Black Lives Matter Has Become a Global Movement

What started as a rallying cry in the U.S. has gone beyond those borders and become a mission to fight anti-black violence around the world.

In the two years since its conception, the Black Lives Matter movement has transformed from a powerful, U.S.-based unifier to a globalized movement connecting black and oppressed people all over the world.

After the acquittal of George Zimmerman in July 2013 in the shooting death of 17-year-old Trayvon Martin, three black women created#BlackLivesMatter to represent black people who were being terrorized by state-sanctioned violence, poverty and mass incarceration.

It was a declaration.

Let's be clear: The reach of anti-black racism is not confined to the borders of North America. Black Lives Matter has become a transformative outlet for all black people from different historical, cultural, socioeconomic and political identities. It is a source of solidarity for the survivors of colonization, exploitation, capitalism and police brutality.

After a grand jury failed to indict then-Ferguson, Mo., Police Officer Darren Wilson for killing 18-year-old Michael Brown, "Black lives matter!" became the rallying cry of protesters in Ferguson and across the nation. The militarization of police, the presence of the National Guard and a citywide curfew in St. Louis drew international attention.

As #BlackLivesMatter gained momentum, social media campaigns like#Palestine2Ferguson connected the violent erasure of Palestinian lives in Gaza to the mistreatment of black people in Ferguson and the U.S. at large. The mutual experiences of struggle and marginalization between African Americans and Palestinians created a real base of international solidarity, with Palestinians using Twitter to provide tips to Ferguson protesters on methods of neutralizing tear gas.

When Freddie Gray died in April, a week after he was brutalized by police officers in Baltimore, that city rose up in defiance. A state of emergency was declared, the National Guard was called and a curfew set. Major protests swept across the country, in open resistance to anti-black racism and police brutality.

Around the time that military forces were being withdrawn in Baltimore and the curfew lifted, Ethiopians in Israel began protesting after an Ethiopian member of the Israeli army was attacked by Israeli police while in full uniform. The systemic anti-black racist discrimination against Ethiopians living in Israel became connected to the larger Black Lives Matter movement, with Ethiopian Jews demanding that their black lives mattered, too. Much as in Ferguson and Baltimore, they demanded an end to discrimination and police brutality in Israel.

Last month, 28-year-old Sandra Bland was pulled over by Texas state Trooper Brian Encinia and was found dead in her cell days later. An international campaign for justice emerged, from a mural in Ottawa to#SandraBland hashtags worldwide. #SayHerName—a campaign seeking justice for black women who died while in police custody, among them four other women in July—connected to #BlackLivesMatter. That connection created a deeper understanding of state violence, expanding the movement to include gender and sexuality under its banner.

In the latest act of resistance, Black Lives Matter Toronto shut down both sides of a major highway in July to agitate and advocate for the families of 33-year-old Jermaine Carby and 45-year-old Andrew Loku, who were killed by police in Canada. #BlackLivesMatter activists in the U.S. used social media in solidarity, helping to shape the narrative in seeking justice for the families.

Anti-black racism continues to thrive on a global scale, from the mass deportation of Haitians out of the Dominican Republic—rendering them not just homeless but stateless—to the international abandonment of African migrants who risk drowning on overcrowded fishing boats while fleeing war-ravaged countries. All are the concern of #BlackLivesMatter.

With 26 chapters in the U.S., Canada and Ghana, the continued expansion and evolution of this movement into a globalized black resistance must go beyond nationalism and borders and strike at the heart of the matter, which is that all black lives matter, everywhere.

ORDER

1. In this batch of matters, a scheme propounded by the Government of India popularly known as "Aadhaar Card Scheme" is under attack on various counts. For the purpose of this order, it is not necessary for us to go into the details of the nature of the scheme

and the various counts on which the scheme is attacked. Suffice it to say that under the said scheme the Government of India is collecting and compiling both the demographic and biometric data of the residents of this country to be used for various purposes, the details of which are not relevant at present.

2. One of the grounds of attack on the scheme is that the very collection of such biometric data is violative of the "right to privacy". Some of the petitioners assert that the right to privacy is implied under Article 21 of the Constitution of India while other petitioners assert that such a right emanates not only from Article 21 but also from various other articles embodying the fundamental rights guaranteed under Part-III of the Constitution of India.

3. When the matter was taken up for hearing, Shri Mukul Rohatgi, learned Attorney General made a submission that in view of the judgments of this Court in M.P. Sharma & Others v. Satish Chandra & Others, AIR 1954 SC 300 and Kharak Singh v. State of U.P. & Others, AIR 1963 SC 1295, (decided by Eight and Six Judges respectively) the legal position regarding the existence of the fundamental right to privacy is doubtful. Further, the learned Attorney General also submitted that in a catena of decisions of this Court rendered subsequently, this Court referred to "right to privacy", contrary to the judgments in the abovementioned cases which resulted

in a jurisprudentially impermissible divergence of judicial opinions.

"A power of search and seizure is in any system of jurisprudence an overriding power of the State for the protection of social security and that power is necessarily regulated by law. When the Constitution makers have thought fit not to subject such regulation to constitutional limitations by recognition of a fundamental right to privacy, analogous to the American Fourth Amendment, we have no justification to import it, into a totally different fundamental right, by some process of strained construction. [See: M.P. Singh & Others v. Satish Chandra & Others, AIR 1954 SC 300, page 306 para 18]

"… Nor do we consider that Art. 21 has any relevance in the context as was sought to be suggested by learned counsel for the petitioner. As already pointed out, the right of privacy is not a guaranteed right under our Constitution and therefore the attempt to ascertain the movement of an individual which is merely a manner in which privacy is invaded is not an infringement of a fundamental right guaranteed by Part III." 4. Learned Attorney General submitted that such impermissible

divergence of opinion commenced with the judgment of this Court in Gobind v. State of M.P. & Another, (1975) 2 SCC 148, which formed the basis for the subsequent decision of this Court wherein the "right to privacy" is asserted or at least referred to. The most important of such cases are R. Rajagopal & Another v. State of Tamil Nadu & Others, (1994) 6 SCC 632 (popularly known as Auto Shanker's case) and People's Union for Civil Liberties (PUCL) v. Union of India & Another, (1997) 1 SCC 301.

5. All the judgments referred to above were rendered by smaller Benches of two or three Judges.
6. Shri K.K. Venugopal, learned senior counsel appearing for one of

the respondents submitted that the decision of this Court in Gobind (supra) is not consistent with the decisions of this Court in M.P. Sharma and Kharak Singh. He submitted that such divergence is also noticed by the academicians, Shri F.S. Nariman, Senior Advocate of this Court and Shri A.M. Bhattacharjee1, Former Chief Justice, High Court at Calcutta and High Court at Bombay.

Therefore, it is submitted by the learned Attorney General and Shri Venugopal that to settle the legal position, this batch of matters is required to be heard by a larger Bench of this Court as these matters throw up for debate important questions – (i) whether there is any "right to privacy" guaranteed under our Constitution. (ii) If such a right exists, what is the source and what are the contours of such a right as there is no express provision in the Constitution adumbrating the right to privacy. It is therefore submitted that these batch of matters are required to be heard and decided by a larger bench of at least five Judges in view of the mandate contained under Article 145(3)2 of the Constitution of India.

The minimum number of Judges who are to sit for the purpose of deciding any case involving a

substantial question of law as to the interpretation of this Constitution or for the purpose of hearing any reference

8. On behalf of the petitioners Shri Gopal Subramanium and Shri Shyam Divan, learned senior counsel very vehemently opposed the suggestion that this batch of matters is required to be heard by a larger bench. According to them:

(i) The conclusions recorded by this Court in R. Rajagopal and PUCL are legally tenable for the reason that the observations made in M.P. Sharma regarding the absence of right to privacy under our Constitution are not part of ratio decidendi of that case and, therefore, do not bind the subsequent smaller Benches.

(ii) Coming to the case of Kharak Singh, majority in Kharak Singh did hold that the right of a person not to be disturbed at his residence by the State and its officers is recognized to be a part of a fundamental right guaranteed under Article 21 which is nothing but an aspect of privacy. The observation in para 20 of the majority judgment at best can be construed only to mean that there is no fundamental right of privacy against the State's authority to keep surveillance on the activities of a person. Even such a conclusion cannot be good law any more in view of the express declaration made by a seven-Judge bench decision of this Court in Maneka Gandhi v. Union of India & Another, (1978) 1 SCC 2483.

necessary for the disposal of the appeal, such Court shall refer the question for opinion to a Court constituted as required by this clause for the purpose of deciding any case involving such a question and shall on receipt of the

opinion dispose of the appeal in conformity with such opinion

It was in

that the question as to the proper scope and

meaning of the expression 'personal liberty' came up pointedly for consideration for the first time before this Court. The

(iii) They further argued that both M.P. Sharma (supra) and Kharak Singh (supra) came to be decided on an interpretation of the Constitution based on the principles expounded in A.K. Gopalan v. State of Madras, AIR 1950 SC 27. Such principles propounded by A.K. Gopalan themselves came to be declared wrong by a larger Bench of this Court in Rustom Cavasjee Cooper v. Union of India, (1970) 1 SCC 248. Therefore, there is no need for the instant batch of matters to be heard by a larger Bench.

