The humble petition of the petitioner above-named

 

MOST RESPECTFULLY SHOWETH

1.                 That the present writ petition is directed against the impugned dereliction by Rajiv Gandhi Cancer Institute and Research Centre, the  respondent-Hospital herein, of its legal obligation to provide free treatment to the petitioner on account of land-allotment on institutional (concessional) rates by the respondent-DDA, as expressly spelt out in the mortgage-permission letter dated 29.06.1993 issued by the respondent-DDA and on account of the petitioner's EWS status, resulting in violation of the Fundamental and Human Right to life and medical aid of the petitioner, 45-year-old Rukhsana, a patient of NHL-Diffuse Large B Cell Lymphoma Stage IV, as guaranteed to her under Article 21 of the Constitution of India read with Articles 38, 39, 41 & 47 of the Constitution. It is further directed against the impugned inaction on the part of the respondents to act upon the representations dated 08.06.2015 and 10.06.2015 requesting for free treatment to the petitioner as well as the impugned inaction on the part of the respondent-DDA to proceed against the respondent-hospital despite the latter's continuing dereliction of its obligation to provide free treatment to EWS patients to the extent of 25% OPD and 10% IPD on account of land-allotment on institutional (concessional) rates by the respondent-DDA and in terms of this Hon'ble Court's DB Judgment & Order dated 22.03.2007 in W.P. (C) No.2866/2002 titled Social Jurist vs. GNCTD & ors. 140 (2007) DLT 698.

BRIEF FACTS

2.                 Brief facts of the case, so far as may be relevant for the purpose of the present writ petition, are given as under.

3.                 That the petitioner's husband works as a Cleaner in a shop and earns Rs.8, 000 a month. He is the sole earning member in the family. The petitioner holds a National Food Security Card in her name as a proof of her EWS status. It is submitted that the family-income limit for availing the EWS benefit at any identified private hospital has been linked to the minimum wages of an unskilled worker in the NCT of Delhi, which is presently Rs. 9,048 per month.

A true copy of the National Food Security Card of the petitioner demonstrating her EWS status is annexed hereto and marked as Annexure P-1.

4.                 That the petitioner had been experiencing symptoms of neck-swelling, weight loss, back-ache and difficulty to walk. She was taken to Dr. B.D. Attam Hospital, Ashok Vihar, New Delhi in January, 2015. She was kept on medication for some time and thereafter advised advanced examination of spine to determine the cause of swelling in neck. Accordingly, she underwent PET-CT on 24.04.2015, the findings whereof revealed a large mass in the cervical region.  Thereafter, she was taken to the respondent-Rajiv Gandhi Cancer Institute and Research Centre on 29.04.2015 where she was registered under CR No. 185368. Upon further examination, she was diagnosed as a case of high grade NHL-Diffuse Large B Cell Lymphoma Stage IV, a form of Cancer and advised to undergo Chemotherapy.

True copy of the medical record of the petitioner is annexed hereto and marked as Annexure P-2 colly.

5.                 That the petitioner underwent the first cycle of Chemotherapy between 02.05.2015 and 03.05.2015 and the second cycle between 25.05.2015 and 26.05.2015, remaining admitted in the respondent-hospital for the said periods. She was required to be re-admitted for third cycle of Chemotherapy on 15.06.2015 but the respondent-Hospital refused to entertain her as she did not have money to pay to the respondent-Hospital.

6.                 That the petitioner's husband has somehow managed to bear the cost of treatment so far, nearly Rs.1,50,000 by borrowing money from various sources. However, he is not in a position to afford further treatment in view of his poor financial condition.

7.                 That the petitioner is medically unattended at present and has no recourse to treatment. She is in a critical state and her condition is worsening with each passing day. The treatment given so far would be rendered futile and her life would be endangered unless the treatment is immediately resumed.

8.                 That the petitioner's husband has made a representation dated 08.06.2015 to the Medical Superintendant of the respondent-Hospital seeking free treatment for the petitioner. The petitioner's husband approached Sh. Ashok Agarwal, EWS monitoring Committee Member with a written representation dated 09.06.2015, who also wrote a letter dated 10.06.2015 to the Principal Secretary, Health, GNCTD to intervene in the matter, with copies thereof to the Medical Superintendent of the respondent-Hospital and the Vice-Chairman of the respondent-DDA. However, no response has been received to the said representations so far.

True copies of the said representation dated 08.06.2015 addressed to the Medical Superintendent, the representation dated 09.06.2015 addressed to Sh. Ashok Agarwal and the letter dated 10.06.2015 addressed to the Principal Secretary (Health) are annexed hereto and marked as Annexure P-3 colly.

9.                 It is submitted that the respondent-Hospital is obliged in law to provide free treatment to EWS patients to the extent of 10% IPD and 25% OPD in terms of the condition of providing free treatment as spelt out in the mortgage-permission letter dated 29.06.1993 issued by the respondent-DDA and vide the Division Bench judgment dated 22.03.2007 of this Hon'ble Court in Social Jurist vs. Government of NCT of Delhi & ors.140 (2007) DLT  698, upheld by the Hon'ble Apex Court vide its judgment dated 01.09.2011 in SLP No. 18599/2007 titledDharamshila Hospital & Research Centre vs. Social Jurist & ors.

The relevant para from the said Division Bench judgment is reproduced as under:

"91. A. All the 20 hospitals stated in this judgment and/or all other hospitals identically situated shall strictly comply with the term of free patient treatment to indigent/poor persons of Delhi as specified above i.e. 25% OPD and 10% IPD patients completely free of charges in all respects."

10.            It is submitted that the case of the respondent-hospital is identical to that of the other hospitals who were parties to the said legal proceedings. The respondent-Indraprastha Cancer Society ("the respondent-Society") was allotted three plots of land admeasuring 2 acres, 2331 sq. mts. & 1.5 acres at institutional/concessional rates of 19 lacs per acre with ground-rent @ 2.5% p.a. of the total premium, 19 lacs per acre with ground-rent @ 5% p.a. and 45 lacs per acre with ground-rent @5% p.a. respectively vide allotment-letters dated 12.03.1990, 15.11.1990 and 15.04.1994 respectively. Although no express condition of free treatment was imposed at the time of allotment, the respondent-DDA vide Clause 7 of the allotment-letter dated 12.03.1990 reserved its right to alter any terms and conditions in its discretion. The said clause is reproduced as under:

"7.    The DDA reserves its right to alter any terms and conditions on its discretion."

11.            That similarly, the respondent-DDA vide Clause (ix) of the allotment-letter dated 15.11.1990 reserved its right to impose additional conditions which were to be binding upon the allottee/respondent-Society. The relevant clauses (ix), (x) & (xi) of the said allotment-letter are reproduced as under:

"(ix)  That all other conditions as contained in the perpetual lease-deed to be executed in this behalf and any other terms/conditions imposed from time to time by the central Govt./Lt. Governor shall be binding upon the allottee. The format of the Lease Deed can be purchased from the office of D.D.A.

(x)      If the allottee violates any terms and conditions as mentioned above in the perpetual lease deed, the allotment shall be cancelled and possession of the land/plot with superstructure standing thereon if any, will be taken over by the Lessor (President of India)/DDA without any compensation to the Allottee.

(xi)     If the allotment is cancelled for breaches of any terms/conditions of the allotment, the possession of plot/land with building, if any will be handed over to the DDA by the Allottee on the date given in the cancellation notice."(Emphasis supplied)

12.     It is submitted that the respondent-DDA vide its letter dated 29.06.1993 granting permission to the respondent-Society to mortgage the two plots admeasuring 2 acres and 2331 sq. mts. in favour of HDFC Bank, expressly spelt out the condition of free treatment vide clauses 4 & 5 of the said letter.

The said clauses are reproduced as under:

"4.     A certain percentage of beds is reserved for the poor patients who are treated and given services free of cost and in the OPDs of which a minimum of 40% poor patients are attended to and given medical advice free of cost.

5.       The hospital shall provide a minimum 25% of the beds free of charge. In the case of a dispensary the facility to the community hall (sic) shall be totally free."

