It was her conviction that she decided not to marry again and live the life the way she wanted. Her job with the Nagarpalika made her independent and she started supporting the families of brothers and sisters apart from encouraging young girls to study and men to leave manual scavenging.
Every time, I met her, she would appreciate the work that we have been doing in the community. 'These young girls must grow. They must study and become independent. It is important for girls to learn sewing, computer and other related things', she would say. It was always good to hear her putting her viewpoint strongly. She was ready to fight and die for the cause of society.
Once, I asked her opinion on what many people think about the issue of manual scavenging will become irrelevant if we increase the money given for the work and pat came her answer,' You pay me Rs 10 or 20 for cleaning your shit, I am ready to give you triple the amount please do come to my home and clean my latrine', she would challenge those who place such arguments. I am ready to be hanged she often said to me than cleaning the human excreta of anyone else. It is inhuman and against our self-respect. I want to ask my community people to come out of this mindset, educate your daughter, chose respectful occupations and live a dignified life.'
Champa Devi was not a theoretician or a politician but a simple woman who faced untouchability and left the life of indignity and disrespect so her feelings and expressions are focused more on the community and not on the government. The fact is while we all ask the government to invest more money and give more resources; it is also important that we listen to the voices of the likes of Champa Devi and introspect. We do not absolve government from its duties towards elimination of manual scavenging but a change is also needed from within and a bigger social awareness campaign inside the communities as the government and its upper caste officials may wait for next hundred years to 'eradicate' untouchability and manual scavenging but the community should not even wait for a day to leave this inhuman and undignified work.
Those of us who devote our time with the community it is essential to acknowledge the spirit of the community elders like Champa Devi which may not look very 'glamorous' and 'mentionable' to the feudal elitist mindset which define people in the name of 'this or that' ideology and not what they fight daily because of birth based discrimination due their caste identities. Champa Devi lived a full life and remains independent till end. Whatever she may be, but Champa Devi's words rejecting the culture of manual scavenging on her own and choosing a life of self respect and dignity would always sound like rhythmic music in my ears forever.

I fail to understand how some Hindus can embark upon a path of destroying their own religion for the sake of domination. In fact, the forces of Hindutva are doing huge disservice to their religion by describing its prime personalities and scriptures as symbols of Indian culture and not Hinduism. This dilutes their religion. What is Hinduism without Rama and Krishna and without Mahabharata and Ramayana? If they want Indians to read some portions of the books, they must seek a subject on religion in all schools with quotes from all the religions rather than simply theirs. This will give a better understanding to the Indian students about all religions. Hindu students will be in a better position to understand how their religion is different from Islam and Christianity.

In what they appear to believe as a masterstroke, the RSS and its sister Hindutva organisations have found a formula for advancing their agenda of Hindutva in the country. They and their supporters in BJP have all been trained to advance the argument that Gita, Ramayana, Yoga, Rama, Krishna – all these are representatives not of Hindu religion but of Indian culture. In previous attempts though, they have been equating "Hindu" with "Indian" and try to label everything Hindu as Indian. The latest in the series is the argument that Gita and Ramayana are in fact Indian historical documents and not the scriptures of Hindu religion. They believe that their argument will be accepted on its face value and will give them a success formula to impose Hinduism, more specifically the domination of Hindu elites, on India in the name of Indian culture. They forget that superfluous unfounded arguments fail the test of scrutiny as well as the test of time.
Are Gita and Ramayana not the scriptures of Hindu Dharma but of the Indian culture? Let me ask them a counter question. What is Hinduism and what are it main sources and scriptures? Who are the founders and preachers of Hinduism? Who are the Avatars they worship? If in answer to these questions, they exclude Ramayana, Mahabharata, Gita, Rama and Krishna, perhaps they will be right in arguing that all of them have nothing to do with Hindu religion. By doing so, they will be denigrating not only Hinduism but also these scriptures and personalities. If Rama was a symbol of Indian culture and not Hindu Dharma, let no Mandir for his worship be built at Ayodhya. Instead let the Babri mosque be rebuilt and renamed after Rama who, as I have found in Valmiki Ramayana, worshipped only one God and did never ask his followers to make statues of him and worship them. Let them tell who the Hindu deities are, and let Rama and Krishna be excluded from the list.
Now, they are arguing that Ramayana and Gita are Indian historical documents. In all probability they do not understand what a historical document is. A historical document is a document that describes the details of the historical events and figures of any time in the past with emphasis on time period – from oldest to the most recent. Ramayana and Mahabharata are largely believed to be literary epics and Rama and Krishna are believed to be venerable figures of Hindu Dharma. There is also a distinct possibility that they might have actually been historical figures but not of India. This writer had written a long article describing how the story of Abraham as told in Old Testament (Bible) is almost similar to the story of Ram as told in Valmiki Ramayana. Even the original name of Abraham was Ab-ram in Bible meaning Father Ram, and Abraham too had to face expulsion to the forest along with wife Sara (similar to Sita) and cousin Lot (similar to Lakshman) where Sara was abducted by the Firawn (similar to Rawan) of the time. Not only this, Abraham's second wife (several Rama kathas describe several wives of Rama) was banished to the forest. Abraham too had two sons, Ishaq and Ismail, like Kush and Lav of Rama. (Please note that this is my personal opinion and not a definitive position of Islamic scholars.) It is quite possible that when Aryans came to India they brought these stories along with them, which then got indianised. While this comparison may be right or wrong, with no final proof to be sure about, the fact remains that Ramayana and Mahabharata cannot be described as historical documents. The historians are not unanimous about the timing of Rama. Religious scholars believe his period to be as old as 1,000,000 years ago.These are the kinds of dates which no historian would agree with Modern Historians have two views. Some say that Rama was not a historical figure at all. Others say that if Rama did actually exist, his period was slightly more than 5000 BC.
Compare this with the historicity of Quran. Everybody knows that the first verse of the Quran was revealed in 610 AD. The exact date and background of the revelation of almost all of more than 6000 verses is known. It describes the history of the creation of the universe and its laws, history of creation of mankind, the history of previous messengers of God and the events happening around Muhammad during its 23 year period of revelation. Still, Muslims will not want it to be treated simply as a historical document of Arab World. To them it is the Book of God, which provides the details about the System of Islam, which is the final version of the religion of God propagated by tens of thousands of Messengers in various parts of the world. .
Irrespective of the historicity of Ramayana and Mahabharata, they are of course parts of the religious, cultural and literary history of the country. But if they are important parts of religious and cultural history of India, so are Quran and Bible. For anything to be part of any country, it does not necessarily have to have its origin in that country. British rule originated in England but it is part of Indian history. Quran has influenced hundreds of millions of people in the Indian subcontinent over a period of more than one thousand years with its 30 pc population accepting Quran as the Book of God and Guide for their individual and family lives. How can a book which influenced one third of the population and led to their conversion to Islam not be regarded as important in the religious and cultural history of the country?
One is fully entitled to taking pride in one's religion, and there is a justification in the argument why should important epics like Ramayana and Mahabharata not be taught as part of literary and religious history in the universities. Hindutva protagonists have also been taking pride in stating that excerpts from Gita and Ramayana are being taught in universities all over the world including America and Europe. But the same applies to Bible, Quran and other religious scriptures. They must know that full-fledged departments of Islamic studies are there in a large number of universities in non-Muslim countries. They also need to know that the Law Department of Harvard University has excerpts from Quran at its Entrance Wall as "Words of Justice". A report says:
The protagonists of Hindutva must also realise the fact that it is religion, which has a direct and bigger effect on culture, and not the vice versa. Culture witnesses huge changes when a new religion or new Prophet/Saint appears anywhere. The Indian culture in Pre-Ashoka period was mainly based on Hindu religion; but with the arrival of Buddhism and Jainism, Indian culture witnessed a sea change. Vegetarianism in Indian culture emanated not from Hinduism but Buddhism and Jainism. When Islam appeared in Arab, it brought huge social and cultural transformation of society.Dresses changed, festivals changed and the laws of governance and business changed. Slavery started disappearing. The concept of marrying innumerable women was replaced by monogamy or restricted polygamy. Inequality on the ground of race, colour or creed vanished. Alcohol was totally banned. Gambling and usury ceased to exist. When Islam arrived in India, another huge change occurred in Indian culture with huge impact on architecture, social norms, dresses, language and arts. Indian culture of today is a combination of Hindu, Buddhist, Jain, Islamic and Christian religious traditions and cultures.

They are totally justified in arguing that religion cannot and should not be sidelined. Unfortunately, Indians belonging to all religions, in fact people all over the world have fallen prey to the designs of the forces of Modernism (Westernism and Communism) that seek to sideline religion in public life. In India, secularism does not mean negation of religion but equal respect to all religions. The atheistic forces of the world have created an atmosphere where religions, instead of fighting the modern morality (which allows the commercialisation of human weaknesses) through united efforts, are fighting one another on the ground of communal hatred. Instead of negating the role of religion, all Indian communities should work for strengthening of religious morality with equal respect to all religions. But for this, all Hindutva and Muslimist leaders and organisations will have to abandon their approach based on identity and domination and must instead cooperate with each other in uprooting the evils and making all partners in peace and prosperity.