9. It is true that Gobind (supra) did not make a clear declaration that there is a right to privacy flowing from any of the fundamental rights guaranteed under Part-III of the Constitution of India, but

observed that "Therefore, even assuming that the right to personal liberty, the right to move freely throughout the territory of India and the freedom of speech create an independent right of privacy as an emanation from them which one can

characterize as a fundamental right, we do not think that the right is absolute". This Court proceeded to decide the case on such basis.
10. However, the subsequent decisions in R. Rajagopal (supra) and

majority of the Judges took the view "that 'personal liberty' is used in the article as a compendious term to include within itself all the varieties of rights which go to make up the 'personal liberties' of man other than those- dealt with in the

several clauses of Article 19(1). In other words, while Article

19(1)

deals with particular species or attributes, of that

freedom, 'personal liberty' in Article

21

takes in and comprises the residue". The minority judges, however, disagreed

with this view taken by the majority and explained their position in the following words: "No doubt the expression 'personal liberty' is a comprehensive one and the right to move freely is an attribute of personal liberty. It is said that the freedom to move freely is carved out of personal liberty and, therefore, the expression 'personal liberty' in

Article

excludes that attribute. In our view, this is not a correct approach. Both are independent fundamental rights,

though there is overlapping. There is no question of one being carved out of another. The fundamental right of life and

personal liberty has many attributes and some of them are found in Article

19. If a person's fundamental right under

Article

21

is infringed, the State can rely upon a law to sustain the action, but that cannot be a complete answer unless

the said law satisfies the test laid down in Article

19(2) so far as the attributes covered by Article

19(1)

are concerned".

There can be no doubt that in view of the decision of this Court in R. C. Cooper v. Union of India,

the

minority view must be regarded as correct and the majority view must be held to have been overruled.

PUCL (supra), the Benches were more categoric in asserting the existence of "right to privacy". While R. Rajagopal's case4 held that the "right to privacy" is implicit under Article 21 of the Constitution, PUCL's case held that the "right to privacy" insofar as it pertains to speech is part of fundamental rights under Articles 19(1)(a) and 21 of the Constitution5.

11. Elaborate submissions are made at the bar by the learned

counsel for the petitioners to demonstrate that world over in all the

countries where Anglo-Saxon jurisprudence is followed, 'privacy' is

recognised as an important aspect of the liberty of human beings. It is

further submitted that it is too late in the day for the Union of India to

argue that the Constitution of India does not recognise privacy as an

aspect of the liberty under Article 21 of the Constitution of India. At

least to the extent that the right of a person to be secure in his house

and not to be disturbed unreasonably by the State or its officers is

Whether right to privacy can be claimed or has been infringed in a given case would depend on the facts of the said case. But the right to hold a telephone conversation in the privacy of one's home or office without interference can certainly be claimed as "right to privacy". Conversations on the telephone are often of an intimate and confidential character. Telephone conversation is a part of modern man's life. It is considered so important that more and more people are carrying mobile telephone instruments in their pockets. Telephone conversation is an important facet of a man's private life. Right to privacy would certainly include telephone conversation in the privacy of one's home or office. Telephone-tapping would, thus, infract Article 21 of the Constitution of India unless it is permitted under the procedure established by law.

19. Right to freedom of speech and expression is guaranteed under Article 19(1)(a) of the Constitution. This freedom means the right to express one's convictions and opinions freely by word of mouth, writing, printing, picture, or in any other manner. When a person is talking on telephone, he is exercising his right to freedom of speech and expression. Telephone-tapping unless it comes within the grounds of restrictions under Article 19(2) would infract Article 19(1)(a) of the Constitution."

expressly recognized and protected in Kharak Singh (supra) though the majority did not describe that aspect of the liberty as a right of privacy, it is nothing but the right of privacy.
12. We are of the opinion that the cases on hand raise far reaching questions of importance involving interpretation of the Constitution. What is at stake is the amplitude of the fundamental rights including that precious and inalienable right under Article 21. If the observations made in M.P. Sharma (supra) and Kharak Singh (supra) are to be read literally and accepted as the law of this country, the fundamental rights guaranteed under the Constitution of India and more particularly right to liberty under Article 21 would be denuded of vigour and vitality. At the same time, we are also of the opinion that the institutional integrity and judicial discipline require that pronouncement made by larger Benches of this Court cannot be ignored by the smaller Benches without appropriately explaining the reasons for not following the pronouncements made by such larger Benches. With due respect to all the learned Judges who rendered the subsequent judgments – where right to privacy is asserted or referred to their Lordships concern for the liberty of human beings, we are of the humble opinion that there appears to be certain amount of apparent unresolved contradiction in the law declared by this Court. 13. Therefore, in our opinion to give a quietus to the kind of

controversy raised in this batch of cases once for all, it is better that the ratio decidendi of M.P. Sharma (supra) and Kharak Singh (supra) is scrutinized and the jurisprudential correctness of the subsequent decisions of this Court where the right to privacy is either asserted or referred be examined and authoritatively decided by a Bench of appropriate strength.

14. We, therefore, direct the Registry to place these matters before the Hon'ble the Chief Justice of India for appropriate orders.

INTERIM ORDER

After the matter was referred for decision by a larger Bench, the learned counsel for the petitioners prayed for further interim orders. The last interim order in force is the order of this Court dated 23.9.2013 which reads as follows:-

"….

All the matters require to be heard finally. List all matters for final hearing after the Constitution Bench is over.

In the meanwhile, no person should suffer for not getting the Aadhaar card inspite of the fact that some authority had issued a circular making it mandatory and when any person applies to get the Aadhaar card voluntarily, it may be checked whether that person is entitled for it under the law and it should not be given to any illegal immigrant."

It was submitted by Shri Shyam Divan, learned counsel for the petitioners that the petitioners having pointed out a serious breach of privacy in their submissions, preceding the reference, this Court may grant an injunction restraining the authorities from proceeding further in the matter of obtaining biometrics etc. for an Aadhaar card. Shri Shyam Divan submitted that the biometric information of an individual can be circulated to other authorities or corporate bodies which, in turn can be used by them for commercial exploitation and, therefore, must be stopped.

The learned Attorney General pointed out, on the other hand, that this Court has at no point of time, even while making the interim order dated 23.9.2013 granted an injunction restraining the Unique Identification Authority of India from going ahead and obtaining biometric or other information from a citizen for the purpose of a Unique Identification Number, better known as "Aadhaar card". It was further submitted that the respondents

have gone ahead with the project and have issued Aadhaar cards to

about 90% of the population. Also that a large amount of money has been spent by the Union Government on this project for issuing Aadhaar cards and that in the circumstances, none of the well-known consideration for grant of injunction are in favour of the petitioners.

The learned Attorney General stated that the respondents do not share any personal information of an Aadhaar card holder through biometrics or otherwise with any other person or authority. This statement allays the apprehension for now, that there is a widespread breach of privacy of those to whom an Aadhaar card has been issued. It was further contended on behalf of the petitioners that there still is breach of privacy. This is a matter which need not be gone into further at this stage.

The learned Attorney General has further submitted that the Aadhaar card is of great benefit since it ensures an effective implementation of several social benefit schemes of the Government like MGNREGA, the distribution of food, ration and kerosene through PDS system and grant of subsidies in the distribution of LPG. It was, therefore, submitted that restraining the respondents from issuing further Aadhaar cards or fully utilising the existing Aadhaar cards for the social schemes of the Government should be allowed.

The learned Attorney General further stated that the

respondent Union of India would ensure that Aadhaar cards would only be issued on a consensual basis after informing the public at large about the fact that the preparation of Aadhaar card involving the parting of biometric information of the individual, which shall however not be used for any purpose other than a social benefit schemes.

