The New Nepal Constitution: A Losers Document?

NEW DELHI: Now that the draft constitution of Nepal is out for public scrutiny, it looks as if the nine year long exercise for constitution writing was a wasted opportunity. The draft constitution has postponed many important issues for a distant, yet unknown, future. The new constitution, the 6th in as many decades, lacks some of the core elements which have been the cause for chain of unrest, bloody and peaceful, in the Himalayan nations for more than a century now. No wonder various sections of Nepalese have already hit the streets to oppose it. 

Padma Ratan Tuladhar, a credible ethnic face and prominent human rights activist, has described the new constitution as a 'losers' document'. This is because, the constitution makers, have ignored the aspirations of the Madheshi (people of the plains), dalits and major ethnic and religious groups in the draft. Since the the Gorkha king Prithvi Narayan Shah united most of the present Nepal, these groups have had a history of marginalization and exclusion. 

Current constitution keeps the exclusion intact. For example, the current draft replaces the word 'proportional representation' for marginalized communities in interim constitution with 'inclusive' participation. This means that the communities will be ensured participation without any promised representation. It further exposes the communities to the competition where they, due to historical reasons, are in disadvantage. 

Similarly on the issue of religious freedom the drafters have shown their disdain for individual's wisdom. The new constitution states that each person shall be free to profess, practice, and preserve his/her religion according to his/her faith, and distance himself/herself from any other religion nevertheless it criminalizes the religious conversion by putting a condition i.e. it categorically states, 'no person shall act or make others act in a manner which is contrary to public health, decency and morality, or behave or act or make others act to disturb public law and order situation, or convert a person of one religion to another religion, or disturb the religion of other people. Such an act shall be punishable by law.' The constitution is inconsistent with the article 18 of the Universal Declaration of Human Rights which gives every human being freedom to change his religion or belief. 

The above argument has to be understood in the current political and social context of Nepal. In last few years, Nepal is being sharply divided on religious lines. Post Monarchy there has been many fold increase in efforts to blunt the democratic aspirations of people by polarizing them on religious line. The political parties, including the Maoists, are unnecessarily debating the word secularism in the draft. They are infusing xenophobia in the citizens' psyche. Even the Maoist leaders Prachand has misinterpreted the word secularism and agreed to find a 'suitable' replacement. In an interview to Outlook Hindi Prachanda said that he was against 'forceful conversion because spread of Christianity in Nepal is dangerous.' He didn't define how. 

Likewise, the constitution is also ambiguous on federalism, land reform and other issues including gender rights. These are the issues that should have not been left for future. It is widely believed that the current constituent assembly has been hijacked by the forces which were fought against to create it. Nepal has seen many violent uprisings in the past. Nepali leaders ought to understand that keeping the status quo won't help in future either. For last nine years, the Constitution Assembly could never show that it was serious in resolving the contentious issues through serious debates. Every major compromise was achieved outside the assembly in often questionable negotiations. 

Those who know about 1990 movement, also known as People Movement I, that resulted in end of absolute monarchy and making of a new constitution could see that the present exercise was no different. Then too in the name of compromise the leaders betrayed the most marginalized and exploited people. That betrayal pushed Nepal to the bloodiest civil war for a decade which ultimately broke the economy and society. It was hoped that the leaders would understand the past mistakes and address the core issues that has caused unrests in regular intervals. Unfortunately they didn't. 

Nepal today stands at square one. It has lost a good opportunity to move on the path of peaceful growth. The leaders may take a deep breath for now and think of themselves as heroes but future certainly will be not very kind to them. They have repeated the same mischief for which they have been punished time and again. It now looks obvious that their reluctance to not learn for the past would cost Nepal dearly.

Nearly 50 members of the Dalit community of Haryana's Bhagana village on Saturday converted to Islam during protest demonstration at Jantar Mantar in the National Capital. The demonstration, organised by Bhagana Kand Sangarsh Samiti (BKSS) was against the alleged persecution faced by the Dalit community at the hands of upper caste Jats.

At the heart of the conflict in Haryana is the struggle over land and it's use and ownership by the poor Dalits which has been grabbed by the dominant castes.

 

Speaking to dna 45-year-old Ved Pal of the BKSS said that the movement to convert to Islam has been gaining pace ever since the brutal gang rape of four Dalit girls in Bhagana village in 2014.The girls were going out to fetch water in the evening and they saw a white colored car rushing towards them and grabbed them inside the car.

 

The girls, aged between 13 and 18 years, belong to the landless Dhanuk caste, and worked for upper caste landowners. Ved Pal said the khap panchayat had imposed a social boycott against the caste group, forcing 250 families to leave their homes and flee the village.

 

"The villagers had to leave our village facing total boycott. Barbers not cutting hair, kids being removed from schools and denying entry into temples is a common happening," Pal said.

 

On Saturday afternoon, around 50 people, all of them men, gathered for demonstration and after brief speeches of community leaders converted to Islam. The protesters recited verses of Quran and offered prayers as well.

 

The development comes after almost a year of holding a sit-in protest at Jantar Mantar. Previously, in a written statement, the victim families had said some of the victims have already converted to Islam in protest against the atrocities of upper caste Hindus.

Satish Kajla, was among the men who converted to Islam on Saturday. While speaking to reporters said that by becoming Muslims he hopes that other Islamic nations would raise voice against the persecution the Dalit community faces.

New Delhi: A full one year after its introduction, the long overdue amendments to the Scheduled Castes and the Scheduled Tribes bill, providing stringent actions for offences against people belonging to the Schedule Castes and Schedule Tribes, have finally been passed by the parliament.

 

On Tuesday amidst boycott by many opposition parties over suspension of 25 Congress MPs, the Lok Sabha passed The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Bill, 2014.

 

The bill was introduced in parliament on July 7, 2014 and referred to the standing committee on July 17 2014.

 

When it was sent to the standing committee by the Lok Sabha it was strongly objected by the Congress who wanted to immediately pass the bill rather than further delay by sending it to standing committee.

 

The Amendment Ordinance 2014 that was brought by Congress led government had certain important amendments in the SC & ST (Prevention of Atrocities) Act 1989 to simplify the process of hearings and strengthen investigation mechanisms. It was signed by the president on March 4, 2014 and had come into force immediately but was not ratified by the next parliament within six months and hence it had lapsed.

 

After its introduction in the parliament by BJP government, it took one more year to pass the bill when it was passed on Tuesday by the Lok Sabha. The bill is virtually the same as the ordinance that was brought by former United Progressive Alliance.

 

This new bill makes it a punishable offence for public servants to 'willfully neglect' duties on matters relating to atrocities against SCs and STs.

 

Highlights:

       The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Bill, 2014 was introduced in the Lok Sabha by the Minister of Social Justice and Empowerment, Thaawar Chand Gehlot on July 16, 2014.

 

       The Bill replaces the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Ordinance, 2014.

 

       The Bill seeks to amend the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. The Act prohibits the commission of offences against members of the Scheduled Castes and Scheduled Tribes (SCs and STs) and establishes special courts for the trial of such offences and the rehabilitation of victims.

 

       Actions to be treated as offences: The Act outlines actions (by non SCs and STs) against SCs or STs to be treated as offences. The Bill amends certain existing categories and adds new categories of actions to be treated as offences.

 

       Forcing an SC or ST individual to vote or not vote for a particular candidate in a manner that is against the law is an offence under the Act. The Bill adds that impeding certain activities related to voting will also be considered an offence. Wrongfully occupying land belonging to SCs or STs is an offence under the Act. The Bill defines 'wrongful' in this context, which was not done under the Act.

       Assaulting or sexual exploiting an SC or ST woman is an offence under the Act. The Bill adds that: (a) intentionally touching an SC or ST woman in a sexual manner without her consent, or (b) using words, acts or gestures of a sexual nature, or (c) dedicating an SC or ST women as a devadasi to a temple, or any similar practice will also be considered an offence. Consent is defined as a voluntary agreement through verbal or non-verbal communication.

 

       New offences added under the Bill include: (a) garlanding with footwear, (b) compelling to dispose or carry human or animal carcasses, or do manual scavenging, (c) abusing SCs or STs by caste name in public, (d) attempting to promote feelings of ill-will against SCs or STs or disrespecting any deceased person held in high esteem, and (e) imposing or threatening a social or economic boycott.

       Preventing SCs or STs from undertaking the following activities will be considered an offence: (a) using common property resources, (c) entering any place of worship that is open to the public, and (d) entering an education or health institution.

 

       The court shall presume that the accused was aware of the caste or tribal identity of the victim if the accused had personal knowledge of the victim or his family, unless the contrary is proved.

 

       Role of public servants: The Act specifies that a non SC or ST public servant who neglects his duties relating to SCs or STs shall be punishable with imprisonment for a term of six months to one year. The Bill specifies these duties, including: (a) registering a complaint or FIR, (b) reading out information given orally, before taking the signature of the informant and giving a copy of this information to the informant, etc.