लखनऊ 19 सितम्बर 2015। बटला हाउस फर्जी मुठभेड़ की सातवीं बरसी पर रिहाई
मंच द्वारा शनिवार को यूपी प्रेस क्लब लखनऊ में 'सरकारी आतंकवाद और वंचित
समाज'विषय पर एक सेमिनार का आयोजन किया गया। सेमिनार को दिल्ली
विश्वविद्यालय के प्रोफेसर, प्रख्यात इतिहासकार व रंगकर्मी शमसुल इस्लाम
ने संबोधित किया।
बटला हाउस फर्जी मुठभेड़ कांड का जिक्र करते हुए शमसुल इस्लाम ने कहा कि
आज राज्य सत्ता द्वारा अपने आतंक को जस्टिफाई करने के लिए 'राष्ट्रीय
सुरक्षा'जैसे एक जुमले का प्रयोग करने लगी है। वह अन्याय के सारे सवाल
को राष्ट्रीय सुरक्षा के के नाम पर दफन करना चाहती है। वह किसी को भी मार
डालने, आतंकित करने, उत्पीडि़त करने का एक अघोषित हक रखने लगी है और यह
सब काम राष्ट्रीय सुरक्षा के नाम पर किया जाने लगा है। उन्होंने एक
उदाहरण देते हुए बताया कि किस तरह से दिल्ली सरकार ने बिजली की प्राइवेट
कंपनियों को लाभ पहुंचाने के लिए जन विरोधी फैसले किए। इन फैसलों द्वारा
आम जनता पर कई गुना ज्यादा बिजली बिल वसूला जाना था। बिजली के इस
प्राइवेटाइजेशन पर कोई हंगामा न मचे इसलिए इस समझौते को राष्ट्रीय
सुरक्षा की श्रेणी में डाल दिया गया। अब आम नागरिक आरटीआई जैसे कानून से
भी इस फैसले के बारे में सरकार की प्राइवेट कंपनियों से क्या डील हुई है,
जान नहीं सकता। यही नहीं प्राइवेट बिजली कंपनियों ने जिन मीटरों का
इस्तेमाल किया था वे अपनी सामान्य गति से तीन गुना तेजी से चलते थे। इस
तरह से जहां राष्ट्रीय सुरक्षा के नाम पर आम जनता को लूटने का खेल चलता
है वहीं राष्ट्रीय सुरक्षा के नाम पर उत्पीड़न के खिलाफ आवाम का मुंह बंद
किया जाता है।
प्रो. शमसुल इस्लाम ने कहा कि आज के वर्तमान राज्य की बुनियाद पूंजीवाद
के आरंभ के युग में 18वीं सदी में ही पड़ गई थी। पूंजीपति वर्ग यह जानता
था कि जब तक आम जनता के दिमाग को गुलाम नहीं बनाया जाएगा तब तक पूंजीवाद
और उसके लूट को जस्टीफाई नहीं किया जा सकेगा। पहले यह माना जाता था कि
राज्य बदमाश लोगों के चंगुल में है, उससे पूरी दुनिया में आम जनता के
भीषण टकराव होते थे। लेकिन फिर पूंजीपति वर्ग ने यह भ्रम फैलाया कि राज्य
सत्ता सबकी है। उसमें सबकी हिस्सेदारी है। उसके फैसले सबकी सहमति से लिए
जा रहे हैं। उन्होंने कहा कि यह शब्द दरअसल दिमाग को गुलाम बनाने के लिए
था। आज मोदी के समर्थक भी इसी की बात करते हैं लेकिन वे यह भूल जाते हैं
कि देश की केवल 31 फीसदी आवाम ने ही उन्हें वोट किया है। यह बात मोदी के
जन विरोधी फैसलों को जस्टीफाई करने के लिए की जाती है। जो इस भ्रम को
बेनकाब कर रहे हैं उन्हें मारा जा रहा है दाभोलकर, पनसरे और कालुबर्गी की
हत्या इसी का नतीजा थी। लेकिन इन सबके बावजूद आज भी वे इस दिशा में
व्यापक सहमति बनाने में असफल है।
उन्होंने कहा कि देश का सत्ता हस्तांतरण भले ही 1947 में हुआ था, लेकिन
यह सरकार जो कि आजादी के बाद सत्ता में आयी, ने अपने कृत्यों से यह साबित
किया कि वह आवाम की जनआंकांक्षा पूरी नहीं करती थी। इसके लिए उन्होंने दो
उदाहरण दिए। पहला सन् 1857 की आजादी की जंग हम इसलिए हारे थे क्योंकि
मराठा और हैदराबाद के निजाम की सेना ने सिंधिया परिवार के खात्मे के लिए
निकली झांसी की रानी लक्ष्मीबाई के साथ लड़ाई की थी। इसी वजह से उन्हे
ग्वालियर में शहादत देनी पड़ी। सन् 1945 में तेलंगाना के इलाके में
निजाम द्वारा आम जनता के उत्पीड़न के खिलाफ कम्यूनिस्टों ने बहादुराना
संघर्ष किया था। लेकिन सरकार ने आजादी के बाद उन्हीं जैसी जन विरोधी
ताकतों को सबसे पहले उपकृत किया। आजादी के बाद भारत ने सबसे पहला एक्शन
हैदराबाद और तेलंगाना में लिया था। इसमें भारतीय सेना ने निजाम के
विरोधियों को, जिन्होंने उसके अत्याचार के खिलाफ संघर्ष किया था बड़े
पैमाने पर मारा। यहां यह भी तथ्य है कि सेना ने अपने आॅपरेशन में केवल
मुसलमानों को मारा था। जबकि निजाम के खिलाफ हिन्दू और मुसलमानों ने मिलकर
संयुक्त लड़ाइयां लड़ी थीं। उन्होंने कहा कि आजादी के बाद हमारे देश में
निजाम को हैदराबाद का गर्वनर बनाया गया। हरी सिंह को भी कश्मीर का गर्वनर
बनाया गया। उस दौर में दोनों अपनी आवाम के खिलाफ दमन के सबसे बड़े चेहरे
माने जाते थे। इससे यह साबित होता है कि राज्य सत्ता आम जन की विरोधी और
भारत के अपने संदर्भें में मूलतः सांप्रदायिक थी।
दूसरा उदाहरण देते हुए उन्होंने कहा कि जिस पुलिस अफसर ने भगत सिंह को
फांसी दिलाने में महत्वपूर्ण भूमिका निभाई थी, आजादी के बाद उसे पंजाब के
पुलिस का मुखिया बनाया गया। कहने का मतलब यह है कि सब कुछ आजाद भारत में
वेसा ही चल रहा था जैसा कि गुलामी के दौर में चलता था। राजसत्ता में आम
जन की भागीदारी का सवाल धोखा से ज्यादा कुछ नहीं था। आज भी राज्य सत्ता
अपने चरित्र में जनविरोधी है। वह इंसाफ देने की कुव्वत नहीं रखती है।
प्रो. शमसुल इस्लाम ने बाबरी विध्वंस प्रकरण के पूरे संदर्भ पर अपनी राय
रखते हुए कहा कि मुंबई बम धमाकों के आरोप में याकूब मेमन को फांसी दी गई।
लेकिन सवाल यह भी तो है कि बाबरी मस्जिद विध्वंस, और उसके बाद उपजी हिंसा
के बाद मुंबई में नौ सौ से अधिक लोग मारे गए थे जिसमें सात सौ मुसलमान
थे। इनके गुनहगारों के लिए क्या किया गया। श्री कृष्णा आयोग ने साफ बताया
है कि इन दंगों में भाजपा के लोग और बाल ठाकरे शामिल था। यह बात
डाॅकुमेंट में दर्ज है लेकिन कोई कार्यवाही नहीं की गई। उन्होंने कहा कि
आसाम के नेल्ली में 1983 में उल्फा ने सरकार के हिसाब से 1800 लोगों का,
जिनमें सब मुसलमान थे, की हत्या की थी। यह द्वितीय विश्व युद्ध के बाद का
सबसे बडा जनसंहार था। लेकिन राष्ट्रवाद की रक्षा के नाम पर राजीव गांधी
से समझौते के तहत कुछ नहीं किया गया। अन्याय की और भी कहानियां हैं। मेरठ
के हाशिमपुरा में सब छूट गए। किसी को भी सजा नहीं हुई। सन् 1984 में सिख
जनसंहार में क्या हुआ? हजारों सिखों को उठाकर मार दिया गया। किसी को
इंसाफ नहीं मिल सकता और हमें इस सत्ता से इंसाफ की उम्मीद नहीं करना
चाहिए। अभी कुछ दिन पहले सीबीआई ने कहा कोर्ट से कहा है कि है कि क्या हम
टाइटलर को जबरजस्ती सिख विरोधी दंगों में फंसा दें? जब जानते हैं कि
जगदीश टाइटलर का इन दंगों में क्या रोल था। यहीं नहीं 1996 में बथानी
टोला का जनसंहार हुआ जिसमें सब बच गए। लक्षमणपुर बाथे में भी सब छूट गए।
मारे गए लोग गरीब, वंचित, और अल्पसंख्यक थे। क्या राज्य की प्रतिबद्धता
इन तबकों को इंसाफ दिलाने की थी। इन सबके बाद भारतीय राज्य अपने मूल
चरित्र में जन विरोधी साबित हो चुका है।
उन्होंने हाल ही में जारी एक रिपोर्ट का हवाला देते हुए कहा कि इस मुल्क
में दलित महिलाओं के खिलाफ रेप और उत्पीड़न के ज्यादातर मामले दर्ज ही
नहीं होते। गुजरात में दलित महिलाओं के रेप पांच सौ प्रतिशत बढ़े हैं।
दलितों और वंचितों के खिलाफ हिंसा कोई चिंता की बात नहीं है। हां अगर
दलित कभी हिंसा करेंगे तो उन्हें फास्ट ट्रेक अदालत में घसीटा जाता है।
वास्तव में यह गरीबों और वंचितों को आतंकित करने की राज्य सत्ता की एक
रणनीति है। और एक पाॅलिसी के तहत ऐसा किया जाता है।
प्रो. शमसुल इस्लाम ने कहा कि आज राज्य सत्ता जिसे आरएसएस संचालित कर रही
है, आम हिंदुओं के खिलाफ है। आरएसएस का आम हिंदुओं से, उसकी समस्याओं से
कुछ भी लेना देना नहीं है। यही बात मुसलमानों के हित संवर्धन का दावा
करने वालों से भी है। उन्हें आम मुसलमान की समस्याओं और उसकी बेहतरी के
सवाल से कुछ भी लेना देना नहीं है। एक उदाहरण देते हुए उन्होंने बताया कि
मुकेश अंबानी जो दुनिया के तीसरे खरबपति ह,ै का घर यतीमखाने की जमीन पर
बना है। लेकिन इसे लेकर कोई सवाल किसी भी नुमाइंदे की ओर से कभी नहीं
किया गया।
उन्होंने कहा कि सवाल और भी हैं जिनमें कई मायनों में हमने शर्म भरे
कीर्तिमान भी बनाए हैं। जैसे भारत में सबसे ज्यादा बेघर लोग रहते हैं।
भारत दुनिया का वो देश है जहां किसान सबसे ज्यादा आत्महत्या करते हैं। इस
देश में दुनिया का सबसे ज्यादा खाना खराब किया जाता है। उन्होंने कहा कि
सरकार यह खुद मानती है कि हम दुनिया की भूखों की राजधानी हैं। भारत विश्व
दासता सूचकांक में भी सबसे आगे है। लेकिन राज्य सत्ता और सरकार को इससे
फर्क नहीं पड़ता। आरएसएस के लोग मुसलमानों से तिरंगा लगाने की बात करते
हैं लेकिन सच यह है कि आरएसएस तिरंगे से कितना प्यार करता है इसकी बानगी
यह है कि वह तीन का रंग ही अशुभ मानता है।
सेमिनार को संबोधित करते हुए प्रो. रमेश दीक्षित ने कहा कि देश के 55
फीसद हिंदू भाजपा को अपनी पार्टी नहीं मानते हैं। इनके चरित्र में
पूंजीवाद की सेवा है और ये आम आदमी के पक्के शत्रु हैं। चाहे वह कांगेेस
हो या फिर भाजपा, पूंजीवाद की दलाली इनके चरित्र में बसी है। उन्होंने
कहा कि अंबानी ग्रुप को आगे बढ़ाने में प्रणव मुखर्जी और नारायण दत्त
तिवारी सबसे आगे थे। आज राजसत्ता का खुला चरित्र सबकेे सामने है और वह
विश्व पूंजीवाद की दलाली कर रही है। हिंदुस्तान की राजसत्ता का चरित्र
गरीब विरोधी और सांप्रदायिक है। यहीं नहीं, मीडिया ने आतंकवाद का मीडिया
ट्रायल किया। उन्होंने कहा कि हम संजरपुर गए थे और उन परिवारों के लोगों
की इलाके में बड़ी इज्जत है। रमेश दीक्षित ने कहा कि आज हिंदुस्तान के
सारे इलाकों को पूंजीपतियों ने बांट लिया है। इसे रोकने के लिए सबसे पहले
लोकतंत्र को बचाना होगा। तभी यह देश और उसके संसाधान बच पाएंगे।
सेमिनार को संबोधित करते हुए एपवा की ताहिरा हसन ने कहा कि यह याद करने
का दिन है। यह इसलिए कि हम इस लड़ाई को आगे केसे बढ़ाएं? बटला की जांच
जांच होनी चाहिए। इसलिए इस प्रकरण की पूरी जांच होनी चाहिए। गिरफ्तारी
दिखाने में खेल क्यों होता है? यह भी एक सवाल है। राजसत्ता असली आतंकवादी
को बचाती है क्योंकि इसकी एक राजनीति है। दरअसल सारा खेल जनता को आतंकित
करके उनके संसाधनों को लूटने का है। बिना पूंजीवाद के खात्मे के आतंकवाद
के खात्मे की कोई उम्मीद नहीं करना चाहिए क्योंकि यह राज्य सत्ता द्वारा
पोषित है। बेगुनाह केवल शिकार होते हैं।
काॅर्ड के अतहर हुसैन ने कहा कि अल्पसंख्यकों के खिलाफ जितने भी जनसंहार
आयोजित हुए उनमें केवल गुजरात जनसंहार के दोषियों को कुछ स्तर पर सजा मिल
पायी। यह इसलिए हुआ कि इस जनसंहार में न्याय के लिए व्यापक स्तर पर जन
समुदाय सड़क पर उतर कर कानूनी लड़ाई भी लड़ा। इस लड़ाई को और भी आगे ले
जाने की जरूरत है। डा. इमरान, अलग दुनिया के केके वत्स, आफाक उल्ला ने भी
अपने विचार रखे।
कार्यक्रम का आरंभ दाभोलकर, पानसरे और कालबुर्गी की शहादत का स्मरण करते
हुए दो मिनट का मौन धारण कर उन्हे श्रद्धांजलि देते हुए शुरू किया गया।

SC panel raps Hisar SSP for 'falsely' booking Dalit girls

Ishwar Singh, a member of the National Commission for Scheduled Castes (NCSC), today rapped the district police for booking minor Dalit siblings who had visited the Senior Superintendent of Police's office.
One of the girls, 12, complained to Singh she and her sisters had gone to meet the SSP, Satyender Gupta, on June 19 to demand action against "negligent" policemen who failed to locate her mother who went missing in May. She claimed her father, Sukhbir Kumar, had committed suicide due because of the police "failure".
She alleged the SSP rebuked them, policewomen thrashed them and later a case was slapped against her, her sisters and other members of the family. They were booked under Sections 332 (voluntarily causing hurt to deter public servant from his duty), 353 (assault or criminal force to deter public servant from discharge of his duty), 354 (assault or criminal force to woman with intent to outrage her modesty), 186 (obstructing public servant in discharge of public functions), 160 (punishment for committing affray), 120 B (criminal conspiracy) of the IPC on the complaint of a policewoman posted at the SP's office.
Dalit activists Rajat Kalsan and Bajrang Intal alleged the police had tried to muzzle the voice of Dalits by slapping cases against them.
Pulling up the SSP, who was present in the meeting, Singh said how could minor girls and other members of their family attack policewoman at the SSP's office in the presence of police force.