Having considered the matter, we are of the view that the balance of interest would be best served, till the matter is finally decided by a larger Bench if the Union of India or the UIDA proceed in the following manner:-

1. The Union of India shall give wide publicity in the electronic and print media including radio and television networks that it is not mandatory for a citizen to obtain an Aadhaar card;

2. The production of an Aadhaar card will not be condition for obtaining any benefits otherwise due to a citizen;

3. The Unique Identification Number or the Aadhaar card will not be used by the respondents for any purpose other than the PDS Scheme and in particular for the purpose of distribution of foodgrains, etc. and cooking fuel, such as kerosene. The Aadhaar card may also be used for the purpose of the LPG Distribution Scheme;

4. The information about an individual obtained by the Unique

Identification Authority of India while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a Court for the purpose of criminal investigation.

Ordered accordingly.

                              -7-       UPON HEARING the Counsel The Court made the following  

O RDER

10.30 a.m.

By a reasoned order, the matters are referred to a Bench of appropriate strength.

Having regard to importance of the matter, it is desirable that the matter be heard at the earliest.

2.00 p.m.

After the matter was referred for decision by a larger Bench, the learned counsel for the petitioners prayed for further interim orders. The last interim order in force is the order of this Court dated 23.9.2013 which reads as follows:-

"….

All the matters require to be heard finally. List all matters for final hearing after the Constitution Bench is over.

In the meanwhile, no person should suffer for not getting the Aadhaar card inspite of the fact that some authority had issued a circular making it mandatory and when any person applies to get the Aadhaar card voluntarily, it may be checked whether that person is entitled for it under the law and it should not be given to any illegal immigrant."

It was submitted by Shri Shyam Divan, learned counsel for the petitioners that the petitioners having pointed out a serious breach of privacy in their submissions, preceding the reference, this Court may grant an injunction restraining the authorities from proceeding further in the matter of obtaining biometrics etc. for an Aadhaar card. Shri Shyam Divan submitted that the biometric information of an individual can be circulated to other authorities or corporate bodies which, in turn can be used by them for commercial exploitation and, therefore, must be stopped.

The learned Attorney General pointed out, on the other hand, that this Court has at no point of time, even while making the interim order dated 23.9.2013 granted an injunction restraining the Unique Identification Authority of India from going ahead and obtaining biometric or other information from a citizen for the purpose of a Unique Identification Number, better known as "Aadhaar card". It was further submitted that the respondents have gone ahead with the project and have issued Aadhaar cards to about 90% of the population. Also that a large amount of money has been spent by the Union Government on this project for issuing Aadhaar cards and that in the circumstances, none of the well-known consideration for grant of injunction are in favour of the petitioners.

The learned Attorney General stated that the respondents do not share any personal information of an Aadhaar card holder through biometrics or otherwise with any other person or authority. This statement allays the apprehension for now, that there is a widespread breach of privacy of those to whom an Aadhaar card has been issued. It was further contended on behalf of the petitioners that there still is breach of privacy. This is a matter which need not be gone into further at this stage.

The learned Attorney General has further submitted that the Aadhaar card is of great benefit since it ensures an effective implementation of several social benefit schemes of the Government like MGNREGA, the distribution of food, ration and kerosene through PDS system and grant of subsidies in the distribution of LPG. It was, therefore, submitted that restraining the respondents from issuing further Aadhaar cards or fully utilising the existing Aadhaar cards for the social schemes of the Government should be allowed.

The learned Attorney General further stated that the respondent Union of India would ensure that Aadhaar cards would only be issued on a consensual basis after informing the public at large about the fact that the preparation of Aadhaar card involving the parting of biometric information of the individual, which shall however not be used for any purpose other than a social benefit schemes.

Having considered the matter, we are of the view that the balance of interest would be best served, till the matter is finally decided by a larger Bench if the Union of India or the UIDA proceed in the following manner:-

1. The Union of India shall give wide publicity in the electronic and print media including radio and television networks that it is not mandatory for a citizen to obtain an Aadhaar card;

2. The production of an Aadhaar card will not be condition for obtaining any benefits otherwise due to a citizen;

3. The Unique Identification Number or the Aadhaar card will not be used by the respondents for any purpose other than the PDS Scheme and in particular for the purpose of distribution of foodgrains, etc. and cooking fuel, such as kerosene. The Aadhaar card may also be used for the purpose of the LPG Distribution Scheme;

4. The information about an individual obtained by the Unique Identification Authority of India while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a Court for the purpose of criminal investigation.

     Ordered accordingly.

In a major judgment, the Constitution Bench of the Supreme Court on Tuesday ruled that Aadhar card can be used for availing government schemes, but it is not necessary. The court has also asked the government to give widespread publicity through various media that Aadhar is not mandatory.

In its ruling, the court said Aadhar can be used for Public Distribution Schemes (PDS) foodgrains, kerosene and LPG, but it was not mandatory to avail the benefits of such schemes. The court also ruled that the information obtained through Unique Identification D can not be shared for any other purpose except for criminal investigation and that too with the court's approval.

"The Government will not use Aadhar for any other purpose. The Information obtained for UID will not be used for any other purpose," the apex court ruled. The Supreme Court bench was hearing petitions challenging the Centre's ambitious scheme to provide Aadhar card to all citizens and decide whether right to privacy is a fundamental right.

Earlier on Tuesday, the apex court had referred the matter to a Constitution Bench. Attorney General Mukul Rohatgi, appearing for the Centre, had said that the matters requires elaborate debate and an authoritative pronouncement in view of the fact that there have been inconsistent decisions as to whether right to privacy is a fundamental right. 

He had cited two judgements, pronounced by six and eight- judge benches, which had held that right to privacy is not a fundamental right. Subsequently, smaller benches had held contrary view and, hence this matter needed to be decided by a larger bench, AG had said.

A three-judge bench, which in the forenoon referred to a larger Constitution Bench a batch of petitions challenging the Aadhar scheme and the issue whether right to privacy is a fundamental right, recorded the statement of Attorney General Mukul Rohatgi that "no personal information of Aadhar card shall be shared by any authority".

"Whether right to privacy is a fundamental right guaranteed under Part III of the Constitution of India, in the light of express ratio to the contrary by an eight-judge bench in M P Sharma case and also by a six-judge bench of this court in Kharak Singh's case" has to be decided, Rohtagi had said. 

The bench directed that the information received by UIDAI shall not be used for any other purposes, except in criminal investigation with the permission of the court.

Referring to pronouncements made in historic cases like A K Gopalan, Maneka Gandhi and bank nationalisation, the top law officer had said that inconsistencies with regard to interpretation of certain fundamental rights can only be "squared up" by a larger bench.

The Centre had opposed a plea seeking initiation of contempt proceedings against it, Reserve Bank of India (RBI) and others for allegedly insisting on Aadhar cards to grant benefits of various schemes to citizens, saying it was not mandatory.

In pursuance of earlier orders, the government has conveyed to the states and authorities concerned not to make Aadhar cards, issued by UIDAI, mandatory for availing various schemes, Additional Solicitor General Pinky Anand had told the court.

The bench was hearing a batch of pleas against decisions of some states to make Aadhar cards compulsory for a range of activities including salary, provident fund disbursal, marriage and property registration.

The government had also said that persons, having Aadhar cards, were being asked to provide it to authorities but this was optional.

Senior advocate Gopal Subramanium, appearing for Mathew Thomas, one of the PIL petitioners, had filed an application seeking initiation of contempt proceedings against the Centre and others, including RBI, and the Election Commission.

He had alleged that the government and others were in violation of earlier orders that had said that no person should be denied any benefit or suffer for not having Aadhar cards.

ORDER

1. In this batch of matters, a scheme propounded by the Government of India popularly known as "Aadhaar Card Scheme" is under attack on various counts. For the purpose of this order, it is not necessary for us to go into the details of the nature of the scheme

and the various counts on which the scheme is attacked. Suffice it to say that under the said scheme the Government of India is collecting and compiling both the demographic and biometric data of the residents of this country to be used for various purposes, the details of which are not relevant at present.

2. One of the grounds of attack on the scheme is that the very collection of such biometric data is violative of the "right to privacy". Some of the petitioners assert that the right to privacy is implied under Article 21 of the Constitution of India while other petitioners assert that such a right emanates not only from Article 21 but also from various other articles embodying the fundamental rights guaranteed under Part-III of the Constitution of India.

3. When the matter was taken up for hearing, Shri Mukul Rohatgi, learned Attorney General made a submission that in view of the judgments of this Court in M.P. Sharma & Others v. Satish Chandra & Others, AIR 1954 SC 300 and Kharak Singh v. State of U.P. & Others, AIR 1963 SC 1295, (decided by Eight and Six Judges respectively) the legal position regarding the existence of the fundamental right to privacy is doubtful. Further, the learned Attorney General also submitted that in a catena of decisions of this Court rendered subsequently, this Court referred to "right to privacy", contrary to the judgments in the abovementioned cases which resulted

in a jurisprudentially impermissible divergence of judicial opinions.