 

       Role of courts: Under the Act, a court of Session at the district level is deemed a Special Court to provide speedy trials for offences. A Special Public Prosecutor is appointed to conduct cases in this court.

 

       The Bill substitutes this provision and specifies that an Exclusive Special Court must be established at the district level to try offences under the Bill. In districts with fewer cases, a Special Court may be established to try offences. An adequate number of courts must be established to ensure that cases are disposed of within two months. Appeals of these courts shall lie with the high court, and must be disposed of within three months. A Public Prosecutor and Exclusive Public Prosecutor shall be appointed for every Special Court and Exclusive Special Court respectively.

 

       Rights of victims and witnesses: The Bill adds a chapter on the rights of victims and witness. It shall be the duty of the state to make arrangements for the protection of victims, their dependents and witnesses. The state government shall specify a scheme to ensure the implementation of rights of victims and witnesses.

 

       The courts established under the Bill may take measures such as: (a) concealing the names of witnesses, (b) taking immediate action in respect of any complaint relating to harassment of a victim, informant or witness, etc. Any such complaint shall be tried separately from the main case and be concluded within two months.

Industrial barons have chosen the sector as another investment opportunity

 

espite its once famed commitment to the ideal of free, universal education for all, researchers say that the higher education sector in Kerala, dominated by self-financing institutions, marches on its belly, driven by the aspirants' ability to pay, expanding inequity and education exclusion.

 

"Education exclusion, instead of declining has increased to an unmanageable scale," says a social class analysis 'Education Exclusion in the Professional Self-Financing Sector in Kerala' by the Centre for the Study of Social Exclusion and Inclusive Policy, Cochin University of Science and Technology.

 

Though self-financing sector in professional education had a "humble beginning," it has been "shaped and reshaped as an industrial sub-sector" to make profit as industrial barons chose it as another investment opportunity.

 

A kind of dualism

The study also found "a kind of dualism" in which quality education is available only to the rich "in the form of public English-medium system." D. Rajasenan, who led the study, said that the number of Scheduled Tribe students who sought admissions to self-financing institutions formed less than three per cent of the total admissions.

 

The percentage of Scheduled Caste students stood between seven and eight per cent. Their combined pass percentage stood between six and seven.

 

The key reason for this, he said, was the private cost on education, which means what the students have to pay for expenses other than tuition. Co-curricular and extra-curricular activities are often prohibitively priced for students from humble economic backgrounds.

 

While the caste-based reservation system has not helped improve the situation, even the universities, and government engineering and medical colleges have turned out to be centres of education exclusion because of the "hidden costs".

 

Most of the data for the study were collected by a survey of 900 students comprising 450 engineering students, 225 students of medicine. and 225 management students in Thrissur, Ernakulam, Thiruvananthapuram, Kollam, and Palakkad districts.

 

The three streams of studies were chosen because they are the "axes around which higher demand, status and earning rotate," the study said.

VARANASI: The double damnation of being a dalit and a prisoner could not deter Ajeet Kumar Saroj from his dream of pursuing higher studies and building a future for himself once he walks out of the jail. Serving a 10-year term for culpable homicide not amounting to murder, Ajeet was awarded the gold medal for securing the highest marks in a diploma course of the Indira Gandhi National Open University (IGNOU) at a convocation here on Saturday


This was also the first time that a diploma-holder was felicitated at the University's convocation in which degrees are conferred upon graduate, post-graduate and doctorate students. 


Ajeet (23), lodged at the Varanasi Central jail after being sentenced to 10-years imprisonment in 2012 under section 304 of the IPC, was awarded gold medal at the 28th convocation of IGNOU held at KN Udupa Auditorium of Banaras Hindu University (BHU) on Saturday. Vice-chancellor of Dr Ram Manohar Lohia Avadh University, Faizabad, Prof GC Jaiswal awarded him the medal. Ajeet was also invited to share his experience from the convocation stage. 


"He is a meritorious student, but it is our bad luck that he is behind bars. I am sure he would achieve success in life," his mother Sushila Devi said after embracing her son. Ajeet topped in the country by getting 75% marks in the one-year Diploma in Tourism Studies. "After his imprisonment, he enrolled himself in several certificate programmes in IGNOU and scored more than 65% marks in each programme," said regional director of IGNOU, Varanasi centre, Dr AN Tripathi. 


Appreciating Ajeet's commitment, jailer and jail-coordinator of IGNOU Bhola Nath Mishra said, "He (Ajeet) will be an inspiration for other prisoners pursuing IGNOU courses." 


Ajeet is also pursuing B.Com (3rd year) through IGNOU. "I have done three diploma and four certificate courses after I was lodged in jail on February 1, 2012. I wish to do MBA for my future career after getting out," Ajeet, whose father Ram Bachan Saroj is a small-time farmer at Chakke village in Jaunpur district, said. "We have made an appeal in the High Court for his bail so that he can do better in his studies," his father said. Ajeet told TOI that he is greatly inspired by late South African statesman Nelson Mandela, who spent years in jail and went on to become the country's President.

East Godavari district unit of Mala Mahanadu at its executive meeting here today with Dhanarasi Shyam sunder in the chair, has resolved extending support to the call given by the SC ST associations for organising a massive rally in the citytomorrow seeking extension of reservations to private sector also.

 

By another resolution, it has denounced the new industrial policy evolved by both the state and central governments paving the way for closing down or handing over the public sector undertakings to the corporate companies. `It is nothing but diluting the reservation facility provided to the SC STs by Dr Ambedkar. Already employment opportunities are getting diminished day by day and the new industrial policy would worsen the situation. Hence it is high time that reservations needed to be extended to private sector also the resolution said. UNI

Andhra Pradesh government today said that it will provide financial assistance to 300 students belonging to scheduled castes (SC) to enable them to pursue higher education in foreign countries.

Andhra Pradesh government today said that it will provide financial assistance to 300 students belonging to scheduled castes (SC) to enable them to pursue higher education in foreign countries.

 

"300 SC students would be provided financial assistance to pursue higher education in foreign countries under Dr Ambedkar Overseas Education Scholarship Scheme in the state in this academic year," Ravela Kishore Babu, state Minister for Social welfare, said.

 

He said that 33 SC students have already availed such assistance.

 

Under NTR Higher Education Scheme, the government will provide financial assistance for SC students to join national level prestigious educational institutions for higher education, he further said.

 

He inspected a few welfare hostels in the city, and informed that all social welfare hostels would be converted into residential schools in a phased manner.

BHUBANESWAR:  The State Government is busy finalising the modalities for constituting a scholarship council that would streamline the process of awarding scholarships to meritorious students.

 

The proposed council will provide a common portal for various scholarship schemes of the Central and State Governments. It would also create a transparent database of the scholars thereby avoiding duplication in processing. Currently, scholarships are being given to eligible students by School and Mass Education, Higher Education, SC/ST Development and Employment and Technical Education and Training (ETET) Departments.

While the budget provision for SC/ST Department is Rs 800 crore, for Higher Education, it is Rs 40 crore and School and Mass Education has a scholarship provision of Rs 100 crore.

 

At a recent meeting of all departments chaired by Chief Secretary GC Pati, it was decided that an apex body would be proposed by the Higher Education Department to look after the overall functioning of the council which will be headed by Chief Minister Naveen Patnaik. Ministers of beneficiary departments would be the members of the council. For day-to-day management, there will be an executive body of the council in which Chief Secretary GC Pati will be the chairman and Development Commissioner would be the vice-chairman.

 

In June, Naveen had directed Pati to examine the proposal for constituting a council exclusively for awarding scholarships to students of Odisha.

 

Higher Education Secretary Gagan Dhal said the council is aimed at streamlining the scholarship disbursal process.

2. प्रशिक्षित भिक्खू तयार केले गेले नाहीत 
3. बहुसंख्यकांची अधर्म संस्कृतिला नष्ट करकरण्याचे काम करून त्याचवेळी त्यांना सदधर्म संस्कृति [बुद्धीजम प्रणीत संस्कृति] कडे नेण्यासाठी काहीही काम झाले नाही. 
4. सांस्कृतिक संघर्षाची प्रतिक्रांति कसे काम करते... त्याबाबत जागरुकता आणण्याचे काम झाले नाही. 

त्यामुळे बौद्ध बनुनही सांस्कृतिकदृष्टया हिंदूच राहील्यामूळे ... 

हा असा अपघात घडणारच।

अतिशुद्रो के उपर अन्याय अत्याचार होते ही रहेंगे। 

इसलिये क्या करना चाहिए... 

1. अन्याय अत्याचार होने पर आवाज उठाना .... ? याने रोग होनेपर उपचार करना। 
या 
2. अन्याय अत्याचार न होने के लिए... जबाबदार वह अधर्म संस्कृति को नामशेष करना 
याने रोग न हो इसके लिए प्रयास करना... प्रतिबंधक उपाय करना।

Islamic State Expands Outside Syria And Iraq

NEW DELHI: The Islamic State has claimed responsibility for a deadly attack in Saudi Arabia, where a blast triggered by a suicide bomber killed 15 people at a mosque inside a special forces headquarters. 