Rally taken out condemning lathi-charge on agitating students
Leaders and party workers from CPI (M), CPI, YSRC, Lok Satta and students from various colleges and members of SFI and DYFI took out a rally on Fridaycondemning the police action against the agitating students and SFI and DYFI members, near the District Collector's office on September 15.
Speaking at the Gandhi statue near GVMC, CPI (M) State secretariat member Ch. Narasinga Rao demanded that the authorities concerned immediately suspend the SHO of Three Town and Two Town Police stations for their highhandedness.
The students from 19 SC/ST and BC hostels were protesting against the bad quality of food being served and lack of basic amenities in the hostel and wanted to give a representation to the District Collector on September 15, when they were lathi-charged and taken into custody by the police present there. About 20 students, including girls, suffered injuries in the incident.
Mr. Narasinga Rao also pointed out that two SFI leaders -- Jagan and Kumar -- were beaten up by the police at Three Town police station which is against the law. "When we tried to bring the incident to the notice of the higher-ups in the Police Department they showed no remorse," he lamented.
Former YSRC MLA Babu Rao said that the TDP government was patronising corporate colleges, while neglecting the government-run colleges and hostels.
YSRC party's district and city president G. Amarnath said that the TDP was trying to stifle the voice of the opposition.
Quoting the recent incident at Koyyuru, when the police cut the public address system during a public meeting wherein the bauxite mining issue was being highlighted, he said: "They also do not want the students to protest in a democratic fashion."
Stir to be intensified
Mr. Narasinga Rao threatened that the agitation would be intensified if the authorities concerned did not take action against the police officers and bring in a positive change at the hostels at the earliest.
Over 500 members from different parties and students from various colleges and hostels participated in the rally which was taken out from Saraswati Park to GVMC Gandhi Statue.

Case Filed against School Teachers

KENDRAPARA: Police on Friday registered a case against four teachers including the headmaster of a Government-run high school in the district following a complaint that a group of Dalit students was prevented from offering prayer to Lord Ganesh on the school premises.
The case has been registered against teachers Rabindra Biswal, Jayanta Biswal, Pyari Mohan Dash and headmaster Ramesh Chandra Rout under various sections of IPC and Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Sources said around 30 Dalit students of Bande Mataram High School in Andara village under Chaudakulat police limits were not allowed to offer puja to Lord Ganesh by the school authorities on Thursday. The school has student strength of 250.
On Friday, 24 Dalit students including 10 girls filed an FIR at Chaudakulat outpost alleging that teachers of the school abused and locked them in a room. Collector Debraj Senapati said District Education Officer (DEO) Sangram Sahoo has been directed to probe into the matter.

BHOPAL: Taking a serious view of slackness in a minor's gang rape case probe by police and doctors, a court of district and session's judge in Anuppur, directed state government for conducting a fresh probe in the case and action against officials who conducted the probe in the case. Accused in the case were acquitted over lack of evidence.
Court of Anand Mohan Khare observed if after going through evidences government feels the need for probe by a higher agency, government can recommend such a probe through CBI for justice to the kin of the girl.
Earlier also, the court through its order dated August 5 rapped local police for its inaction and poor investigation that resulted in acquittal of the accused.
Recent order came in a case of gang rape and murder of a tribal girl in 2012. Two people Rajkumar Singh and Pramod Shukla were made accused by police and a case was registered at Karanpathar police station of the district.
Judge observed it appeared investigating police officers and doctors who conducted the medical tests and probe have done a formality. At the same time, prime witnesses in the case turned hostile. In its order the judge also observed that state government, 'If after going through the order, evidences and police diaries finds there has been dereliction of duty by Dr Fulsai Marabi, Dr Shaili Jain, Dr Anil Yadav, the investigation officer of case, G P Mishra, who was then deputy superintendent of police, and other officials, then strict action should be taken against them so that courts established by rule of law, do not find any difficulty in punishing the accused in cases of crime against women of ST and SC community."

"Form panel to probe land allotment to dalits, tribals'

AHMEDABAD: Gujarat high court on Friday suggested the state government to form a committee to look into complaints by dalits and tribals that they were allotted agriculture land as part of land reforms, but the allotments have remained only on paper.
A bench of acting Chief Justice Jayant Patel and Justice N V Anjaria also sought the government's opinion within 15 days on whether such an exercise could fulfil the purpose of extending benefits of reforms to the suppressed class of people.
The judges opined for such investigation committee because it would be difficult for the court to adjudicate the complaints of non-allotment of land by beneficiaries as such type of complaints would be thousands in number.
The court asked the authorities to undertake this exercise in response to a PIL filed three years ago by one Jignesh Mevani, who has sought directions to officials to furnish information on allotment of wasteland to the poor and landless farmers in Ahmedabad and Surendranagar districts.
The PIL also demanded that due procedure for allotment of land for agriculture purpose should be followed and the benefits should reach SCs and STs.

Parents lock school over 'casteist' slur by teacher

Though the students or their parents have not filed any complaint, the Deputy Commissioner has directed the Malout Sub-Divisional Magistrate to investigate the matter.
A team of Jawahar Navodaya Vidyalaya officials from Chandigarh also reached the school today.

Lucknow: After reporters of women-run news network "Khabar Lahariya" in Uttar Pradesh's Banda faced months of stalking and harassment by a serial caller, police have finally come to their aid - after orders from higher-ups - and the accused has been arrested.
In a press conference here, "Khabar Lahariya" editor Kavita said after orders from senior officials, police in Banda in the state's Bundelkhand region took action to trace and capture the accused.
Kavita said the action was delayed, yet appreciated police's prompt and sensitive action.
Meera, the chief of operations, said there was a need for systems of security, like the 1090 helpline, to be more efficient and accountable, as well the environment to report cases of harassment to be more enabling.
Since January this year, five members of the publication were repeatedly harassed by an unknown caller, who identified himself as Nishu.
Despite a complaint, the matter, according to Kavita, was not taken seriously and brushed off as an "ordinary" case until orders from higher officials.
The accused, Saddam alias Nishu, was arrested on Tuesday, shortly after orders from the state government.