"A power of search and seizure is in any system of jurisprudence an overriding power of the State for the protection of social security and that power is necessarily regulated by law. When the Constitution makers have thought fit not to subject such regulation to constitutional limitations by recognition of a fundamental right to privacy, analogous to the American Fourth Amendment, we have no justification to import it, into a totally different fundamental right, by some process of strained construction. [See: M.P. Singh & Others v. Satish Chandra & Others, AIR 1954 SC 300, page 306 para 18]

"… Nor do we consider that Art. 21 has any relevance in the context as was sought to be suggested by learned counsel for the petitioner. As already pointed out, the right of privacy is not a guaranteed right under our Constitution and therefore the attempt to ascertain the movement of an individual which is merely a manner in which privacy is invaded is not an infringement of a fundamental right guaranteed by Part III." 4. Learned Attorney General submitted that such impermissible

divergence of opinion commenced with the judgment of this Court in Gobind v. State of M.P. & Another, (1975) 2 SCC 148, which formed the basis for the subsequent decision of this Court wherein the "right to privacy" is asserted or at least referred to. The most important of such cases are R. Rajagopal & Another v. State of Tamil Nadu & Others, (1994) 6 SCC 632 (popularly known as Auto Shanker's case) and People's Union for Civil Liberties (PUCL) v. Union of India & Another, (1997) 1 SCC 301.

5. All the judgments referred to above were rendered by smaller Benches of two or three Judges.
6. Shri K.K. Venugopal, learned senior counsel appearing for one of

the respondents submitted that the decision of this Court in Gobind (supra) is not consistent with the decisions of this Court in M.P. Sharma and Kharak Singh. He submitted that such divergence is also noticed by the academicians, Shri F.S. Nariman, Senior Advocate of this Court and Shri A.M. Bhattacharjee1, Former Chief Justice, High Court at Calcutta and High Court at Bombay.

Therefore, it is submitted by the learned Attorney General and Shri Venugopal that to settle the legal position, this batch of matters is required to be heard by a larger Bench of this Court as these matters throw up for debate important questions – (i) whether there is any "right to privacy" guaranteed under our Constitution. (ii) If such a right exists, what is the source and what are the contours of such a right as there is no express provision in the Constitution adumbrating the right to privacy. It is therefore submitted that these batch of matters are required to be heard and decided by a larger bench of at least five Judges in view of the mandate contained under Article 145(3)2 of the Constitution of India.

8. On behalf of the petitioners Shri Gopal Subramanium and Shri Shyam Divan, learned senior counsel very vehemently opposed the suggestion that this batch of matters is required to be heard by a larger bench. According to them:

(i) The conclusions recorded by this Court in R. Rajagopal and PUCL are legally tenable for the reason that the observations made in M.P. Sharma regarding the absence of right to privacy under our Constitution are not part of ratio decidendi of that case and, therefore, do not bind the subsequent smaller Benches.

(ii) Coming to the case of Kharak Singh, majority in Kharak Singh did hold that the right of a person not to be disturbed at his residence by the State and its officers is recognized to be a part of a fundamental right guaranteed under Article 21 which is nothing but an aspect of privacy. The observation in para 20 of the majority judgment at best can be construed only to mean that there is no fundamental right of privacy against the State's authority to keep surveillance on the activities of a person. Even such a conclusion cannot be good law any more in view of the express declaration made by a seven-Judge bench decision of this Court in Maneka Gandhi v. Union of India & Another, (1978) 1 SCC 2483.

necessary for the disposal of the appeal, such Court shall refer the question for opinion to a Court constituted as required by this clause for the purpose of deciding any case involving such a question and shall on receipt of the

opinion dispose of the appeal in conformity with such opinion

meaning of the expression 'personal liberty' came up pointedly for consideration for the first time before this Court. The

(iii) They further argued that both M.P. Sharma (supra) and Kharak Singh (supra) came to be decided on an interpretation of the Constitution based on the principles expounded in A.K. Gopalan v. State of Madras, AIR 1950 SC 27. Such principles propounded by A.K. Gopalan themselves came to be declared wrong by a larger Bench of this Court in Rustom Cavasjee Cooper v. Union of India, (1970) 1 SCC 248. Therefore, there is no need for the instant batch of matters to be heard by a larger Bench.

9. It is true that Gobind (supra) did not make a clear declaration that there is a right to privacy flowing from any of the fundamental rights guaranteed under Part-III of the Constitution of India, but

observed that "Therefore, even assuming that the right to personal liberty, the right to move freely throughout the territory of India and the freedom of speech create an independent right of privacy as an emanation from them which one can

characterize as a fundamental right, we do not think that the right is absolute". This Court proceeded to decide the case on such basis.
10. However, the subsequent decisions in R. Rajagopal (supra) and

majority of the Judges took the view "that 'personal liberty' is used in the article as a compendious term to include within itself all the varieties of rights which go to make up the 'personal liberties' of man other than those- dealt with in the

several clauses of Article 19(1). In other words, while Article

19(1)

deals with particular species or attributes, of that

freedom, 'personal liberty' in Article

21

takes in and comprises the residue". The minority judges, however, disagreed

with this view taken by the majority and explained their position in the following words: "No doubt the expression 'personal liberty' is a comprehensive one and the right to move freely is an attribute of personal liberty. It is said that the freedom to move freely is carved out of personal liberty and, therefore, the expression 'personal liberty' in

Article

excludes that attribute. In our view, this is not a correct approach. Both are independent fundamental rights,

though there is overlapping. There is no question of one being carved out of another. The fundamental right of life and

personal liberty has many attributes and some of them are found in Article

19. If a person's fundamental right under

Article

21

is infringed, the State can rely upon a law to sustain the action, but that cannot be a complete answer unless

the said law satisfies the test laid down in Article

19(2) so far as the attributes covered by Article

19(1)

are concerned".

There can be no doubt that in view of the decision of this Court in R. C. Cooper v. Union of India,

the

minority view must be regarded as correct and the majority view must be held to have been overruled.

PUCL (supra), the Benches were more categoric in asserting the existence of "right to privacy". While R. Rajagopal's case4 held that the "right to privacy" is implicit under Article 21 of the Constitution, PUCL's case held that the "right to privacy" insofar as it pertains to speech is part of fundamental rights under Articles 19(1)(a) and 21 of the Constitution5.

11. Elaborate submissions are made at the bar by the learned

counsel for the petitioners to demonstrate that world over in all the

countries where Anglo-Saxon jurisprudence is followed, 'privacy' is

recognised as an important aspect of the liberty of human beings. It is

further submitted that it is too late in the day for the Union of India to

argue that the Constitution of India does not recognise privacy as an

aspect of the liberty under Article 21 of the Constitution of India. At

least to the extent that the right of a person to be secure in his house

and not to be disturbed unreasonably by the State or its officers is

Whether right to privacy can be claimed or has been infringed in a given case would depend on the facts of the said case. But the right to hold a telephone conversation in the privacy of one's home or office without interference can certainly be claimed as "right to privacy". Conversations on the telephone are often of an intimate and confidential character. Telephone conversation is a part of modern man's life. It is considered so important that more and more people are carrying mobile telephone instruments in their pockets. Telephone conversation is an important facet of a man's private life. Right to privacy would certainly include telephone conversation in the privacy of one's home or office. Telephone-tapping would, thus, infract Article 21 of the Constitution of India unless it is permitted under the procedure established by law.

19. Right to freedom of speech and expression is guaranteed under Article 19(1)(a) of the Constitution. This freedom means the right to express one's convictions and opinions freely by word of mouth, writing, printing, picture, or in any other manner. When a person is talking on telephone, he is exercising his right to freedom of speech and expression. Telephone-tapping unless it comes within the grounds of restrictions under Article 19(2) would infract Article 19(1)(a) of the Constitution."

expressly recognized and protected in Kharak Singh (supra) though the majority did not describe that aspect of the liberty as a right of privacy, it is nothing but the right of privacy.
12. We are of the opinion that the cases on hand raise far reaching questions of importance involving interpretation of the Constitution. What is at stake is the amplitude of the fundamental rights including that precious and inalienable right under Article 21. If the observations made in M.P. Sharma (supra) and Kharak Singh (supra) are to be read literally and accepted as the law of this country, the fundamental rights guaranteed under the Constitution of India and more particularly right to liberty under Article 21 would be denuded of vigour and vitality. At the same time, we are also of the opinion that the institutional integrity and judicial discipline require that pronouncement made by larger Benches of this Court cannot be ignored by the smaller Benches without appropriately explaining the reasons for not following the pronouncements made by such larger Benches. With due respect to all the learned Judges who rendered the subsequent judgments – where right to privacy is asserted or referred to their Lordships concern for the liberty of human beings, we are of the humble opinion that there appears to be certain amount of apparent unresolved contradiction in the law declared by this Court. 13. Therefore, in our opinion to give a quietus to the kind of

controversy raised in this batch of cases once for all, it is better that the ratio decidendi of M.P. Sharma (supra) and Kharak Singh (supra) is scrutinized and the jurisprudential correctness of the subsequent decisions of this Court where the right to privacy is either asserted or referred be examined and authoritatively decided by a Bench of appropriate strength.