True copies of the relevant record pertaining to land-allotment to the respondent-hospital along with the mortgage-permission letter is annexed hereto and marked as Annexure P-4 colly.

13.     It is submitted that the above stipulation of providing free treatment as contained in the mortgage-permission letter dated 29.06.1993, when read in conjunction with the above-said directions of the Hon'ble High Court in its Judgment and Order dated 22.03.2007 makes it amply clear that the respondent-Hospital is under a permanent and binding obligation, enforceable in law, to provide free treatment to the extent of at least 10% IPD and 25% OPD patients belonging to EWS category.

14.     It is submitted that an Application being C.M no.15454/2008 in W.P. (C) 2866/2002 was filed by the petitioner therein Social Jurist seeking initiation of contempt proceedings against inter alia the respondent-Hospital for contempt of the Order dated 22.03.2007 of this Hon'ble Court (supra), however, the same was dismissed with the following observations:

"4.    The learned counsel representing these three hospitals have contended that since neither they were impleaded as a party to the writ petition nor were they given any opportunity of hearing before the orders dated 22.3.2007 and 17.7.2007 came to be passed, such orders cannot, in law, be applied to them. This is also their submission that since neither the letter of allotment issued to them nor the lease deed originally executed in their favour contained any stipulation to provide free treatment to any patient, they are not under any legal obligation to provide free beds and/or free treatment to any patient coming to their hospital. They have also drawn our attention to the order dated 10.8.2007 whereby this Court observed that further arguments were required to be addressed in respect of hospitals which did not have a stipulation in their lease deed or the allotment letter regarding free treatment. They have also pointed out that Moolchand Khairati Lal Trust Hospital and St. Stephan Hospital have already filed writ petitions challenging the action of the respondents. According to the learned counsel representing Rajiv Gandhi Cancer Institute and Research Centre, similar writ petition is proposed to be filed by the said hospital. The learned counsel for the respondents on the other hand submits that since the land to these hospitals was allotted at concessional rates and later a clause requiring them to provide free beds and free treatment to the poor patients has also since been inserted in the lease deed, they are under a legal obligation to comply with the orders passed by this Court on 22.3.2007 and 17.7.2007.

5.       In our view, considering the fact that these three hospitals were not impleaded as a party to the W.P.(C) 2866/2002 either initially or during pendency of the writ petition, no notice or opportunity of hearing was given to them before the said orders came to be passed, and this Court vide order dated 10.8.2007 acknowledged that further arguments were required to be addressed in respect of hospitals which do not have a stipulation in their lease deeds or the allotment letters regarding free treatment to the patients, no case for initiating proceedings for disobedience of the orders dated 22.3.2007 and 17.7.2007 by the aforesaid three hospitals is made out. This is not a case of a contumacious or willful disobedience of the orders of the Court. Initiation of contempt proceedings would not be justified where a person accused of disobedience has a bonafide case with respect to the applicability of the order alleged to have been disobeyed by him and it would be difficult to justify initiation of contempt proceedings against him. We, therefore, find no merits in CM 15454/2008, filed by the petitioner. The same is hereby dismissed."(Emphasis supplied)

True copies of the Orders dated 15.11.2002, 15.07.2004, the Judgment & Order dated 22.03.2007 and the Order dated 13.03.2013in W.P. (C) No.2866 of 2002 titled Social Jurist v. Government of NCT of Delhi & ors. And the Judgment of the Hon'ble Supreme Court dated 01.09.2011 in SLP No. 18599/2007 titled Dharamshila Hospital & Research Centre vs. Social Jurist & ors. are annexed hereto and marked asAnnexure P-5 colly.

15.     It is submitted that the respondent-Hospital/Society has not filed any petition on the above-said issue in this Hon'ble Court so far.

16.     It is submitted that the respondent-DDA in the above-said Writ Petition No. 2866/2002 titled Social Jurist vs. GNCTD & ors. had also endorsed the stand of the petitioner that the respondent-Hospital is obliged in law to provide free treatment to EWS patients in view of land-allotment at concessional rates and in terms of the mortgage-permission letter dated 29.06.1993. The stand of the DDA is summarized in its reply to an Application by the respondent-Hospital in the said writ petition.

          True copies of the said reply of the DDA and its rejoinder as filed by the respondent-Hospital are annexed hereto and marked as Annexure P-6 colly.

17.     It is submitted that the respondent-Hospital is blatantly sitting over and enjoying public land as a bounty without fulfilling its reciprocal/concomitant obligations much to the disadvantage of pubic exchequer and public good and in gross violation of the terms of allotment and the law of the land. It is pertinent to draw attention of this Court to the observations of the Hon'ble Supreme Court of India in Union of India v. Jain Sabha (1997) 1 SCC 164: 

          "11.   Before parting with this case, we think it appropriate to observe that it is high time the Government reviews the entire policy relating to allotment of land to schools and other charitable institutions. Where the public property is being given to such institutions practically free, stringent conditions have to be attached with respect to the user of the land and the manner in which schools or other institutions established thereon shall function. The conditions imposed should be consistent with public interest and should always stipulate that in case of violation of any of those conditions, the land shall be resumed by the Government. Not only such conditions should be stipulated but constant monitoring should be done to ensure that those conditions are being observed in practice."

18.     It is submitted that even dehors the obligation of the respondent-Hospital to provide free treatment to the petitioner as an EWS patient, the respondent-Government of NCT of Delhi is under a Constitutional obligation to provide free life-saving treatment to the petitioner in view of her inability to afford the cost of the same. The Hon'ble Supreme Court in Paschim Bangal Khet Mazdoor Samity & ors. vs. State of W.B. & anr. (1996) 4 SCC 37 has held that it is the Constitutional obligation of the State to provide adequate medical services to the people. Reiterating the same position, this Hon'ble Court in W.P. (C) No.7279 of 2013 titled Master Mohd. Ahmed (Minor) vs. AIIMS & ors. 208 (2014) DLT 199 has held vide its Judgment & Order dated 17.04.2014 that the State is under a duty in law to provide medical aid on fair, reasonable, equitable and affordable basis and that the State cannot allow a patient to die for want of money for treatment.      

 GROUNDS:

19.     The petitioner seeks to challenge the impugned inactions on the part of the respondents on the following grounds, inter alia:

A.               Because the impugned denial of free treatment to the petitioner by the respondent-Hospital is violative of the Fundamental and Human Right to life and medical aid of the petitioner, as guaranteed to her under Article 21 of the Constitution of India read with 38, 39, 41 & 47.

B.               Because the respondent-Hospital is bound in law to provide free treatment to the extent of 25% OPD and 10% IPD to patients belonging to the EWS category on account of land-allotment on institutional (concessional) rates by the respondent-DDA, as expressly spelt out in the mortgage-permission letter dated 29.06.1993 issued by the respondent-Delhi Development Authority (DDA) and in terms of this Hon'ble Court's DB Judgment & Order dared 22.03.2007 in W.P. (C) No.2866/2002 titled Social Jurist vs. GNCTD & ors. 140 (2007) DLT  698.

C.               Because the petitioner having a family-income of Rs.8,000 is entitled to free treatment under the EWS category at the respondent-Hospital.

D.               Because the respondent-DDA has failed to proceed against the respondent-hospital despite the latter's continuing dereliction of its obligation to provide free treatment to EWS patients to the extent of 25% OPD and 10% IPD on account of land-allotment on institutional (concessional) rates by the respondent-DDA.

E.                Because the petitioner presently has no access to treatment. She is in a critical state and her condition is worsening with each passing day. The treatment given so far would be rendered futile and her life would be endangered unless the treatment is immediately resumed.