In the midst of the confusion created by the largely uninformed discussion in the TV Channels and the print media, following the agitation of the Patidars or Patels of Gujarat, it is necessary to make all people in the country, intellectuals like Surjit Bhalla and Indira Hirway, as well as people in general, aware of a few essential basic facts and correct certain common errors.
COMMON ERRORS OFT-REPEATED BY EMINENT KNOWLEDGEABLE PERSONS
(a) Reservation in this country was started by vote-hungry politicians;
(b) Reservation was, as stated by K. N. Bhat, former Additional Solicitor General of India, in his article titled "Divide and Serve" in Asian Age dated 4. 9. 2015, "invented by the divide and rule policy of the British";
(c) Reservation was started after the Constitution of India 1950;
(d) Reservation was, as asserted by Joginder Singh in his article Pandora's Open Box of Caste-Based Reservation in Pioneer dated 7.9.2015 with confidence matched by ignorance, provided in the Constitution only for Scheduled Castes (SCs) and Scheduled Tribes (STs), and subsequently extended to "the rest", i.e., the Socially and Educationally Backward Classes (SEdBCs) / Other Backward Classes (OBCs) / Backward Classes (BCs) (hereafter referred to as BCs), by politicians like V.P. Singh and Arjun Singh in the 1990s;
(e) The root of Reservation, as again asserted by Joginder Singh in the same article as mentioned above, is traced back only to the Mandal Commission, established in 1979;
(f) The Constitution recognizes only SCs and STs and does not recognize BCs.
(g) The Constitution does not provide for Reservation for BCs.
(h) The Constitution provides Reservation only for 10 years as misunderstood latest by Indira Hirway ("Rethinking Reservation and Development", The Hindu, 31.8.2015) and by many other scholars before her and by many learned anchors and commentators on the TV channels.
None of the above is factually true.The confusion in the minds of eminent persons is illustrated by K.N. Bhat attributing Reservation to the "divide and rule policy of the British", while Joginder Singh asserts with equal self-assurance that "the programme of divide and conquer was taught to the Britishers by the Indians".There are also certain other basic errors pertaining to BCs such as the nature of the BC lists and the place of religious minorities vis-à-vis the BC lists. These will be discussed and clarified lower down.
CORRECT BASIC FACTS
(i) Reservation was first started in Kolhapur by the initiative of the Maharaja of Kolhapur in 1902.
Next it was introduced by the Maharaja of Mysore in his Princely State in May 1921.
The third in the line was the Madras Presidency (which included the present Tamil Nadu, the present Andhra Pradesh, the northern part of Kerala and certain parts of the present Karnataka) where it was introduced in September 1921 by the Justice Party which came to power in the Province on the plank of curbing the then existing Brahmin monopoly.
Next was the Bombay Presidency in 1931.
Next came Travancore where the Maharaja introduced Reservation in 1935, followed by the Maharaja of Cochin.
Thus, before Independence the whole of the peninsula was covered by Reservation.
This Reservation was for Backward Classes defined to include not only those who subsequently came to be known as the Scheduled Castes and Scheduled Tribes, but also many of those who are now included in the list of Socially and Educationally Backward Classes.
Reservation was introduced, largely by the initiatives of socially sensitive rulers of Princely States in response to local social reform movements directed against caste-based monopolies and to secure a reasonable share in governance and administration for those who had been kept out.
Elementary Constitutional literacy will inform that there are specific Articles which recognize the BCs such as Article 340(1), Article 15(4), Article 16(4) (along with SCs and STs), etc. and provide Reservation for them.
A time-limit of 10 years was prescribed by the Constitution only for Reservation of seats in elections to the Lok Sabha and State Assemblies.
A common error of opinion is that Reservation is at the cost of the merit. This biased opinion is disproved by experience.
The peninsular States are ahead of the States in the rest of India in all parameters of development and welfare. This is not accidental. An important contributory causatory factor is the bringing in of a larger part of the population into governance, administration and education through Reservation in response to social reform movements in the peninsular States – a process that suffered considerable delay in the rest of India.
(ii) At the national level, Reservation was introduced for the SCs through the initiative of Dr Babasaheb Ambedkar in 1943. With his wisdom, he foresaw that those in whose hands power would effectively reside in post-colonial India would be averse to providing Reservation and other measures required for the SCs and, therefore, he joined the Viceroy's Executive Council as Member (a fact that Arun Shourie's misses in his book Worshipping False Gods), convinced the Viceroy against counter-advice by certain other members and secured Reservation, Post-Matric Scholarship (PMS) scheme and Overseas Scholarship Scheme for SCs, which could then be automatically extended to the STs on attainment of Independence.
Dr Ambedkar knew that the BCs too had a case and was prepared to help them. But, for certain reasons of tactical error (details later), the then BC leaders could not take his help, missed the pre-Independence bus, and consequently had to wait till 1990.
(iii) Dr Babasaheb Ambedkar's initiative of 1943 ensured continuation of Reservation after Independence under the Constitution.
THREE CATEGORIES OF RESERVATION
There are three categories of Reservation –
(a) Reservation in the posts and services of the State (including Public Sector Undertakings, Public Sector Banks, Universities and other entities which come under the rubric of "State" under Article 12 as interpreted by the Supreme Court)
(b) Reservation in admission to seats in educational institutions, and
(c) Reservation of seats in elections to the Lok Sabha and State Assemblies, usually referred to as "Political Reservation".
It is only the Reservation at (c) which initially had a 10 year time-limit.
Reservation at (a) and (b) had and have no time-limit. Many scholars and anchors confuse Reservation at (c) with Reservation at (a) and (b), for which there is no time limit. It means that Reservation in the services and educational seats can and should continue as long as necessary for fulfilling the purpose for which the regime of Reservation was established in this county well before pre-independence days continuing after Independence and under the Constitution.
PURPOSE OF RESERVATION
Reservation was never intended as a measure for poverty elimination or poverty alleviation.
Reservation was never intended as a measure to solve unemployment.
Reservation was intended to correct an imbalance in the structure of governance and administration and the supporting structures of education and electoral seats, that had come into existence on account of the gross imbalances and distortions created by the Indian Caste System, i.e., Caste System-with-"Untouchability" over the centuries continuing to the present day (without change in essence though with some quantitative attenuation and marginal modification).
Consequent to the imbalance and distortion created by the caste system, including denial by various means – including physical violence against Dalit children, who were waylaid on way to school, beaten up and driven back home, as recorded in the Report of the Hunter Commission 1882, there was nil or negligible presence of what are now categorized as Scheduled Castes and Scheduled Tribes and Backward Classes and in some regions even from upper caste non-Brahmins in the services of the State. The State services were thus nearly monopolized by Brahmins in some regions or by Brahmins in combination with certain non-Brahmin upper castes like Kayasthas, Karans, CKPs, Khatris, Vaishyas/Banias, Rajputs/Thakurs, Kammas and Reddys, Nairs, Nattukkottai Chettiars, Vellalas. It is this distortion that the vast majority of the people peacefully agitated against and the Maharajas of Kolhapur, Mysore, Travancore and Cochin and the elected Indian rulers of the Justice Party in Madras responded.
FOR WHOM CONSITUTITON PROVIDES RESERVATION
The Constitution provides Reservation for only three social classes –
(a) Scheduled Castes (SCs), now popularly known as Dalits
(b) Scheduled Tribes (STs), now popularly known as Adivasis
(c) Socially and Educationally Backward Classes (not Socially and Economically Backward Classes as trotted out by many scholars and learned TV anchors and commentators) – referred to in different States as Socially and Educationally Backward Classes or as the Other Backward Classes or as the Backward Classes (BCs).
Reservation cannot be provided under the Constitution for any other social class. Apart from social classes, Reservation can be provided for categories which can be rationally classified, e.g., the women, the physically handicapped. These categories cut across the social classes. Reservation for them is characterized by the Supreme Court as "Horizontal Reservation" while the Reservation for the three social classes is characterized as "Vertical Reservation" in the Mandal case judgment.
The Constitution does not provide and does not permit Reservation for the "Poor" or the so-called spurious "Economically Backward Classes" (no such class is recognized by the Constitution. Some Governments have coined this term to make it look like a Constitutional category). Poverty not preceded by and not consequential to social backwardness (or "Untouchability" or isolation under vulnerable conditions) is no ground for allowing Reservation as seen from a reading of the Constitution and as amply clarified by the Supreme Court's landmark Mandal case judgment.
HOW HAVE THE THREE SOCIAL CLASSES BEEN IDENTIFIED AND HOW ANY CHANGE IS MADE
(a) Scheduled Castes
SCs have been identified and specified on the basis of "Untouchability", i.e., castes, on which has been imposed "Untouchability", have been listed as Scheduled Castes by a series of Presidential Orders.
Any addition, deletion, modification in any of the entries in the Schedules can be made only by the Parliament by law. "SC status" is not a largesse to be handed over by any Government or leader or Party to any community at will.
If any community, which is not in the existing lists of SCs, wants to be included in the Schedule of SCs, it must show that it is the victim of "Untouchability". This factum must be established with evidence by the concerned State Government and then will be enquired into by the anthropological wing of the Registrar General of India.
Only when both of them record with evidence the factum of "Untouchability" of a community and the concerned Ministry (now the Ministry of Social Justice & Empowerment) is also convinced, can the matter be taken forward to the Parliament through legislation.
No State Government can declare by Executive Order or by law any community to be a Scheduled Caste.
(b) Scheduled Tribes
STs have been identified and specified on the basis of a group of characteristics which can be collectively described as isolation under vulnerable conditions.
The procedure for adding a community to the list of STs is the same as for SCs.
While an SC can be a caste or a tribe or a sub-caste or part of a caste or tribe, a Scheduled Tribe cannot be a caste. A community seeking inclusion in the Schedule of Scheduled Tribes for any State should first show that it is a tribe, and then show that it fulfills the criteria for a tribe to be included as a Scheduled Tribe.
Demands are sometimes being made and recommended by certain State Governments in certain cases for inclusion in the list of SCs and STs even when they know that the criteria are not fulfilled, and even with the full knowledge that the recommendation cannot be and will not be accepted and acted on. This is less than honest.
(c) Socially and Educationally Backward Classes
BCs have been identified on the basis of social backwardness as well as educational backwardness. It is not social backwardness or educational backwardness, but both.
The BCs include Socially and Educationally Backward Classes not only of Hindus, but also of Muslims and Christians. Eminent persons like Manish Tewari assert that the "Indian template of affirmative action……… leaves out of its ambit religious minorities" (Manish Tewari, "Regression for Progression", Asian Age, 5.9.2015). This is based on ignorance. Castes / communities of Muslims accounting for about 75 to 85 percent of the population of Muslims of India have been included in the list of BCs, and castes and communities accounting for the bulk of the population of non-ST Christians have also been included in the list of BCs. A relatively small proportion of Sikhs have also been included in the List of BCs. Though SC converts to Buddhism were included in the list of BCs recommended by the Mandal Commission, they were not recommended for inclusion by the Expert Committee on Backward Classes of 1992 and consequently were not included by the Govt. of India in the Central BC because they were recognized as SCs in 1990. Jains are not included because, as everyone knows, they belong to one Socially Advanced Caste (SAC). Zorastrians or Parsis are not included because they are the one small fortunate religious community of India which is free from the caste system.
A caste or community, which is not in the existing lists of BCs, and seeks recognition as a BC and inclusion in a BC list, must establish its eligibility in three steps:-
First step
First the applicant community must establish, that it is "socially backward".
The term social backwardness is not correctly understood. It is not a factor that is measurable arithmetically or statistically. Social backwardness describes the low position of a caste in the traditional hierarchy of the traditional social system of India, known as the Indian Caste System, existing over the centuries to this day.
Usually, socially backward communities are linked to a traditional occupation, which is considered to be inferior or "lowly" and sometimes even stigmatized. Dr. Ambedkar speaks of a hierarchy of occupations in the Indian system paralleling the hierarchy of castes.
If a caste or community is not established to be socially backward, the next two steps would not arise. If a caste is found to be socially backward, the examination proceeds to the second step.
Second Step
After a caste is shown to be socially backward, in order to be recognized as a socially and Educationally Backward Class and to be included in the list of Socially and Educationally Backward Classes, it should next be show that it is also educationally backward. This is not a matter only of literacy and differential literacy levels. The educational level of comparison has been steadily going up. In the Central Educational Institutions Reservation case judgment (Ashoka Kumar Thakur vs Union of India) of 2008, the Supreme Court has observed that the appropriate level for comparison under present conditions is graduation. In other words, at the level of graduation and above, including professional education, it must be shown that a caste or community seeking recognition as BC ranks significantly lower than the Socially Advanced Castes (SACs) of the State/country.
It is virtually impossible to find a caste which genuinely is socially backward, but is also not educationally backward. In other words, a genuinely socially backward caste will also be educationally backward. If caste is not educationally backward, its claim of social backwardness must be scrutinized very carefully as a caste not educationally backward is extremely unlikely to be socially backward. The converse is not true. Every caste that is educationally backward, is not necessarily socially backward. There are sub-castes of certain well-known Socially Advanced Castes which are relatively backward educationally. That is why the Constitution has wisely insisted that, for the purpose of the Constitution, backwardness has to be both social as well as educational.
On passing these two steps, the third step arises in the case of Reservation of appointments and posts in the services under the State.
Third Step
A caste which is socially and educationally backward, must also be established to be not adequately represented in the appointments and posts in the services under the State for it to be eligible for Reservation in the posts and services of the State under Article 16(4).
It is virtually impossible to find a caste which genuinely is socially and educationally backward but which is adequately represented in the appointments and posts in the services under the State. But the converse is not true. Every caste or community which is not adequately represented in the posts and services of the State is not necessarily socially and educationally backward.
CENTRAL LIST OF BCs AND STATE LIST OF BCs
In the case of SCs and STs, there is a single list or Schedule of SCs for each State. That list or Schedule of SCs for each State and Schedule of STs for each State was first issued by the President of India. Thereafter, any change in the Schedule could be and can be made only by Parliament through legislation. State Governments cannot issue Schedules or Lists of SCs or STs for the respective States or make any change including additions or deletions in the Schedules of SCs and STs as issued by the President of India with any modifications made by Parliament through legislation.
Unlike this position relating to SCs and STs, in the case of BCs there is a Central List of BCs for each State; and there is also a State List of BCs issued by each State listing the BCs of that State. The cause of the dichotomy will be discussed in detail in one of my forthcoming books, but briefly is rooted in a historic evasion of its Constitutional duty to BCs by the Central Government in 1955.
It is not correct to say that there are only State lists of BCs and there is no Central list of BCs as asserted by Zakka Jacob, the anchor of the CNN-IBN channel on 2. 9. 2015 with self-assurance matched only by his ignorance, in a panel discussion where other panelists except one were also ignorant of this basic fact. The two lists, the purposes of each and the procedure for inclusion in each are outlined below. It is also to be clarified that the two lists are mostly the same for most of the States. Only in the case of very few States, particularly, Tamil Nadu and Karnataka, for historical reasons (which will be explained in one of my forthcoming books), there are a few differences – certain castes in the State list are not included in the Central list for valid reasons (which will also be elucidated in a forthcoming book). In the case of other States divergence between the State list of BCs and the Central list of BCs for each of those States is absent or marginal.
PURPOSE OF CENTRAL LIST OF BCs AND STATE LIST OF BCs
The Central List of BCs is applicable for Reservation of appointments and posts in the services of the State under the Central Government and Central institutions;
Reservation in admission to seats in educational institutions of the Central Government and Centrally-aided educational institutions;
and for other Central programmes/schemes/policies of Social Justice for BCs;
The State list of each State is applicable for
Reservation of appointments and posts in the services of the State under that State Government and institutions of that State;
Reservation in admission to seats in educational institutions of that State Government
and educational institutions aided by that State Government;
and for other Social Justice programmes/schemes/policies of that State Government.
CENTRAL LIST — ITS PREPARATION
The first-phase Central List was issued in 1993, by listing State-wise those castes which were included in the State list of Backward Classes of each State as in 1992 (at that time there were State Lists in 14 States which States accounted for about 85% of the population of the country) and also in the Mandal List for that Sate. This is also known as the "common list" as it was prepared by listing castes common to the State List and the Mandal List. The common-listing provided a double check. Castes or communities which were in one of the lists, but not in the other were not included in the Common List or the first-phase Central list. This painstaking exercise was done by the Expert Committee on Backward Classes of which I was the crucial member in terms of knowledge and background.
This was the procedure laid down in the Government of India's Memorandum of 13.8. 1990, on my advice, to preclude certain anomalies. This procedure was upheld by the Supreme Court in its landmark Mandal case judgment of 1992.
Thereafter, following the procedure laid down in the OM of 1990 and the Supreme Court's direction of 1992, the NCBC took up applications for inclusion in the Central List of BCs, of various castes and communities which did not find place in the First-phase Central List / Common List.
The procedure for inclusion of a caste or community in the list of BCs is different for the State and for the Centre though the criteria are the same for inclusion in the State list as well as the Central list.
PROCEDURE FOR INCLUSION OF A CASTE/COMMUNITY IN STATE LISTS OF BCs
For inclusion in the State List of a State of a caste/community which is not in the State List of that State, an application must be made by or on behalf of a caste or community to the State Commission for Backward Classes of the relevant State. A State Commission has been established in every State pursuant to a direction of the Supreme Court in the landmark Mandal case (Indra Sawhney v Union of India) judgment of 1992 which upheld the Government of India's Order of 1990 under the late Shri V.P. Singh (I was the Secretary of the concerned Ministry of Welfare then and that Order was issued as per my guidance) recognizing the Socially and Educationally Backward Classes and providing 27% Reservation for them in direct recruitment (not promotion) to the appointments and posts in the services of the State under the Central Government and Central PSUs and other Central institutions.
Evidence must be provided to the Commission of the social and educational backwardness and inadequate representation of the applying caste/community in the services of the State.
After examination and enquiry, if the State Commission is convinced and arrives at the finding that the applicant caste is socially and educationally backward and inadequately represented in the services of the State, it advises the concerned State Government for the inclusion of that caste in the State List of BCs. Otherwise, it tenders Advice the State Government to reject the application. Otherwise it tenders Advice to the State Government to reject the application. The Advice of the State Commission is ordinarily binding on the State Government. In cases of disagreements with the Commission the Government has to record reasons.
PROCEDURE FOR INCLUSION OF A CASTE/COMMUNITY IN THE CENTRAL LIST OF BCs
For inclusion in the Central List of BCs of a caste or community not already included in the Central List, an application must be made to the National Commission for Backward Classes (NCBC), also established pursuant to the Supreme Court's direction in the Mandal case judgment. The NCBC as also some of the State Commissions for Backward Classes have been established by statute, in the case of the Centre, by the National Commission for Backward Classes Act, 1992. The NCBC, after examination and enquiry tenders Advice to the Central Government for inclusion of an applicant caste/community in the Central list of BCs if the NCBC is convinced that it is socially and educationally backward and inadequately represented in the services of the State; and otherwise to reject the application. The NCBC's Advice is ordinarily binding on the Central Government. In cases of disagreements with the Commission the Government has to record reasons.
The Central Government has almost never disagreed with the NCBC's Advice. A rare instance of disagreement was the decision of the Central Government just before the Lok Sabha elections of 2014 to include Jats in the Central List of BCs for a number of States, over-ruling the NCBC's Advice; and this decision of the Central Government was set aside by the Supreme Court shortly thereafter. In 1997, there was a split Advice of the NCBC to Central Government where the Central Government referred it back to the NCBC (this case will be dealt with in my forthcoming book referred to above).
After the issue of the Common Lists, following the procedure laid down in the OM of 1990 and the Supreme Court's direction of 1992, explained under the head "Central List — Its Preparation", the NCBC took up applications of various castes and communities for inclusion in the Central List, which did not find place in the Common Lists.
Before examining individual applications, the NCBC laid down well-thought-out Guidelines for Consideration of applications, carefully prepared a Questionnaire to be filled by the applicants and issued clear Guidelines for Filling up the Questionnaire and a transparent procedure for speedy examination of applications. This transparent procedure included one or more Public Hearings in each case, preceded by wide publicity through media through locally popular media.
So far, the applications of about 350 castes / communities for inclusion have been advised by the NCBC for inclusion (apart from applications of sub-castes, synonyms of castes/communities already included in the Central List) and the applications of about 470 castes have been advised to be rejected. Among the castes whose applications were rejected, are "powerful castes", some of whose members had mounted agitations against Reservation for Backward Classes in 1990 all over North India and again, less intensely but equally virulently, in 2006-2007. Among the prominent faces in the electronic media and in Delhi's politics, I can recognize some of the active agitationists of 1990 and 2006-2007. When Reservation for BCs was introduced in a State in 1981, one of these powerful castes agitated against it by attacking the Scheduled Castes, and again in 1995, when in that State the percentage of Reservation for BCs was increased to 28% post-Mandal. All these agitations were against Reservation for Backward Classes with snide attacks on Reservation for SCs and STs also. Their applications were rejected for the simple reason that they are not socially backward. Nor are they educationally backward. Nor, further, are they inadequately represented in the services of the State.
In the contrary, their representation in the services is multiples of their population proportion.
It is one of these castes that has now changed its tactics and is agitating for its inclusion in the list of Backward Classes or scrapping of all Reservation altogether, giving another opportunity for the media to provide publicity with a slant against Reservation, as they have been doing in the past too whenever anything was done for the SCs or STs or BCs or whenever any section mounted agitation against whatever limited was done for the SCs, or STs or BCs as mandated by the Constitution.
One of the allegations of the Writ Petitioners of 2006-2007 against the Central Educational Institutions (Reservation in Admission) Act, 2006 (the Writ Petitions started even before the Act was passed or even moved in the Parliament) was that the inclusion of castes in the BC lists was arbitrary and powerful castes had been included. The Ministry of Human Resources Development (HRD) had sought my help as Advisor to guide the Government's defence, aware of my knowledge, background, objectivity and loyalty to the Constitution.
I agreed to be Advisor on the condition that no remuneration would be paid to me, which is my usual condition for undertaking any work connected with the legitimate rights of SCs, STs and BCs. Since I was in the know of the entire matter, I could provide necessary information to the Government's Counsels and they, on that basis, showed to the Supreme Court how it was powerful castes which were not socially backward whose applications had been rejected, and submitted the Findings and Advices of NCBC in a number of illustrative cases. These include the cases of some of today's agitationists. This seems to have impressed the Supreme Court of the principled way, based on the Constitutional mandate and socio-historical facts, in which applications for inclusion had been considered. The Supreme Court upheld the Constitutional validity of the impugned legislation which provided Reservation for SCs, STs and BCs in the Central and Centrally Aided educational institutions. This credibility should be maintained. For maintaining this credibility, the Central and State Governments and the National and State Commissions should be absolutely scrupulous about unequivocally repudiating and rejecting the pressures of powerful non-Backward castes to infiltrate into the list of BCs and also any other wrong attempts to include in the Schedule of SCs, castes which did not and do not suffer from "Untouchability" and to include in the Schedule of STs non-tribal communities and communities which though tribal do not fulfil the criteria of STs. Unfortunately, Governments often falter knowingly and deliberately especially on the eve of general elections. This will not only harm the genuine SCs, STs and BCs, but also make it all the more difficult for India for optimally progress.
AGITATIONS AND THE ABILITY TO MOUNT AGITATIONS, IS NOT A CRITERION FOR INCLUSION IN THE LIST OF BCs
Of the castes which have been rejected on the objective Advices of the NCBC, two or three of those which have numerical social, economic and political power are the ones which are now agitating for inclusion. Gujjars and Yadavs are not among the agitationists as confidently stated by Shri K. N. Bhat in his article referred to above. Gujjars have already been included in the Central lists for all States where they exist. What the Gujjars in Rajasthan agitated for was for recognition as a Scheduled Tribe and inclusion in the Schedule of STs. Realizing the impossibility of this effort, they have settled for recognition as a category of BCs with a separate sub-quota. The complications still existing in this case will be explained separately. Yadavs have been included in the Central List for all States where they exist. Therefore, the question of their agitation for inclusion in the list of BCs does not arise.
At present, the agitating castes are the Patidar/Patels of Gujarat, the Marathas of Maharashtra and the Jats of a number of north-western States. Marathas have been rejected by the State Commission for inclusion in the State List of Maharashtra and by the NCBC for inclusion in the Central List for Maharashtra on the ground that they are not socially backward. Jats, with the exception of part of Rajasthan, have also been rejected. I am not sure whether the Patels or Patils have ever gone before the State Commission. To my knowledge, they have not applied to the NCBC.
If the application of a caste for inclusion is rejected by the State Government or Central Government, following the above procedure detailed above, the remedy laid down by the Supreme Court in the Mandal case judgment is that in such cases appeal lies to the Supreme Court and only to the Supreme Court.
The agitation of Patels or Patidars of Gujarat is not new. The renowned social scientist Shri Viswanathan said in a TV programme recently that this is something new. It is not factually correct. As I mentioned earlier, they agitated in 1981 by attacking the SCs when Reservation was introduced for BCs in Gujarat and again in 1995 when the State Government increased the percentage of Reservation of BCs in that State to 28% after the Supreme Court's Mandal case judgment. On both occasions, they were against all Reservations. Now also their demand is scrapping of all Reservations or the inclusion of Patels / Patidars also in the list of BCs — the latter is just impossible for the simple reason mentioned earlier. Therefore, effectively their real demand is the old demand to scrap all Reservations, which is nothing new.
Agitations and the ability to mount agitations do not constitute a criterion for inclusion in the list of BCs or in any list. It is in fact evidence that the agitating communities do not have justification to get included in the list of BCs or any other List that they seek to be included in.
WHAT NEXT?
— For SCs, STs and BCs
The monstrosity and utter impossibility of the demand for inclusion of any Socially Advanced Caste in the list of Backward Classes (or for that matter the demand of any non-tribe for inclusion in the list or Schedule of STs or the demand of any caste which is not a victim of "Untouchabilty" to be included in the list or Schedule of SCs) does not invalidate the socio-historical realities and Constitutional mandate on which Reservation for SCs, STs and BCs is based.
But, Reservation is only one item in a holistic and comprehensive package of Social Justice measures required to be undertaken, and sincerely and thoroughly implemented in order to achieve the Constitutionally mandated goal of Social Equality, i.e., Equality of SCs, STs and BCs with SACs in all parameters of development and welfare in all fields, such as economic; educational at all levels; health, nutrition and infant and child survival-related; housing and residential areas facilities-related, etc.
I have given to successive Governments, different Prime Ministers, different important Ministers, different political parties and different leaders a complete Road-Map listing out each of these Social Justice measures of which Reservation is one part – legislative measures as well as programmatic/schematic measures (I can e-mail a copy of this Road-Map to anyone of you who ask for it). No Government in India, either at the Central level or at the State level, irrespective of political parties, has applied itself to this vital national task. These measures are based on the Constitutional mandates, Presidential commitments to Joint Sessions of the Parliament, specific Constitutional amendments, Recommendations of authoritative bodies with which I have been associated in one way or the other – as Chairman or as Member or as Advisor or as informal Advisor — such as Committee of Ministers on Dalit Affairs (2005-2008) under the Chairmanship of Shri Pranab Mukherjee, the then Finance Minister, who is the present President; the National Commission for Review of the Working of the Constitution of India under the Chairmanship of Justice (Retd) M.N. Venkatachaliah, former Chief Justice of India; many Plan Working Groups and Planning Commission's Steering Committees, and also public documents formulated by me and adopted, partly or wholly, by successive Governments (but not implemented) like the Dalit Manifesto of 1996, etc. They also figure in my published articles and papers and a book of mine titled Empowering Dalits for Empowering India: A Road-Map (Manak Publications, Delhi, 2009).
Unless this vital task is fulfilled and Social Equality established and the capability is created through sincere implementation of the legislative and programmatic / schematic measures communicated through my Road-Map, India cannot achieve optimal progress. The caste system, the inhuman "Untouchabilty", which is an important part of the caste system, and all-pervasive discriminations and inequalities of the centuries of our history and the decades of our Independence created by the caste system and "Untouchability" are a dead weight on the nation, a heavy stone round our national neck.
Only after the adoption and consistent and thorough implementation of these measures over a reasonable time, and only after, thereby, the capability is created in every deprived and disadvantaged caste / community of India to secure its due share of employment under the State, employment outside the State, self-employment, seats in educational institutions and of every other life opportunity on its own "merit" in open competition can the question of gradually giving up Reservation arise — this has to be done very carefully making sure that there is no danger of relapse. This cannot be dictated by any scholar or academician or leader or Party or any SAC unilaterally. This will have to be arrived at by mutual consultation, at the appropriate stage and time, fully involving the SCs, STs and BCs and SACs.
In other words, the question of gradually giving up Reservation for SCs, STs and BCs can be thought of, only when
(a) their representation, at all levels of the services in each cadre, reaches the proportion equivalent to their proportion in the population of the country, in the case of the services under the Union of India and reaches the proportion equivalent to their proportion in the population of the respective States in the case of the services under the States; and
(b) the State, through the holistic measures mentioned above, enables them to become capable, through open competition, of maintaining the level of representation mentioned at (a); and
(c) "Untouchability" and vulnerable tribal isolation and all their consequences completely disappear, and the SCs, STs and BCs reach the level of Equality with the SACs in all parameters of development, welfare and life.
These tasks can be fulfilled by the Socially Advanced Castes (SACs) who occupy the commanding heights of most of the Central and State governments, who occupy the commanding heights of most crucial institutions including academic institutions, financial institutions, and by relatively stronger communities of BCs, i.e., relatively more populous land-owning communities of BCs. It is they who can, if they are serious, abolish "Untouchability" and desist from its practice by deed, by word and by thought and ensure that all other measures mentioned above are taken without any mental reservation or implementational deficit.
— For SACs
It is true that in the Socially Advanced Castes (SACs), there are persons who are poor and unemployed. But that alone is not the cause of the agitation against Reservation. Psychologically, for many persons of the SACs it is galling to see that persons from communities which they used to looked down upon and whom they still consider inferior have begun to register progress through Reservation and the other limited Social Justice measures that have been taken so far. There is resentment towards persons of the SC, ST and BC communities who have moved forward and upward.
There is adequate information (I can share such information with doubting Thomases, if any) to show that even now in all indicators including poverty, levels of income, educational achievement at each level, living conditions etc, the SACs are best placed while the SCs and STs are at the bottom, with the BCs coming in between, usually closer to the SCs and STs than to the SACs.
All the same the problem of poverty and unemployment does exist among SACs also.
The remedy for this is not the abolition of Reservation. The following figures show that the number of persons who are getting employment in the services under the State through Reservation is only a miniscule part of the number of those who are unemployed.