The blast took place in Abha, close to the Yemeni border. Twelve of the victims were members of a Special Weapons and Tactics (SWAT) unit, while three others were workers of the compound. Nine people were wounded in the attack. 

The attack is the biggest Islamic State claimed attack targeting security workers in Saudi Arabia -- with the militant group recently gaining inroads into the oil rich kingdom. A spate of attacks in July were traced to the Islamic State, including a car bomb that exploded at a security checkpoint in Riyadh, and a policeman being gunned down during a raid in Taif where Islamic State flags were found. 

Most significantly, the Islamic State claimed responsibility for two deadly attacks on Shia mosques in May. The attack on the Al-Anoud mosque in Dammam killed three people and wounded four others. The attack on a mosque in the village of al-Qadeeh killed ten people and injured over seventy others -- and was the first attack explicitly claimed by the Islamic State on Saudi soil. 

The Islamic State has long targeted Saudi Arabia, with the group's leader, Abu Bakr al-Baghdadi, in numerous videos and recordings, calling for attacks against the Saudi regime. In a video released last year, Baghdadi declared a target list for attacks in Saudi Arabia, without mentioning the country by name because it is a name derived from the ruling tribe, the al-Saud, whose authority IS does not accept. Baghdadi referred to Saudi Arabia as the "head of the snake and stronghold of disease." The topmost position on the target list was accorded to Shias in Saudi Arabia. The leader urged supporters to "draw their swords" to fight and to kill Shiites, using the pejorative, sectarian term "rafidhah" for the sect. 

At around the same time, a bombing in a small Shiite village in Saudi Arabia's oil-rich Al Ahsa region in the east killed eight people was linked to the Islamic State. Authorities revealed that the leader of the attack was connected to IS militants, who received orders from abroad "specifying the target, the targeted, time of execution." This is the first time, however, that the group has openly claimed an attack in Saudi Arabia. 

The latest attack signals the aspirations of the group to expand out of Syria and Iraq. It has already established a foothold in conflict-torn Yemen, where a Saudi-led coalition is bombing Houthi rebels. The Islamic State has claimed a string of attacks on mosques in Yemen. 

The group is also active in Tunisia, where it claimed an attack on tourists at the Bardo Museum in Tunis that killed 23 people. 

It is also active in Libya, where in addition to a series of attacks on embassies in the Libyan capital of Tripoli, the group released a video purportedly showing the killing of up to 30 Ethiopian Christians and the beheading of 21 Egyptian Coptic Christians. The videos was released by the Islamic State's media arm and was carried out by militants who say they are associated with the Tripoli Province of Islamic State -- a Libyan group that pledged allegiance to IS last year. 

The beheading followed an attack on the luxurious Corinthia hotel in central Tripoli that killed nine people three weeks earlier that was claimed by the Islamic State. The militant group have also claimed other attacks -- including a series of attacks targeting empty embassies and local security buildings in Tripoli. 

However, despite these attacks, it is not clear how much influence the group holds. For one, the Islamic State has seen success by capitalizing on the Shia-Sunni conflict in Iraq and Syria, and sectarian tensions of this scale do not exist in Libya. The crisis in Libya is more directly concerned with the local power vacuum, and this context has led to many on social media wondering whether the group is really responsible for all the attacks it has claimed. 

Also recently, militant group Boko Haram that is based in Nigeria, pledged allegiance to the Islamic State. The group officially changed its name to Islamic State's West Africa Province," or ISWAP. Boko Haram -- itself a nickname for Jama'atu Ahlis Sunna Lidda'awati wal-Jihad, which in Arabic means "People Committed to the Propagation of the Prophet's Teachings and Jihad" -- had pledged allegiance to the Islamic State previously, but till now, was operating under its independent name. "Our caliph, God save him, has accepted the pledge of loyalty of our brothers of Boko Haram so we congratulate Muslims and our jihadi brothers in West Africa," Reuters quoted Islamic State spokesman Abu Mohammad Adnani as saying in an audio message in March. 

The group is also making inroads into South Asia, with reports emerging from Pakistan and Afghanistan indicating that IS militants are active in the region. 43 Ismaili Shia Muslims were killed and 20 others injured as Jundullah "Soldiers of Allah" that swore allegiance to the Islamic State last November struck in Karachi earlier this month. Jundullah spokesperson Ahmed Marwat told Reuters ,"These killed people were Ismaili and we consider them kafir (non-Muslim). We had four attackers. In the coming days we will attack Ismailis, Shi'ites and Christians." According to some reports, a blood-stained pamphlet was found at the scene in which the Islamic State itself had claimed responsibility. 

Significantly, Jundullah had claimed last November that a delegation from the Islamic State had visited Balochistan. Marwat said then that the purpose of the visit was to see how it could work to unite Pakistani militant groups. This was just after Jundullah had announced it allegiance to IS. The military offensive against the militants has proven to be a double edged sword in Pakistan. On the one hand it has weakened and splintered the militant organisations, and on the other as a result of this has led them to seek new coalitions with the Islamic State clearly cashing in on the opportunity to enter both Pakistan and Afghanistan through the two outfits of the Taliban respectively, and their offshoots. 

Earlier, the provincial government of Balochistan had conveyed a confidential report to the federal government and law enforcement agencies warning of increased footprints of IS, also known by the Arabic acronym Daish, in Pakistan. 

In Afghanistan, the Islamic State claimed its first attack several weeks ago, when a suicide bomber detonated his explosives-laden vest outside a bank in Jalalabad, the capital of the eastern province of Nangahar, killing at least 34 people and injuring 125 others. The attack was claimed by a group called ISIS Wilayat Khorasan, with a statement issued naming the suicide bomber as Abu Mohammad Khorasani. A photograph purportedly of Khorasani was included, showing the attacker seated on a prayer mat, a scarf covering his face and a Kalashnikov rifle by his side. A black Islamic State flag was visible in the background. 

These attacks indicate that the Islamic State has very much gained influence outside of its Syria and Iraq-based stronghold. This is a rare but very significant achievement for a militant group that's expansion is usually curtailed by ideology, sects, societal differences and local opposing militias.

NAGA ACCORD: THE MOUSE THAT ROARED?

NEW DELHI: The "historic" New Delhi-Naga accord signed by the government with the National Socialist Council of Nagaland (Isak-Muivah) in the presence of Prime Minister Narendra Modi and NSCN chief Thuingaleng Muivah has run into trouble even before the details have been disclosed. And government interlocutors, faced with a building backlash from the north-east, have been virtually forced to move back a couple of steps in admitting that the 'accord' was not a final document but just a draft agreement at best. 

Witness the movement. The week opened with the disruption of Parliament, a belligerent Congress party after the suspension of its MPs in the Lok Sabha, followed by the sudden announcement that the government had reached an accord with the Nagas, thereby ending the vexed dispute that has been hanging fire since independence. PM Modi spoke amidst smiles, congratulatory handshakes, of the "historic peace accord" adding, ""the Nagaland political issue had lingered for six decades, taking a huge toll on generations of our people." The impression given to the media in attendance was that the accord being discussed for years now with the NSCN (IM) had finally been agreed upon, and as PM Modi tweeted "today, we mark not merely the end of a problem but the beginning of a new future. #Nagaland http://nm4.in/1g0sUvP 

The news alerted all states in the North East, as a 'solution' as per the NSCN(IM) position lay in sovereignty and the creation of a Greater Nagaland, carved out of the other states with a substantial Naga population. Has the NSCN(IM) given up its position? was the question being asked by the Nagas with the corollary, "If yes, how will they justify the struggle of the past decades? There was no answer, as there were no details being given out of the 'accord' finalised in Delhi. 

Has the government agreed to the demand for Greater Nagaland, was the other question creating major concern amongst the states of Assam, Manipur and Arunachal Pradesh. The reaction built up on speculation, to the point where the Chief Ministers of these states felt compelled to rush to Delhi for clarifications. They met PM Modi, Home Minister Rajnath Singh and were now told that no this was not a final accord, it was just an agreement, and that before anything is finalised they would all be consulted. They have returned to their states with the assurance from the top echelons of the government that they will be part of the final decision. 

This takes the issue back to Nagaland where the reaction to this news has been extremely adverse. They have taken us for a ride, is the response of the people according to well informed journalists. 

It has been clear from the response that the sticking points, if indeed 'resolved' will create a huge political backlash for one of the other signatories to the accord. If the government has conceded on the NSCN-IM's demand for a Greater Nagaland, the north-eastern states will react strongly, perhaps violently. This has been the issue all along, and according to sources, there is no indication that a via media has been found. The present interlocutors said that the NSCN-IM has agreed to work with the Indian Constitution, but this then raises question marks over the compromise on sovereignty and what actually has the Naga group achieved. Besides from the New Delhi perspective, if the government has conceded major ground on the issue of sovereignty even if through a compromise of sorts, this will impact on all future peace talks with armed insurgents who still operate in the states of the North East. 