F.                Because the respondent-Government of NCT of Delhi is even otherwise obliged in law to provide free life-saving treatment to the petitioner in view of her inability to afford the cost of the same. The Hon'ble Supreme Court in Paschim Bangal Khet Mazdoor Samity & ors. vs. State of W.B. & anr. (1996) 4 SCC 37 has held that it is the Constitutional obligation of the State to provide adequate medical services to the people. Reiterating the same position, this Hon'ble Court in W.P. (C) No.7279 of 2013 titled Master Mohd. Ahmed (Minor) vs. AIIMS & ors. 208 (2014) DLT 199 has held vide its Judgment & Order dated 17.04.2014 that the State is under a duty in law to provide medical aid on fair, reasonable, equitable and affordable basis and that the State cannot allow a patient to die for want of money for treatment.

G.                  Because the Hon'ble Supreme Court in Jain Sabha case has held that where public property is allotted to institutions at concessional rates, stringent conditions should be imposed upon the manner of its use and the adherence to those conditions should be closely monitored.

18.            That the petitioner has no other efficacious remedy except to approach this Hon'ble Court by way of the present writ petition.

19.     That the petitioner has not filed any other similar petition in this Hon'ble Court or in any other High Court in India or the Hon'ble Supreme Court of India.

PRAYER

In the premise aforesaid, it is most humbly prayed that this Hon'ble Court may be pleased to:

          i.            Direct the respondent-Rajiv Gandhi Cancer Institute and Research Centre to forthwith provide complete medical treatment to the petitioner free of cost in all respects; 

       ii.            Direct the respondent-DDA to proceed against the respondent-hospital for its continued dereliction of its obligation to provide free treatment to EWS patients; and

     iii.            Issue any such other orders or directions as this Hon'ble Court may deem fit in the interests of justice; and

     iv.            Allow the present writ petition with costs in favour of the petitioner.

Dismissing justice, crimes against humanity, sentiments of Indian Muslims and the Muslims worldwide, the government of Indian Prime Minister Narendra Modi, the architect of the massacre of Muslims in Godhra, has abstained in the United Nations resolution holding Israel accountable for its latest war crimes in Gaza in 2014. 

India joined four other countries such as Kenya, Ethiopia, Paraguay and Macedonia to abstain while 41 countries vote in favor of the resolution. The United States where governments are made and unmade by powerful pro Zionist Jewish lobbies and the  successive US presidents shamefully implement  evil Zionist  agenda in the Middle East and worldwide, stand isolated by the whole world as it was the only country to vote against the resolution.

All European Union member states of the Council voted in favor of the resolution. These include Britain and France which planted the alien and barbaric entity of Israel   in the lands of Palestinians in the heart of Middle East.

The fact that India abstained reflects a significant policy change as traditionally, India voted in favor of all resolutions condemning Israeli crimes against humanity in UN institutions. Friday's abstention is another sign of warming ties between India, under RSS Hindutva fascism, and Israel since the election of Prime Minister Narendra Modi in 2014.   

Welcoming the UN Human Rights Council report, the resolution calls for the implementation of the report, its recommendations and end to the impunity of Israeli officials responsible for war crimes.  The resolution also calls on all   on all UNHRC member states to ensure the application of international law in the occupied Palestinian territories. 

The report, written by Commission of Inquiry's chairwoman, the American jurist Mary McGowan Davis   and Doudou Diene, a lawyer from Senegal, said that "impunity prevails across the board" regarding the actions of Israeli forces in Gaza, and it called on Israel to "break with its recent lamentable track record in holding wrongdoers accountable."  

Alongside the shocking death toll, the document also talks about the enormous destruction of civilian infrastructure in Gaza. Some international agencies have calculated that the reconstruction of the enclave may take more than 100 years, due to the Israeli blockade. In this regard, the commission says the impact of the 2014 attacks "cannot be assessed

separately from the blockade."

 On 23 July 2014, the Human Rights Council adopted a resolution in which it decided to establish an independent, international commission of inquiry to investigate all violations of international humanitarian law and international human rights law in the Occupied Palestinian Territory, including East Jerusalem, particularly in the occupied Gaza Strip, in the context of the military operations conducted since 13 June 2014, and to report to the Council at its twenty-eighth session in March 2015.  

 Israeli forces frequently used precision-guided missiles, indicating that they were aimed at specific targets, the report said, but many of the attacks came when families were gathered to break the Ramadan fast or were asleep, increasing the likelihood of civilian deaths. In six cases that the panel looked into, they found little or no information to explain why residential buildings "which are prima facie civilian objects immune from attack, were considered to be legitimate military objectives." 

Writing in the Indian daily HINDU   VIJAY PRASHAD who teaches International Studies at Trinity College, had this to state;  

"By abstaining from a crucial vote that would have allowed the ICC to investigate Israeli war crimes, India sends signals of a disturbingly different stance towards Palestine.  

 Israel has pinned its hopes on the Narendra Modi government to break India's ties with the Palestinians and join the United States, Palau and Nauru in the pro-Israel bloc in the UN. The Bharatiya Janata Party and its ancestors have called for close ties with Israel since 1948, largely because of their antipathy to Muslims. Mr. Modi has already suggested that he would be the first Indian head of government to visit Israel. This new alignment could very well be signaled by India's abstention on this vote. Suggestions of principle by the Ministry of External Affairs are well and good, but these might not contain the entire story. Other, less noble, motivations might be at play.

India's abstention does not help the situation in West Asia. In fact, it has given the Israeli policymakers respite, and has betrayed the slim hopes of the Palestinian people. There are few issues that can unite this much of the international community in almost unanimous agreement.

Images   show just how isolated the US is on the global stage, and just how deranged US public and political discourse around Israel-Palestine is. The fact that the international political disparity continued to grow in the wake of Israel's summer 2014 attack on Gaza and that the US refuses to pass even the most moderately worded and lukewarm of UN resolutions further demonstrate this fact.

The "battle for the hearts and minds," as it is said, of 95% of the world was already won long ago. The international community is, with few exceptions, united in its desire to see international law respected in occupied Palestine (in the form of an end to Israel's illegal occupation of the West Bank and East Jerusalem and the cessation of its illegal siege on Gaza) and human rights guaranteed to the indigenous Palestinian population.

The US is—and has long been, as renowned historian Rashid Khalidi details—the primary obstacle standing in the way of justice, equality, and peace in Israel-Palestine.

I lodge this present complaint in the matter where the marginalized DALIT victims were subjected to both mental and physical torture, illegal arrest, custodial violence and false implication into criminal charges by the perpetrator police personnel. The Superintendent of Police, Murshidabad already received written complaint against the perpetrator police personnel of Raninagar Police Station, but as typical no action was taken against the perpetrator police personnel till date. Our attached fact finding report gives details of the incident.
This incident shows the barefaced activities of the perpetrator police personnel of Raninagar Police Station who deliberately resorted to illegal acts in perpetrating torture upon the victim. The perpetrator police personnel enjoying full impunity as still there is no action against them instead a complaint has already been sent to the Superintendent of Police, Murshidabad.
In this case, Article 21 of the Constitution of India; the Human Rights as defined under the Protection of Human Rights Act, 1993; Articles 2, 5, 6, and 8 of the UN Code of Conduct by the Law Enforcement Officials has been blatantly violated by the perpetrator police personnel.  

Due to gross human rights violation of the victims we seek your urgent intervention in this matter in the following manner:-
·         The whole matter must be enquired into by one neutral authority appointed by the Commission.
·         The proper charges of  Schedule Caste and Schedule Tribe (Prevention of Atrocities) Act 1989 and of Indian Penal Code must be included  against the perpetrators
·         The perpetrator police personnel must be booked under the law for their gross illegal activities and punished accordingly.
·         The complaint of the victim must be acknowledged immediately and proper must be directed to be taken on the same by the concerned authorities.
·         The victims should be provided with adequate compensation and protection

Particulars of the victim: - Mr. Biman Mondal, son of late Biswanath Mondal, aged about-40 years, Scheduled Caste by birth, by occupation-farmer, residing at village- Rajapur, Police Station-Raninagar, District-Murshidabad, West Bengal, India.

Particulars of the secondary victims: - Ms. Arati Mondal (mother of the victim),aged about 65 years; Ms. Protima Mondal (wife of the victim), aged about-35 years; Ms. Priyanka Mondal (daughter of the victim), aged about 14 years; Master Rahul Mondal (son of the victim), aged about-12 years.