It can be seen from the above Table that the seats reserved for SCs, STs and BCs in public employment is only a miniscule proportion (0.69%) of the total number of educated unemployed in India. Therefore, to say that Reservation is the cause for unemployment of youth of SACs is Barking up the wrong tree.
So far as those who are poor among the SACs are concerned, the proper remedy is to provide them scholarships and educational loans so that no child or youth has to drop out of education at any stage only on account of financial incapacity of the family. This can be done and should be done without abridging the scholarships and other measures required for the SCs, STs and BCs.
Care must be taken that the poor of the SAC, who are to be helped in this manner, are identified carefully. There are States where such help is provided for the poor among the SACs. The method of identification, namely, certificate of poverty is often availed of by children of well-to-do landowning families because there is no record of their income as is available in the case of salary earners, and poverty certificates from the appropriate authorities can be bought from the prescribed authorities. There are instances of such purchasability of poverty certificate.
So far as unemployment is concerned, various other measures, unconnected with Reservation, are necessary pertaining to the economy. That is matter for a separate discussion. But, what I want to make clear at this stage is that the unemployment that prevails among SAC youth (which is also there among SC, ST and BC youth) has nothing to do with Reservation.
Solution is possible if all sections of the population, but particularly the powerful sections approach issues objectively and not on the basis of birth-based biases of ancient origin and present currency, and if the SACs (subject to honorable exceptions), give up the dream of bringing back a pre-Mandal, pre-Ambedkar situation — in a sort of "Reverse Dandi March".