14. We, therefore, direct the Registry to place these matters before the Hon'ble the Chief Justice of India for appropriate orders.

INTERIM ORDER

After the matter was referred for decision by a larger Bench, the learned counsel for the petitioners prayed for further interim orders. The last interim order in force is the order of this Court dated 23.9.2013 which reads as follows:-

"….

All the matters require to be heard finally. List all matters for final hearing after the Constitution Bench is over.

In the meanwhile, no person should suffer for not getting the Aadhaar card inspite of the fact that some authority had issued a circular making it mandatory and when any person applies to get the Aadhaar card voluntarily, it may be checked whether that person is entitled for it under the law and it should not be given to any illegal immigrant."

It was submitted by Shri Shyam Divan, learned counsel for the petitioners that the petitioners having pointed out a serious breach of privacy in their submissions, preceding the reference, this Court may grant an injunction restraining the authorities from proceeding further in the matter of obtaining biometrics etc. for an Aadhaar card. Shri Shyam Divan submitted that the biometric information of an individual can be circulated to other authorities or corporate bodies which, in turn can be used by them for commercial exploitation and, therefore, must be stopped.

The learned Attorney General pointed out, on the other hand, that this Court has at no point of time, even while making the interim order dated 23.9.2013 granted an injunction restraining the Unique Identification Authority of India from going ahead and obtaining biometric or other information from a citizen for the purpose of a Unique Identification Number, better known as "Aadhaar card". It was further submitted that the respondents

have gone ahead with the project and have issued Aadhaar cards to

about 90% of the population. Also that a large amount of money has been spent by the Union Government on this project for issuing Aadhaar cards and that in the circumstances, none of the well-known consideration for grant of injunction are in favour of the petitioners.

The learned Attorney General stated that the respondents do not share any personal information of an Aadhaar card holder through biometrics or otherwise with any other person or authority. This statement allays the apprehension for now, that there is a widespread breach of privacy of those to whom an Aadhaar card has been issued. It was further contended on behalf of the petitioners that there still is breach of privacy. This is a matter which need not be gone into further at this stage.

The learned Attorney General has further submitted that the Aadhaar card is of great benefit since it ensures an effective implementation of several social benefit schemes of the Government like MGNREGA, the distribution of food, ration and kerosene through PDS system and grant of subsidies in the distribution of LPG. It was, therefore, submitted that restraining the respondents from issuing further Aadhaar cards or fully utilising the existing Aadhaar cards for the social schemes of the Government should be allowed.

The learned Attorney General further stated that the

respondent Union of India would ensure that Aadhaar cards would only be issued on a consensual basis after informing the public at large about the fact that the preparation of Aadhaar card involving the parting of biometric information of the individual, which shall however not be used for any purpose other than a social benefit schemes.

Having considered the matter, we are of the view that the balance of interest would be best served, till the matter is finally decided by a larger Bench if the Union of India or the UIDA proceed in the following manner:-

1. The Union of India shall give wide publicity in the electronic and print media including radio and television networks that it is not mandatory for a citizen to obtain an Aadhaar card;

2. The production of an Aadhaar card will not be condition for obtaining any benefits otherwise due to a citizen;

3. The Unique Identification Number or the Aadhaar card will not be used by the respondents for any purpose other than the PDS Scheme and in particular for the purpose of distribution of foodgrains, etc. and cooking fuel, such as kerosene. The Aadhaar card may also be used for the purpose of the LPG Distribution Scheme;

4. The information about an individual obtained by the Unique

Identification Authority of India while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a Court for the purpose of criminal investigation.

Ordered accordingly.

This statement allays the apprehension for now, that there is a widespread breach of privacy of those to whom an Aadhaar card has been issued. It was further contended on behalf of the petitioners that there still is breach of privacy. This is a matter which need not be gone into further at this stage.

The learned Attorney General has further submitted that the Aadhaar card is of great benefit since it ensures an effective implementation of several social benefit schemes of the Government like MGNREGA, the distribution of food, ration and kerosene through PDS system and grant of subsidies in the distribution of LPG. It was, therefore, submitted that restraining the respondents from issuing further Aadhaar cards or fully utilising the existing Aadhaar cards for the social schemes of the Government should be allowed.

The learned Attorney General further stated that the respondent Union of India would ensure that Aadhaar cards would only be issued on a consensual basis after informing the public at large about the fact that the preparation of Aadhaar card involving the parting of biometric information of the individual, which shall however not be used for any purpose other than a social benefit schemes.

Having considered the matter, we are of the view that the balance of interest would be best served, till the matter is finally decided by a larger Bench if the Union of India or the UIDA proceed in the following manner:-

1. The Union of India shall give wide publicity in the electronic and print media including radio and television networks that it is not mandatory for a citizen to obtain an Aadhaar card;

2. The production of an Aadhaar card will not be condition for obtaining any benefits otherwise due to a citizen;

3. The Unique Identification Number or the Aadhaar card will not be used by the respondents for any purpose other than the PDS Scheme and in particular for the purpose of distribution of foodgrains, etc. and cooking fuel, such as kerosene. The Aadhaar card may also be used for the purpose of the LPG Distribution Scheme;

4. The information about an individual obtained by the Unique Identification Authority of India while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a Court for the purpose of criminal investigation.

     Ordered accordingly.

"On 8th. Aug. 2015, around 6.30 am, an uneducated single mother with her daughter were in Anna University Campus Chennai, looking for direction to Anna Arangam for her daughter's counseling in B.Sc. Agriculture which was scheduled at 8.30 am.

The mother, a farmer tending cattle, and the girl were from a small village near Trichy. Due to some misguidance, they did not 
know that the counseling was at Agriculture University in Coimbatore. Luckily for the girl, some early morning walkers turned up who informed her that she was to be in Coimbatore rather than Chennai. 

The girl had scored 1017/ 1200 though suffering from illness during the +2 exams, and had somehow got misguided to attend interview at Chennai.

Thankfully, one of the walkers offered to sponsor to send both of them by flight immediately to Coimbatore. Other walkers pitched in – they asked friends/ contacts to inform the Registrar about the case. By 7.50 am it was agreed to look into the case. Meanwhile breakfast was provided to the mother and daughter . 

The sponsor of the flight tickets transported them to the airport by 8.15 am to board the 10.05 am flight to Coimbatore. Arrangements were made to pick them up from Coimbatore airport at 11.40 am by car. They reached the University counseling venue by 12.15 pm

The Registrar had made an arrangement to ensure that the candidate got fair counselling. Through the counseling the candidate was offered B.Sc. – bio technology in TNAU – Cbe. at 2.00 pm the same day.

The Polit Bureau of the Communist Party of India (Marxist) has issued the
following statement:



The Polit Bureau of the CPI(M) condemns the arrest of P. Madhu, Secretary of
the Andhra Pradesh State Committee of the Party and Central Committee
member. Comrade Madhu was arrested at the Amudalavalasa railway station, in
Srikakulam district in the early morning of August 12. The police have
arrested him to prevent him from visiting the area where forcible land
acquisition is taking place for the Polaki Power Plant. Many other leaders
and cadres of the Party in Srikakulam district were arrested while
protesting the detention of Madhu.



The Chief Minister, Chandrababu Naidu is constantly resorting to
anti-democratic repressive measures to suppress peaceful protests. The Polit
Bureau demands the immediate release of P Madhu and all those who were
arrested in Srikakulam District.