Particulars of the perpetrators: - (1) The Officer-in-Charge of Raninagar Police Station; (2) Mr. Sanjoy Chakraborty, the Sub-Inspector of Police, Raninagar Police Station; (3) Mr. Kaji Jamaluddin, the Assistant Sub-Inspector of Police, Raninagar Police Station; (4) Mr. Tanmoy Bhakt, the Sub-Inspector of Police, Raninagar Police Station 

Date & time of incident: - On 22.3.2015 at noon and subsequent thereafter.

Place of incident: - At the residence of the victim, Raninagar Police Station and Char-Rajapur Police Camp.

Fact Finding Details:-
It is revealed during the fact finding that the victim resides with his family members in the property which belonged to his forefathers and after the death of his father he became one of the co-owners of the property. The victim alleged that Mr. Nousad Mal, Haider Mal and Mr. Rabiul Mal, all sons of Late Khorsed Mal have been trying to forcibly evict him from the property. In this regard the victim lodged several complaints at Raninagar Police Station against the aforesaid persons and the police discharged duty by only issuing GDEs i.e. Raninagar Police Station GDE no. (i) 901 dated 15.10.2012; (ii) 553 dated 13.2.2015; (iii) 1117 dated 21.3.2015; (iv) 492 dated 11.1.2013, but the police did not take any legal action against the aforesaid persons as alleged by the victim. The victim further alleged that the aforesaid persons gained courage in their wrongful attempt to evict him from his ancestral property due to passive support from the police of Raninagar Police Station. 

Under such circumstances, on 22.3.2015 at noon Mr. Sanjoy Chakraborty being the Sub-Inspector of Police along with one police constable from Raninagar Police Station came to the residence of the victim riding in a motorbike and lifted him from his residence without disclosing any reason. No legal formalities were complied with at the time of his apprehension. He was brought at Char-Rajapur Police Camp and he was illegally kept in detention in a room. Thereafter Mr. Kaji Jamaluddin being the Assistant Sub-Inspector of Police from Raninagar Police Station took the victim to Raninagar Police Station and he was put into police lock-up. At about 10 pm on that day Mr. Tanmoy Bhakt brought him out from the police lock-up and took him to another room. In the said room, Mr. Tanmoy Bhakt abused him in filthy languages and beat him by police baton. The victim soon lost his sense but he was not provided any medical treatment. After few hours when he came to sense, he was again subjected to physical assault in custody. His family members were not allowed by the police to meet with him. The victim stated that during custodial torture he requested for water but it was refused to him. He was even threatened to not to disclose the incident to anybody otherwise he would be falsely implicated into severe criminal charges. On 23.3.2015 he was produced before the Sub-Divisional Officer's court, Domkal implicating him in a criminal case vide Raninagar Police Station GDE no.1148 dated 22.3.2015 under section 151/107 of Cr. P. C. and he was released on bail. On 24.3.2015 he was medically treated at Murshidabad Medical College and Hospital and the clinical notes recorded that he was suffering from physical assault.

On 4.4.2015 he sent written complaint through registered post to the District Magistrate, Murshidabad and the Superintendent of Police, Murshidabad stating the incident of illegal arrest and custodial violence committed upon him but till date no action has been taken on his complaints.

રશિયામાં મોદી-શરીફની મુલાકાત સમયે દેશમાં આતંકવાદી હુમલાનો ભય
દેશમાં ફરી એકવાર આતંકવાદી હુમલોનો ભય મંડરાઇ રહ્યો છે. રશિયાના ઉફામાં 10 જુલાઇના રોજ વડાપ્રધાન નરેન્દ્ર મોદી અને પાકિસ્તાનના વડાપ્રધાન નવાઝ શરીફની સાથે મુલાકાત કરી શકે છે, વળી ઇન્ટેલિજન્સ એજન્સીઓ અનુસાર આ મુલાકાત પર આતંકવાદીઓની ખરાબ નજર છે. રિપોર્ટના આધાર પર સેના, રાજ્યોની પોલીસ અને કેટલાય સંવેદનશીલ રાજ્યોમાં આતંકવાદીઓ હુમલાને ધ્યાનમાં રાખીને એલર્ટ કરી દેવામાં આવ્યા છે. ઇન્ટેલિજન્સની રિપોર્ટ અનુસાર આ વખતે ખતરો દેશના શહેરોમાં જ નહી પણ આંતરરાષ્ટ્રીય સરહદ પર પણ છે. એવામાં એલઓસી અને સરહદ પર સેનાને સતર્ક કરી દેવામાં આવ્યા છે. સેના અને બીએસએફના યૂનિટ પર પણ આંતકવાદી હુમલાની આશંકા વ્યક્ત કરવામાં આવી રહી છે. રિપોર્ટ અનુસાર આતંકવાદીઓના નિશાના પર દેશના કેટલાય મોટા અને નાના શહેરો હોઇ શકે છે. તેમની યોજના સીરિયલ બ્લાસ્ટ કે એકથી વધારે બ્લાસ્ટની પણ હોઇ શકે છે. જાણાવા મળી રહ્યું છે કે આતંકવાદી દેશની આર્થિક અન કોમ્યુનિટી શાંતિનો ભંગ કરવ માંગે છે. એજન્સીઓએ રાજ્ય પર પોલીસને સાવચેત કર્યા છે કે તેઓ અફવાઓને ફેલાતી અટકાવે કારણ કે આતંકવાદીઓ કોમી એખલાસને બગાડવા અને રમખાણો કરાવવાનો પ્રયત્ન કરી શકે છે. વડાપ્રધાન નરેન્દ્ર ઉફામાં સમ્મેલન ઉપરાંત શુક્રવારના રોજ નવાઝ શરીફની સાથે અલગથી મુલાકાત કરી શકે છે. જો કે આ મુલાકાતને લઇને સમયની ખાતરી હજુ થઇ નથી, પણ મુલાકાત લગભગ નિશ્ચિત છે. ઉલ્લેખનીય છે કે ઓગસ્ટમાં બન્ને દેશોની વચ્ચે વિદેશ સચિવ સ્તરની મંત્રણા બાદ પહેલીવાર બન્ને વડાપ્રધાન મુલાકાત કરશે. જો કે આ પહેલા નેપાળમાં નવેમ્બર 2014માં SAARC સમ્મેલન દરમિયાન નરેન્દ્ર મોદી અને નવાઝ શરીફ સામ-સામે થયા હતા.

નવી દિલ્હી- સુપ્રિમ કોર્ટે મધ્યપ્રદેશના વ્યાપમ કૌભાંડની તપાસ CBIને સોંપી દીધી છે. સુપ્રિમ કોર્ટે આ વિશે સીબીઆઈને નોટિસ આપી છે. સુપ્રિમ કોર્ટના આદેશ બાદ હવે એ સ્પષ્ટ થઈ ગયું છે કે CBI વ્યાપમ કૌભાંડની સંકળાયેલા તમામ કેસોની તપાસ કરશે. સીબીઆઈ તમામ શંકાસ્પદ રીતે મૃત્યુ પામેલી વ્યક્તિના કેસની પણ તપાસ કરશે. મધ્ય પ્રદેશના રાજ્યપાલને કાઢવા સંબંધિત અરજી પર સુપ્રિમ કોર્ટે કેન્દ્ર, મધ્ય પ્રદેશ સરકાર અને મધ્યપ્રદેશના રાજ્યપાલને નોટિસ મોકલી છે.