कल्याणदेव भट्टराई-अन्तत खरबौ खर्चेर तोकेको भन्दा चारदोहर बढी समय लगाएर नेपालको नयाँ संविधान बन्यो ।सत्ताको लागि जे पनि गर्न तयार हुने भ्रष्ट नेताहरु र तीनका जूत्ता पोलिस गर्ने मोटामोटि ५८५ मिलेर जनतालाई एक थान संविधान दिए । तर भोलीका दिनमा यो संविधान एक कागजको खोष्टो सिवाय केही हुने छैन ।
जसरी भए पनि जस्तोसुकै संविधान दिए हुन्थ्यो भन्ने स्थितिमा संविधानसभालाईपुर्याए त्यही जस्तोसुकै संविधान अहिले जारी गरिएको छ । यसले नागरिक र मुलुकलाई के दिन्छ ? भन्ने प्रश्न अबका दिनमा उठ्ने छ ।जनता संविधान आयो भनेर खुसी हुने कुनै ठाँउ छैन । बरु अब संविधानसभा भन्ने कमईखाने भाँडो रहनेछैन भन्नेमा खुसी हुने छन । विवादका बीचमा एक थान कागजको खोष्टो प्राप्त गर्न कुनै पनि दृष्टिकोणले जनताको लागि उपलब्धि हुनै सकिदैन ।
पाँच लाख मूल्य पर्ने सामानलाई पन्ध्र खरबमा खरीद गरेर बाँकी आफनै खरीदकर्ताले आफै झ्वाम पार्नु गरीब र अविकसित देशको लागि लज्जाको विषय हो । निर्विवाद भ्रष्टाचार गरेर बनाईएको संविधानले मुलुकलाई कस्तो बनाउला । यसको जवाफ कसले देला ।
हो,एउटा कुरामा खुसी व्यक्त गर्न सकिन्छ कि अब उपरान्त यी भ्रष्टाचारी जमातले संविधानलाई नै कारण देखाएर देशलाई लुट्ने, गर्नै नहुने काम गर्ने विकासका कार्य बन्द हुने छ । आफ्नो पार्टीको अधिवेशन समयमा गर्न नसकेर अन्तरिम संविधान संशोधन गर्न खोज्ने नसके नयाँ संविधानमै आफ्नो पार्टी अनुकुलको संविधान बनाउने कहाँ सम्मको हर्कत हो ?
राजनीतिमा सबै चरित्र घिनलाग्दा भईसके । वितेका ८ वर्षमा अनेक काम भए । दुई- दुई ठाउमा हारेका लार्यि प्रधानमन्त्री बनाउने, प्रधानन्यायधीशलार्इ प्रधानमन्त्री बनाउने, प्रधानमन्त्री बनाउन एक्काइस पल्ट चुनाब गराउने लगायत विभिन्न गैरप्रजातान्त्रिक घिनलाग्दा तमासा प्रदर्शन गरे दलहरुले ।
यी नौटंकीहरु अब पनि यस्तै प्रदर्शन गर्दैनन् भन्ने हामीसंग कुनै ठोस आधार छैन ।जनताको राय बुझने भन्दै अरबौ खर्चेर देशभरी प्रदर्शित गरेको दुई दिने नौटंकीले पनि स्पष्ट पारको छ कि वर्तमान राजनितिक नेता भनौदाहरुको न त जनताप्रति कुनै आस्था छ , न त तिनमा उत्तरदायित्वबोध छ, न त प्रजातान्त्रिक संस्कार छ, न त जनताको लागि नै यीनले राजनितिक पेशा रोजेका हुन । जनताले जबरजस्त रुपमा माग गरेको प्रधानमन्त्रीको सिधा चुनाव बाट छनोट गर्ने लगायत चौरासी प्रतिशत जनता हिन्दु भएकोले देशलाई हिन्दु राज्य भन्नु पर्ने सामान्य प्रजातान्त्रिक मागलाई पनि नेताहरुबाट अश्वीकार गर्नुले यीनीहरु देश लुट्न राजनितिमा लागेका जमात हुन र यीनीहरु संग कुनै पनि प्रजातान्त्रिक संस्कार छैन बिना संकोच भन्न सकिन्छ ।
अहिले टि।भि। मा, अखबारमा जताततै यी भ्रष्ट, देश लुटेर धनी भएको जमातहरुको मूस्कान र एक अर्का प्रति बधाईको ओइरो लागेको देखिन्छ । यी भ्रष्ट नेताहरुको यो खुसीहाँसो जनताले केहि प्राप्त गरे भनेर हुदै होइन किनभने आम नेपाली जनताले त केही प्राप्त नै गरका छैनन् । आम जनतालार्इ त मुर्ख बनाइएको छ ।जातियताको नाममा, विभिन्न भाषा, क्षेत्र, धर्मको नाममा एक अर्काको विरुद्ध अनावश्क रुपमा भड्काइएको छ । जे प्राप्त गरेका छन् ,तीनै सत्तालिप्सा भ्रष्ट नेता र तीनका तावेदारहरुले प्राप्त गरेका छन र त्यो आप्mनो प्राप्तिमा यी लुटेरा जमातहरु उन्मूक्त भएर हाँसेका छन र खुसी भएका छन् ।
हिजो सम्म आतंककारी भनेर टाउकोको मूल्य तोकिएकाहरु आज देशलाई ६७ वर्ष देखि जनताले मागेको संविधान दिनेमा रुपान्तर भएपछि खुसी नहुने कुरै भएन । विगत २७ वर्ष देखि देशलाई लुट्दै औषधि उपचार देखि विभिन्न बहानामा देशको धनलाई आफ्नो बपौति ठान्दै प्रयोग गरेर आइरहेका डाँकाहरुको जमातले संविधानमा जनताको भ्रष्टाचारीलाई फाँसीको सजायको मागलाई अश्वीकार गर्दै –अख्तियार दुरुपयोगको अधिकारमा भारी मात्रामा कटौती गरेर देशलाई लुट्न चारैतिरबाट खुल्ला राख्न सफल भएपछि भ्रष्टहरुको अनुहारमा त्यस प्रकारको उन्मूक्त हाँसो प्रस्फुटन हुनुमा के अच्चम्म भयो !
संविधानमा जनताले खुसी मान्न पर्ने के आधार छ । अब केहि राम्रो हुन्छ भन्ने ठाउँ कहाँ छ । वर्तमान व्यथिति र लुटलाई अन्त गर्ने आधार के छ । यस अवस्थामा जनताले किन खुसी हुनुपर्ने ।संविधान स्वयंममा साध्य होइन यो त देशलाई विकास गर्न र आम जनतालाई आ – आप्mनो जिविका संचालन गर्न पर्याप्त र सजिला सुगम बाटोहरु खोलिदिने तथा स्वास्थ्य शिक्षा, रोजगारी, बसाई जस्ता अत्यावश्क कुराको परिपुर्ति गर्नको लागि बनाइने एक साधन मात्र हो । संविधान स्वयंमले न त कुनै कार्य गर्छ, न त कुनै परिवर्तननै लिएर आउन सक्छ ।यस्ले त सहि रुपमा देश र जनताको उन्नति को लागि कार्य गर्न सक्ने एक बाटो मात्र खोलिदिन्छ ।
इमान्दारिताका साथ भन्ने हो भने हाम्रो देशमा आज सम्म लागू गरीएका कुनै पनि संविधानले यो देशलाई विकास गर्न र आम जनतालाई समृद्धि बनाउने बाटो कहिले पनि बन्द गरेको थिएन – तथापी हामी अज्जै सम्म पनि यहि गरीबी, अशिक्षा,पछौटेपन, थिचोमिचो, बेइमानी लगायत भ्रष्टाचार जस्तो क्यान्सररुपी भाइरस बाट ग्रस्त भएका छौं । यी सबै हाम्रो राम्रा काम गर्ने चाहनालाई संविधानले रोकेकोले होइन बरु जे जस्तो संविधान भएपनि बेक्कारको राजनितिक कारण देखाएर यो देशलाई साशन गर्ने डाँकाहरुले साशनको नाममा देश लुटेको र जनतालाई मूर्ख बनाएको हो भनेर भन्न कुनै संकोच गर्नै पर्दैन । यस यथार्थतालाई मध्य नजर गरेर भन्ने हने भने ती नेता भ्रष्ट संस्कार बोकेका, देश भनेको लुट्नकै लागि हो भनेर मान्यता राखी राजनितिमा आएका र सत्ता को लागि आप्mनो चेलीबेटी सम्म बेच्न तयार हुने भ्रष्ट सत्तालिप्सा भएका जमात नै पुन शासक बन्ने नयाँ संविधानले कसरी देशमा सकरात्मक परीवर्तन लिएर आउछ, देशको मनोबल बढाउछ र देशको उन्नति गर्छ 'पूरानो रक्सि नयाँ बोतलमा राखेर जनतालाई विभिन्न सक्ने नसक्ने आश्वाशन बाडेर, अनेक थरीका दुई घन्टा पनि नटिक्ने वकम्फूसे कूरा गर्दै आफु नेता भएको भ्रममा बाचेका यी भ्रमका नाईकेहरुले नयाँ संविधान आउदैमा देशको विकास कसरी गर्छन ।
बिगत ६५ वर्ष देखि एउटा संसद भवन बनाउन नसक्ने र राष्ट्रपति लाई पुलिस कार्यलयमा राख्ने देशले सात वटा गभर्नर भवन, संसद भवद बनाउदै देशको निर्माण गर्ने र जनताको जीवनस्तर उठाउने जस्ता बकम्पूmसे गफ गरेर जनतालाई अनेकौ हुनैनसक्ने आश्वाशन बाड्दै खाली आप्mना भ्रष्ट कार्यकर्तालाई देश लुट्ने पद सिर्जना गर्न बनाइएको संघीयता स्वयंमा नै एक मूर्ख हास्यासपद र टिक्नै नसक्ने कार्य हो भनि सबै नेपालीले बुझेको यथार्थता हो । वर्तमान कटु यथार्थता के हो भने भ्रष्ट कमिसनखोर सत्ता लोभि जमातलाई खुसी हुने र उन्मुक्त भएर हास्ने प्रशस्त ठाउँ यस संविधानले दिए पनि जनता खुसी हुनुपर्ने र कुनै सकारात्मक परीवर्तनको आशा राख्नुपर्ने कुनै आधार नै नयाँ संविधानले नदिएकोले जनता किन खुसी हुने १ हो जनताले चाहे अनुसार र देशमा ठोस सकरात्मक परीवर्तन लिएर आउन आवश्यक पर्ने केहि आधारहरु नयाँ संविधानमा समावेश गरेको भए जनताले पनि खुसी मनाउथे होलान् । देशलाई संचालन गर्न प्रधानमन्त्रीको सिधा चुनावबाट छनोट गर्ने प्रावधान नराख्नुको कारण नै वर्तमान भ्रष्ट नेताहरुसंग जनतामा जाने हिम्मत, देश बनाउने कुनै ठोस योजना र गरीबी अन्त गर्ने कार्यक्रम आदि नभएकोले नै होइन र ।
बिदेशी दूतावासबाट प्राप्त मोटो खामबाट कुनै पनि ठाउमा धाँधली गरेर पन्ध्र बिस प्रतिशत मत मात्र प्राप्त गरेपनि वर्तमान नियमले विजय हुन पाइने र एक पटक सभासद भएपछि पैसा र विभिन्न प्रलोभनको आधारमा बाँकी आवश्यक सभासदको संख्या सजिलै प्राप्त गर्न सक्ने भएकोले नै देश लुट्न आएका डाँकाहरुले प्रधानमन्त्रीको सिधा चुनावको प्रावधान नराखेको हो भन्ने सबैले नबुझेको कहाँ हो र !
त्यस्तै देश लूट्ने एक मात्र उद्देश्य राखि जीवन चलाउन सक्ने अन्य कुनै क्षमता, योग्यता र सिप नभएका जमातहरुको राजनितिमा भिड भएकालेनै अख्तियार दुरुपयोग आयोगको अधिकार कटौती नगर्ने भ्रष्टाचारीलाई मृत्यू दण्ड दिने र महत्वपूर्ण पदको लागि कुनै सैक्षिक योग्यता राख्ने जस्ता प्रावधान राजनितिमा डकैतहरुको बाहूलियता भएकोले नै समावेश गर्न नसकेको हो भनेर सबै नेपालीले बुझेका छन् ।
अपीतु संविधानमा देश लुट्न आएका भ्रष्टाचारी सत्तालिप्सा डाँकाहरुलाई खुसी बनाउन अनेकौ कारण भएपनि आम नेपाली जनताले खुसी मनाउनुपर्ने कुनै पनि कारण नभएको र "बेल पाक्यो कागलाई हर्ष न विस्मात"भनेझै आम नेपाली जनताको लागि संविधान नामाकरण गरीएको एक कागजको खोष्टा बाहेक अरु केहि नभएको र यसले वर्तमान जनताको स्थितिमा कुनै सकरात्मक परिवर्तन लिएर नआउने यथार्थतालाई बुझेको हुनुपर्छ ।