New Delhi, Aug. 11, 2015: Jamaat-e-Islami Hind has strongly appealed to the government of India not to abandon its basic responsibility of safe-guarding the moral fiber of society. Vice-President Nusrat Ali said that: "After deciding to block all pornographic content from the internet, the government suddenly wilted under pressure from some quarters and has now confined itself to blocking only those sites which display child porn. This is regrettable as it is the bounden duty of every government to protect the interests of its citizens especially the moral character of the younger generation. Our youth will fall prey to these evils if not stopped at its roots and the resulting moral decadence and sexual anarchy is bound to sap the vital energies of our nation."
He drew the attention of the government that liberal countries like the UK and the UAE block all pornographic material at the ISP level through filters and proxy servers and so there is no dearth of technology to accomplish this task. Nusrat Ali also disagreed with the comment by Attorney-General Mukul Rohatgi that: "Somebody wants to watch porn in the privacy of his room, can we prevent that?"
Nusrat Ali also said: "Jamaat believes that all pornography including child porn is a blot on society and a grave dishonor to human dignity. Alcohol and pornography have a direct relation with the rise in sexual crimes against women and children in India and the government must come out heavily against these forces who are trying to weaken our country morally."

JIH Condemns Terrorist Attack in Saudi Arabia

New Delhi, Aug. 7, 2015: Jamaat-e-Islami Hind has strongly condemned the terrorist attack that took place outside the mosque in the city of Asir in Saudi Arabia and said that it is a conspiracy hatched by anti-Islam forces.
In a statement to the press, Vice-President of Jamaat-e-Islami Hind, Nusrat Ali, said that so far Saudi Arabia was spared of the violence and turmoil in the Middle East. However a spate of violent incidents seems to engulf it too like other countries into the cycle of terror and insecurity, which has caused great anxiety and apprehension in Muslims. This anxiety has been compounded because of the presence of the two Holy mosques inside Saudi Arabia.
Vice-President JIH – Nusrat Ali drew the attention of the Saudi government to carry out a high level investigation into the attack so the perpetrators of the crime and their master-minds are exposed. He also emphasized that the government of Saudi Arabia must ensure that peace and stability prevail in the entire kingdom and that the Saudis take the necessary steps to contain the divisive forces.
He offered his prayers for the martyrs and wished a speedy recovery to the injured.

Fearing the dead

Necrophobia is a dreaded psychiatric disorder where the patient has a fear of the dead. Like a number of other psychiatric diseases, the condition has little hope of a complete cure and we are told that most patients live with the disease. Fortunately, the condition is rare and by all assumptions there would be a few hundred thousand patients across the globe. But can we imagine what happens when a country suffers from necrophobia? Yes, a country! And that too one of the most populous country on the planet?

Welcome to the Democratic Republic of India.

When on July 30th, Yakub Memon, the culprit of 1993 Bombay blasts was hanged, we were told by chest thumping anchors and balking government representatives that a closure for the victims of the blast has been achieved. 'Closure' as accomplishment and surety.

The highest court of the land handed this 'closure' to the kin of the blast victims after thorough deliberations and evidence, which I am sure, must have weighed heavily, beyond the 'collective consciousness' of the nation. The predawn verdict was compared by some to the rays of the morning sun thrust into darkness, to usher a new era. A new era, which could have, only begin with the extinction of a life.

Accepting that Yakub Memon was guilty. Accepting that it was 'correct' to give him the capital punishment. And accepting that he should have been hanged to death on the specified day and time (as he was), there is something, which still needs pointing out. The Mumbai Police issued a warning to those planning to attend Memon's prospective funeral. The legal warning read thatnobody will photograph/videograph Yakub Memon's corpse during transportation. This step had been taken by the police to ensure tranquility and harmony in the city. A measure, we were told, taken to prevent visuals being used later by anti-national elements to provoke people and youngsters.

Yakub Memon was luckier than his predecessor at the gallows, Afzal Guru, whose body was never handed over to his family. After being hanged to satisfy the collective consciousness of the nation, Guru was buried within the premises of the Tihar jail itself. The fact that the government fears the dead amazes me. Every now and then the jingoist machinery reminds us of what a willing state can achieve. From waging wars to sending rockets to Mars, governments in power have time and again shown their might.  

How the hell can such mightier than the mighty state be afraid of the dead?

It is baffling that a corpse as lean as that of Afzal Guru and as feeble and old as of Yakub Memon could actually push a government into prohibitory and preventive mode. This necrophobia of the Indian state, which boasts of one of the largest armed forces on the planet, is shameful to say the least.

On a closer scrutiny, the present sarkar and its agenda of "hope" appears to flow through the corporate barrel. Be it the land bill, the new drug policy, or the venomous comments of its own members, the government in power appears to have yet another psychiatric disorder. It suffers from cherophobia, the fear of happiness (of its own people)!

বরিশালে ৬ কবি ও ব্লগারকে ইসলাম বিরোধী আখ্যায়িত করে তাদের হত্যার হুমকি দিয়েছে 'আনসার বিডি বাংলা টিম' নামে একটি সংগঠন।

সোমবার রাতে সংশ্লিষ্টদের ফেসবুকের ইনবক্সে এবং 'আনসার বিডি বরিশাল বিভাগীয় টিমের' ব্লগে ৬ জনের ছবিসহ হত্যার হুমকি দেয়া হয়.
হুমকিপ্রাপ্তরা হলেন, কবি ও লেখক হেনরী স্বপন, কবি তুহিন দাস, কবি সৈয়দ মেহেদী হাসান, গণজাগরণ মঞ্চের কর্মী নজরুল বিশ্বাস, ব্লগার ও জেলা ছাত্র ইউনিয়নের সাধারণ সম্পাদক প্রীতম চৌধুরী এবং ব্লগার চারু তুহিন।
হুমকি বার্তায় তারা বলেন, আলহামদুলিল্লাহ। বরিশাল বিভাগীয় শহরে আনসার বিডি বাংলা টিম সাফল্যের সঙ্গে কার্যক্রম শুরু করেছে। এই লক্ষ্যে ৩ জন কবি এবং ৩ জন সংগঠক ও ব্লগারকে তারা ইসলামের শত্রু হিসেবে নির্বাচিত করেছেন। তারা খুব শীঘ্রই তাদের লক্ষ্যে পৌঁছে যাবে।
এ দিকে এ ঘটনায় মঙ্গলবার বিকেলে কোতোয়ালী থানায় সাধারণ ডায়রি করেছেন ৩ লেখক ও ব্লগার। এতে তারা নিরাপত্তা চেয়েছেন।


হুমকিপ্রাপ্ত কবি ও লেখক হেনরী স্বপন জানিয়েছেন, তিনি সব সময় মানবতার পক্ষে লেখালেখি করেন। সাম্প্রতিক সময়ে খুন হওয়া ব্লগারদের পক্ষেও লিখেছেন। ইসলাম বিদ্বেষী কোন লেখা লেখেননি। কিন্তু এরপরও হুমকি পাওয়ায় পরিবার-পরিজন নিয়ে আতঙ্কিত তিনি।
হুমকিপ্রাপ্ত আরেক কবি ও ব্লগার তুহিন দাস জানিয়েছেন, তিনি মুক্তিযুদ্ধ এবং গণজাগরণ মঞ্চের পক্ষে কথা বলেছেন, লেখালেখি করেছেন। তিনিও ইসলামের বিরুদ্ধে কোন সময় কথা বলেননি। এরপরও এই হত্যার হুমকি তাকে বিচলিত করেছে। তাই নিরাপত্তা চাওয়ার পাশাপাশি সংশ্লিষ্টদের খুঁজে বের করে কঠোর শাস্তির দাবি জানিয়েছেন।
বরিশালের ২৭টি সাংস্কৃতিক সংগঠনের জোট সমন্বয় পরিষদের সভাপতি শান্তি দাস জানিয়েছেন, কেউ যদি ইসলাম কিংবা কোন ধর্মের বিরুদ্ধে কথা বলে, তার বিরুদ্ধে আইনানুগ ব্যবস্থা নেয়া যেতে পারে। তাই বলে ইসলাম বিদ্বেষী আখ্যায়িত করে কাউকে হত্যার হুমকি মুক্তমনা লেখক-সাংস্কৃতিক কর্মীদের চিন্তিত করেছে। তিনি মুক্তমনা ব্লগার, কবি ও সাংস্কৃতিক কর্মীদের নিরাপত্তা নিশ্চিত করার জন্য সংশ্লিষ্ট প্রশাসনের প্রতি আহ্বান জানিয়েছেন।
বরিশাল মেট্রোপলিটন পুলিশের উপ-কমিশনার (দক্ষিণ) গোলাম রউফ খান জানান, হুমকিপ্রাপ্তদের নজরদারীসহ সার্বক্ষণিক নিরাপত্তা প্রদান করা হবে।সংগঠনের অস্তিত্ব খুঁজে বের করে তাদের বিরুদ্ধে কঠোর আইনগত ব্যবস্থা নেয়া হবে।