આસારામ સામે રાજસ્થાનની કોર્ટમાં ચાલી રહેલા જાતિય દુર્વ્યવહારના કેસમાં એક સાક્ષી 'હોસ્ટાઇલ' ઠર્યા છે. મહિલા સાક્ષી એ કોર્ટમાં સ્પષ્ટતા કરી હતી કે તેમને આસારામની પ્રવૃત્તિ અંગે કોઇ માહિતી નથી. પિડીતાના વકીલ પ્રમોદ વર્માએ કહ્યું કે સુધા પાઠક કોર્ટમાં હાજર થઇ હતી, તેણે કોર્ટને પોતે આશ્રમમાં એક ફાર્મ વર્કર હોવાથી આસારામની પ્રવૃત્તિ અંગે તેમની પાસે કોઇ માહિતી ન હોવાની જુબાની આપી હતી. કોર્ટે સ્પષ્ટતા માંગી હતી કે તે કોઇ દબાણ હેઠળ ડરેલી નથી ને ? ત્યારે તેણે નકારાત્મક જવાબ આપ્યો હતો. જોકે અગાઉ તેણે જાનનું જોખમ હોવાની અરજી કરેલી. આસારામ ઓગસ્ટ ૨૦૧૩થી જેલમાં છે. ગત વર્ષે ૨૦ ઓગસ્ટે એક ૧૬ વર્ષીય કિશોરીએ ફરિયાદ નોંધાવ્યા બાદ તેમની ધરપકડ કરવામાં આવી હતી. કિશોરીએ આસારામ સામે જાતિય દુર્વ્યવહારની ફરિયાદ નોંધાવી હતી. ૧ જુલાઇએ કોર્ટમાં હાજર રહેલી વર્ષા પાઠકે ત્યારે તેના પર જીવનું જોખમ હોવાનું કહ્યું હતું. જોકે પિડિતાના વકીલે સાક્ષીના ફરી જવાથી કેસમાં ખાસ ફેર નહી પડે તેમ કહ્યું હતું. આ કેસના છેલ્લા સાક્ષી, તપાસનિશ અધિકારી એ.સી.પી. ચંચલ મિશ્રા કાલે કોર્ટમાં જુબાની આપશે. આસારામ અને તેના પુત્ર સામે ગુજરાતમાં સુરત ખાતે પણ બળાત્કારનો કેસ થયેલો છે.

Ufa (Russia): More than a year after they met in Delhi, Prime Minister Narendra Modi and his Pakistani counterpart Nawaz Sharif are meeting in Ufa on Friday. According to sources, the Kashmir issue will take a backseat as Pakistan wants to increase trade ties with India. The much anticipated meet is talking place on the sidelines of the Shanghai Cooperation Organisation summit.

The two leaders shook hands and posed for photographers before settling down for delegation-level talks. Indian delegation included National Security Advisor Ajit Doval and Foreign Secretary S Jaishankar while Sartaj Aziz, Sharif's advisor on foreign affairs and national security, was in the Pakistani delegation.

Sources say that at least 5 agreements are expected to be signed by the two leaders and three-year multiple entry visas are likely to be given to Pakistan businessmen.

It is also being said that Pakistan realises that harping on Kashmir with Modi government is a futile attempt.

The meeting holds importance as Pakistan will be hosting the SAARC summit in 2016 and Modi will have to visit the country then. Thus both countries are hoping to bring back the dialogue process.


Setting the tone for the meeting, Modi and Sharif had on Thursday exchanged pleasantries and chatted briefly when they came face-to-face at a dinner hosted by Russian President Vladimir Putin for leaders of five BRICS countries and 10 SCO nations.

"It is confirmed. PM @narendramodi and PM Nawaz Sharif will have a bilateral meeting in Ufa tomorrow at 9.15 am (9.45 am IST) on sidelines of SCO Summit," External Affairs Ministry spokesman Vikas Swarup had tweeted.

Officials said the two leaders would be reviewing the relationship and all issues could be on the table. "Terrorism for India is a major concern," an official said, indicating that the issue could be taken up by Modi at tomorrow's meeting.

In Islamabad, Pakistan Foreign Office spokesman Qazi Khalilullah said bilateral issues of importance will be discussed in the Modi-Sharif meeting. "India has proposed a meeting and Pakistan has positively responded to it," the spokesman said.

Indian officials, while insisting that expectations should not be raised for the meeting, likened India- Pakistan relations to a cricket match. "You never know how the match will progress till it ends," a senior official said.

The official was commenting while contending that there have been positive gestures in India-Pakistan relations in the recent months, like Modi calling up Sharif to greet him on Ramzan which was followed by release of fishermen by both the countries.

Modi and Sharif met at Modi's swearing-in ceremony in May 2014. Thereafter the two leaders came together in Kathmandu in November 2014 for the SAARC Summit but did not have a bilateral meeting because of acrimony between the two countries at that time.

The NC General Secretary said all promises and pledges that were officially announced by PDP in its 'Agenda of the Alliance' with the BJP had been exposed as plain lies.


"The brazen silence of Mufti Sahab in the face of such revelations by his alliance partner makes it evident that PDP has tacitly agreed to compromise on the sensitive issues of Article 370 and State Subject Laws. She was responding to a question on Modi "strongly" and "clearly" conveying India's concerns yesterday to President Xi Jinping in Ufa, Russia, over China blocking its proposal for action by the UN against Pakistan on Lakhvi's release.

India had also rejected the "weak evidence" theory propounded by Beijing in this regard.

Terming Modi-Xi talks as "constructive and inclusive", she said China has maintained good communication with India and other parties on the Lakhvi issue.

About India's concerns over terrorism, she said: "I can tell you that both India and China are victims of terrorism. China opposes all forms of terrorism and support the UN playing the leading role in coordinating international cooperation on anti-terrorism. China has actively taken part in global cooperation."

India had sought action against Pakistan for release of LeT commander Lakhvi in the 26/11 trial in violation of a UN resolution at a meeting of the UN Sanctions Committee last month but the Chinese representatives blocked the move on grounds that New Delhi did not provide sufficient information.

Today's replies by Hua were little more elaborate than the Chinese Foreign Ministry's earlier replies on the issue.

On July 2, answering questions on the technical hold put by China on the Lakhvi issue in UN, Deputy Director General of the Asian Affairs Department of Chinese Foreign Ministry Huang Xilian said the issue should be discussed in the India-China joint mechanism on terrorism between the two countries.

"We have mechanism of counter-terrorism consultation between the two ministries" in which it can be discussed, he had said.

However, in his briefing after Modi-Xi talks last night, Foreign Secretary S Jaishankar said, "there is no particular mechanism. The MEA can discuss with the Embassy (Chinese). There are a range of mechanisms."

The Prime Minister conveyed to Xi how the people of India viewed the Chinese action.

China had earlier also put a technical hold on India's demand for UN Security Council to take action against Hizbul Mujahudeen Chief Syed Salahuddin and LeT leader HafeezSayed citing rules the UNSC resolution 1267.

In a letter to the current Chair of the UN Sanctions Committee Jim McLay, India's Permanent Representative to the UN Asoke Mukherjee had said Lakhvi's release by a Pakistani court was in violation of the 1267 UN resolution dealing with designated entities and individuals.

Prabhu said that railways is committed to improving connectivity in the state, which is vital to its well being.

"We have flagged off four new trains…We are planning to add more coaches to these trains so that more people can travel. We are in constant touch with the state government; we have decided to hold a meeting with state government once every 15 days so that problems related to improving rail network in Jammu and Kashmir can be solved," he said.

"Peace in the region is the most important thing, new projects can function effectively only if the atmosphere is peaceful. The job opportunity for youth of the state will improve once connectivity improves," he added. The new trains will facilitate rail travel along Banihal-Qazigund-Baramulla rail track which passes through the Pir Panjal mountain range.

Fresh violence on the Line of Control, whatever may be the immediate provocation and whosoever may have started it, is a grim reminder of the widening gap between India and Pakistan on the political front and the inability of the two countries to initiate the much needed dialogue process. A common perception, atleast in New Delhi, is that dialogue with Pakistan can begin only after cessation of all violence on the borders, control over terrorism and infiltration bids. This premise is not based on logic. The vulnerability of the borders including the Line of Control and invariable periods of violence, infact, underline the need for hastening a peace process that could spell in basic confidence building measures like cessation of violence and bringing mechanisms in place to sort out petty skirmishes at the very initial stages rather than allowing them to blow out of proportion due to lack of any communication. The unreasonable show of allegations and counter allegations do not only enable such hostilities to appropriate the peace constituency but they eventually also take us further away from peace process in the South Asian region and the resolution of the Kashmir dispute. This is fraught with dangers especially when Kashmir is quoted to be a nuclear flashpoint between India and Pakistan. Doubtlessly, the imperative is to begin a process of engagement and work towards cessation of violence rather than adding fuel to the fire.