नेताजी अगर जिंदा थे,तो उन्हें किसने मारा और हत्यारे ने कोई सबूत पीछे नहीं छोड़ा कि इस महादेश के नेताजी क व्यक्तित्व कृतित्व पर परदा जो तना हुआ है.उसे एक झटके से हटा दिया जाये और कातिल का चेहरा भी बेनकाब हो जाये।
ममता बनर्जी और नरेंद्र भाई मोदी के साथ साथ संघ परिवार का एजंडा मालूम है।लेकिन ममता बनर्जी ने एक तीर से दो निसाने साधकर कांग्रेस और वामपंधियों को किनारे करके जनसंहारी अश्वमेध में हिंदुत्व सुनामी का नये सिरे से जो महाआयोजन किया है,वह संघ परिवार के लिए खतरे की घंटी भी है प्रलयंकर।
जगजाहिर है कि हमारे तमाम कामरेड ऐतिहासिक भूलों के लिए मशहूर हैं और लकीर के फकीर भी वे बने हुए हैं बेशर्म और जनता ने इसकी सजा बी उन्हें खूब दी है।
ममता दीदी का धन्यवाद कि नेताजी का रहस्य खुला भी नहीं तो क्या,नेताजी के दिलोदिमाग में हिंदुस्तान की जो तस्वीर थी और उनकी आजादी का जो मतलब था,वे सारी बातें अब सार्वजनिक हैं।
मसलन आज सुबह के संस्करण में बांग्ला दैनिक एइ समय ने अंतर्ध्यान से पहले नेताजी का बंगाल में 24 परगना युवा सम्मेलन को संबोधित भाषण का पुलिसिया रिकार्ड हूबहू छाप दिया है।
इस भाषण से पता चलता है कि नेताजी द्वितीय विश्वयुद्ध से पहले से आजादी की खुशबू महसूस ही नहीं रहे थे बल्कि आजादी के लिए हर तैयारी कर रहे थे।आजादी जीतने के लिए हर जंग के लिए वे तैयार थे।इसी जंग के लिए वे जनता को जोड़कर मोर्चाबंद करने के मुहिम में लगे थे तो कांग्रेस ने उनका साथ कतई नहीं दिया।
अपने इस संबोधन में दुनियाभर की घटनाओं का उनने विश्लेषण किया।पूंजी वाद और साम्राज्यवाद के गढ़ों को ढहाने के लिए वे स्टालिन के साथ हिटलर की मोर्चाबंदी को रणनीतिक तौर पर सही मान रहे थे और मान रहे ते कि इस महादेश को अंग्रेजी हुकूमत के खात्मे के बाद पूंजी और साम्राज्यवाद से सबसे ज्यादा नुकसान पहुंचने वाला है और इसे रोकने के लिए जोसेफ स्टालिन की रणनीति को वे सही मान रहे थे।
भारत छोड़ने की उनकी प्रेरणा निर्णायक आजादी की लड़ाई छेड़ने की मुकम्मल तैयारी थी।
इस भाषण से साफ जाहिर है कि नेताजी बेहद बेचैनी के साथ महसूस करने लगी थी कि कांग्रेस कोई आजादी वाजादी की लड़ाई लड़ ही नहीं रही थी।आजादी की लड़ाई को नेतृत्व देने की बात तो बहुत दूर की कौड़ी है,वैश्विक हालात और बरतानिया की शिकस्त को नेताजी जिस तरह पढ़ पा रहे थे,तथाकथित राष्ट्रीय नेता उसे सिरे से नजरअंदाज कर रहे थे और सारे के सारे लोग किसी भी तरह,येन तेन प्रकारेण सत्ता पर काबिज होने के फिराक में थे।
दूसरी तरफ, नेताजी बार बार गुहार लगा रहे थे कि देश के तमाम वामपंथियों, सेकुलर और डेमोक्रेटिक ताकतों का गठजोड़ बनाकर कांग्रेस आजादी का हीरावल दस्ता बने और हिंदुत्व के पुनरूत्थान के खिलाफ जमकर लोहा लें।
नेताजी मान रहे थे कि मुसलमानों से नफरत की वजह से मुल्क का बंटवारा करने पर तुली हैं सबसे ज्यादा हिंदुत्ववादी ताकतें और कांग्रेस जानबूझकर उन ताकतों की मददगार है।
नेताजी मान रहे थे कि हिंदुत्व से इंसानियत का मुल्क हिंदुस्तां की सरजमीं का चप्पा चप्पा खतरे में है जो आज भी सबसे बड़ा हकीकत है।नेताजी ने तब बंगाली युवाजनों को चेता रहे थे कि हिंदू महासभा का,संघ परिवार का मुकाबला डटकर नहीं किया तो पूरा देश जलेगा नफरत की आग में और खून की नदियां बहेंगी।
वही तो हासिल हुआ है और बाकी सबकुछ नेताजी की तरह गुमशुदा है।किसी को मालूम भी नहीं है कि जिंदा भी है या मर गया है नेताजी की तरह सबकुछ।
युवाजनों का वे वक्त की चुनौतियों का मुकाबला करने की तैयारियों में चुस्त चाकचौबंद और लामबंद रहने का आवाहन कर रहे थे और उनकी चेतावनी थी कि वक्त का मुकाबला न किया तो बंगाल तो क्या सारा देश सांप्रदायिक हो जायेगा और हिंदुस्तान तबाह हो जायेगा।वे हिंदुत्व को मुल्क और इंसानियत के लिए सबसे बड़ा खतरा बता रहे थे।
संघ परिवार के लिए नेताजी को भगवान बनाकर पूजना उतना ही आसान है जैसे वे फिलवक्त अंबेडकर को विष्णु का अवतार बनाने को तुले हुए हैं।अंबेडकर और नेताजी के डायनामाइट से उनके हवाई किले सबसे पहले तहस नहस होने हैं।
सारी अफवाहें बिना किसी सबूत के नेताजी के हत्यारे बतौर नेहरु को कटघरे में खड़ा करने के मकसद से हैं।
दीदी ने जो दस्तावेज जारी किये हैं,उससे कांग्रेस और वामपंथी भले कटघरे में खड़े हैं,लेकिन किसी भी सूरत में साबित नहीं हुआ है कि आखिर इस देश की सबसे अजीज शख्सियत का अंजाम क्या हुआ और सच यही है कि पहले जैसे लापता थे नेताजी,इन दस्तावेजों के जगजाहिर होने के बावजूद उसीतरह लापता है नेताजी।
केंद्र के पास जो 135 फाइलें है ,जाहिर है कि उनसे नेहरु को हत्यारा साबित किया नहीं जा सकता।
वरना अटल बिहारी वाजपेयी की सरकार उन्हें तभी सार्वजनिक कर देती।नेहरु और कांग्रेस को कटघरे में खड़ा करने से नहीं चूकती।
केंद्र के बजाय बंगाल सरकार की पहल पर भी संघ परिवार में मामूली सी हलचल नहीं है।
ऐसा करिश्मा क्यों हो रहा है,इस पर खास गौर करने की जरुरत है।
ऐसा इसलिए हो रहा है क्योंकि नेताजी पूंजी और साम्राज्यवाद से भी बड़ा खतरा हिंदुत्व को मान रहे थे और संघ परिवार इस सच को किसी कीमत पर उसीतरह लाना नहीं चाहती।
उसीतरह जैसे अंबेडकर की पूजा अर्चना के सिवाय अंबेडकर के विचारों और खासकर उनके आर्थिक विचारों से संघियों,कांग्रेसियों या वामपंथियों को कुछ लेना देना नहीं है।
जाति उन्मूलन के जरिये वर्गीय ध्रूवीकरण की हर गुंजाइश को खत्म करने की कोशिशों का नाम है क्लास रूल,क्लास कास्ट हेजेमनी की यह सियासत जो चरित्र से फासीवादी है और इसीवजह से राष्ट्र सैन्य व्यवस्था में तब्दील है।नागरिकों के तमाम हकहकूक का काम तमाम और जनसंहारी अश्वमेध है तरक्की का नाम।
नेताजी के इस भाषण में अंध राष्ट्रवाद का नामोनिसां नहीं है जिसका अवतार उन्हें आजाद देश की सियासत ने बनाया है और न फासीवाद के हक में नेताजी खड़े थे जबकि भारत में फासीवाद को रोकने की हरचंद कोशिश के लिए वे जनता की लामबंदी के लिए लड़ रहे थे और उनके इस फासीवादविरोधी इंसानियत की जमीन पर तामीर हुआ आजाद हिंद फौज का मुकम्मल हिंदुस्तानी फौज जिसका हिंदुत्व से दूर दूर का वास्ता नहीं है।
कांग्रेस को अपने पापों का घड़ा फूटने का डर रहा होगा लेकिन संघ परिवार को उससे बड़ा डर है कि सच उजागर हो गया तो नेताजी उसके हिंदुत्व के एजंडा के लिए जिंदा या मुर्दा बेहद भारी पड़ने वाले हैं और इसीलिए संघ परिवार की दो दो सरकारे नेताजी की 135 फाइलों पर खामोश बैठी रही और इस मुल्क से उनका सरोकार बस बिजनेस फ्रेंडली हुकूमत का नस्ली वर्चस्व वेले अबाध पूंजी का राजकाज है,जिसके सखत खिलाफ रहे हैं नेताजी।
यहां तक कि नेताजी साम्राज्यवाद,पूंजी और फासीवाद के त्रिशुल के मुकाबले जहर से जहर काटने की तर्ज पर फासीवादियों के साथ स्टालिन के नक्शेकदम पर लामबंद होकर एकमुस्त अमेरिकी और ब्रिटिश साम्राज्यवाद के साथ साथ हिंदुत्व के पुनरूत्थान को भी शिकस्त देने की कोशिश कर रहे थे।
मजहबी सियासत जिनकी पूंजी है,नफरत की नींव पर खड़े हैं जिनके तमाम शीशे के तिलिस्म,उनके लिए नेताजी से बढ़कर कोई खथारा दूसरा नहीं हो सकता।
इसीलिए संघ परिवार इन सवालों से टकराने से परहेज कर रहा है किः
देश को आजाद कराने के लिए क्यों छोड़ा नेताजी ने देश और क्यों सत्ता वर्ग ने उन्हें जिंदा दफना दिया?
क्या चल रहा था नेताजी के दिलोदिमाग में?
क्यों नेताजी पूंजीवाद और साम्राज्यवाद से बड़ा खतरा मान रहे थे हिंदुत्व के पुनरूत्थान को मुल्क और इंसानियत के लिए?
क्यों नेताजी स्टालिन से प्रेरित होकर जर्मनी पहुंच गये जंग में हार का नतीजा जानते हुए?
क्यों नेताजी की लगातार चेतावनियों के बावजूद कांग्रेस ने पूरे देश को जोड़ने की कोई कोशिश नहीं की?
मेरे पिता पुलिनबाबू ने और उनके दोस्त बनारस में शहीद मणींद्र बनर्जी के सबसे छोटे भाई स्वतंत्रतासेनानी बसंतकुमार बनर्जी की खास कोशिश रही है कि कमसकम नेताजी क्या हैं,मैं इसे समझ लूं।
इतिहास कायदे से पढ़ भी नहीं पाया था कि उनदोनों ने मिलकर मुझे पहले और दूसरे विश्वयुद्ध का इतिहास सारे ब्यौरों के साथ पढ़ा दिया और तबसे लेकर ये सवाल हमरे वजूद के हिस्से हैं और हम उनसे टकराकर बार बार बारंबार लहूलुहान होते रहे हैं कि देश का बंटवारा किन्हीं विदेशी ताकतों की न साजिश है और न कारस्तानी।
बंटवारा उन्हीं लोगों ने कियाजो फिर बंटवारे पर आमादा हैं।
यह कुरुक्षेत्र बेइंतहा,बेपनाह सजाया हमारे ही लोगों ने जिन्हें हम राष्ट्र नेता के बतौर हर वक्त अपने साथ नत्थीकिये हुए हैं और उन्ही साजिशों और कारस्तानियों का कुल नतीजा यह है कि नेताजी जनता की नजर में जो हैं सो हैं,सेकुलर और डेमोक्रेट,कम्युनिस्ट और माओवादियों की नजर में भी फासिस्ट खलनायक गद्दार हैं नेताजी और जो असल गद्दार,असल खलनायक,असल फासिस्ट हैं वे सारे के सारे सेकुलर डेमोक्रेट हैं।
नेताजी की फाइलों में दरअसल यही राज दफन है और इंसानियत के मुल्क को फासीवाद के शिकंजे से रिहा करने वास्ते इस सच का खुलासा करना बेहद जरुरी है और उन सवालों का जवाब भी खोजना अनिवार्य है,जिसका सामना न करने से आज देश में हर कहीं आग लगी हुई है और हर कहीं खून की नदियां बहने लगी हैं और हर किसीके हाथ पांव तो कटे ही कटे हैं,चेहरा तक गायब है।
अपने वजूद के बारे में मालूमात करने के लिए बी ये सवाल बेहद मौजू हैं किः
देश को आजाद कराने के लिए क्यों छोड़ा नेताजी ने देश और क्यों सत्ता वर्ग ने उन्हें जिंदा दफना दिया?