From all the confusion emerging because of the inexplicable decision to announce an 'accord' and then keep it secret is the one question that those associated with the peace process in the North East and in New Delhi are asking: what was the need for this sudden announcement if nothing really is finalised? Conversely, the question is being reframed to ask: what has been agreed to that they do not want the rest of the country to know?" 

The one answer that many officials conversant with and part of the peace process in some capacity or the other agreed to was that there was some level of desperation from the NSCN-IM. Muivah is aware of the fact that he is not a Naga, and is regarded with some suspicion by many there. The Naga credibility for the organisation comes from Isak Chishi Swi who is in the intensive care unit of a hospital in Delhi. It was thus necessary for the two leaders to get a pact together during his life, so that it was not rejected altogether by the Nagas as a Muivah initiative or as a source said, "sell out" even. 

PM Modi is thus credited with going ahead on this as he needed diversionary tactics, being under tremendous pressure in Parliament from the Opposition. He had clearly hoped that the accord would then come as a positive in a pond of negatives, and break the cycle of critical headlines in the media. Interestingly Congress president Sonia Gandhi questioned the government's failure to consult the chief ministers subsequently, saying, "from this I take that this government is arrogant... their arrogance is even more clear than it was before, it's an insult to the chief minister, not only to them, but also to the people of those states and federal structure of our country." 

All in all, the story has changed sharply from 'what is there in the accord' to a 'is there a Naga accord at all?"

SRINAGAR: Forces fired aerial shots on Friday to disperse violent protesters in Kakpora village of Jammu and Kashmir's Pulwama district where an alleged Lashkar-e-Tayaba commander was killed in an encounter with security forces yesterday while two others managed to escape. 

Ahead of the funeral, a large crowd of people, shouting pro-freedom and anti-India slogans, staged a protest in Kakpora against the killing of the militant, a local named Talib Ahmad Shah, who was the district commander of Lashkar for Pulwama. 

The slain militant had a post-graduate degree in Physical Education. He belongs to a well-off family. His father is a government employee in R&B Department and the family owns large tracts of apple orchards. Talib had joined Lashkar in 2012, reportedly after relentless raids and harassment by forces for his alleged involvement in stone pelting during the 2010 civilian unrest in Kashmir Valley. 

On Friday morning, clashes broke out between the forces and protesters who had imposed curfew-like restrictions in the area during which incidents of stone-pelting were reported. To disperse the crowds, police and paramilitary troopers fired aerial shots and tear-gas shells during which some protesters reportedly suffered injuries. 

Earlier on Thursday, three LeT militants had taken refuge inside a house in Astan Mohalla of Kakpora following which a siege was laid around the locality and a house-to-house search operation was carried out by J&K Police's counter-insurgency unit police, Army's 50 RR and CRPF personnel. 

"While the search operation was going on, the militants opened fire at the search party, triggering the gun-battle," the official said. 

In the initial exchange of gunfire, the LeT commander, Talib Ahmad Shah, was killed while two other militants managed to escape from the house. The Army sources said two militants including the divisional commander of LeT identified as Abu Qasim were with Talib but they managed to escape and took refuge inside another house where a fresh encounter began on Thursday evening. The forces used Improvised Explosive Devices and blasted three house but the militants continued to fire at them. 

Meanwhile, as the cordon-and-search operation was underway on Thursday evening, residents of the area started massive protests and pelted stones at the forces who retaliated by lobbing teargas and pepper gas shells. 

A J&K police official said the protesters tried to break the cordon around the house where the militants were holed up. In the ensuing clashes, a protester identified as Lateef Ahmad of Qazigund Pulwama, was injured after a teargas shell hit his abdomen. He was rushed to hospital but his condition is stated to be stable. 

The two militants managed to escape from the area, taking advantage of the darkness, following which the search operation was called off on Friday morning. 

The situation remains tense with sporadic incidents of stone pelting reported from some localities in Pulwama district. Authorities have imposed restriction, especially in the native village of the slain militant where preparations are underway for his funeral. 

Meanwhile, two police officials were injured when militants attacked a police post in Basantgarh area of Udhampur district later Thursday evening. The injured cops were identified as Gul Mohammad and Rajesh Kumar. 

A J&K Police officer said a group of four to five militants struck at the police post at about 9 pm. "The policemen present at the post also retaliated and the exchange of fire was going on till midnight. However, they managed to escape and disappeared from the area," he said. 

A large contingent of Army, CRPF and police teams have been rushed to the area and a search operation is being carried out to nab the suspects. The attack came a day after the militants ambushed a convoy of forces, killing two BSF jawans, before one of them was shot dead and another was captured alive.

NEW DELHI: Newly appointed Delhi Commission of Women Chairperson hit hard on the profession of sex worker while talking at an event organized by NGO Pairvi. Maliwal equated any act of prostitution with the act of "rape" and called it a "blot" on the society demanding its complete eradication by the government. 

She referred to GB Road in central Delhi by saying that every month six lakh condoms are delivered to the brothels of GB Road and said that, "Six lakh condoms means six lakh rapes we are allowing in Delhi." 

"And the figure could be much more as the cases of minor girls are not reported. Strangely, I found that it is being accepted by people in a way. I have spoken to a lot of people about it after visiting G B Road, and they said if you get the red light area closed, rapes will increase. I condemn such mindset," she said at the event organized to discuss the post –earthquake state of human trafficking on the Indo-Nepal border. 

Maliwal also spoke of the dire conditions of the protection homes for girls, saying that the plight of these rescue homes are so bad that many girls are ready to go back to GB road than staying there. "Also, the Superintendents don't get changed in 25 years, which indicates a big nexus. We will work on these aspects and submit our recommendations and pursue them till they are accepted," she added further with reference to the rescue homes. 

The chief office-bearer of the DCW said that she has taken a pledge to alleviate the concern s of the residents of GB Road within next three years. She also said that the Trafficking Committee of DCW will be working tight with Centre, State, and NGOs to get the issues resolved. 

Meanwhile, a new proposal on the issue of prostitution has just been drafted by Amnesty International, which contends that "Prostitution is a human right" and defines prostitution as the "sex work means that sex workers who are engaging in commercial sex have consented to do so." The proposal calls for the decriminalization of the sex-trade worldwide.

The Revenue Department has amended income tax rules to provide for reporting of information with regards to financial assets and accounts, a month after India signed a tax information sharing agreement with the US.

The Income Tax rules define various terms such as financial asset, financial account, excluded accounts, participating and non-participating financial institutions, among others.

On July 9, India and the US signed tax agreement under the Foreign Account Tax Compliance Act (FATCA) that will enable automatic exchange of financial information between the two nations about tax evaders from September 30.

The rules define various terms such as financial asset, financial account, excluded accounts, participating and non-participating financial institutions, among others.

The norms prescribe information to be maintained by the reporting financial institution such as name, address, taxpayer identification number (assigned to the account holder by the country or territory of his residence for tax purposes) and date and place of birth (in the case of an individual) of each reportable person.

The rules prescribe reporting requirements on a staggered basis starting from earlier year 2014 and reporting of all details prescribed from calendar year 2017 onwards.

They also specify due diligence procedure for identifying reportable account and various forms.

"Though FATCA reporting has presented short-term challenges for the industry, the rules will provide much needed guidance to the industry to upgrade their internal information systems for FATCA reporting and help them be compliant," said Amit Maheshwari, Partner Ashok Maheshwary and Associates.

Bahroze Kamdin, Partner, Deloitte Haskins and Sells LLP said the FATCA rules "luciently" provide for the definitions of various terminology, the information to be maintained and reported and the due diligence process to be followed for identifying preexisting and new accounts.

"India is the first country to have come out with joint rules for FATCA and the OECD CRS," Kamdin said and added, the methodical approach will help financial institutions meet the strict timelines.

After signing of FATCA, beginning September 30, banks, mutual funds, insurance, pension and stock-broking firms will report their Indian client details to the United States which will be shared with New Delhi.

Indian entities will do a reciprocal information sharing about Americans.

The FATCA agreement would "enhance tax transparency and accountability in matters of financial reporting and payment of taxes which are legitimately due to various governments," Revenue Secretary Shaktikanta Das had said.