For normality to come on the borders, some serious steps need to be taken for which seriousness is desirable not only from the Indian side but also the Pakistani side, since it takes two to clap. Both sides first of all need to shun the tradition of using the fragility of the borders for petty political ends. Kashmir issue and border firing has always been used by power centres in Pakistan to assert themselves and wriggle out of the domestic political mess in the country. In India, these has often been used for electoral gains, irrespective of which party uses it. There should be unanimity both within the two respective countries and an understanding with each other to resume existing mechanisms of bilateral negotiations at all levels and strengthening them for restoring peace and winning the confidence of the people. A beginning should be made by putting to regular use the dedicated hotlines reserved for the purpose of sorting out border skirmishes and hostility. The Director General of Military Operations (DGMOs) must meet and sort out the recent escalation of hostilities so that the ugly spectacle of blame-game with its vicious cycle of who pressed the trigger first can come to a complete halt. The aim, however, should not simply be cessation of hostilities but also accelerating the process of moving forward with other CBMs including creation of demilitarized zones on the LoC, which can be achievable through greater co-operation of militaries on both sides. Such measures need better diplomatic ties and negotiations at the higher level. The larger goal should be to resume dialogue at all levels, strengthen bilateral ties through introduction of major confidence building measures and strengthening of existing ones majorly with the prime focus on people of people movement and interactions. This would ultimately help the resolution of negotiations at all levels - terrorism, trade and all minor and major disputes including Kashmir. It goes without saying that the latter would also require a simultaneous process of opening negotiations with the people of the state on both sides of the Line of Control.


India's latest policy of pro-active engagement with host of countries in South Asia, particularly Saarc region by isolating Pakistan will not be helpful in bringing peace in the Saarc region or in strengthening India's own bilateral relations with other neighbours as Pakistan continues to be a strong contender and stakeholder in the region. It cannot be either shunned or isolated. It must not be excluded if one is looking for longer lasting peace, stability, democracy and progress. Terms of engagement in foreign relations must find an important place for Pakistan in India's itinerary and vice versa.

एक लघु यात्रा, दो टिप्पणियाँ....

8-9 जुलाई को कौसानी में था. लक्ष्मी आश्रम में सरला बहन की 33वीं पुण्यतिथि थी. इस बार बहुत कम लोग थे. मगर वहाँ उपस्थित होकर अच्छा लगा. कौसानी में तो बच्चे भी उनके बारे में जानते ही हैं. अल्मोड़ा में एक नवयुवक से पूछा तो उसे भी हल्की सी जानकारी थी ही. वैसे आज के नौजवानों को सरला बहन के बारे क्यों जानना चाहिये ? उन्हें बड़ी कम्पनियों में जॉब चाहिये, महानगरों की जिंदगी चाहिये और सोशल मीडिया. वैसे जो जानना चाहें, उन्हें शायद गूगल सर्च करते हुए कुछ मिल जाये.
अगली सुबह पत्नी के आग्रह पर उनके साथ कोट भ्रामरी के मंदिर चला गया. गाड़ी से नीचे उतरा तो देखा कि एक दानवाकार ढाँचे ने देवी के मंदिर को ढँक दिया है. आस्था के नाम पर भी पैसे वाला आदमी अपना गुरूर दिखाने से नहीं चूकता. उसे इसी में संतोष है कि वह लाखों लोगों की आस्था को अपने अंगूठे से दबा दे !
इसी में चालीस-पैंतालीस साल पुराना एक वाकया याद आया. बिड़ला जी अपने पैसे से बद्रीनाथ धाम का पुनर्निर्माण करना चाहते थे. गढ़वाल के लोगों को लगा कि बिड़ला जी मन्दिर में अपना विशिष्ट ठप्पा लगा कर उसके पुरातन स्वरुप को नष्ट कर देंगे. वे चंडी प्रसाद भट्ट के नेतृत्व में विरोध करने उठ खड़े हुए. अल्मोड़ा से शमशेर सिंह बिष्ट जैसे नौजवान भी पहुँचे. अन्ततः वह योजना रुक गयी.
आज तो सरकार ही चाहेगी कि मंदिर पीपीपी मोड में बने, धर्म में विदेशी निवेश हो !
बहरहाल मंदिर के पुजारी मोहन चन्द्र तिवारी खुश थे कि बलि प्रथा रुक गयी...

इस टेप को सुनने के बाद मेरे मन में मुलायम सिंह यादव को लेकर जो थोड़ी बहुत इज्जत बची हुई थी, वह भी खत्म हो गई... आखिर इन्हें इस उम्र में अब क्या जरूरत पड़ गई थी एक आईपीएस को डायरेक्ट फोन कर धमकाने की... कहीं ऐसा तो नहीं पुत्र अखिलेश के मोह के मारे मुलायम अब चुनाव नजदीक देख खुद एक एक को देख लेने वाले अंदाज में एक्टिव हो गए हैं... इसी क्रम में अमिताभ ठाकुर को धमका कर उनके एक्टिविजम पर लगाम लगाना चाहते हों ताकि प्रदेश सरकार की भ्रष्टाचार की पोल न खुले. ये बहुत ही गंभीर बात है. इस टेप के आधार पर तो मुलायम सिंह यादव के खिलाफ मुकदमा लिखाया जाना चाहिए. हम आप जैसे कामन मैन तो तुरंत धमकाने के आरोप में धर कर जेल भेज दिए जाएंगे लेकिन यही धमकाने का काम जब मुलायम सिंह यादव जैसा बड़ा नेता करे तो पूरे सिस्टम को सांप सूंघ जाता है.

Dear friends,



We are deeply concerned over the fact that your members are continuing a dharna and indefinite relay hunger strike at Jantar Mantar in New Delhi since June 14, 2015.



The armed forces of this country have played a crucial role in the national life and made great sacrifices for the unity and territorial integrity since the inception of our Republic.



Understandably, the retirees from the armed forces have been legitimately agitating for recognition and implementation of `One Rank One Pension'.  The demand has attracted support on principle by the entire political spectrum of the country.  We of the CPI(M) have also time and again reiterated our support for this legitimate demand.



The BJP has been more specific in promising the ex-servicemen in the run-up to the elections and subsequent to the assumption of office by no less than the Prime Minister himself.  In fact, Shri Narendra Modi, as the Prime Ministerial nominee for the BJP in March 2014, made this commitment in a rally of Ex-servicemen in Rewari, Haryana.  He categorically mentioned in the event of BJP coming to power, this demand will be implemented within one month of assumption of office.



But like so many other electoral commitments made to different democratic sections of the society, the Union government has also reneged on this question.



In this moment of anguish which has forced you in this course of agitation for your legitimate demand, we express our firm commitment on behalf of our Party to your demand.  We re-assure you that we will be in solidarity both inside and outside the Parliament for the realization of your demand.