24 परगना युवा सम्मलन में नेताजी ने अपने भाषण में ब्रिटिश प्रधानमंत्री चैंबरलेन के इस्तीफे का जिक्र करते हुए कहा कि वे संकट की घड़ी में प्रधानमंत्री पद से इस्तीफा देकर सर्वदलीय सरकार में मामूली मंत्री बन सकते हैं तो भारत की आजादी की लड़ाई में शामिल तमाम लोग कांग्रेस में क्यों नहीं हो सकते और कांग्रेस को वामपंथियों से इतनी परहेज क्यों है।हूबहू अनुवादः
नेताजी ने कहाः1938 में म्युनिख समझौते से जो अमन चैन का दावा किया गया,उसीसे साफ जाहिर है कि फिर जंग लाजिमी है।तबसे लगातार चीख रहा हूं कि वक्त के मुकाबले के लिए तैयार हो जाइये।तब कोई तैयारी की नहीं।अब लड़ाई जब शुरु हो चुकी है और 8-9 महाने बीत गये,तब भी आप कुछ कर नहीं रहे हैं।...हमने जबाव में कहा और आज भी कहता हूं कि अगर आजादी की लड़ाई में हम हार भी गये तो परवाह नहीं,हमें आजादी की जंग लड़नी होगी।हमें पीछे हटना नहीं है और आगे बढ़ते चले जाना है।लड़ाई से पहले हाथ पांव जोड़कर बैठ जाने का कोई मतलब है नहीं।1921 में आंदोलन हुआ।1930 में हुआ।1932 में हुआ।हम हारते रहे हैं।उस हार से हमें शर्मिंदा होने की जरुरत नहीं है।क्योंकि उन हारों के जरिये हमने लड़ाई के मार्फत अपने आत्मसम्मानबोध का परिचय दिया।और इन्हीं हारों से आजादी का जुनून पैदा हुआ और वही हारें हमारी ताकत में तब्दील हैं।हम कह भी सकते हैं कि कमसकम हमने कोशिश की।कमसकम एक पार्टी लड़ रही थी।लेकिन हम नाकाम रहे क्योंकि गांधीजी की कांग्रेस ने हमारा साथ नहीं दिया….
नेताजी ने कहाः
यूरोप में इतना उथल पुथल है और कांग्रेस वर्किग कमिटी क्या कर रही है।कोई काम करना तो दूर,एकसाथ बैठकर इस मसले पर कोई सलाह मशविरा की भी नौबत नहीं है।वे अंग्रेज अगर लेटलतीफ हैं,तो हम क्या हैं,मुझे मालूम नहीं है।लेकिन उम्मीद है कि देश के युवाजन हालात पर जरुर गौर करेंगे।वे अपने खून की गर्मजोशी जरुर जाहिर करेंगे,मुझे उम्मीद है।
नेताजी ने कहाः
हमारे लिए सबसे बड़ा कार्यभार यह है कि हम किस तरह पूरे मुल्क को जोड़कर एक बना दें।यह जो भीषण परिस्थितियां हैं,हम एकसाथ लामबंद हुए बिना किसी भी सूरत में उनका मुकाबला कर नहीं सकते।हम लोग एकताबद्ध होने के लिए जो कुछ कर रहे हैं,वह कतई काफी नहीं है।
नेताजी ने कहाः
सवाल यह है कि कांग्रेस में यह विभाजन क्यों है।राष्ट्रहित में गांधी वादी और वामपंथी अलग अलग क्यों हैं,सवाल यह है।क्यों नहीं उनमें एकता होती,सवाल यह है।नार्वे पर हमला हुआ तो ब्रिटिश प्रधानमंत्री को लगा कि हालात के मुकाबले पहल उन्हीं को करनी चाहिए।उनने कर दी पहल।यही असल देशभक्ति है।अब भी उनमें (अंग्रेजों में) देशभक्ति है।मिस्टर चैंबरनलेन ने प्रधानमंत्री पद से इस्तीफा दे दिया और नये मंत्रिमडल में मामूली मंत्री भी बन गये। कितना निःस्वार्थ होने पर ऐसा संभव है,सोचें।नतीजा यह हुआ कि ब्रिटेन में सारे दलों में एकता हो गयी।
नेताजी ने कहाः
उनकी जैसी भयंकर समस्या है,उससे कम भयंकर हमारे हालत नहीं हैं।अगर हमारी युवाशक्ति जाग रही होती तो बहुत पहले देश एकताबद्ध हो गया होता।
नेताजी ने कहाः
कांग्रेस के बाहर जो ताकतें हैं,उनका और कांग्रेस का एका क्यों नहीं हो पा रहा है,सवाल यह है।यह एकता तभी संभव है जब हम सारे लोग मिलजुलकर कोशिश भी करें।हम कोशिश करें कि जो हालात हैं,उनके मुकाबले कांग्रेस के मध्य हम पूरे देश को एकजुट करें।बाहर जो हैं खड़े,उनको कांग्रेस में शामिल करके पूरे देश को लामबंद किया जाये,फौरी जरुरत इस कोशिश की है।इस कोशिश में जान की बाजी दांव पर लगानी है।हम कोशिश करें और फेल हो जाये,यह अलग किस्सा है।लेकिन अफसोस कि कोई कोशिश ही नहीं हो रही है।
इस भाषण की शुरुआत में पूंजी और साम्राज्यवाद के मुकाबले स्टालिन की पहल को उनने तरजीह दी।
नेताजी ने कहाः
...इस महायुद्ध में शुरु से लेकर आजतक की सारी घटनाएं जो घटित हुई,उनका अंदेशा किसी को नहीं था।जब पहले दुनिया में लोगों को मालूम पड़ा कि जर्मनी और रूस में समझौता हो गया,तो लोगों को यकीन न हुआ।क्यों नहीं हुआ यकीन,इस पर गौर करें क्योंकि तब तक जर्मनी लगातार लगातार सोवियत संघ पर हमले करता रहा।किसी को यकीन ही नहीं हुआ कि इस दुश्मनी का कोई अंत कहीं होना है।इस दुश्मनी की वजह विचारधाराओं में फर्क रहा है।लेकिन हैरतअंगेज करिश्मा यह हुआ कि जो नाजी रोजाना कम्युनिस्टों पर हमला किये बिना अन्नजल ग्रहण नहीं कर रहे थे उनने रातोंरात वैचारिक मतभेद भूलकर तुरतफुरत कम्युनिस्टों के साथ समझौता कर लिया।…
अब नेताजी के भाषण के इस हिस्से पर खास गौर करेंः
नेताजी ने कहा-
लड़ाई का कोई विकल्प नहीं है।यह लड़ई तब शुरु हो गयी जब,रामगढ़ में हमने सोचा कि देश के किस सूबे में,किस जिले में हम लड़ाई कैसे शुरु करें।बांग्लादेश (संयुक्त बंगाल) के संदर्भ में सोचा यही गया कि हम व्यक्ति के नागरिक अधिकारों को मुद्दा बनाकर लड़ें सबसे पहले।वजह यह थी कि बंगाल में जिसतरह आर्डिनेंस पर आर्डिनेंस जारी करके नागरिक अधिकारों का निर्मम हनन हो रहा था,वैसा दूसरे सूबों में नहीं हो रहा था।जब आर्डिनेंस के खिलाफ हमने पहली सभा की तो हमें मालूम न था कि सरकार बहादुर की क्या प्रतिक्रिया होगी।पता नहीं क्यों, किस सुबुद्धि या दुर्बुद्धि के तहत सरकार बहादर ने हमपर हमले नहीं किये।कहीं कहीं गिरफ्तारियां हुईं लेकिन व्यापक गिरफ्तारियां नहीं हुईं।इस जनवरी से हमने फिर नागरिक अधिकारों के लिए आंदोलन शुरु किया है।इसका नतीजा यह है कि पिछले सितंबर में जो हमारे नागरिक हक हकूक थे,उन्हें दोबारा बहाल करने में हमें कामयाबी मिल गयी…
आगे नेताजी ने जो कहा है उसपर ताजा हालात के मद्देनजर खास गौर करने की जरुरत है।
नेताजी ने कहा-
हम तथाकथिक कानून तोड़कर आंदोलन कर रहे हैं और किसी भी बाधा को हम मान नहीं रहे हैं।लेकि हमें रोकने वाली सरकार कभी कभार और अक्सरहां दूसरे दलों को सभा करने की खुली इजाजत दे रही है..नदिया जिले में हमने इजाजत मांगी तो नहीं दी गयी।लेकिन हिंदू महासभा ने सम्मेलन करने की जब इजाजत मांगी तो दे दी।...हमें किसी की इजाजत की जरुरत नहीं है।रामगढ़ के बाद बहुत गिरफ्तारियां हुई हैं और गिरफ्तारियों का सिलसिला आगे भी जारी रहने वाला है क्योंकि आंदोलन जारी है।लडा़ई के तौर तरीके हर सूबे में और हर जिले में अलग अलग होंगे।
फिर नेताजी ने चेतावनी दी एकदम खुली चेतावनी।
नेताजीने कहाः
हम जैसे आजादी के लिए लड़ रहे हैं वैसे ही प्रतिक्रियावादी ताकतों का भी हमें मुकाबला करना है।बहुतों को ऐतराज है कि हम जंग शुरु करने के बाद म्युनिसिपल चुनावों में क्यों हिंदू महासभा से भिड़ गये।अगर जिस जनशक्ति के सहारे हम आजादी की लड़ाई लड़ रहे हैं,वह कांग्रेस में आस्था खो दें और कांग्रेस विरोधी दूसरे संगठन पर यकीन कर लें तो कांग्रेस का क्या होगा और भारतीय राष्ट्रवाद का क्या होगा,मसला यह है।
फिर नेताजी ने जिस गहराते फासीवादी हिंदुत्व पुनरूत्थान के संकट को आजादी,मुल्क और इंसानियत के लिए सबसे बड़ा संकट बताया,हम आज उसीके शिकंजे में हैं और इसीलिए खास गौर करें कांग्रेस को चुनौती दे रही हिंदू महासभा से राष्ट्र और राष्ट्रवाद को सबसे बड़ा खतरा बताते हुए नेताजी ने कहाः
भारतीय राष्ट्रवाद का यह शत्रू तत्व है और इसे हराने की हमारी चुनौती है। आज हिंदू महासभा मुसलिम विद्वेष से प्रेरित अंग्रेजी हुकूमत के साथ खड़ी दीख रही है।उनका एक ही मकसद है किसी भी तरह मुसलमानों को सबक सीखाना।इस मकसद को हासिल करने के लिए वे अंग्रेजों का साथ देने में हिचकिचायेंगे भी नहीं।अंग्रेजों की कदमबोशी करने से भी उन्हें खास परहेज नहीं है।
नेताजी ने दो टुक शब्दों में कह दियाः
मुसलमान हमारे दुश्मन हैं और अंग्रेज हमारे दोस्त हैं ,यह मानसिकता हमारी समझ से बाहर है।
उनने कहा कि राजनीति का पहला सबक यह है कि हम याद रखें कि हमारा दुश्मन विदेशी साम्राज्यवाद है।फिर याद रखना है कि विदेशी साम्राज्यवाद के सहयोगी जो हैं,जो भारतीय नागरिक और भारतीय संगठन साम्राज्यवादियों क हमजोली हैं,हमारे दुश्मन वे तमाम लोग और उनके वे तमाम संगठन भी हैं।
मेरे ख्याल से इतना अनुवाद ही काफी है हाजमे के लिए।
मूल भाषण जो एई समय में छपा है,उसका इमेज नत्थी कर रहा हूं और इस मुल्क से,इंसानियत से जिन्हें मुहब्बत है वे खुद पढ़ लें।
बांग्ला नहीं आती तो तर्जुा करके पढ़ लें और दूसरों को जरूर पढ़ा दें क्योंकि जब नेताजी ने यह भाषण दिया था तब देश फासीवाद के शिकंजे में नहीं था और कांग्रेस तब भी आजादी की लड़ाई लड़ रही थी।अब हालात उससे कहीं भयंकर हैं।
अब कांग्रेस वह कांग्रेस भी नहीं है और सियासत मजहब और हुकूमत फासीवादी है और मुल्क बाजार।
विडंबना है कि जिस कांग्रेस के सिपाही खुद को मानते रहे हैं नेताजी शुरु से आखिर तक,नेताजी की गुमशुदगी के मामले में वही कांग्रेस कटघरे में हैं