ব্লগার নিলয় হত্যার তদন্তে সহায়তা করার জন্য যুক্তরাষ্ট্রের কেন্দ্রীয় গোয়েন্দা সংস্থা ফেডারেল ব্যুরো অব ইনভেস্টিগেশন (এফবিআই) সদস্যের প্রতিনিধি দল রবিবার দুপুর দেড়টার দিকে ডিবি কার্যালয়ে প্রবেশ করেছেন। সেখানে বৈঠক শেষে নিলয় হত্যার ঘটনাস্থল পরিদর্শন করবেন এফবিআই সদস্যরা।
ঢাকা মহানগর গোয়েন্দা পুলিশকে (ডিবি) তদন্তে সহায়তার জন্য তারা বাংলাদেশে এসেছেন। ডিসি (ডিবি) মাহবুব আলম দ্য রিপোর্টকে বিষয়টি নিশ্চিত করেছেন। এই প্রতিনিধি দলে এফবিআইয়ের তিনজন সদস্য রয়েছেন।
জানা গেছে, ব্লগার নিলয় হত্যার পর শনিবার সকালে মোবাইল ফোনের মাধ্যমে ডিবির এক উপ-কমিশনারের (ডিসি) সঙ্গে যোগাযোগ করে এফবিআই। এ সময় এফবিআই এ হত্যার তদন্তে সহয়তা করার ইচ্ছা প্রকাশ করেন। পরে এফবিআইকে আনুষ্ঠানিক অনুমতি দেওয়া হয়।
এ বিষয়ে ডিবির ডিসি মাহবুব আলম বলেন, এফবিআই সদস্যরা নিলয় হত্যার ঘটনার তদন্তের সহায়তা করার জন্য রবিবার সকালে ডিবি অফিসে আসবেন। তারা প্রযুক্তিগত সহায়তার পাশাপাশি অন্যান্য কারিগরি বিষয়ে সহায়তা করবে।
রাজধানী খিলগাঁওয়ের গোড়ানের ১৬৭ নম্বর বাড়ির পঞ্চম তলায় শুক্রবার দুপুরে বাসাভাড়া নেওয়ার কথা বলে চার যুবক বাসায় প্রবেশ করে ধারালো অস্ত্র দিয়ে কুপিয়ে হত্যা করে নীলাদ্রি চক্রবর্তী নিলয়কে।
এ ঘটনায় রাতে তার স্ত্রী আশামনি অজ্ঞাতপরিচয় চারজনকে আসামি করে খিলগাঁও থানায় একটি হত্যা মামলা দায়ের করেন।
এর আগে, যুক্তরাষ্ট্রের নাগরিক ও বিজ্ঞান লেখক অভিজিৎ রায়কে হত্যার ঘটনায় তদন্তে সহায়তা করছে এফবিআই।

Nagasaki Peace Declaration

At 11:02am, on the 9th August 1945, a single atomic bomb instantly
reduced Nagasaki to a ruin.

A vast amount of radiation passed through people's bodies, and the city was struck by heat rays and a blast that defy imagination. 74,000 of the city's population of 240,000 people were killed. A further 75,000 individuals sustained injuries.

It was said that  vegetation would not grow for at least 70 years. However, today, 70 years on, this hill in Urakami, which was once a ruin, is now enveloped in greenery. Nevertheless, those hibakusha, atomic bomb survivors, whose bodies were eaten away by radiation, and who continue to suffer from the aftereffects, can never forget that day.

The atomic bomb was born of war, and was used in war. The conviction that nuclear weapons must not exist, and that we must never go to war again, was deeply and powerfully engraved upon the hearts of the hibakusha, who know firsthand the fearsome destructive force of atomic bombs. The peaceful ideology of the Constitution of Japan was born from these painful and harsh experiences, and from reflection upon the war. Since the war, our country has walked the path of a peaceful nation.

For the sake of Nagasaki, and for the sake of all of Japan, we must never change the peaceful principle that we renounce war.

Most of our population is now made up of the post-war generation. The memories of war are fast fading from our society. We must not forget the atomic bomb experiences of those in Nagasaki and Hiroshima. Neither should we forget the air raids which destroyed Tokyo and many other cities, the Battle of Okinawa, nor the many people of Asia who suffered because of this tragic war. Now, 70 years on, it is vital that we continue to pass on those memories.

I ask that those of you who experienced the atomic bomb and the war in Japan and across the globe speak of your experiences, and not allow those memories to fade.

To the young generation, I ask that you do not push wartime experiences aside saying that they are stories of the past. Understand that the wartime generation tell you their stories because what they speak of could, in the future, happen to you as well. Therefore, please inherit their wish for peace. Please imagine what you would do in such circumstances, and ask yourself "What can I do for the sake of peace?" You, the young generation, have the power to transcend national borders and create new relationships.

download (3)The greatest power to realize a world without war and without nuclear weapons lies inside each and every one of us. Listen to stories of the war, sign petitions for nuclear abolition, and visit atomic bomb exhibitions. Together, these individual actions can create a much
larger power. In Nagasaki, the younger generation, which includes second and third generation hibakusha, are inheriting the wish for peace and are taking action. Our individual strengths are the greatest power in realizing a world without war and without nuclear weapons. The power of civil society is the power to move governments, and to move the world.

In May of this year, the "Review Conference of the Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT)" ended without the adoption of a Final Document. However, the efforts of those countries which are attempting to ban nuclear weapons made possible a draft Final Document which incorporated steps towards
nuclear disarmament.

I ask the following of the heads of the NPT member states. Please do not let this Review Conference have been a waste. Please continue your efforts to debate a legal framework, such as a "Nuclear Weapons Convention (NWC)", at every opportunity, including at the General Assembly of the United Nations.

Many countries at the Review Conference were in agreement that it is important to visit the atomic-bombed cities of Nagasaki and Hiroshima. Once again, I make a call from Nagasaki.

I address President Obama, heads of state, including the heads of the nuclear weapon states, and all the people of the world. Please come to Nagasaki and Hiroshima, and see for yourself exactly what happened under those mushroom clouds 70 years ago. Please understand and accept the message of the hibakusha, who are still doing their best to pass on their experiences, not simply as "victims", but as "members of the human race".

I appeal to the Government of Japan. Please explore national security measures which do not rely on nuclear deterrence. The establishment of a "Northeast Asia Nuclear-Weapon-Free Zone (NEA-NWFZ)", as advocated by researchers in America, Japan, Korea, China, and many other countries, would make this possible. Fix your sights on the future, and please consider a conversion from a "nuclear umbrella" to a "non-nuclear umbrella".

This summer, Nagasaki held the "International Youth Peace Forum", where young people from 128 different countries and regions considered and discussed peace.

In November, Nagasaki will host the "Pugwash International Conference" for the first time. At this Conference, which was inspired by Albert Einstein, who understood the terror of nuclear weapons, scientists from all over the world will gather, discuss the problem of nuclear weapons, and convey a message of peace from Nagasaki to the world.

Furthermore, 4 years on from the Great East Japan Earthquake, Nagasaki continues to support the people of Fukushima who are suffering due to the accident at the nuclear power plant.

The Diet is currently deliberating a bill which will determine how our country guarantees its security. There is widespread unease and concern that the oath which was engraved onto our hearts 70 years ago and the peaceful ideology of the Constitution of Japan are now wavering. I urge the Government and the Diet to listen to these voices of unease and concern, concentrate their wisdom, and conduct careful and sincere deliberations.

This year, the average age of the hibakusha has now passed 80. I strongly request that the
Government of Japan fulfill its responsibility of providing substantial care that conforms to the actual needs of the hibakusha, and increase the extent of the area acknowledged as being exposed to the atomic bomb while those who were there are still alive.download

We, the people of Nagasaki, offer our most heartfelt condolences to those who lost their lives to the atomic bomb. We hereby declare that together with the citizens of Hiroshima, we shall continue to use all our strength to achieve a world without nuclear weapons, and the realization of peace.

आर्थिक प्रलोभनमा सरोगेसी सेवा सञ्चालन गर्न दिने मन्त्रालयको तयारी

काठमाडौं – स्वास्थ्य तथा जनसंख्या मन्त्रालयका अधिकारीहरु कानुन बिना नै सरोगेसी (भाडाको कोख) सेवालाई सञ्चालन स्वीकृति दिन लागि परेका छन् । विश्वव्यापी रूपमा विवादित सरोगेसी सेवालाई नेपालमा बैधानिकता दिने वा नदिने भन्ने विषयमा बहश भइरहेका बेला मन्त्रालयका अधिकारी भने आर्थिक प्रलोभनमा परी स्वीकृति दिन लागि परेका हुन् ।

गत फागुनमा स्वास्थ्य मन्त्रालय कर्मचारी प्रशासन शाखाका तत्कालिन सहसचिव केदारबहादुर बोगटीले नियमविपरित जमलस्थित ग्राण्डी सिटी क्लिनिकलाई 'सरोगेट मदर'सञ्चालन स्वीकृति दिएका थिए । सो पत्र विवादित बनेपछि स्वास्थ्य मन्त्री खगराज अधिकारीले छानबिन कमिटी गठन गरी कारबाही गर्ने बताएका थिए । तर, अहिले मन्त्री अधिकारीकै निर्देशनमा 'गुपचुप'मा सरोगेसी सेवा बैधानिक बनाउन लागिपरेको देखिएको छ ।