२०७२ असार १९परासी। स्वतन्त्र मधेश गठबन्धनको राष्ट्रिय परिषद्को चौथो बैठक यही असार १८ र १९ गते गते नवलपरासीको पाल्हीमा सम्पन्न भएको छ। सो बैठकमा मधेशका १७ जिल्लाका संयोजक तथा परिषद्का सदस्यहरूको सहभागिता थियो भने राजविराज स्थित निवास वरिपरि नै नेपाल प्रहरी तथा जनपद प्रहरीले घेरा हालेपछि गठबन्धनका केन्द्रीय संयोजक डा. सी. के. राउत आउन सकेका थिएनन्। डा. राउतले लिखित रूपमा र विडियो मार्फत् आफ्नो कुरा प्रस्तुत गरेका थिए।

 

सो बैठकमा संगठनको विस्तारवर्तमान राजनैतिक प्रक्रिया र आगामी रणनीतिको विषयमा छलफल भएको थियो। बैठकका सहभागीहरूले वर्तमान राजनैतिक दिशाको समीक्षा गर्दै अब पनि आजादी आन्दोलनमा नलागेर मधेशी जनतालाई कुनै नेता वा अगुवाले भ्रममा राख्न खोजे त्यसको कडा प्रतिकार गर्नु पर्ने र भंडाफोर अभियान नै चलाउनु पर्ने,  तथा मधेशको विरोधमा कार्य गर्ने जुनसुकै पार्टी वा संगठनका नेताहरूलाई मधेशमा बहिष्कार गर्न सुझाव दिएका थिए। केही सहभागीले त मधेशलाई बारम्बार भजाएर खाने र मधेशी जनतालाई दिग्भ्रमित गर्ने गद्दारहरूलाई मधेश छिर्न नै पूरै प्रतिबन्ध लगाउनुपर्ने भनेर आक्रोश समेत पोखे।

Illegal Evictions of adivasis from Kanha and Achanakmar National Parks #WTFnews

50 million people are estimated to have been displaced by Modi's development projects in India, of which about 60% are adivasis. As adivasis account for only 8% of the population of India, this figure is shocking. 50 million people is, as Arundhati Roy points out, 'almost three times the population of Australia. More than three times the number of refugees that Partition created in India. Ten times the number of Palestinian refugees'. So why does nobody know about the horrors I witnessed in Madhya Pradesh and Chhattisgarh, whilst travelling from village to village and witnessing the illegal evictions ofBaiga and Gond adivasis from Kanha and Achanakmar National Parks? Before heading out there, I had what I thought was a pretty good understanding of the situation: eviction was limited to these particular adivasi communities in this specific region. Very quickly I came to realize that eviction and dispossession is a reality for most agricultural communities in this part of India. Whether this is to make way for mining and industrial projects, or in the name of 'conservation', lakhs of families are constantly being uprooted from the land which sustains them and their families.

In this region eviction and the effects of it are widespread over a large geographic area where communication and transport between places is poor and unreliable; the result of this is that there is very little that local, grassroots NGOs are able to do simply because the battle they are fighting is so much bigger than their reach. Displacement is a traumatic and disastrous experience for any community, and here the boundary between adivasi and non-adivasi villagers is blurred because everybody is suffering the same problems and competing for the same limited resources. However, for adivasis the repercussions of displacement are greater, more severe; the process disrupts and destroys every aspect of their lifestyle and livelihood. Historically, adivasis have been dependant on the jungle and their surrounding environment, existing in a symbiotic relationship whereby one supports the other. From the forest they take food, 'jhari-bhooti' (jungle medicine) and wood to build houses and cook food but, thanks to hundreds of years of rules and restrictions placed on their access to forest resources, this way of life had already but become difficult. But when adivasis are forced out of their homes, where they have lived their lives deep in the forest, they are forced into a lifestyle that they have had no experience of: money, and the modern world. Previously they gathered everything they needed from the forest, took water and fish from the clean river; they now find themselves starving to death or earning measly wages for hard, exploitative labour to feed their families. Previously they were self-sufficient, now they are on the bottom rungs of a society where everything, from where to find food to understanding money, is unfamiliar.

 

Bazaari Singh Baiga, Badhu Singh Baiga, Dham Singh Baiga, Phool Singh Baiga from Peepatola village, Amaniya panchayat, Chhattisgarh We will never leave here. For us, only the jungle for us is good. We don't want fields or houses in another place. We want to stay living in the jungle, we don't want to move to a city, where would we get wood from? We get everything we need from the jungle. If we moved from here we would die very quickly! We get all our jhari booti [jungle medicine!] from the jungle, we cant use government medicines, only our jhari booti makes us better when we're sick. If you got sick, or if a snake bit you right now, we wouldn't give you any 'outside', 'doctor' medicines, we would go to the jungle and give you jhari booti and you would get better. We don't need hospitals or doctors, and our jhari booti is free, it doesn't cost any money! We don't buy things, we take everything from the jungle and make things ourselves with our own hands (like bamboo baskets etc).'

In the absence of state-provided Resettlement and Rehabilition, once they leave their village these communities disperse across the region, going to places where they might know somebody, a distant relative. Some cross into the neighbouring states of Chhattisgarh, Andhra Pradesh; once this happens the state government views them as Internally Displaced Persons (IDPs) and holds no responsibility to provide them with any assistance. Nobody goes far – Rajasthan, Himachal Pradesh, Kerala – these are all foreign places to these people who wouldn't ever have the money to get there if they ever wanted to. They scatter in the search for land, they tell me there isn't enough land available to support an entire displaced community. I instinctively think, 'What?! I am surrounded by land, open space! I can see enough resources to support countless agricultural communities!' I am told it is government land and I realize, of course, they'd be moved on before their crops even yielded a single harvest. This, while all around the national park tourist lodges spring up, catering for the luxury needs of western and domestic, urban-based tourists, who swan around in their open top jeeps with camera lenses and packaged bottle water.Dependency on forest resources means that adivasis are often held responsible for deforestation and 'conservation' is often a reason given to justify their eviction. But deforestation began increasing exponentially when adivasis started being forced out of the forest. This is what does not make sense about the 'conservation' narrative. Conservation of the natural world is central to the adivasi world view and lifestyle: to them the natural world is so sacred that they refuse to till the land and hurt their 'Mother Goddess', to them the forest is the source of all life and to cause it harm would be like harming a family member. Rather, deforestation began on a large scale when the British colonial government gradually appropriated much of India's forest land to further their own, economic purposes. The forests were cut down and the timber trade became one of the many lucrative industries for the extractive colonial state.

After 1947 the Independent government continued much in the same vein and adivasis continued to be thrown off their resource rich forest land to make room for mining, dams and other industrial projects. Much legislation was brought in to ease state appropriation of forest land and restrictions on foreign industrial projects were eased. Today, as national parks spring up across the nation, adivasis are turfed off their land to make way for western and domestic tourists. Their luxury needs must be catered for, the 5* tourist lodges, the jeeps, the piles of packaged drinking water.

And yet, conservationists like WWF view adivasis, and not the forces of imperialism, modern-day capitalism and tourism, as the enemy of conservation.It is worth noting that WWF have a vested interest in Kanha; although they claim not to be involved in tourism there, their website displays a 12 day tour around Kanha and other national parks for no less than $8,995. The infamous panda logo is found in all parts of the region, from the gates of the national park to small forest villages on the edge of the buffer zone.

Noonsari, the makeshift village of displaced Baiga adivasi, in Mawai district Madhya Pradesh. This is called a dhanoosna. When they used to go hunting in the jungle, they used this. Theres one in every house, they keep it as its part of their culture but they cant use it. It takes a whole day to make a single arrow from peacock feather and cartilage. They put poison in the end and it kills animals very quickly.

Today, the situation is very much the same; according to the Forest Survey of India, between 1999 and 2013 India lost 9.4 million hectares of forest cover. This does not make sense about the 'conservation' narrative. How can the guardians of the forest be the ones held responsible for its destruction, when they hold this environment so sacred that they refuse to even till the land as it would hurt their 'Mother Goddess'? The adivasi relationship with the environment means that they carefully maintain the delicate balance of biodiversity, and yet they get turfed out, giving the state free rein to what it views as a resource to be exploited for financial gain. If organizations like WWF are actually interested in conservation, they must speak out against these illegal evictions.