"যুক্তি এবং প্রতিযুক্তির চুলচেরা বিচারে যাওয়াই যায়। কিন্তু সেটা না গেলেও একটা কথা বুঝতে অসুবিধে হয় না। ইয়াকুবের সূত্রে ভারতীয় মুসলিমদের প্রান্তিকীকরণের বিষয়টি আবার নতুন করে নাড়া দিচ্ছে এ দেশকে। বিশেষত এ দেশের মুসলিম সমাজকে। ভুল হোক, ঠিক হোক, এই রকম একটা কথা উঠছে, আশঙ্কা তৈরি হচ্ছে। খুব একটা কাঙ্ক্ষিত নয় ব্যাপারটা। রাষ্ট্রের কোন ধরনের কাজকর্মের জন্য এমনটা ঘটছে, সেটা হয়তো ভাবার সময় এসেছে। 
জম্মু ও কাশ্মীর অঞ্চলে আরও কয়েক ধাপ এগিয়েছে ব্যাপারটা। নতুন আঁচে জ্বলে উঠছে দিল্লি-বিরোধিতার আগুন। হয়তো স্বাভাবিক— জম্মু ও কাশ্মীরই তো এ দেশের একমাত্র মুসলিম-সংখ্যাগরিষ্ঠ রাজ্য। যে সব প্রশ্ন উঠছে, আর যে ভাবে সেগুলো উঠছে, দুটো জিনিস থেকেই পরিষ্কার, কাশ্মীরের মুসলিমরা মনে করছেন, এ দেশটা মুসলিমদের জন্য তত নিরাপদ নয়। এমনকী এ দেশের বিচারব্যবস্থার মধ্যেও পক্ষপাতিত্ব। রাজিন্দর সাচার কমিটি কয়েক বছর আগে ভারতের মুসলিমদের পশ্চাদপরতার যে ছবি এঁকেছিল, কিছুই পাল্টাতে দেখা গেল না তার পর। শুধু এক-একটি ঘটনায় আবার নতুন করে মুসলিমদের নিরাপত্তাবোধের অভাব প্রবল হয়ে উঠছে। আর কে না জানে, দুনিয়া-জোড়া ইসলামি জঙ্গিরা ঠিক এটাই চায়, এই মনোভাবটাকে কাজে লাগাতেই তারা তাক করে বসে আছে। হয়তো না জেনেবুঝে, কিংবা হয়তো বাধ্য হয়ে, তাদের ফাঁদেই পা দিচ্ছে ভারতীয় রাষ্ট্র।"

১৯ বিশিষ্ট নাগরিককে প্রাণনাশের ঘোষণা

শিক্ষামন্ত্রী নুরুল ইসলাম নাহিদ, সুরঞ্জিত সেন গুপ্ত, সমাজকল্যান মন্ত্রী মহসিন আলীসহ ১৯ জনকে হত্যার ঘোষণা দিয়েছে ইত্তেহাদুল মুজাহিদিন নামে একটি সংগঠন।

ঐ সংগঠনের কাছ থেকে ডাক যোগে পাঠানো এক চিঠিতে ২০ জনের নাম রয়েছে। এর মধ্যে প্রথম নাম নীলাদ্রি চট্টোপাধ্যায়ের, তবে তার নাম কেটে দেওয়া হয়েছে।

তালিকায় আরো যাদের নাম রয়েছে তারা হলেন: প্রফেসর জাফর ইকবাল, আরিফ জেবতিক, ফেরদৌসী প্রীয়ভাষিনী, আব্দুর রহমান, মকবুল হোসেন (উদিচি শিল্পী গোষ্ঠী), আরিফুর রহমান, অমি রহমান পিয়াল, অনন্য আজাদ, মাহমুদুল হক মুন্সি, মারুফ রসুল, আরাফাত রহমান, নির্ঝর মজুমদার, ড: আতিক, আশফাক আনুপ ও নূর নবী দুলাল।

একটি অনলাইন নিউজ পোর্টালের ঠিকানায় এ চিঠি পাঠানো হয়েছে। ১০ আগস্ট সিলেটে থেকে পাঠানো চিঠিটিতে সিলেট পোস্ট অফিসের সিল রয়েছে।

On the Murder of Writer and Rationalist "Niloy Neel" in Bangladesh : Statement by Mukto Mona

Following the murders of Rajeeb Haider, Avijit Roy, Washiqur Rahmna, and Ananta Bijoy Das, today, the Mukto-Mona writer, blogger, and activist Niloy Neel has been hacked to death. He wrote in Mutko-Mona as well as in Istishon, and Facebook under the name of "Niloy Neel" (twitter: #NiloyNeel). In addition to writing, Niloy Neel was involved in various social justice movements and was the founder of the Bangladesh Science and Rationalists Association.

Ansar Al Islam, the Bangladesh branch of Al Qaeda in the Indian Subcontinent (AQIS) has claimed responsibility for murdering Niloy Neel in his own home, in front of his family, because of his writing. The fundamentalists continue in their tradition of responding to the pen with machetes; the government of Bangladesh continues to supply the fundamentalists with all that is necessary to keep their machetes honed. One by one the enlightened, the freethinking writers, and activists of Bangladesh, are being brutally murdered. Their only crime is taking a stand against injustice, and superstitions prevalent in society. A machete may kill, in a cowardly manner, a human being of flesh and bone; it cannot kill their ideology. Our fight will continue. With all our strength we will continue to speak our minds, our dreams. For as long as there is even a single member of the freethinking community alive; for as long as a single sentence written by freethinking writers survives.

Niloy Neel's FB status regarding lack of safety:

"Two men were following me two days ago. This happened when I was on my way back from attending the rally organized to protest "The Murder of Ananta Bijoy Das." First, when I reached a certain place via public bus, they came with me to the same spot. Then, when I got on to a Laguna to reach my destination, one of them climbed aboard the Laguna with me. On the Laguna I realized this was the same guy who was on the bus with me, but there were two of them then. I thought to myself, well, it's possible; perhaps one of them was going somewhere else so he took a different route.

Until then it seemed as usual. But on the Laguna, the young man was continually texting from his cellphone which made me suspicious. When I exited the Laguna before I reached my actual destination, he got off with me. I was quite scared, and hurried into a unfamiliar alley. Later when I looked back, I noticed that another young man, who had also been on the bus, had joined this young man, and they had not followed me into the alley; they were waiting at the alley entrance. Then I was quite certain that I was being followed. Because even if their destination was the same, they reached their through separate routes, following me. I went farther into the alley, and took a rickshaw keeping the hood up, and traveled to my destination. I reached in apparent safety with the help of a friend nearby.

When I tried to lodge a General Diary about this incident, I faced an even more bizarre situation. A police officer had told me in confidence that the police do not want to accept General Diaries like this because the officer who accepted such a General Diary, related to the personal safety of an individual, remains accountable to ensure the personal safety of said individual. If the said individual faces any difficulty, then the relevant police officer may even lose his job for negligence in duty. This is what I saw when I visited the thanas to file a General Diary. When the surveillance on me had occurred, I had had to pass by several thanas, and so today when I visited one that had been in the vicinity, they refused to accept my General Diary. They told me this isn't under our jurisdiction, go to this other thana, it's their jurisdiction, and also, leave the country as soon as possible."

On May 15, 2015, Niloy had been followed by some people when he was returning from participating in a protest rally for the murder of Ananta Bijoy Das. When he realized what was happening, he had gone to the police station to file a General Diary (GD). His GD was not accepted. He posted in detail about this incident on Facebook, where he expressed fear that his life was under threat. With his life he has proved that people who are atheists, non-religionists, secular, anti-fundamentalist, and pro-freedom-of-speech are not safe in Bangladesh; as if they have no other choice than to leave their country. They are not safe even in their own homes—Niloy Neel was murdered in his house. One man gained entrance to his house by pretending to be there to rent an apartment; then others entered, locked everyone in the house in one room, while hacking Niloy to death in the other. Niloy died right there; his blood spattered over all the books he loved, his computer.