सबैको ध्यान संविधानमा मोडिएकै समय पारेर मन्त्रालयले सरोगेसी सेवालाई स्वीकृति दिने आशयको सूचना सार्वजनिक गरेको छ । केही दिनअघि सार्वजनिक सूचनाको प्रकृति हेर्दा सरोगेसी सेवा नेपालमा पूर्ण बैधानिक भइसकेको छनक दिन्छ । मन्त्रालयका सूचना अधिकारी (को हुन् भनर नाम समेत उल्लेख छैन । यसले पनि नियतमा खोट देखाउँछ ।)को हस्ताक्षरमा जारी गरिएको सूचनामा मिति समेत उल्लेख छैन । सूचनामा नेपाल सरकारको गत २ असोजको निर्णय कार्यान्वयन गर्ने भनिएको छ । तर, मन्त्री परिषद्ले असोज २ गते सरोगेसी सम्बन्धी कार्यबिधि बनाउने निर्णय गरेको थियो ।
मन्त्रालयका चिकित्सा महाशाखा प्रमुख डा. गुणराज लोहनीले मन्त्रिपरिषद्ले कार्यविधि बनाउने निर्णय गरेकाले कार्यबिधि नबनाई कसैलाई पनि सञ्चालन स्विकृति दिन नमिल्ने बताएका छन्. । 'कानुन नबनाई सञ्चालन स्विकृति दिन मिल्दैन,'डा. लोहनीले भने ।
उपत्यकाका ग्राण्डि सिटी क्लिनिक, ग्राण्डी अन्तराष्ट्रिय अस्पताल, भेनस र ओम अस्पतालले गैरकानुनी रुपमा सरोगेसी सेवा दिदै आएका छन् ।
स्रोतका अनुसार २ करोड रुपैयाँको चलखेलमा सरोगेसी सेवालाई कानुन बिना नै सुचारु गर्न उक्त सूचना जारी गरिएको हो । यसअघि मन्त्रालयले नै गैरकानुनी ठहर्याएर कारबाही गर्ने भनिएका बोगटी जोगाउन नयाँ सूचना जारी गर्न मन्त्रीले दबाब दिएको स्रोतले बताएको छ ।
नियमअनुसार कर्मचारी प्रशासन शाखाबाट दिनै नमिल्ने पत्र बोगटीले काटेका थिए । जमलस्थित ग्राण्डी सिटी क्लिनिकलाई दिइएको सो पत्रमा चलानी नम्बर समेत केरमेट छ । सो पत्रको प्रतिलिपि मन्त्रालयमा दर्ता समेत छैन ।

मन्त्रालयका अधिकांश कर्मचारी तथा उच्च अधिकारीहरु नेपालमा सरोगेसी सेवा सञ्चालन गर्न नदिने पक्षमा छन् । 'कानुन ल्याएर पनि दिन नमिल्ले सेवालाई कानुन बिनै सञ्चालन स्विकृती दिन खोज्नुले आर्थिक प्रलोभनको गन्ध आँउछ'मन्त्रालयका एक उच्च अधिकारीले भने, 'भारत र थाइलेण्डबाट पाठ सिकेर नेपाल सरकारले यस्ता विषयमा गम्भिरता पूर्वक निर्णय लिनुपर्छ ।'

अन्तराष्ट्रिय रुपमा विवादीत विषयमा स्वास्थ्य मन्त्रलयले बहस र कानुन बिनै सञ्चालन स्विकृती दिन नहुने वरिष्ठ चिकित्सकहरु बताउछन् । 'सरोगेसीमा मानव अंग प्रत्यारोपण कानुन पनि लागू हुनुपर्छ, तेस्रो पक्षको पाठेघरलाई भाँडो मात्र सम्झनु हुदैन,'एक वरिष्ठ चिकित्सकले भने, 'गरिब महिलालाई पैसाका लागि कोख भाडा लगाउन बाध्य पारिनु हुदैन ।'

नेपालमा सरोगेसी सेवा लिन आउने सबै भन्दा बढी इजरायली गे वा एकल पुरुष रहेका छन् । इजरायलमा गे वा एकल पुरुषका लागि सरोगेसी सेवामा प्रतिबन्ध छ । आफ्नो मुलुकमा प्रतिबन्ध भएपछि उनीहरु सेवाका लागि दलालमार्फत नेपाल आउने गरेका हुन् । दलालले त्यस्ता व्यक्तिबाट करिब एक करोड रुपियाँसम्म सेवा शुल्क उठाउँदै आएका छन् । एजेण्टले नेपालका अस्पताललाई ४० लाखसम्म दिने गरेको बुझिएको छ ।

सरोगेसीका लागि आकर्षक गन्तब्य रहेका दुई मुलुक थाइल्यान्ड र भारतमा विकृति देखिएपछि व्यवसायिक सरोगेसी प्रतिबन्धित लगाएपनि नेपालमा भने सेवा सुचारुका लागि मन्त्रीहरु नै लबिङमा लागेका छन् । गतवर्षदेखि थाइ संसदले व्यवसायिक सरोगेसी सेवामा पूर्ण प्रतिबन्ध लगाएको हो । यसैगरी भारतको उच्च अदालतले पनि २०१५ फेब्रुअरी २५ मा केन्द्रीय सरकारलाई व्यवसायिक सरोगेसी सेवामा प्रतिबन्ध लगाउन आदेश दिएको छ ।

सरोगेट माफियाहरुले नेपालमा करिव अढाई वर्षदेखि आफू अनूकुल कानुनी वातावरण बनाउन राजनीतिक तथा प्रशासनिक क्षेत्रमा प्रभाव पार्ने कोशिष गर्दै आएका छन् । नयाँ स्वास्थ्य नीतिमा समेत बाँझोपनाका नाममा सरोगेसी भित्र्याउन उनीहरुले ठूलै चलखेल गरेको बुझिएको छ । उनीहरुकै दबाबमा गत कार्तिक २२ गते मन्त्रीपरिषद्ले सरोगेसीसम्बन्धी कार्यविधि बनाउने निर्णय गरेको स्रोतको दाबी छ । मन्त्रीपरिषद्को यही निर्णयलाई माफियाहरुले 'सरोगेसीले नेपालमा कानूनी मान्यता'पाएको गलत व्याख्या गर्दै सेवा सुचारु गराएका हुन् ।

Dalit crushed in the thrasher Machine Re: Time to rise against dalit attrocities.

Greeting !

 

You all remember that on 24th July we had disseminated a picture of a Dalit Mannu Tanti from Lakhi Sarai (Bihar) who had been murdered by crushing on thresher (Fodder cutting machine) on April 26, 2015.

 

After we got lot more responses and different set of people, movements, organizations etc had taken up this issue to ensure justice to the victim.

 

I wanted to add that just on 7th Aug2014  National Human Rights Commission-NHRC has registered a case and made me complainant.

 

On 7th Aug2015 we had received a mail from NHRC stated that"NHRC has received your complaint regarding MUNNU TANTI. The Regn. No. is : 2410/4/19/2015. You may use this registration number for future reference.

 

Now we appeal to all the friends to use this information and reference no wherever it is useful/ needful.

 

We do wanted to inform you that most of the commissions are regularly monitoring our news updates and registering cases basis on our information.

यह घटना बिहार राज्य के जिला लक्खीसराय गांव खररा की है। स्व. मन्नू तांती के साथ यह घटी है. केवल अपने पिछले चार दिनों की मजदूरी मांगने के कारण मन्नू तांती को गेहूं निकालने वाली थ्रेसर में जिन्दा पीस दिया गया. इस जघन्य हत्या का अंजाम उसके गांव के दबंग लोगों दिया.

In parts of Khammam district in Telengana, massive plantations are being carried out on podu (shifting cultivation) fields under the Haritha Haraam Afforestation scheme of the state government without recognizing the rights of the cultivators under the Forest rights Act (FRA).                             इंसाफ माँगा था, इस्लाम मिला !