In 2006 a piece of legislation came out that looked like it might actually work in favour of adivasis and for once uphold their claims to ownership of their ancestral land. The Forest Rights Act recognizes the 'any traditional right customarily enjoyed' by any 'forest dwelling Scheduled Tribes' or 'Traditional Forest Dwellers'. These include not only rights to forest habitation, but also 'the right to cultivate for their livelihood, the right to collect minor forest produce, the right to graze cattle, the right to convert leases or grants (pattas) to titles, the right to manage the community forest resources, and the right to enjoy any customary/ traditional practice, however excluding hunting'. According to the legislation set out in the Indian Constitution (FRA, 2006), when adivasis are threatened with eviction their Forest Rights must be processed and submitted.However, the implementation of the FRA has been scattered at best. According to PESA (Panchayat Extension to Scheduled Areas) legislation, a Gram Sabha must be involved in every stage of the decision-making process and give full consent to the displacement. But this is more often than not ignored completely, and the registers at public meetings filled with forged signatures. Resettlement and rehabilitation, a legal obligation of the government, is a joke. In the majority of cases, not a single part of the legal process had been adhered to, and the displaced adivasis are simply wandering around in search of land, wages, life.

Adivasis experience the law as a mechanism of control and exploitation, rather than a system of justice. They are not informed of the rights they hold as citizens of India and the legislation which protects them. So any legal processes they encounter take place within unbalanced power structures, and the law can be manipulated, or even just ignored, by corporations and the state. The FRA, part of the legal process which must be adhered to at every stage of the eviction of an adivasi village is not an option, as the adivasis are not allowed to invoke it when threatened with eviction.The fact that not a single one of the adivasis I spoke with, from several villages in various stages of eviction, knew of the FRA or how to get their forest rights recognized means that, put very simply, these evictions have been illegal from start to finish.Rather, forest department officials turn up in the villages and tell them they will have to go.

In every village I went to I asked if an official notice (a legal requirement) had been given and time after time was met with a resounding 'no', or looks of confusion. Over a period of a few years, forest officials constantly harass and threaten the adivasi villagers. "They say 'if you don't leave we will come back with elephants'". In the 1970s the Forest Department chased villagers off their land with elephants, and the fear of this is still very present in the adivasi imagination. Today, officials need only mention this threat and a whole community flees their land in terror.  It is not consent or voluntary relocation if a community of people flee their land in fear of stampeding elephants after years of harassment, although this is how the government and WWF seem to have interpreted it.

 

 Baiga women in Hirapur village, Madhya Pradesh, right on the edge of Kanha national park. They were displaced in the 1970s. 'This lush green jungle - we can only see it, but we cant touch it. We cant take anything which was  our traditions, our daily bread, it was everything to us. Our rights are written down in a book but we are illiterate.'

 

The compensation given is supposedly 10 lakh per adult male. This means that women and anyone under the age of 18 receive absolutely nothing; a family of 8 members, with only one male over the age of 18, would receive only one payment of 10 lakh for the loss of land which supported the whole family. As my friend Kalawati said, who visited villages evicted from the core zone of Achanakmar tiger reserve, 'I don't think the government is giving them enough. 10 lakh is not a lot. They should be giving them 50 lakh, or they should just not evict them – that would be best'. On top of this they are supposed to be given the 10 lakh in a 'hand holding' process designed to assist them in the process of buying land which just doesn't happen. Even if they do get the money they're just left completely to their own devices to buy land, leaving them wide open to exploitation. Middle men and landlords give them inflated rates far beyond their means. I heard cases of the same land being sold to two people; rather, the money being taken from both people but the land being given to neither.

Eviction really does mean the end for these communities. The majority of these families end up wandering, lost, squatting on village land in places where resources are already so scarce the villagers aren't willing to share with these  social outcasts whom they 'treat like dogs'. They face constant discrimination; villagers view them as 'backward' and 'primitive' outsiders. I visited one make shift village on squatted land formed by 12 of 150 families evicted from a forest village. Between these 12 families they couldn't afford to buy land, nor could they get government ration coupons as they're not registered in the panchayat. They have no identity, neither the state nor mainstream society views them as citizens of 'the world's largest democracy'. When I asked to be shown around the village they proudly displayed bows and arrows and other tools that they used to use to hunt and collect food, back when they were free. Now they live off supplies bought from the local weekly market, their limited finances slowly dwindling away.

We won't find it. we were the kings of the jungle, but here they treat us like dogs. It's only sadness here. We can't even taken wood. Our lives are like dogs!'

It is time that the systemic exploitation of these human beings comes to an end. However the future does not look promising. While Modi's government is currently bypassing countless provisions of the Forest Rights Act and the Land Acquisition Act, they are also engaged in dismantling these acts and removing any legislation which requires consent of the gram sabha. This is routinely violated, but as long as it remains enshrined in the Constitution the possibility to legally challenge these evictions exists. Once these provisions are gone there will be nothing standing in the way of these communities and utter destitution.

5 villages are due to be evicted from the core zone of Achanakmar. They know the resettlement package the government is promising is a lie and they don't want to leave their village. The government has said that the villagers have consented to the relocation in a Gram Sabha meeting, but this is a lie. The villagers say the Gram Sabha never happened, the consent is forged. These people must not be forced to leave their village. However Modi's government is rapidly dismantling the legislation which already provides them with little protection, and they don't have long.

As Arundhati Roy puts it, the voices of the 50 million people displaced by development projects in India have not been unheard, they have been deliberately silenced. It is time that the reality of what is happening to these people becomes common knowledge, because only then can it come to an end. The lies and the promises, and the warped perceptions of these 'backward people' in need of development must come to an end.

World Bank Says 59 pc PDS Grains Don't Reach People, Bundelkhand Shows You Why

In a report in 2011, the World Bank had stated that almost 59 percent supply of the public distribution system (PDS) fails to reach households in India. The World Bank attributed poor supply of the PDS to uneven implementation and high leakage in the supply mechanism. Currently, even as the PDS system has been brought under computerized monitoring for tracking supply and the National Food Security Act 2013 is working on targeted PDS, stories from Uttar Pradesh's Bundelkhand tell us why the poor still remain unfed. The situation at the fair price shops, the role of Kotedars or ration shopkeepers and lack of grievance redressal leaves the system faulty.

Panwadi - gao se kotedar webOver the last week in Mahoba district of Uttar Pradesh, Nandlal Singh Patel, Mahendra and Devendra have been complaining against the region's kotedar Harishchandra at the Kulpahar tehsil. The men have been running from pillar to post to complain about how almost every week the area kotedar does not supply ration and oil properly. The matter has also been taken up with the supply inspector, but no action has been taken so far.

'The kotedar opens the shops as per his whims. It has been like this for a year, the shop opens on just two days in a month. We go without food for days … finally we took up the matter with the tehsil. The supply inspector found quintals of grains in sacks left unsupplied, but nothing has been seized,' one of the men said. The villagers from Panwari block are demanding strict action to be taken against the kotedar. With no progress, sub divisional magistrate Muhammad Rizwan has assured that a reinvestigation of the matter would take place.

This is not the first time that kotedars have been at the centre of ration supply embezzlement. While a kotedar is the key point where government's supply of grains and fuel are allotted, how this reaches households is a complex issue. In 2014, Khabar Lahariya had reported about several other instances where the supply was siphoned off at fair price shops. In Mahoba's Jaitpur block, the villagers complained that the kotedar opened ration shop only on two days in a month. The kotedar had been operating the same way since 16 years in this Dalit village. Almost 50 kms away from Mahoba, the situation is not much different. People in neighbouring Banda district's Naraini block say sacks of ration supply items remain locked in local shops. In September last year, the matter was also raised at the Atarra tehsil for further investigation.

Under targeted public distribution system (TPDS), the central government and state government work jointly to bring grains and other essential ration items to poor households. To track the procurement, allocation and transportation of food grains to Food Corporation of India (FCI) depots, the centre has allocated Rs 80 crore in this year's budget.

However, a significant task lies after this as the operational responsibilities for ration supply are relayed to the state government. This involves identification of below poverty line (BPL) families, issuance of ration cards, and distribution of food grains at subsidized prices through fair price shops.

According to the ministry of consumer affairs, food and public distribution, there were 5 lakh fair price shops across the country in 2011. With over 73,000 such shops in Uttar Pradesh itself, experiences from Banda and Mahoba districts tell us why transparency and accountability at the grassroots scale are critical in ensuring a fair and adequate supply of food to the poor.