अहमदाबाद।गुजरात सरकार ने संविधान निर्माता डॉ बी आर अंबेडकर पर लिखी उस किताब को वापस ले लिया है जिसमें कथित तौर पर हिंदू विरोधी कंटेंट था।यह किताब क्लास 6 से आठ तक के बच्चों को सरकारी स्कूल में पढ़ाई जानी थी।यह किताब डॉ अंबेडकर की 125वीं सालगिरह पर स्कूलों में बांटी गई थी। सरकार ने इसे उस वक्त वापस लेने का फैसला किया, जब उसे पता चला कि पब्लिशर ने इसमें अंबेडकर की उन '22 कसमों'को भी शामिल किया है,जो 

उन्होंने 1956 में बड़े पैमाने पर हुए धर्मांतरण के दौरान कही थीं। इस धर्मांतरण में उनके हजारों समर्थकों ने हिंदू धर्म छोड़कर बौद्ध धर्म स्वीकार कर लिया था।15 अक्टूबर 1956 को नागपुर में हुए इस धर्मांतरण कार्यक्रम में अंबेडकर ने 22 कसमों का जिक्र किया था।इनमें अंबेडकर ने कहा था कि हिंदू धर्म 'असमानता पर आधारित'है।उन्होंने हिंदू रीति रिवाजों की आलोचना भी की थी।किताब का नाम राष्ट्रीय महापुरुष भारत रत्न डॉ बी आर अंबेडकर है।इसे गुजराती में दलित स्कॉलर पीए परमार ने लिखा है।इस किताब को बच्चों को पढ़ाए जाने का फैसला राज्य सरकार की डिपार्टमेंट ऑफ सोशल जस्टिस एंड एमपावरमेंट ने लिया था। अब इसी विभाग ने इसे वापस लेने का फैसला किया है। किताब को बच्चों में इसलिए बांटा गया था ताकि वे राज्य स्तर के क्विज कॉम्पिटिशन में हिस्सा ले सकें।सूत्रों के मुताबि, अहमदाबाद के पब्लिशर सूर्य प्रकाशन ने ये किताबें जिला मुख्यालयों को पहले ही पहुंचा दी थीं। जब इन्हें वापस लेने का फैसला लिया गया तब तक इन्हें बच्चों में बांटा जा चुका था।सरकार ने इसकी चार लाख से ज्यादा कॉपीज छपवाई हैं जिनमें से अधिकतर बांटी जा चुकी हैं।अधिकारियों का कहना है कि पब्लिशर ने किताब में कुछ ऐसा भी जोड़ दिया, जिससे प्राइमरी के बच्चों के बीच गलत संदेश जा सकता है।इसलिए इन्हें वापस लेने का फैसला किया गया।वहीं किताब के लेखक परमार ने कहा कि उनकी किताब में इन 22 कसमों का जिक्र नहीं था।पब्लिशर ने इसे जोड़ने से पहले उनकी राय नहीं ली।

लखनऊ, 13 अगस्त 2015। रिहाई मंच ने सीतापुर के महमूदाबाद पुलिस थाने में
युवती की रेप के बाद हत्या पर तीखी प्रतिक्रिया व्यक्त करते हुए कहा है
कि इस घटना ने एक बार फिर साबित किया कि अखिलेश यादव सरकार न सिर्फ कानून
और व्यवस्था के मामले में फेल हो चुकी है बल्कि वह अपने आपराधिक
बलात्कारी पुलिस अमले का संरक्षण भी कर रही है। इस घटना ने एक बार यह फिर
साबित कर दिया है कि अखिलेश यादव की पुलिस बेलगाम होकर हत्यारों का एक
गिरोह बन चुकी है। एक तरफ वह थाने के भीतर हत्या करती है तो दूसरी ओर
इंसाफ की मांग कर रहे लोगों पर गोली भी चलाती है जिसमें एक बेगुनाह युवक
नदीम की मौत हो जाती है। दूसरी ओर अखिलेश यादव केवल और केवल मुआवजा बांट
कर इंसाफ का कत्ल करने की हर संभव कोशिश कर रहे हैं। मंच ने कहा कि
मुआवजा इंसाफ की लड़ाई को कभी दबा नहीं सकता है। अखिलेश यादव ने मुआवजे
की पेशकश करके यह साबित कर दिया है कि वह पीडि़त परिवारों को इंसाफ नहीं
दे सकते। मंच ने महमूदाबाद पुलिस थाने में युवती की रेप के बाद हत्या के
मामले में थाने पर तैनात पूरे स्टाॅफ सहित जिले के एसएसपी को तत्काल
बर्खास्त कर, हत्या का मुकदमा दर्ज करते हुए इस पूरे प्रकरण की सीबीआई
जांच करवाने की मांग की है।

रिहाई मंच के अध्यक्ष मुहम्मद शुऐब ने कहा कि पुलिस द्वारा यह कहना कि
लड़की के पिता ने अपनी लड़की की आत्महत्या की बात को लिखित तौर पर मान
लिया है, यह बात पूरी तरह से झूठ है। क्योंकि घटना के चश्मदीद पुलिस वाले
हैं न कि लड़की के पिता। ऐसे में लड़की के पिता द्वारा यह कहना कि लड़की
ने आत्महत्या की यह पूरी तरह से झूठा और पुलिस के दबाव में दिया गया
बेबुनियाद बयान है। क्योंकि वह घटना के चश्मदीद नहीं है। उन्होंने आरोप
लगाया कि पुलिस ने अपनी गर्दन बचाने के लिए लड़की के पिता से जबरिया
लिखवा लिया है। सीतापुर के महमूदाबाद पुलिस थाने में युवती के कथित
आत्महत्या की पुलिसिया कहानी जिस तरह से सामने आई है, वह बेहद लचर,
हल्की, अविश्वसनीय और गढ़ी गई मालूम होती है। मुहम्मद शुऐब ने कहा कि
मृतका के जो फोटोग्राफ सामने आए हैं जिसमें टाॅयलेट में मृतका के दोनों
पैर घुटने तक जमीन से छू रहे हैं और गले से फंदा लगा हुआ है, ऐसी स्थिति
में आत्महत्या हो ही नहीं सकती। इन तस्वीरों के बाद पूरी पुलिसिया कहानी
ही फर्जी साबित हो जाती है। उन्होंने कहा कि अखिलेश सरकार के उल्टे दिन
बड़ी तेजी से शुरू हो चुके हैं। आगामी चुनाव तक इनका खात्मा तय है।
मुहम्मद शुऐब ने कहा कि महमूदाबाद की घटना की सच्चाई जानने के लिए रिहाई
मंच की एक टीम घटनास्थल का दौरा करेगी और परिजनों तथा स्थानीय जनता
द्वारा द्वारा इंसाफ के लिए किए जा रहे उनके इस संघर्ष में साथ खड़ा
होगा।

रिहाई मंच नेता हरे राम मिश्र ने कहा है कि पत्रकार जगेन्द्र को जिंदा
जला देने, बाराबंकी में पत्रकार की मां को जिंदा जला देने, बहराइच में
आरटीआई कार्यकर्ता गुरु प्रसाद शुक्ला को पीट-पीट कर मार डालने, झांसी
में किसान को जिंदा जला देने जैसी विभत्स घटनाओं के बाद महमूदाबाद में
थाने में युवती की हत्या ने साफ कर दिया है कि अखिलेश सरकार अपराधियों का
एक गैंग है। लखीमपुर थाने में सोनम हत्या कांड मायावती सरकार के ताबूत की
आखिरी कील बना और महमूदाबाद की घटना अखिलेश सरकार के ताबूत की आखिरी कील
साबित होगी। उन्होंने कहा कि जिस तरीके से महमूदाबाद की घटना में पुलिस
को बचाने के लिए लड़की के पिता से जबरन लिखवाया गया है उसने प्रदेश के हर
उस मां-बाप, भाई-बहन को यह संदेश दिया है कि इंसाफ का कत्ल और अपराधियों
को बचाने के लिए उनके प्रदेश का युवा मुख्यमंत्री किसी भी हद तक जा सकता
हैं। उन्होंने राज्य महिला आयोग व महिला सम्मान प्रकोष्ठ पर सवाल करते
हुए कहा कि प्रदेश में महिलाओं की सुरक्षा के विज्ञापन करने वाली सपा
सांसद डिंपल यादव को इस घटना पर अपनी स्थिति स्पष्ट करनी चाहिए कि वह
थाने के हत्यारी-बलात्कारी पुलिसिया अमले के साथ हैं या फिर पीडि़ता के
इंसाफ के साथ हैं।

       To encourage and celebrate the power of innovative mobile solutions that drive inclusive growth across the country, the Vodafone Foundation launched the 'Mobile for Good Awards' in 2011.This year, in an effort to maximise impact and support tech for good projects, the Vodafone Foundation has joined hands with the NASSCOM Foundation for the Mobile for Good initiative.

     The M4G Awards 2015 has 2 categories- 'Leading Change Maker – NPO Category' and 'Leading Change Maker – For profit category' and invites applications across the 4 crucial areas of Health, Education, Women Empowerment & Inclusive Development and Agriculture. The NPO category will focus on recognising all projects by NGOs and NFPs. The For Profit category will focus on initiatives by Social enterprises and individuals. This year, a special category has been introduced for Government led mobile solutions.