लगभग 4 माह तक उनका सामाजिक बहिष्कार किया गया ,आर्थिक नाकेबंदी हुयी ,तरह तरह की मानसिक प्रताड़नाएँ दी गयी | गाँव में सार्वजनिक नल से पानी भरना मना था ,शौच के लिए शामलात जमीन का उपयोग नहीं किया जा सकता था ,एक मात्र गैर दलित डॉक्टर ने उनका इलाज करना बंद कर दिया ,जानवरों का गोबर डालना अथवा मरे जानवरों को दफ़नाने के लिए गाँव की भूमि का उपयोग तक वे नहीं कर सकते थे | उनका दूल्हा या दुल्हन घोड़े पर बैठ जाये ,यह तो संभव ही नहीं था| जब साँस लेना भी दूभर होने लगा तो अंततः भगाना गाँव के 70 दलित परिवारों ने 21 मई 2012 को अपने जानवरों समेत गाँव छोड़ देना ही उचित समझा| वे न्याय की प्रत्याशा में जिला मुख्यालय हिसार स्थित मिनी सचिवालय के पास आ जमें ,जहाँ पर उन्होंने विरोध स्वरुप धरना प्रदर्शन शुरू कर दिया| भगाना के दलितों ने ग्राम पंचायत के सरपंच से लेकर देश के महामहिम राष्ट्रपति महोदय तक हर जगह न्याय की गुहार लगायी ,वे तहसीलदार के पास गए ,उपखंड अधिकारी को अपनी पीड़ा से अवगत कराया ,जिले के पुलिस अधीक्षक तथा जिला कलेक्टर को अर्जियां दी| तत्कालीन और वर्तमान मुख्यमंत्री से कई कई बार मिले| विभिन्न आयोगों ,संस्थाओं एवं संगठनों के दरवाजों को खटखटाते रहे ,दिल्ली में हर पार्टी के अलाकमानों के दरवाजों पर दस्तक दी मगर कहीं से इंसाफ की कोई उम्मीद नहीं जगी| उन्होंने अपने संघर्ष को व्यापक बनाने के लिए हिसार से उठकर दिल्ली जंतर मंतर पर अपना डेरा जमाया तथा 16 अप्रैल 2014 से अब तक दिल्ली में बैठ कर पुरे देश को अपनी व्यथा कथा कहते रहे ,मगर समाज और राज के इस नक्कारखाने में भगाना के इन दलितों  की आवाज़ को कभी नहीं सुना गया| हर स्तर पर ,हर दिन वे लड़ते रहे ,पहले उन्होंने घर छोड़ा ,फिर गाँव छोड़ा ,जिला और प्रदेश छोड़ा और अंततः थक हार कर धर्म को भी छोड़ गए ,तब कहीं जाकर थोड़ी बहुत हलचल हुयी है लेकिन अब भी उनकी समस्या के समाधान की बात नहीं हो रही है| अब विमर्श के विषय बदल रहे है ,कोई यह नहीं जानना चाहता है कि आखिर भगाना के दलितों को इतना बड़ा कदम उठाने के लिए किन परिस्तिथियों  ने मजबूर किया ?

भगाना हरियाणा के हिसार जिला मुख्यालय से मात्र 17 किमी दूर का एक पारम्परिक गाँव है| जिसमे 59 % जाट ,8 % सामान्य सवर्ण {ब्राह्मण ,बनिया ,पंजाबी } 9 % अन्य पिछड़ी जातियां { चिम्बी ,तेली ,कुम्हार ,लौहार व गोस्वामी }तथा 24 % दलित { चमार ,खटिक ,डोमा ,वाल्मीकि एवं बैगा } निवास करते है| वर्ष 2000 में यहाँ पर अम्बेडकर वेलफेयर समिति बनी ,दलित संगठित होने लगे| उन्हें गाँव में अपने साथ होने वाले अन्याय साफ नज़र आने लगे ,वे अपने नागरिक अधिकारों को प्राप्त करने के प्रयास में एकजुट होने लगे ,जिससे यथास्थितिवादी ताकतें असहज होने लगी| दलितों ने अपने लिए आवासीय भूमि के पट्टे मांगे तथा गाँव की शामलाती जमीन पर अपनी भागीदारी सुनिश्चित करने की मांग उठाई| संघर्ष की वास्तविक शुरुआत वर्ष 2012 में तब हुयी जबकि दलितों ने गाँव में स्थित चमार चौक का नाम अम्बेडकर चौक करने तथा वहां पर अम्बेडकर की प्रतिमा लगाने की मांग शुरू की| दरअसल यह चौक दलित परिवारों की आबादी के पास स्थित है ,जहाँ पर कई दलितों के घरों के दरवाजे खुलते है ,मगर गाँव के दबंगों को यह गवारा ना था कि इस चौक पर दलितों का कब्ज़ा हो| इतना ही नहीं बल्कि गाँव में दलितों को आवासीय भूखंड देने के लिए बनायीं गयी महात्मा गाँधी बस्ती विकास योजना के तहत प्लॉट्स का पंजीकरण और आवंटन भी उन्हें स्वीकार नहीं था| गाँव की शामलाती जमीन पर दलितों की आवाजाही भी उन्हें बर्दाश्त नहीं थी.कुल मिलाकर भगाना स्वाभिमानी दलितों के लिए नरक बन चुका था ,ऐसे में दलितों के लिए गाँव छोड़कर चले जाने तथा इंसाफ के लिए आवाज़ उठाने के अलावा  कोई चारा ही नहीं था| इस तरह यह लडाई चलती रही| विगत तीन वर्षों से यह जंग बहुत सघन और मज़बूत हो गयी ,पहले हिसार के मिनी सचिवालय के बाहर और अंततः जंतर मंतर पर यह संघर्ष जारी रहा| 2014 से जंतर मंतर को ठिकाना बना कर लड़ रहे इन दलितों को कोई न्याय नहीं मिल पाया ,ऊपर से चार दलित नाबालिग लड़कियों का भगाना गाँव में अपहरण और सामूहिक दुष्कर्म का मामला और हो गया ,जिसमे भी पुलिस की भूमिका संतोषजनक नहीं रह पाई ,इससे भी आक्रोश बढ़ता गया| हरियाणा की पिछली सरकार ने संघर्षरत दलितों से न्याय के कई वादे किये मगर वे सत्ता से बाहर हो गए ,भाजपा की सरकार के मुख्यमंत्री खट्टर से भी भगाना के पीड़ित चार बार मिलकर आये ,मगर कोई कार्यवाही नहीं हुयी ,लम्बे संघर्ष के कारण दलित संगठनों के रहनुमाओं ने भी कन्नी काट ली ,जब कोई भी साथी नहीं रहा ,तब भगाना के दलितों को कोई ना कोई तो कदम उठाना ही था ,इसलिए उन्होंने संसद के सत्र के दौरान एक रैली का आह्वान करता हुआ पर्चा सबको भेजा ,यह रैली 8 अगस्त 2015 को आयोजित की गयी थी ,इसी दौरान करीब 100 परिवारों ने जंतर मंतर पर ही कलमा और नमाज पढ़कर इस्लाम कुबूल करने का ऐलान कर दिया ,जिससे देश भर में हडकंप मचा हुआ है| भगाना में इसकी प्रतिक्रिया में गाँव में सर्वजाति महापंचायत हुयी है जिसमे हिन्दू महासभा ,विश्व हिन्दू परिषद् तथा बजरंग दल के नेता भी शामिल हुए ,उन्होंने खुलेआम यह फैसला किया है कि –"धर्म परिवर्तन करने वाले लोग फिर से हिन्दू बनकर आयें ,वरना उन्हें गाँव में नहीं घुसने देंगे| "विहिप के अन्तर्राष्ट्रीय महामंत्री डॉ सुरेन्द्र जैन का कहना है कि – "यह धर्मांतरण पूरी तरह से ब्लेकमेलिंग है ,इसे किसी भी सूरत में बर्दाश्त नहीं किया जायेगा| " हिन्दू महासभा के धर्मपाल सिवाच का संकल्प है कि –"भगाना के दलितों की हर हाल में हिन्दू धर्म में वापसी कराएँगे|"जो दलित मजहब बदल कर गाँव लौटे है उन्हें हिंदूवादी नेताओं ने समझाने के नाम पर धमकाने की कोशिश भी की है वहीँ दूसरी और देश और प्रदेश की हिंदूवादी सरकारों ने सत्ता का कहर भी ढाना  प्रारम्भ कर दिया है | धर्मांतरण के तुरंत बाद ही शुक्रवार की रात को हिसार के मिनी सचिवालय के बाहर विगत तीन वर्षों से धरना दे रहे दलितों को हरियाणा पुलिस ने जबरन हटा दिया और टेंट फाड़ दिए है| दिल्ली जंतर मंतर पर भी 10 अगस्त की रात को पुलिस ने धरनार्थियों पर धावा बोल दिया ,विरोध करने पर लाठी चार्ज किया गया ,जिससे 11 लोग घायल हो गए है.यहाँ से भी इन लोगों को खदेड़ने का पूरा प्रयास किया गया है| अब स्थिति यह है इस्लाम अपना चुके लोगों का गाँव में बहिष्कार किया जा चुका है,हालाँकि यह भी सच है कि इनका पहले से ही ग्रामीणों ने सामाजिक बहिष्कार किया हुआ था| हिसार से उन्हें भगाया जा चुका है और जंतर मंतर से भी वो खदेड़े गए है ,ऐसे में यह सवाल उठना लाज़िमी है कि भगाना के इतने लम्बे आन्दोलन का आखिर भविष्य क्या होगा ? क्या यह आगे भी चल पायेगा या यही ख़त्म हो जायेगा ? यह सवाल मैंने आन्दोलन से बहुत नज़दीक से जुड़े हुए तथा धर्मान्तरण कार्यक्रम के मुख्य योजनाकार अब्दुल रज्जाक अम्बेडकर से पूंछा ,उनका कहना है कि – "जालिमों के खिलाफ यह लड़ाई जारी रहेगी| जंतर मंतर पर धरना जारी है और आईंदा भी जारी रहेगा ,जहाँ तक गाँव की सर्वखाप पंचायत के फैसले की तो हम उससे नहीं डरते ,हम लोग जल्दी ही भगाना जायेंगे ,यह हमारा लोकतान्त्रिक अधिकार है " | रज्जाक अम्बेडकर का कहना है कि –'हमें मालूम था कि इस धर्मांतरण के बाद हमारी मुश्किलात बढ़ेगी ,क्योंकि साम्प्रदायिक संगठन इसे हिन्दू मुस्लिम का मुद्दा बना रहे है ,पर जिन दलितों ने इस्लाम कुबूल कर लिया है ,वो इस्लाम में रह कर ही इंसाफ की लडाई लड़ेंगे|' 9 अगस्त की  रात में हुए हमले में पुलिस के निर्दयी लाठीवार में रज्जाक को भी गंभीर चौटें पंहुची है ,मगर उनका हौंसला बरक़रार है ,वे बताते है कि –'धर्मान्तरित दलित जानते है कि अब उनका अनुसूचित जाति का स्टेट्स नहीं बचेगा ,मगर उन्हें यह भी उम्मीद है मुस्लिम बिरादरी उनके सहयोग में आगे आएगी|'

जिन दलितों ने धर्म बदला है ,उनका मनोबल चारों तरफ से हो रहे प्रहारों के बावजूद भी कमजोर नहीं लगता है| नव धर्मान्तरित सतीश काजला जो कि अब अब्दुल कलाम अम्बेडकर है ,कहते है कि-'हम हर हाल में अब मुसलमान ही रहेंगे , जो कदम हमने उठाया ,वह अगर हमारे पूर्वज उठा लेते तो आज ये दिन हमको नहीं देखने पड़ते|'इसी तरह पिछड़े वर्ग से ताल्लुक रखने वाले भगाना निवासी धर्मान्तरित वीरेन्द्र सिंह बागोरिया का कहना है कि –'हम पूरी तरह से इस्लाम अपना चुके है और अब किसी भी भय ,दबाव या प्रलोभन में वापस हिन्दू नहीं बनेंगे|'अन्य दलित व अति पिछड़े जिन्होंने इस्लाम कबूला है ,वो भी अपने फैसले पर फ़िलहाल तो मजबूती से टिके हुए है .भाजपा ,संघ ,विहिप ,बजरंग दल तथा हिन्दू महासभा अपना पूरा जोर लगा रही है कि धर्मान्तरित लोग अपने मूल धर्म में लौट आये ,मगर भगाना के पीड़ित दलितों ने अपना सन्देश स्पष्ट कर दिया है कि अगर हिन्दुओं को दलितों की परवाह नहीं है तो दलितों को भी हिन्दुओं की रत्ती भर भी परवाह नहीं है| एक ऐसे वक़्त में जबकि एक दक्षिणपंथी हिन्दू शासक दिल्ली की सल्लतनत पर काबिज़ है ,ऐसे में उसकी नाक के नीचे खुलेआम ,चेतावनी देकर ,पर्चे बाँट कर ,ऐलानिया तौर पर पीड़ित दलित इस्लाम कुबूल कर रहे है तो यह वर्ष 2020 में बनने वाले कथित हिन्दू राष्ट्र के मार्ग में गति अवरोधक बन सकता है| भगाना के दलितों ने लम्बे समय तक सोच कर यह निर्णय लिया है ,एक माह पहले जब मैं उनके धरने में गया तब मुझे इसका अहसास होने लगा था कि उनका रुख मजहब बदलने की तरफ है और वे शायद इस्लाम का दामन थामेंगे|   

  एक लोकतान्त्रिक देश में कोई भी नागरिक किसी भी धर्म को स्वीकारे या अस्वीकार करे ,यह उनकी व्यक्तिगत इच्छा है और कानूनन इसमें कुछ भी गलत नहीं है ,इसलिए भगाना के दलितों द्वारा किये गए इस्लाम को कुबूलने के निर्णय से मुझे कोई आपति नहीं है ,मैं उनके निर्णय का आदर करता हूँ ,हालाँकि मेरी व्यक्तिगत मान्यता यह है कि धर्मान्तरण किसी भी समस्या का हल नहीं हो सकता है क्योंकि यह खुद ही एक समस्या है| संगठित धर्म के आडम्बर और पाखंड तथा उसकी घटिया राजनीती सदैव ही  धर्म का सक्षम तबका तय करता है ,भारत के जितने भी धर्म है ,उन सबमें जातियां पाई जाती है तथा कम ज्यादा जातिगत भेदभाव भी मौजूद रहता है ,इस्लाम भी इससे अछुता नहीं है.जैसा कि दलित चिन्तक एस आर दारापुरी का कहना  है कि-"धर्मपरिवर्तन दलित उत्पीडन का हल नहीं है ,दलितों को संघर्ष का रास्ता अपनाना चाहिए ,हाँ अगर धर्म बदलना ही है तो बौद्ध धर्म अपनाना चाहिए जिसके सिद्धांत और व्यव्हार में अंतर नहीं है जबकि भारतीय इस्लाम ,इसाई और सिख धर्म में यह अंतर पाया जाता है | "वाकई यह एक विचारणीय प्रश्न है कि क्या हिन्दू धर्म का त्याग करके किसी और धर्म को अपना लेने मात्र से कोई व्यक्ति जातिगत घृणा से मुक्त हो जाता है या धार्मिक नफरत का भी शिकार होने लगता है| जैसा कि भगाना के धर्मान्तरित दलितों के साथ होने लगा है कि धर्म बदलते ही उनके प्रति राज्य और समुदाय दोनों का व्यवहार अत्यंत क्रूर हो गया है| फिर यह भी देखना होगा कि क्या आज मुसलमान खुद भी स्वयं को सुरक्षित महसूस करते है ,जिस तरीके से बहुसंख्यक भीड़ के हमले उन पर बढ़ रहे है ,गुजरात ,मुज्जफरनगर ,अटाली जैसे हमले इसके उदहारण है ,ऐसे में भले ही दलित उनका दामन थाम रहे है ,मगर उनका दमन थमेगा ,इसकी सम्भावना बहुत क्षीण नजर आती है .

अंतिम बात यह है कि अब भगाना  के दलितों की आस्था बाबा साहेब के संविधान के प्रति उतनी प्रगाढ़ रह पायेगी या वो अपनी समस्याओं के हल कुरान और शरिया तथा अपने बिरदाराने मुसलमान में ढूंढेगे ? क्या लडाई के मुद्दे और तरीके बदल जायेंगे ,क्या अब भी भगाना के दलित मुस्लिम अपने गाँव के चमार चौक पर अम्बेडकर की प्रतिमा लगाने हेतु संघर्ष करेंगे या यह उनके लिए बुतपरस्ती की बात हो जाएगी ,सवाल यह भी है कि क्या भारतीय मुसलमान भगाना के नव मुस्लिमों को अपने मज़हब में बराबरी का दर्जा देंगे या उनको वहां भी पसमांदा के साथ बैठ कर मसावात की जंग को जारी रखना होगा ? अगर ऐसा हुआ तो फिर यह  खाई से निकलकर कुएं में गिरने वाली बात ही होगी| भगाना के दलितों को इंसाफ मिले यह मेरी भी सदैव चाहत रही है ,मगर उन्हें इंसाफ के बजाय इस्लाम मिला है ,जो कि उनका अपना चुनाव है ,हम उनके धर्म बदलने के संवैधानिक अधिकार के पक्ष में खड़े है ,कोई भी ताकत उनके साथ जोर जबरदस्ती नहीं कर पायें और जो भी उनका चयन है ,वे अपनी चयनित आस्था का अनुपालन करे,यह सुनिश्चित करना अब भारतीय राष्ट्र राज्य की जिम्मेदारी है ,मगर अब भी मुझे दलित समस्याओं का हल धर्म बदलने में नहीं दिखाई पड़ता है| आज दलितों को एक धर्म छोड़कर दुसरे धर्म में जाने की जरुरत नहीं है ,उन्हें किसी भी धर्म को स्वीकारने के बजाय सारे धर्मों को नकारना होगा ,तभी मुक्ति संभव है ,संभवतः सब धर्मों को दलितों की जरुरत है ,मगर मेरा मानना है कि दलितों को किसी भी धर्म की जरुरत नहीं है .धर्म रहित एक लोकतंत्र जरुर चाहिए ,जहाँ पर  समता ,स्वतंत्रता और भाईचारा से परिपूर्ण जीवन जीने का हक सुनिश्चित हो|
